HomeMy WebLinkAboutbocc.ord.016.2002 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, ESTABLISHING FEES FOR THE CLERK AND RECORDER'S OFFICE FOR PREPARATION OF COURT ORDERED RECORDS ORDINANCE NO.d/G 2002 1. The Board of County Commissioners (BOCC) is the entity, which represents and acts on behalf of Pitkin County. In its capacity, the BOCC conducts proceedings and renders decisions with respect to administrative and land use applications. 2. The Pitkin County Clerk and Recorder, or her designee, serving in the capacity of the Clerk to the BOCC attends all regular and special meetings of the BOCC, records and maintains proceedings and associated documents. 3. Under C.R.C.P 106(a)(4) a motion can be filed by an applicant (plaintiff), by and through their counsel, for the Clerk and Recorder to certify a complete and accurate record of proceedings involving a case. Such record shall include one or more verbatim transcripts, copies of tapes and all other associated documents, which are the subject of a BOCC public hearing. 4. The Pitkin County Clerk and Recorder wishes to set fees which are consistent and fair to the public and which reflect the expense incurred in providing such records. 5. Certain fees currently charged for preparation of such records do not reflect the cost of staff time necessary to provide such records. NOW THEREFORE BE IT ORDAINED by the Board of County Commissioners of Pitkin County that it approves the Clerk and Recorder's request to bill out the costs for preparation of a court ordered record at the current employee hourly rate, which includes benefits. All additional costs associated with such record shall be passed on to the plaintiff e.g., copying costs, etc. INTRODUCED, FIRST READ, AND SET FOR PUBLIC HEARING ON THE 24th DAY OF JULY, 2002.
