RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY, COLORADO, GRANTING AN EXTENSION OF A TEMPORARY
COMMERCIAL USE PERMIT ON THE BAUMANN PROPERTY
Resolution No. 99- 07)
RECITALS
1. Kiewit Western Company ("Applicant") has applied to the Board of County
Commissioners of Pitkin County, Colorado ("BOCC"), for approval of an extension to a
temporary commercial use permit pursuant to the Pitkin County Land Use Code.
2. The subject property is located on the Baumann property at 26150Highway 82 and is
described in Exhibit A.
3. The BOCC heard this application at a regularly scheduled meeting on December 1,
1999, at which time evidence and testimony were presented with respect to this
application.
4. The BOCC determined that the proposed activity meets the applicable criteria
established in the Land Use Code, provided the conditions listed in this resolution are
adhered to.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Pitkin County, Colorado, that it does hereby grant approval of the Kiewit western
request for extension of a temporary commercial use permit for materials storage,
employee parking, and equipment maintenance activities on the Baumann property until
November 1, 2000, subject to the following conditions which shall run with the land and
be binding on all successors in interest:
1. All material representations made by the Applicant in the application shall be adhered
to and considered conditions of approval.
2. The applicant shall prepare and submit a new site plan which delineates specific areas
and uses for approval of the County Engineer and the Community Development Director
prior to commencement of proposed activities on the property..
3. The Applicant shall prepare and submit a drainage and erosion control plan and a dust
and noise mitigation plan for approval of the County Engineer and the Community
Development Director prior to commencement of proposed activities on the property.
4. The Applicant shall prepare and submit a detailed landscaping and revegetation plan
for all disturbed areas outside the CDOT right of way for approval of the Land
Management Department prior to commencement of proposed activities on the property.

5. Backing operations which necessitate backup warning signals shall be kept to the
minimum feasible.
6. Non maintenance activities shall be limited to the hours of 7:00 am to 5:00 pm.
Maintenance activities shall be limited to 7:00 am to 10:00 pm.

A tract of land situated in Tracts 65, 66, 67 and 68, said tracts being parts of Sections 21,
22, 27 and 28, T8S, R86W of 6th P.M, being known as Parcel #2 and containing 414.087 acres
more or less. ( For reference and complete description see Book 347, Page 213, Pitkin County
Records, January 10, 1995 less .55 acre strip along Highway 82 to Dept. of Transportation now
considered part of Highway 82.)
