Vos Caudill, Pitkin County, CO ADMINISTRATIVE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF PTTKIN COUNTY, COLORADO, APPROVING THE SHATZ ACTIVITY ENVELOPE AND SITE PLAN REVIEW Administrative Decision No. $: 2016 RECITALS 1) Sallie Dean Shatz (hereafter "Applicant") has applied to the Community Development Director of Pitkin County (hereafter "Director") to establish an Activity Envelope and obtain Site Plan Review approval to develop a single family residence. 2) The property is located at 668 Shield O Road, and is more specifically described in Exhibit A. 3) The parcel contains 6.68 acres and is non -conforming in size in the RS -30 zone district. 4) The Community Development Director approved a building envelope in 1988 that was recorded in Plat Book 20 at Page 99. A single family residence was built in 1989. The residence was deconstructed in 2008. 5) The Board of County Commissioners approved a lot line adjustment that added acreage to the subject parcel, pursuant to Resolution No. 97-72. The Lot Line Adjustment Plat is recorded in Plat Book 42 at Pages 85-86. 6) The Director finds that the proposed Activity Envelope and Site Plan complies with the Land Use Code ("Code") as follows: A. The wildfire hazard is rated as medium and can be mitigated. B. The Activity Envelope is comprised primarily of slopes of less than 30%. Some slopes in excess of 30% are included within the Activity Envelope. These slopes qualify as minor slope anomalies pursuant to Sec. 7-20-20(c)(3) of the Code, as they are the result of man-made cut and fill from the previous development of the parcel. C. Adjustable, building -mounted solar energy collectors will be used for on-site residential purposes. D. There are no known or mapped watercourses or water features on the site. E. The parcel is within mapped elk winter range. The proposed residence will not create any additional impacts on wildlife, as it is replacing a previously existing residence. F. The Colorado Division of Water Resources issued a well permit for household use only (no outside uses) in 1988. The well has been drilled and is within the Activity Envelope. G. An on-site wastewater treatment system ("OWTS") can be accommodated within the Activity Envelope. Either a new OWTS will be installed, or the existing drain field that served the previous residence might be used if it is in good condition. The original septic tank was filled in. H. The residence will have limited visibility and will not break a ridgeline as seen from Snowmass Creek Road. I. The residence will be sited in the same general area as the previous residence, in order to minimize disturbance to the property. J. The existing driveway will be utilized and widened, and a turnaround will accommodate emergency vehicles. On-site water supply for fire -fighting is not required, as there is a 10,000 gallon community water tank in the vicinity. Administrative Decision Nr 5-2016 Page 2 - APPROVED by the Director, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. Prior to submission of any building permit applications for the residence, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation of them. 3. With the building permit application for the residence, the Applicant shall: A. Provide proof of an adequate water supply (in terns of quantity and availability) for domestic and fire protection purposes, and for irrigation purposes, if applicable. B. Submit a site specific drainage and erosion control plan prepared by a qualified engineer or geologist for review and approval by the Planning Engineer. If the project disturbs more than one acre, a State Stormwater Permit shall be obtained prior to permit issuance. All historic and natural drainage patterns shall be maintained. C. Submit a construction management plan for review and approval by the Planning Engineer. D. Submit a landscape plan and a revegetation plan for disturbed areas with appropriate seed mixes. Provide a plan for irrigation, since the well permit does not permit irrigation. E. Submit an exterior lighting plan. 4. Prior to issuance of a building permit for the residence, the Applicant shall: A. Obtain an On -Site Wastewater Treatment System ("OWTS") Construction Permit application from Environmental Health. The existing drain field may be used if it is inspected, found to be in good condition, and sized to accommodate the new residence. B. Pay the applicable County road and employee housing impact fees. C. Obtain a County access/driveway permit for the improvements to the driveway, including widening to 14' and installing an emergency vehicle turnaround. If the driveway exceeds 400' in length, a pullout shall be installed along the driveway. The permit shall be approved by the Planning Engineer and the Basalt Fire Department. D. Obtain a fireplace/woodstove permit from the Community Development Department, if necessary. E. Provide documentation that the Applicant is current with payments to the Shield O Terrace Homeowners Association for road maintenance. 5. 5,750 square feet of gross floor area is exempt from growth management without the use of TDRs or growth management allotments for additional floor area. 6. The Applicant shall comply with the following standards to mitigate for development in a medium wildfire hazard area: A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): Administrative Decision Nc S -2016 Page 3 1) Brush, debris, and non -ornamental vegetation shall be removed within a minimum 10 foot perimeter around the structures. 2) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a 30 foot perimeter around the structures. 