CO ADMINISTRATIVE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF PITKIN COUNTY, COLORADO, GRANTING APPROVAL FOR THE MARKETPLACE LLC SITE PLAN Administrative Decision No. 0 -2016 RECITALS Michael and Roxanne Lawler, also known as Aspen Grocery, LLC, (hereafter referred to as the "Applicant") has applied to the Community Development Director of Pitkin County ("Director") for Site Plan Review for construction of a loading dock shelter over an existing loading dock at the Roxy's Market property in the Aspen Airport Business Center (AABC). The proposed shelter is approximately 14' 5" in height and is approximately 730 square feet in total floor area. 2. The Lot is within the B-2 Zone District. The Lot is located at 119 AABC Road. The Lot is legally described as Block 3, Lot 4-A of the AABC Subdivision. PID#: 264334403341. 3. No previous land use decisions apply to the property. 4. The owner of the subject property "Marketplace LLC" has provided a letter stating their consent to process the application. 5. The Director finds that the addition is not subject to Commercial GMQS for additional employees generated by the 730 square foot shelter because it is not heated, useable floor area for the grocery store and is effectively only a shelter to keep snow and ice off the loading dock. 6. The Director further finds that the loading dock shelter complies with Site Plan criteria and specifically complies with the setback and Floor Area Ratio (FAR) requirements in the B-2 Zone District. 7. The Director further finds that the proposal is consistent with the West of Maroon Master Plan (WOMP) and in compliance with the WOMP Overlay Zone District, particularly WOMP standards that dictate a 15' height requirement within the 200' setback from the Hwy 82 right of way. 8. The affidavit of public notice was mailed on December 301, 2015 to property owners within 300' of the subject property. No objections were received within the 30 day public notice period. Public notice was published in the Aspen Times Newspaper on January 7t6, 2016. APPROVED by the Director, subject to the following conditions: The Applicant shall adhere to all material representations made in the current or prior applications or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. Prior to submission of the future building permit application, the Applicant shall submit for approval by the County Attorney and Community Development a Site Plan in accordance with 2.1.12 of the Pitkin County Land Use Application Manual. The above referenced approvals shall be a condition precedent to finalization and recordation. 4. The shelter shall utilize indigenous earth -tone colors or a color consistent with the existing building. Any reflective roofing shall be pre-treated to render it non -reflective, prior to installation. 5. The loading dock shelter shall not exceed 15' in height, measured pursuant to the Land Use Code. 6. Lighting for the shelter shall be in compliance with the Code. Representations of the lighting fixtures shall be provided at building permit submittal and approved prior to installation. 7. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, § 2-20-170 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on [3 , 2019. 8. Adjacent is a three sided shelter used to cover the trash. The property lies next to Highway 82 where it is located in B-2 zoning. The existing loading ramp is within the 200' set back from Highway 82 corridor. The grocery store was approved for expansion per Ordinance of the board of county commissioners of Pitkin County, Colorado, Amending Title 8 of the Pitkin County code, specifically The 2006 Land Use Code for Land Use Code Text Amendments -Ordinance No. 023 -2012 -recorded December 1, 2012. Description of Proiect/Development: The applicant is seeking Site Plan approval to construct a loading dock shelter to be built on top of the existing concrete ramp. This would add approximately 729 square feet to the buildings FAR. The shelter will protect the concrete ramp from weather allowing the unloading to not be affected by the weather. The shelter height will be less than 15' which is required in the W.O.M.P. Land Use Code for any building built in 200' of Highway 82. The current Roxy's Market is approximately 10,092 SF and the other stores are 3,232 SF. The total building is approximately 13,324 SF. UU0002 Page 2 Land Use Approvals This section of the land use application demonstrates compliance with the standards identified in the Pitkin County Pre- Application conference summary sheet (see attachment #2). The code sections are given in bold, and the responses in italics. Items Addressed per Application Summary: Sec. 3-70-50: West Maroon (WOMP) Overlay Zone District The exist loading dock is located in the Airport Business Center (ABC) There is an existing structure that covers the dumpster on three sides adjacent to the loading dock. The proposed canopy structure will be modest and discreet. The proposed design will be built at the finish grade of the existing Roxy's Market, which is lower than the natural topography and in keeping with the intent of the WOMP. The structure is located within the two hundred (200) feet of Highway 82 Right of Way; limiting it to a fifteen (15) feet peak roof (see attached #9B). This structure meets the requirement. On Block 3, Lot 4a there are three existing mature pine trees which are located between the proposed loading dock structure and Highway 82. Sec. 7-20-120(d): Standards for Scenic View Protection Areas (Hwy 82 is a designated scenic corridor) As a lot within Highway 82 Scenic Corridor, a scenic review prior to development is required and subject to the Standards for Development within Scenic View Protection Areas. The proposed location for development will be built on the existing loading dock ramp which is 178.25 feet from Highway 82 (see attachment #11 C ). This finish surface is lower than the natural topography between Highway 82 and Roxy's Market; therefore minimizing visibility of development on the site. This structure will be low scale and maintain the visual transition along Highway 82 corridor. Existing vegetation will hide the proposed loading dock. Earth tone materials will be use on the development and the roof will have a non -reflective color composition or be treated prior to installation. See Attachment #9C for the proposed lighting plan of the loading dock and Attachment #9D for the cut sheets. Sec. 7-20-140: Lighting The lighting strategy will conform to the Lighting Standards contained in Section 7-20-140 of the Pitkin County Land Use Code. The loading dock will have down -lit with wall mounted incandescent fixtures (see attached #9D spec for example). Summary This applicant is proposing to build a loading dock structure on the existing loading dock ramp.
