COUNTY, COLORADO,GRANTING APPROVAL OF THE BUTTERMILK
METROPOLITAN DISTRICT 1041 HAZARD REVIEW AND SITE SELECTION FOR
A MAJOR DOMESTIC WATER SYSTEM
Resolution No.g-2002
RECITALS
1. The Buttermilk Metropolitan District("Applicanf)has applied to the Pitkin County Board
of County Commissioners ("BOCC") to consider 1041 Hazard Review and Site Selection
a Major Domestic Water System.
2. The system will be encompassed within the West Buttermilk Subdivision and portions of
the Eagle Pines Subdivision,West Buttermilk Pfister Tracts, Buttermilk Ski Area,Airport
Ranch,Pitkin County Airport, Owl Creek Ranch PUD and East owl Creek PUD.
3. The BOCC heard this application at a duly noticed public hearing on August 14, 2002, at
which time evidence and testimony were presented with respect to this application.
4. The BOCC has determined that installation of the water system is necessary for the health,
safety and welfare of residents within the Buttermilk Metropolitan District.
5. The BOCC finther determined that installation of the water system will result in minimal
disturbance to wildlife habitat and slopes in excess of 30 percent.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County
Commissioners that it does hereby approve the Buttermilk Metro District 1041 hazard Review and
Site Selection for a Major Domestic Water System subject to the following conditions,which shall
run with the land and be binding on all successors in interest.
1. The Applicant shall adhere to all material representations made in the application and in the
public meetings.
2. All water lines shall be contained within existing road rights-of-way or utility corridors that
have already been disturbed.
3. The Applicant shall provide for the Community Development Department consent from
each private property owner in the Buttermilk Metropolitan District allowing the placement
of water lines or storage tanks,wells, etc. on their property.
4. The Applicant shall comply with the following wildlife mitigation conditions:

a. All disturbed areas where water lines are buried shall be reseeded or replanted
with native vegetation upon final construction.
b. A weed management program shall be implemented until native vegetation has
become well established.
c. Construction workers shall allow no dogs on the construction site.
d. Construction of the water tank shall not take place from May 15`h to June 30`h
e. All power lines associated with the water tank shall be buried.
5. The Applicant shall prepare a revegetation plan for review and approval of the
Community Development and Land Management Departments prior to issuance of any
earth moving or building permits.
6. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin
County Land Use Code and Colorado Statutes, subject to the exceptions set forth in the
Pitkin County Land Use Code § 4-140 and C.R.S., § 24-68-105. The statutory vested
rights granted herein shall expire on August 14, 2005.