3) Spacing between clumps of brush and vegetation within the 30 foot perimeters shall be a minimum of two times the height of the fuel. Maximum diameter of the clumps shall not exceed 10 feet. All measurements shall be from the edges of the crowns of the fuel. 4) All branches from trees and brush within the 30 foot perimeter shall be pruned to a height of 10 feet above the ground and ladder fuels from around trees and brush shall be removed. 5) Tree crown separation within the 30 foot perimeters shall have a minimum of 10 feet between the edges of the crowns. 6) All branches which extend over the roof eaves shall be trimmed and all branches within 15 feet of the chimneys shall be removed. 7) The density of fuels within a 100 foot perimeter of the structure shall be reduced. 8) All deadfall within the 100 foot perimeter shall be removed. 9) Low vegetation shall be maintained within a 10 foot perimeter around all structures. 10) The Applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Roofing Materials: Roofs shall be constructed with a Class A roof covering or a Class A assembly as defined in the building code. Wood shake/shingle roof coverings are prohibited. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: I ) All roof coverings shall be constructed of non-combustible materials and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing the roof. 3) Protrusions above the roofline, such as parapets, shall be prohibited. 4) Roofs shall be installed as required by the approved building code and shall have a minimum slope of 1:48. 5) All roof designs, coverings or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. C. Roof Venting: Soffit venting shall be located in the outer 1/3d portion of the overhang. Attic, soffit and other roof venting shall be of a non -corrosive metal mesh with maximum ''/e" openings. D. Projections at the Roofline, including Soffits, Rafters, Porch or Deck Roofs, Fascias, or Other: 1) Sheath with non-combustible materials, or 2) Combustible materials underlain with 5/8" Type X gypboard or equal, or 3) Minimum 4x(i rafters with 2x T&G decking. E. Decks, Decking, Cantilevered Floors, or other Projections below the Roofline: Minimum 6x6 posts, 6x10 beams, 3x8 joists, 3x decking and 2x railings, or equivalent log construction. F. Maintenance and Miscellaneous Requirements 1) Roofs and gutters shall be kept clear of debris. 2) Yards shall be kept clear of all litter, slash, and flammable debris. 3) All flammable materials and firewood/wood piles shall be stored on a parallel contour a minimum of 15 feet away from any structure. J Administrative Decision No. -2016 Page 4 4) Weeds and grasses within the fifteen -foot (IT) perimeter and under trees shall be maintained to a height of not more than six inches (6"). 5) Fences shall be kept clear of brush and debris. 6) Wood fences shall not connect to the structure. 7) Fuel tanks shall be installed underground with an approved container. 8) Propane tanks shall be installed according to NFPA 58 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any above -ground tank. Any wood enclosure around the tank shall be constructed with materials approved for 2 hour fire -resistive construction on the exterior side of the walls. 9) Each structure shall have a minimum of one 10 pound approved ABC fine extinguisher placed in a visible and accessible location. 10) Addresses shall be clearly marked with 2 inch noncombustible letters and shall be visible at the primary point of access from the public or common access road and installed on a non- combustible post. 11) New utility lines shall be buried within the driveway. The Applicant shall comply with all standards for development within Scenic View Protection Areas as represented in the application and approved in this Decision. The exterior of the residence shall utilize earth tone materials or colors that are indigenous to the site and the roofs shall have a non - reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflectivity, with the exception of materials associated with solar or photovoltaic equipment. Driveway lighting is prohibited and all other lighting shall comply with the lighting code. 8. The Applicant shall comply with the following measures to mitigate impacts to wildlife: A. Native vegetation shall be maintained outside of the activity envelope. B. Trash/garbage shall be kept in an approved bear resistant container or enclosure, pursuant to the County's Wildlife Protection Ordinance. Verification of compliance shall be provided prior to issuance of a certificate of occupancy. C. Fencing shall comply with the following, except for fencing immediately adjacent to the buildings to contain pets or livestock: 1) Wood fencing shall employ three rails or less, be the round or split rail type, shall not exceed 48 inches in height above ground level and 12 inches in width (top view), and shall have at least 18 inches between two of the rails. 2) Wire fencing shall consist of no more than 3 strands of smooth wire and shall not exceed 42 inches in height. 