Septic permit approved per compliance with the owner design received August 3, 2004. Any changes must be
approved by this department and the design engineerrp iof to them being made. Minimum horizontal distances
between components of the system and physical features shall conform to the Pitkin County ISDS regulations.
Design is for a 1,000 gallon two-compartment concrete septic tank with an effluent filter on the outlet. Flow is to be

This department does not endorse any brand of products. This permit must be kept on-site during installation..
This department must be called for an inspection with a minimum of 48 hours advanced notice. The owner must
submit an as -built letter to this department.
'Revegetation over the area of the field is very important for the functioning of the system. Pitkin County has guidelines that must be
followed to assure the plants that are introduced are appropriate for the conditions of the area. The use of native plants is strongly

Plans and specifications of the propo ed individual sewage disposal system have been reviewed and are considered
satisfactory. Permission is hereby granted to the owner or the agent to perform the work indicated in accordance with the Pitkin
County ISDS Regulation in effect at the time of issue. This permit becomes invalid 6 months from the dale that the permit was
issued unless system construction has commenced or an extension has been approved in writing by the Department.
As -built drawings must be included with this permit before the final approval will be issued.

The fee for a ISDS application is $600 for a permit that takes 6 hours or less for the department to approve. If approval takes
longer than 6 hours, a rate of $100 per hour will be charged. The maximum fee is $1000. The basic fee of $600 is due at the
time of application. The remainder, if any, will be due in two stages: first, at the time of issuance of the ISDS permit; second,
before final approval of the ISDS permit.
Application for an individual sewage disposal system is hereby submitted. I hereby certify that the above information is true and
accurate and that I have provided true and accurate information on locations of all existing and proposed wells, contour
intervals, buildings, property lines, ditches, slopes, waterlines, springs, suction or irrigation lines, drinking water cisterns, drain
tiles, irrigation ditches, lakes, water courses, streams, floodplains, dry gulches, and existing septic systems. I hereby certify
that any such features not shown on attached site map are not present. Issuance of the permit does not imply the approval of
any other permit required for construction pursuant to Pitkin County codes. No construction may be undertaken until all
approvals and permits have been obtained.

The Pitkin County Environmental Health Department, Pitkin County and employees of these agencies will be held harmless
should the individual sewage disposal system fail or malfunction. The permit to construct is issued on information submitted by
the applicant or his/her representatives. The owner assumes full re risibility in case of failure of the system. c/

On Novemeber 23, 2005 1 conducted a site visit to Mac Smith's property at 3714 Track 36 and verified that the
cesspool had been properly abandoned.
This department has no further issues with the septic system and I have given "final approval" to the new septic
system, permit #0405.

I am the Pitkin County Code Enforcement Officer and this letter is in regard to your property
located at 3714 Bear Ridge, Pitkin County, formerly addressed as Tract 3714, 36 rd, Pitkin
County. -
I understand you have gained 1041 Review approval for the building located on this property and
that approval was predicated upon your installing a new septic system. I understand the new
septic system has been installed and inspected by Pitkin County Environmental Health.
However, the old system has apparently not been properly abandoned and inspected and is
consequently in violation of the Pitkin County Code.
The cure for this violation is for you to properly abandon the old septic system and then have it
inspected by the Pitkin County Environmental Health Dept. Please do so by November 30th,
2005 and inform me when this has been accomplished.
I appreciate your working to bring your property into compliance with the Pitkin County Code.
The staff of the County Environmental Health Dept. is available at 920-5070 to advise you
exactly how to abandon the old septic system and to inspect it afterwards. I am available at 920-
2814 if you have other questions or concerns.

Wastewater System Violation at 3714 Tract 36 Road, Basalt, Colorado
Dear Property Owners Smith:
As you are aware, the determination of the Pitkin County Hearing Officer granting
approval of your 1041 submission for the above -referenced property (Determination 19-2002),
required in Recital #7 that:
Prior to the issuance of any building permits, the Applicant
shall replace the existing septic system, which currently does
not comply with State and County standards. Replacement of
the existing septic system requires a septic permit from the
Environmental Health Department. The sewage disposal
system must be designed by a registered professional engineer.
The sewage disposal system shall be located within the
approved building envelope.
The Environmental Health Department served you with an official Notice of Violation on
October 27, 2003, which provided you with a deadline of December 15, 2003 to submit an
application form with appropriate fees for a septic permit. Because you have not complied with
this requirement to date, the matter has been turned over to my office for further action.
It is clear that the EHD has allowed you more than adequate time to address this matter
and bring your system into compliance. This letter serves as Final Notice that you must submit
an application form with appropriate fees to the EHD on or before March 15, 2004 or the County
will have no other recourse than to commence further enforcement actions against you including

including penalties for the use of a non -conforming septic system pursuant to C.R.S. § 25-10-
113(2), and for building without a building permit pursuant to Title 28 § 30 of the Colorado
Revised Statutes.
Once your septic permit application has been submitted to EHD, Nancy MacKenzie will
provide you with appropriate deadlines for your complete application including soil test results
and for replacement of the system.

