This permit must be retained and made available for inspection at the above location upon request
This permit shall not be transferred without approval of the issuing agency
This permit shall expire 120 days after its issuance if construction has not commenced and a valid building permit has not been obtained. Any change in
dans or specifications after the permit has been issued invalidates the permit, unless approval is secured from an Environmental Health Officer for such
changes.
This permit is temporary until fine! approval is granted by the issuing agency in writing. Final approval cannot be granted until construction, repair, and/or
cperation have occurred in conformity with the conditions of this permit. This permit is valid only for the individual sewago disposal system and/or equipment
specifically identified herein.
Before issuing final approval of this permit, the issuing agency reserves the right to impose conditional terms and conditions required N meet its applicable
regulations on a continuing basis. Monitoring and testing requirements may also be imposed. The issuing officer shall be notified not loss than 24 hours
p-ior to backfilling or closing up the work which would prevent inspection of components installed in places otherwise inaccessible following such backfilling
o- closure.
Tnis permit may be revoked or suspended by the issuing agency for reasons set forth in the regulations of said agency cr of the State Board of Health, as
applicable, including failure to meet any term or condition imposed thereon during temporary approval or upon final apploval.
Each and every condition of this permit is a materiel part hereof and is not severable. Any challenge to, or appeal of, a condition hereof shall constitute a
rejection of the entire permit and upon such occurrence this permit shall be deemed denied ab inhio.
This permit is issued and accepted with the understanding that a fee in the amount of $_ may be charged for each of no more than two annual effluent
samples routinely collected and tested from subject system as deemed necessary by the issuing agency to monitor said system for compliance with the
Provisions of Article 10, Title 25, C.R.S. 1973, as amended, and the rules and regulations which implement said Article; and that a like foe may be charged
for each such sampling taken in conjunction with the determination of compliance of subject system with a cease and desist order issued pursuant to C.R.S.
1973, Section 2570-107(1)(k).
The issuance of this permit does not imply compliance with other state or local regulatory or building requirement, nor shall it act to certify that the subject
system will operate in compliance with applicable state and local regulations adopted pursuant to Article 10 of Title 25, C.R.S. 1973, as amended, except for
the purposes of establishing final approval of. an installed system for issuance of a local occupancy permit pursuant to C.R.S. 1973, 25-10.111(2).

After reviewing the septic permit issued in 1995 we have determined the engineer
design may have not been installed as stated in the as -built. This department may have
decreased sizing requirements for both the tanks and the field due to limited use. From
what we can determine, a total of 2500 gallon tank capacity was installed and the size of
field is undetermined. With increased traffic and use of these facilities we did a re-
evaluation of the figures.

Violations were noted in toilet areas of the Snowmass General Store 10/22/99. Two of
the three toilets were backed up. Staff at the establishment say this is a common
occurrence. Possible cause of these problems may be the result of an undersized
system.

This letter is to inform you that certain parts of the soils data report submitted for your lot
are incomplete or do not comply with requirements of the Pitkin County Individual Sewage
Disposal Regulations. This letter will also tell you what additional tests you need to have
performed in order for us to issue your septic permit. We would also be very happy to
discuss this matter with you or your agent and explain the requirements of our regulation.
The following requirements of the county regulations have not been met.
(� The minimum number of perc tests was not done: at least three pert tests are required,
and at least three perc tests in every 1200 sq. ft. of absorption system.
("r Pert holes were not soaked for at least eight hours prior to the test.
[ ] Pere rate had not stabilized in the perc holes.
[ ] Data from one profile hole at least eight feet deep and including the soil at least four
feet below the bottom of the proposed absorption system was not provided.

