PUBLIC COMMENT : None COMMISSIONER COMMENTS: Commissioner Richards expressed her sympathy for the attacks in Paris last Friday. She asked for a moment of silence and prayers for those who have suffered a great loss and for an end to these endless wars. Commissioner Newman gave kudos to the Aspen Skiing Company opening up Aspen Mountain early last weekend, and reported that the ski season opens this coming weekend. Additionally, he complimented the Aspen Community Theater fir their production of the Beauty and the Beast, which he commented was as good of a production that he has ever seen in New York. Also, he reported that there is new chain BOARD OF COUNTY COMMISSIONER I REGULAR MEETING NOVEMBER 18,2015 law legislation for 1-70, which could result in a fine of $160 if someone's tires don't comply with the specifications. Commissioner Clapper commented that the roads are extremely ice packed and encouraged everyone to drive and cross the roadways safely and with caution. CONSENT ITEMS: CONSENT ITEMS — SINGLE READING: Approval of Minutes of Regular Meetings of October 28th and November 4th Work Sessions of October 20th and October 27th Staff Person: Jeanette Jones, Clerk to the Board of County Commissioners Action: Commissioner Clapper requested an amendment to the November 4th minutes associated with the Lauks application that being that the current trespassing resident shall not be allowed to occupy the cabin that is located on the property. Action: Commissioner Richards moved approval of the minutes as amended. Commissioner Clapper seconded the motion. Motion passed with five yea votes. INDIVIDUAL CONSIDERATION ITEMS: INDIVIDUAL CONSIDERATION ITEMS/FIRST READINGS SET FOR PUBLIC HEARING ON DECEMBER 2, 2015 Resolution Approving and Intergovernmental Agreement with Eagle County for Child Welfare and Adult Protection Services — Motion to Staff Person: Kim Dubois, Health and Human Services Action: Commissioner Clapper moved approval of the Resolution with an amendment requested by Commissioner Owsley, that the effective and terminations dates of the agreement be listed in the Resolution. Commissioner Richards seconded the motion. Motion passed with five yea votes. Resolution Approving an Intergovernmental Agreement with the City of Aspen for the Pitkin County Nordic Ski Trails Program Management — Motion to Staff Person: Gary Tennenbaum, Assistant Open Space and Trails Director Action: Commissioner Newman moved approval of first reading of the Agreement as written and set for second reading and public hearing on December 2, 2015. Commissioner Clapper seconded the motion. Motion passed with five yea votes. BOARD OF COUNTY COMMISSIONER 2 REGULAR MEETING NOVEMBER 18,2015 INDIVIDUAL CONSIDERATION ITEMS/PUBLIC HEARING — SECOND READINGS: Second Reading — Ordinance Authorizing the Chair to Execute an Amended and Restated Agreement for Grant and Acceptance of a Trail Easement from AVR AH, LLC — Motion to Continue to December 2, 2015 Staff Person: John Ely, County Attorney Action: Commissioner Clapper moved to continue this Ordinance to December 2, 2015. Commissioner Richards seconded the motion. Motion passed with five yea votes. Second Reading — Ordinance No. 034-2015 - Authorizing Dottie Fox Overlook Acquisition — Motion to Approve Staff Person: Matthew Adeletti, Open Space and Trails Acquisition Manager Direction: Commissioner Child requested that staff work closely with the Snowmass Capital Creek Caucus on the management plan. Action: Commissioner Child moved to approve the Ordinance as written. Commissioner Clapper seconded the motion. Motion passed with five yea votes. LAND USE ITEMS: Resolution Approving the Reagan Request to Eliminate Employee Dwelling Unit Deed Restriction, and Special Review for a Caretaker Unit— Motion to Continue Staff Planner: Suzanne Wolff, Senior Planner Direction: Staff was asked to work with the applicant to provide the following prior to the next reading on this application: • Research past minutes to provide information of previous BOCC approvals on the other units listed in the packet information. • Detailed statistics on the qualifications of the employee who resided in this particular unit • Research for how the numbers on this unit and the previous numbers (associated with other units listed) were arrived at • Information on purchases of recent employee units. Action: Commissioner Clapper moved to continue this matter pending further research by staff and the applicant. Commissioner Richards seconded the motion. Motion passed with five yea votes.