I just had remembered that the sheriffs office used to act as a process server for legal papers. They
charge, but they go to the person's residence or work and document that the papers have been
served and received. Hugh Roberts also does this type of work.

Dear Property Owners:
On February 5, 2002, the Pitkin County Department of Environmental Health (DEH)
provided property owner Jo Jo Smith with a memorandum advising that the wastewater system
installed on the above referenced property did not conform to state and County Regulations and
must be abandoned and replaced with a conforming system. The DEH failed to receive a
response and on October 23, 2003, served you with an official Notice of Violation for the
prohibited wastewater system owned by you at 3714 Tract 36 Road, Basalt. The DEH requested
that you file an application for a conforming septic system by December 15, 2003. To date, you
have not complied and remain in violation of the Pitkin County Sewage Disposal System
Regulation, Section 4-11.9.
It is imperative that you submit a septic application with appropriate fees to the Pitkin
County Department of Environmental Health within thirty (30) days of this letter or the County
will have no other recourse than to file a Complaint in the Pitkin County District Court.

Subject: Percolation Testing, 3714 Tract 36 Road, West of East Sopris Creek Road,
Pitkin County, Colorado
Dear Mr. Smith:
As requested by you, Hepworth - Pawlak Geotechnical, Inc. performed percolation testing
at the subject site. Hepworth —Pawlak Geotechnical, Inc. previously performed
percolation testing at the subject site and presented our findings in a report dated July 7,
2003, Job No. 102 684.
Tbree percolation test holes were excavated on June 23, 2004 at the locations shown on
Figure 1. The subsoils exposed in the percolation test holes consisted of about 2'/z feet of
topsoil overlying sandy clay with shale fragments. Percolation test holes were hand. dug
in the bottom of shallow backhoe pits and soaked with water on June 23, 2004.
Percolation testing was conducted on June 24, 2004, by a representative of Hepworth -
Pawlak Geotechnical, Inc. The percolation test results are summarized on Table 1.
Based on the subsurface conditions encountered and the percolation test results, the tested
area should be suitable for a conventional infiltration septic disposal system. Pitkin
County requires that a professional civil engineer design the septic disposal system.

Dear Property Owners Smith:
As you are aware, the determination of the Pitkin County Hearing Officer granting
approval of your 1041 submission for the above -referenced property (Determination 19-2002),
required in Recital #7 that:
Prior to the issuance of any building permits, the Applicant
shall replace the existing septic system, which currently does
not comply with State and County standards. Replacement of
the existing septic system requires a septic permit from the
Environmental Health Department. The sewage disposal
system must be designed by a registered professional engineer.
The sewage disposal system shall be located within the
approved building envelope.
The Environmental Health Department served you with an official Notice of Violation on
October 27, 2003, which provided you with a deadline of December 15, 2003 to submit an
application form with appropriate fees for a septic permit. Because you have not complied with
this requirement to date, the matter has been turned over to my office for further action.
It is clear that the EHD has allowed you more than adequate time to address this matter
and bring your system into compliance. This letter serves as Final Notice that you must submit
an application form with appropriate fees to the EHD on or before March 15, 2004 or the County
will have no other recourse than to commence further enforcement actions against you including

Derr Mr. and Mrs. Smith,
This letter serves'as an official Notice of Violation (NOV) of a malfunctioning
wastewater treatment system owned by you,at 3714 Tract 36 Rd.
Last year the Environmental Health Department (EHD) reviewed your house plans and
the design of the septic system that was installed. A memo to you from this Department
dated February 5, 2002 stated that the septic system, was installed without a permit and
that it did not conform to State and county regulations. A drawing which you provided
indicated that this system meets the definition of a cesspool. Cesspools' are prohibited in
the State of Colorado pursuant to § 25-10-112(4), 8 C.R.S. (2002). In addition,
provisions of the Pitkin County Individual Sewage Disposal System Regulations prohibit
use of systems like your own. The memo stated that the cesspool.was to be abandoned
and replaced with a system that does conform to current regulations. We have not
received a septic application from you.
This NOV is issued under the authority of the Pitkin County Sewage Disposal System
Regulation, Section 4-11.9, Notice of violation of mhlfunctioning system: As stated in
the Regulation; "When the jEnvironmental,Health] Department learns that a system is not
working properly, it will issue a notice of violation (NOV)."
The exact violation(s) of the Regulation are:
Article 3, 6.28.050 Adequate sewage facilities required: "No one may construct
or maintain any dwelling or other. occupied structure that does not have adequate
facilitfm for the sanitary disposal of sewage in a way that will not endanger the public
health."
Article 9, 6.28.540 No discharge is permitted that does not comply with Rules
and Regulations: "No sewage or effluent may be discharged into or on the surface of the
ground or into state waters unless'the sewage system and effluent meets the minimum
requirements of this regulation and the owner or applicant has obtained the proper
discharge permits from the [Water Quality Control] Division."