3) Mesh or woven wire fences are prohibited, except when used for protection around isolated trees or clumps of trees. D. Avoid fruit -bearing trees and shrubs in any landscaping. E. Construction workers shall be prohibited from bringing dogs on-site during construction. F. All outside doors shall utilize only solid round handled door knobs unless another type is required by the applicable building code for disabled accessibility purposes. G. Bird feeders, including hummingbird feeders, shall be hung away from any deck or window, and shall be at least 10' from the ground suspended between 2 trees or posts. All seed feeders shall include a seed catchment pan to catch discarded seeds. Bird feeders should be removed from April through November. Administrative Decision Nc 15--2016 Page 5 9. No structural development in excess of 30" above or below natural grade shall occur within the setbacks of the lot, with the exception of driveways and associated retaining walls of up to 6' above or below natural grade and fencing. Landscaping in the form of berms shall not exceed four feet from the most restrictive grade. Any development located within setbacks mandated by County zoning regulations that does not comply with these restrictions shall require a variance from the Board of Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. 10. No development including grading, excavation, fill placement, berming, landscaping, vegetation removal or disturbance, well or septic system shall occur outside of the approved activity envelope, except as necessary to comply with the wildfire mitigation measures described above. 11. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the comers of the activity envelope and install construction fencing around the construction site within the perimeter of the activity envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy. 12. All areas disturbed by construction shall be re -vegetated with native shrubs and grasses within one growing season of the project's completion. 13. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit. Any structures represented in the application may not be permitted under building and zoning regulations. 14. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. 15. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code § 2-20-170 and C.R.S. § 24-68-105. The statutory vested rights granted herein shall expire on 2019. I ri Pitkin County Community Development Department Aspen, Colorado November 16th, 2015 RE: 668 Shield O Road Shatz Residence Parcel ID # 264522300018 Activity Envelope and Site Plan Review Sallie Shatz is requesting to establish an Activity Envelop and obtain Site Plan Review approval for development of a single-family residence. A building envelope was approved in 1988 and recorded in Plat Book 20 at Page 99, and a residence was built in 1989. The Applicant demolished (deconstructed) the house in 2008. The proposed new home will be approximately 3,000 sf with garage included in area and will be predominantly single story. The original well remains intact and functional. The original septic tank was filled in and will need to be replaced. A new septic field is also planned unless the old one is located, inspected and found to be serviceable. The new construction is planned to be located about 80' north of the original site in an area which has been previously disturbed. The building complies with all minimum setbacks (50' Front, 30' Side/Rear). The maximum building Height is (way) less than 28' (much of it below 20'h). The location and profile will allow for the new structure to be built with minimal impacts to the surrounding area. Code Sections, which have been noted in the pre -application process, are referenced with responses below: 2-30-20(g):Activity Envelope and Site Plan Criteria for Approval A pre -application conference was held and the summary is attached. Each of the sections to be addressed below: 4-30-50(h): Solar Energy Collectors Photovoltaic and Solar Thermal Panels are planned to be located on adjustable racking on the roofs of the 2 side wings of the project which are sloped down toward the South for efficient energy collection. The current plan includes 2 Kw of solar PV and 2 solar thermal panels @ 4'x10'. The systems could be enlarged if incentives are found to help defray the costs but in any case would not exceed 400sf in size. Sec 7-10-50: Activity Envelope This project complies with the provisions of the Land Use Code. All "Constrained Areas" are to be avoided or mitigated for and the project is located near existing development. The Activity Envelope avoids all constrained areas (steep slopes) on the property. This envelope will allow for the project and associated utilities, 3 Shatz Residence I grading, and landscaping to occur as well as give an outer limit to future repairs or improvements to the existing structures. While the Activity envelope must encompass an area large enough to accommodate landscaping, utilities, and future needs, the goal of the project is to maintain as much area as practices predominantly in a pre -disturbed area. And most of the property will be left in the existing natural state. The area of site planned for the new construction minimizes impact on surrounding properties and maximizes compliance with development standards by balancing development of the site with maintaining the natural setting. A Site Plan for development is included with this application. Sec 7-20-10: Site Preparation and Grading All grading and filling shall take place within the Activity Envelope. No trees in excess of 6" d.b.h. will be removed. All soil will remain on site except for a small amount inherently attached to grubbed materials to be hauled off. No erosion problems will be created and all areas of disturbance occur over areas that have been previously been disrupted or are relatively level. Any modified cuts and fills are designed as less than 30% averages to allow for adequate vegetation and stability. Sec 7-20-20 Steep and Potentially unstable slopes Slopes are delineated on the Site Plan. Much of the property consists of topography with less than 15% slope. Slopes which exceed 30% slope have been delineated outside the Activity Envelope except for small areas of obviously made -made cut and fill slopes from the previous development on site. The proposed residence will replace a structure located on site for decades and nearby properties have all had stable soils conditions so we have some historical confidence of stability and soils testing will occur during excavation to confirm all load bearing assumptions. 