As requested, Nelson Environmental and Wastewater Solutions, ltd., performed a soils
study and percolation tests to design a septic system for the existing residence and
commercial building on the property owned by you. The purpose of this investigation is
to evaluate the feasibility of abandoning the existing, aging sewage treatment plant and
replacing it with a more conventional septic system. We conducted this study
according to Section 4-5 of Pitkin County R"Matfons on Individual Sewage
QWggM SyMmm on October 13, 1994. We have based our recommendations on the
subsurface conditions encountered. We will furnish this letter to the Aspen/Pitkin
Environmental Health Department to obtain a permit to construct this individual sewage
The existing two-story building contains two-bedroom apartment and several small
businesses including a small general store and restaurant, a gas station, an autornobile
mechanics Shop and a post office. They are all currently served by a "Case-Cotter'"m
aerated plant and sewage lagoon system located on the Snowrnass Cabins property
across Highway 82, installed in the early 197(7s. This existing system is rated at a
capacity of approximately 8,000 gallons per day. There are two wells on the property
providing a souros of water to the businesses and residence and one for irrigation.
It is a possibility that a new post office facility might be constructed in the future.
However, for purposes of the on-site sewage disposal system design, the additional
building is not being considered in the flow calculations and design.
The property is 2.43 acres in size. As noted, the drinking water is provided from an
individual well already drilled on the property.

The site is in the Snowmass area. The Roaring Fork River is located across the
Highway from the North Property line, and is approximately 100 feet lower and three
hundred and fifty feet from the proposed absorption area. Most of the property is on a
flat site just South of Highway 82.
The ground surface, which appears to have been filled from two to four feet above
natural grade in the area proposed for new absorption pits, slopes rather gently to the
North at less than a 5% grade. This area is approximately ten feet above the building.
The vegetation consists of grasses, sagebrush and cleared parking areas. The steeper
hillsides to the South property line and away from the developed area are vegetated
with oak brush.
The profile pit, adjacent to the proposed absorption area, was excavated to a depth of
approximately nine feet below the existing grade. No groundwater was encountered
and bedrock was not present within nine feet of the surface of the ground.
The subsurface soil conditions were evaluated with the standard percolation test
procedures at the approximate location shown on Figure 1. The test holes were
excavated with a backhoe before our arrival at the site. The subsoil in which the
percolation testing was done was below two feet of fill material and nineteen inches of
topsoil. In the shallower test hole, the soil consisted of a sandy sift with flagstone
fragments a few inches in diameter. This layer exhibited some smearing under the
presswe of the excavating ecluipment.
Below the depth of the first percolation test hole was a consistent layer of sand, gravel
and cobble rocks to a depth of one hundred eight inches. The sands were well
consolidated, and showed little tendency to swell. There was a considerable portion
(over 50%) of fine soil material even in the deeper excavation where the second
percolation test hole was looted.
Percolation testing was performed in the proposed absorption area East of the existing
building. Two smaller holes were hand dug in the bottom of backhoe excavations, one
at a depth of approximately forty-one inches below the surface, and one at the bottom

of the profile pit at a depth of ninety eight -inches. We pre-soaked the percolation test
holes by adding water approximately six hours before beginning the percolation test
and keeping the bottom of the holes submerged until the percolation test
measurements were taken. There was no water remaining in any of the percolation
test holes after each of the initial presoaking periods.
The results of the percolation testing are presented in Table I. These resutts indicate
the Bitty sands and deeper sand and gravel matrix have an average weighted
percolation rate of 17 minutes per inch and are acceptable for a conventional infiltration
design for the on-site sewage system.
Ljm;ftWjqM: This report has been prepared in accordance with generally accepted
practices in this area for use for sewage disposal design purposes. The conclusions
and recommendations submitted in this report are based upon data obtained from our
site visits at the location indicated. There is some possibility that the nature and extent
of variations in the subsurface soils across the site may not have been evident at the
time of this investigation, and may need additional evaluation if further excavation
reveals conditions different from those described. This office should be advised of any
unusual situations as soon as possible so we may reevaluation of our
recorrtrttertdationS.

Dear Bill,
As requested, Nelson Environmental and Wastewater Solutions, Ltd., performed a soils
study and redone the percolation tests at the request of the Aspen/Pitkin Environmental
Health Department in order for your consulting engineer to confirm his design of an
"Infiltrator"'' septic system for the existing residential and commercial building on the
property . The purpose of this investigation is to, again, evaluate the feasibility of
abandoning the existing, aging sewage treatment plant and replacing it with a more
conventional septic system. We conducted this study according to Article 5 of the
Pitkin County Individual Sewage Disposal System Regulation (Revised May, 19951
on June 16, 1995. We have based our recommendations on the subsurface conditions
encountered. We will furnish this letter to the Aspen/Pitkin Environmental Health
Department to finally obtain a permit to construct this replacement individual sewage
system.
The existing two-story building contains a two-bedroom apartment and several small
businesses Including a small general store and restaurant, a gas station, an automobile
mechanics shop and a post office. The building is currently served by a Case-CotterTo
aerated plant and sewage lagoon system located on the Snowmass Cabins property
across Highway 82, and installed in the early 1970's. This existing system is rated at a
capacity of approximately 8,000 gallons per day. There are two wells on the property
providing a source of water, one to the businesses and residence and one for irrigation.
It is a possibility that a new post office facility might be constructed in the future.
However, for purposes of the on-site sewage disposal system design, the additional
building is not being considered in the flow calculations and design.
The property is 2.43 acres in size. As noted, the drinking water is provided from an
individual well already drilled on the property.