On May I3, 2003 I stopped by your house to inquire about the status of your application.
No one was home, but I did leave my card" During this visit I observed some test pits and . .
that water ground was within 24 inches from the top of the ground. This indicates that _
your existing system may well beconnecting to groundwater and have possible, .
environmental and public health impacts. Article 5, 6.28.380 requires that the soil data
must be obtained during the period of seasonally high groundwater so that a 4 -foot
separation from groundwater can be maintained. If a mound system is required to 0
maintain separation from groundwater, an engineer must design the system..
This NOV requires that you comply withAlie following deadlines to bring your system
into compliance:
December 15, 2003 - submit an application form and fee for aseptic permit.
June 30, 2004 - complete application including soil test results (obtained during
the period of seasonally high groundwater) and a design of the system.
October 15, 2004 - deadline for replacement of the sewage treatment system will
be on or before this date:
Please be advised that should you fail comply with any of these deadlines, further use of .
your system shall be prohibited. -Moreover, pursuant to statute, you may be liable for
penalties of up to $50 per day for use of a non-compliant system. See § 25-10-113(2), 8
C.R.S. (2002).
EHD has endeavored to allow you adequate time to address your system and will
continue to work with you to bring it into compliance. If you wish to discuss the specific
regulatory requirements which govern your facility do not hesitate to contact me. I must,,
emphasize, however, that your current system is illegal and corrective actions must be
taken without further delay.
Thank you for your prompt attention to this most serious matter.

The Environmental Health Department has reviewed your house plans and the
design of the septic system that was installed.
1) The septic system that was installed without a permit does not conform to
State and county regulations. It must be abandoned and replaced with a
system that does conform to current regulations.
"PITKIN COUNTY INDIVIDUAL SEWAGE DISPOSAL SYSTEM
REGULATION, ARTICLE 3-4, ADEQUATE SEWAGE FACILITIES
REQUIRED: No one may construct or maintain any dwelling or
other occupied structure that does not have adequate facilities
for the sanitary disposal of sewage in a way that will not
endanger the public health."
2) You will need to get soil data ( 3 percolation tests and a profile hole) in the
area where the new absorption system is to be located. The percolation test
must be performed by or under the supervision of a Colorado Registered
Professional Engineer. Soil tests may only be performed from April 15th
through November 15.
3) The design and size of the system is determined by the soil data, the number
of bedrooms and potential bedrooms in your house, and the size of your
house. The plans you submitted indicated that the house has 3 potential
bedrooms: the den, the downstairs bedroom and the upstairs master
bedroom. The permit we issue will state that the system is not sized for the
"workroom" to be used as a bedroom.
4) Based on the inner -wall dimensions of the house, the house has a total of
1,943 sq. ft.

5) At this time your source of water is hauled water and you have a 1,000 gallon
holding tank. You stated that you do not have a clothes washer and do not
have a garbage disposal. The system can be designed based on a fixture
count since you have a limited water supply.
Shower = 14.7 g/p/d; kitchen sink = 1.8 g/p/d; bathroom sink =8.4 g/p/d;
and the toilet = 24.8
TOTAL = 49.7 g/p/d X 3 BR's X 2 people per bedroom equals an average
daily waste flow of 298 gallons and a Design Flow of 522 gallons.
A minimum 750 gallon two compartment septic tank would be required.
The size of the absorption area cannot be determined until the soil data is
done. (As an example: if the soil has an average perc rate of 30 mpi, the
absorption area, without reductions, would be 572 sq. ft.)
5) If the system is designed based on the limited water supply, the
permit that is issued will become invalid if and when a well is drilled
for the water source. The sewage disposal system would have to be
enlarged and designed using the traditional flow of 75 gallons/person/day
for a house of less than 2,000 sq. ft. The Design flow for sizing the system
with a well would be 788 gallons per day. A minimum 1,000 gallon two
compartment septic tank would be required. The size of the absorption
area cannot be determined until the soil data is done. (As an example: if
the soil has an average perc rate of 30 mpi, the absorption area, without
reductions, would be 862 sq. ft.)