7-20-30: Water Courses and Drainage There are no surface water courses draining through the property. There are nc apparent wetlands or wetland plants such as willows. It is a generally dry, south and east facing bench covered with sage and scrubland flora. There are no dry gulches coursing through the place either. 7-20-50: Geologic Hazards There are no mapped geologic hazards and there is nothing evident on site of any hazards of concern. Sec 7-20-60: Wildfire The parcel is within a mapped Medium Wildfire Hazard zone. The project has an adequate access road and driveway, and there are centralized water supply tanks located with the Shield O subdivision. The building details will follow the Medium Hazard construction specifications listed in 7-20-60 (c)4b. Shatz Residence ■1 r Sec 7-20-70: Wildlife County Maps show this lot included within an Elk Winter Range zone. No permanent fences are planned as part of the development, most of the mature trees on site are to be preserved, no new fruit bearing trees and shrubs are planned, development is generally contained to the existing disturbed areas, the majority of the site is to remain in natural condition, trash containers will be bear resistant and in general this project will not alter the existing condition for habitat in this area. Sec 7-20-120 Scenic View protection areas The building site is well concealed from Snowmass Creek Road and may only possibly be seen through heavy vegetation from a perspective a couple of miles up valley. From that vantage point it would be difficult to discern any development with the naked eye. The project does not break any skyline from Snowmass Creek Road because of the hillside topography behind the terrace of the property. Exhibit 7-20-120 shows photos from the building site looking in the direction of Snowmass Creek Road and from Snowmass Creek Road looking back toward the property. Sec 7-20-130 Landscaping and Vegetation Protection The site shall remain in a natural state except a few small areas outside the originally disturbed zone of development. No major changes to the landscape topography or flora are planned. 7-30: Roads, Driveways and Parking There is an existing driveway (permit attached) will serve the new home as well as it did the previous house. It provides easy access from Shield O Road. A new parking area and turnaround will be constructed as part of the project as determined by the Basalt Fire requirements. (Brooke Stott with BFPD has inspected the site and her recommendations to widen the driveway to 14' and ensure the turnaround size is sufficient will be incorporated into the final building permit plans) There will be a minimum of 4 parking places provided on site, which is double the required amount. 7-50: Public Services and Utilities (existing well, OWTS and utilities) The property has buried Electricity, TV, and Telephone services available (and they were used for the original house) The existing well provides an adequate and safe supply of water to the property. Well inspection and water testing results are attached for the record. Shatz Residence Carla Ostberg has inspected the site and reviewed test holes for the purpose of designing a new ISDS. The site can easily be served once again with a conventional type of septic system which she is currently designing. Technical Reports: There are no Technical Reports included at this time but could be added if deemed necessary. A. Geologic or Engineering Report — there are no natural geologic hazards, unstable soils, floodplain, etc. B. A Wildfire Mitigation Plan is not required for the project and not included. C. Drainage Study. The small scale of this project and topographical location ensure that no drainage issues exist or will be created. A preliminary Drainage Study and Drainage Plan are attached. D. There are no stream, wetland, or riparian areas involved. E. Civil Engineering Report -Existing well, permit and report attached -original ISDS to be replaced with new system -power and phone lines currently provided to building site -no drainage issues on this relatively dry South east facing bench site -soils suitable for spread footings In summary, this is a relatively simple project (quite modest by area standards), which is sensitive to the site constraints, follows the code requirements and should receive Administrative approval. I offer the following comments for this activity envelope and site plan review; Access: The existing driveway will need to meet the Pitkin County Asset Management Plan and widen the driveway width to 14 feet and follow the turnaround requirements set by the Basalt Fire Department. If the driveway exceeds 400 feet, a pullout would be required. Water Supply: The activity envelope is in close proximity to a 10,000 gallon community water tank for the Shield O homeowners. We can use the community tank as our closest manual water supply needs for firefighting. Wildfire Mitigation: According to the application, a wildfire mitigation plan is not required and not included. However, since the parcel is listed as a Medium Wildfire Hazard zone, it's important that the homeowner work with wildfire mitigation personnel to make that assessment.