The site is in the Snowmass area. The Roaring Fork River is located across the
Highway from the North Property line, and is approximately 100 feet lower and three
hundred and fifty feet from the proposed absorption area. Most of the property is on a
flat site just South of Highway 82.
The ground surface, which appears to have been filled from two to four feet above
natural grade in the area proposed for new absorption bed, slopes rather gently to the
North at less than a 5% grade. This area is approximately ten feet above the elevation
of the building slab. The vegetation consists of grasses, sagebrush and cleared
parking areas. The steeper hillsides to the South property line and away from the
developed area are vegetated with oak brush.
Subsurface Conditions:
The profile pit, adjacent to the proposed absorption area, was excavated to a depth of
approximately nine feet below the existing grade. No groundwater was encountered
and bedrock was not present within nine feet of the surface of the ground.
The subsurface soil conditions were evaluated with the standard percolation test
procedures at the approximate locations shown on Figure 1. The test holes were
excavated with a backhoe before our arrival at the site. The subsoil in which the
percolation testing was done was, in most cases, below two feet of fill material and
twelve to twenty-four inches of topsoil. Below a depth of forty inches, four of the five
percolation test holes exhibited a consistent layer of sand, gravel and cobble rocks to a
depth of five to six feet. The sands were well consolidated, and showed little tendency
to swell. There was a considerable portion (over 50%) of fine soil material within the
native subsoil matrix.
The soils of the fifth test hole, excavated in native materials to the West and against
the hillside consisted of twenty-two inches of topsoil overlaying a layer of sandy loam
and flag sandstone fragments to a depth of sixty-four inches.

Percolation testing was performed in five test holes within or immediately adjacent to
the proposed absorption area, four hundred feet East of the existing building. One foot

minutes throughout the day. There was no water remaining in any of the percolation
test holes overnight and after each of the initial presoaking periods.
The results of the percolation testing are presented in Table I. These results indicate
the silty sands and deeper sand and gravel matrix have an average weighted
percolation rate of 21 minutes per inch and are acceptable for a conventional infiltration
design for the on-site sewage system.
Umftations: This report has been prepared in accordance with generally accepted
practices in this area for use for sewage disposal design purposes. The conclusions
and recommendations submitted in this report are based upon data obtained from our
site visits at the location indicated. There is some possibility that the nature and extent
of variations in the subsurface soils across the site may not have been evident at the
time of this investigation, and may need additional evaluation if further excavation
reveals conditions different from those described. This office should be advised of any
unusual situations as soon as possible so we may reevaluation of our
recommendations.

THIS LEACH FIELD EASEMENT AGREEMENT is made and granted this day of
November 1999, by Avalanche Associates, a Colorado general partnership, P.O. Box 500,
Snowmass, Colorado as the owner of the real property known as the Commercial Parcel and the real
property known as the Post Office Parcel as shown on the Avalanche Associates Subdivision
Exemption Plat recorded in the office of the Pitkin County Clerk and recorder on 29 July 1999 in
Plat Book 50 at Page 65 as reception number 433870.

