There is a non—exclusive easement for fishing and boating which traverses the property. The easement extends five (5) feet above the high water line on the property along the bank of the roaring Fork River. The use of and access across land within Kirianoff South Parcel outside the fishing and boating easement is for safety, emergency and incidental up river and down river access and not for recreational travel or activities. This easement is described in further detail at Book 757 at Page 951. 10. Fences shown hereon have been shown for general reference and do not necessarily depict limits of ownership. 11. Due to current snow cover on this property, it is possible that some ground level features may not be shown, or the locations shown hereon may be approximate (i.e. edge of drives, walks, water valves, etc.). 12. The property shown hereon is subject to all easements, rights—of—way, building setbacks or other restrictions of record, as such items may affect this property. This survey does not represent a title search by this surveyor to determine ownership or to discover easements or other encumbrances of record. All information pertaining to ownership, easement and other encumbrances of record has been taken from the title insurance commitment issued by Westcor Land Title Insurance Company, Commitment No. PCT23922W, having an effective date of January 27, 2015. Item 8: The document in Book 188 at Page 48 is an Affidavit of Values for mining claim improvements and does not appear to burden the subject parcel. The Colorado Bureau of Land Management records show no patented mining claims on the subject parcel and no evidence of mining activity was noted on the subject parcel at the time of survey. Item 9: An easement and right of way 20 feet in width for a road woy as set forth in instrument recorded April 16, 1942 in Book 167 at Page 438 refers to the Marie Load Claim which has no record of patent in the Colorado Bureau of Land Management Records therefor its location cannot be determined. At the time of this survey no evidence of a mine or mining road was found on the subject parcel. Item 10: An easement and right of way granted to Rock Mountain Natural Gas Company, Inc., in instruments recorded October 19, 1961 in Book 195 at Page 434 and October 31, 1962 in Book 199 at Page 520 does not affect the subject parcel. All evidence of a gas line resides on the north side of the Roaring Fork Transportation Authority Right of Way. Item 11: An easement and right of way for an easement for ingress and egress as set forth in instrument recorded August 29, 1967 in Book 228 at Page 526 provides access across Lots 1 and 2 of the Irvin Naylor Lot Split as recorded at Reception No. 243626 and is graphically depicted. Item 12: Easement and right of way for an electric transmission or distribution line or system, as granted to Holy Cross Electric Association, Inc., in Instruments recorded October 23, 1973 in Book 280 at Pages 644-646 affects the subject parcel the extents of which are shown hereon. Item 13: An easement and right of way for ingress and egress as set forth in instrument recorded December 16, 1975 in Book 306 at Page 726, 729, and 732 for a 1 acre parcel. There is no record of a 1 acre parcel located within Tract 68 of Township 8 South, Range 86 West in the Pitkin County records. Thus it is unclear where a 50 foot access easement from Highway 82 and crossing the Southeast portion of the subject parcel is located. Item 14: Terms, conditions, provisions, and obligations as set forth in Agreement recorded June 28, 1994 in Book 754 at Page 269 describes an agreement for the Johns Lot Line Adjustment and granting an easement across Johns parcel to access the subject parcel. The deed references an "Attached Exhibit" which was not attached, therefor the definition and location of the "the easement area" is not described within this deed or on the plat of Johns Lot Line Adjustment. Item 15: Terms, conditions, provisions, obligations and all matters as r:et forth in Resolution of the Board of county Commissioners recorded December 2, 1992 in Book 696 at Page 143 as Resolution No. 92-405 and re—recorded December 16, 1992 in Book 697 at Page 939 and re—recorded August 9, 1994 in B ok 757 at Page 951 affects the subject parcel the extents of which are graphically depicted. Item 16: Terms, conditions, provisions, obligations and all matters as set forth in Resolutions of the Board of County Commissioners recorded October 13, 1995 in Book 796 at Page 828 as Resolution No. 95-174 affects the subject parcel but cannot be graphically depicted. Item 17: Terms, conditions, provisions, and obligations as set forth in Agreement for a Caretaker Dwelling Unit recorded March 26, 1996 as Reception No. 391174 affects the subject parcel but cannot be graphically depicted. Item 18: There are no easements and/or access roads shown in Plat Book 38 Page 54 that affect the subject parcel. The building,m, caretaker dwelling and riding arena envelope is converted, by terms and provisions of the Pitkin County Board of Commissioners resolution No. 193-2002. See Item 21. 1 Item 19: An easement and right of way for an electric transmission or distribution line or system as granted to Holy Cross Electric Association, Inc., in instrument recorded September 17, 1999 as Reception No. 435612 affects the subject parcel the extents of which are graphically depicted. Item 20: The terms, conditions, provisions and obligations as set forth in CDOT Agreement recorded October 31, 2000 as Reception No. 448402 is a temporary easement for the construction of a driveway and was designed to terminate after construction. It no longer affects the subject parcel. Items 21 & 22: The terms and provisions of the Pitkin County Board of County Commissioners Resolutions No. 193-2002 Recorded as Reception No. 474188 & 126-2003 Recorded as Reception No. 491305 cannot be graphically depicted.