A. Avalanche Associates, is the Owner of certain real property described in the
Avalanche Associates Subdivision Exemption Plat recorded in the office of the Pitkin County Clerk

B. This Agreement is to provide for the Commercial Parcel and its successors in interest,
certain rights and duties for an easement to use, keep and maintain the leach field as more
particularly defined on the Avalanche Associates Subdivision Exemption Plat and any amendments
thereto, to allow the Commercial Parcel the exclusive use of the leach field and its subsurface sewer
and septic pipeline across and underneath the Post Office Parcel from the easterly boundary of the
Commercial Parcel to the leach field located on the easterly portion of the Post Office Parcel and for
access as needed for repairs, replacement, maintenance and upkeep of the leach field, pipeline and
its supporting improvements.
AGREEMENT
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of
which is hereby admitted and acknowledged, and in consideration of the mutual covenants and
conditions contained herein, it is agreed as follows:
Recitals. The foregoing recitals are true and correct.
2. Ownership, Avalanche Associates, a Colorado general partnership ("Avalanche")
is the owner of the Commercial Parcel and the Post Office Parcel of the zeal property shown on the
Avalanche Associates Subdivision Exemption Plat recorded in the office of the Pitkin County Clerk
and Recorder on 29 July 1999 in Plat Book 50 at Page 65 as reception number 433870 and on the
First Amendment to the Avalanche Associates Subdivision Exemption Plat recorded on
December 1999 in Plat Book _ at Page _ as reception number in the office of the Pitkin
County Clerk and Recorder.
3. Grant. Subject to the terms and conditions set forth herein, Avalanche hereby grants
and conveys to the use and benefit of the Commercial Parcel, its successors and assigns, without
warranty of title, a private exclusive easement as more particularly defined and described on the First
Amendment to the Avalanche Associates Subdivision Exemption recorded in the office of the Pitkin

4. Rights. Purpose and Maintenance.
(a) Reservation of Rights. Exclusive use of this leach field easement is hereby
granted. It is intended that the leach field and leach field easement will be used solely by the
Commercial Parcel for its sewer and septic pipeline and related improvements across and
under the Post Office Parcel and for the leach field located on the Post Office Parcel. The
owner of the Post Office Parcel expressly reserves the right to use the surface of the easement
for any purpose not inconsistent with the leach field use granted to the Commercial Property
hereunder.
(b) Purpose. Avalanche hereby grants this exclusiveeasemeritto the Commercial
Parcel for the leach field and the non-exclusive easement to allow its subsurface sewer and
septic pipeline to cross the Post Office Parcel from the easterly boundary of the Commercial
Parcel to the leach field located on the easterly portion of the Post Office Parcel and for
access as needed for repairs, replacement, maintenance and upkeep of the Ieach field,
pipeline and their supporting improvements.
(c) Maintenance. Maintenance, repairs and upkeep of the easement shall be the
responsibility of the owner of the Commercial Parcel and shall be performed in a timely
mannerto have a reasonably minimal impact on the activities taking place on the Post Office
Parcel.
5. Subsequent Owners. The exclusive easement granted herein shall be appurtenant to
the Commercial Parcel and may not be transferred, assigned or conveyed apart or separately from
such lands.
6. Location of Easement. The exact location of leach field easement is shown on the
First Amendment to the Avalanche Associates Subdivision Exemption Plat recorded in the office
of the Pitkin County Clerk and Recorder on _ December 1999 in Plat Book _ at Page _ as

7. )tannins of Benefits and Burdens. All provisions of this instrument, including all
benefits and burdens, shall run with the Commercial Parcel and are binding upon and shall inure to

8. Coon. The rule of strict construction does not apply to this instrument. This
Leach Field Easement Agreement shall be given a reasonable construction in light of the intention
to confer on the Commercial Parcel a usable right for its leach field together with its sewer and septic
pipeline together with the rights provided by the Sewer & Septic Easement Agreement granted on
15 July 1999 and recorded on 29 July 1999 as reception number 433873 in the office of the Pitkin
County Clerk and Recorder.
9. Notices. Any notice, demand or communication shall be given by personal service
or certified mail, return receipt requested, with first class postage pre -paid thereon, and unless sooner
received, shall be deemed to have been received three (3) days after the date of certification.
10. Attorneys' Fees. If this Agreement becomes the subject of litigation to resolve a
claim of breach of this Easement Agreement, the party found to be in breach or otherwise in default
shall pay the reasonable attorney's fees, expenses and court costs of the non -breaching party. It is
further agreed that jurisdiction and venue shall be proper only in Pitkin County, Colorado and
Colorado law shall apply.
11. Enforcement. Enforcement ofthis Agreement shall be an action at law or equity, and
may include injunctive relief.
