This permit is for an emergency repair. The existing system was not located as expected and was excavated
during construction of the caretaker unit
Septic permit approved per compliance with the engineer letter dated June 25, 1999. The design is based on the
soil data and the November 19, 1998 design for the detached caretaker unit which was issued ISDS permit #99037.
The design is for a 1,000 gallon tank, a lifting pump if needed, and a drywell 13' X 13' X 10'.
** The design is based on the soil data obtained for the caretaker unit which was 14 mpi perc rate . The engineer
will observe the excavation for the drywell. If the soil type appears different than that observed for the caretaker
unit, additional perc tests will be done.
Any changes must be approved by this department and the design engineer prior to them being made.
Minimum horizontal distances between components of the system and physical features shall conform to the Pitkin
County ISDS regulations.

longer than 6 hours, a rate of $55 per hour will be charged. The maximum fee is $1000. The basic fee of 5330 is due at the time
of application. The remainder, if any, will be due in two stages: first, at the time of issuance of the ISIDS permit; second, before

NOTE: SEPTIC PERMIT APPLICATIONS CANNOT BE ACCEPTED UNTIL ALL OF THE
INFORMATION BELOW IS INCLUDED.
The soils test and system design must be done by a Registered Professional Engineer. You should
plan to meet with the RPE at your site to discuss where the soils tests should be done to meet all
of the County regulations and where you want to put your house. The RPE will be your contact
for issues you want to discuss about your system's size and location. The RPE should check each
box to indicate the following have been submitted before the application can be accepted.

Percolation tests must have a minimum of 3 perc holes and one in every 1200 sq. ft. of

Two site visits were made on Tuesday, June 29 and Thursday, July 1, 1999 to ascertain the
soils and constructed improvements for the replacement ISDS damaged June 25, 1999.
The soils can be described as:
6"- 12" Topsoil, Sandy -Clay Loam
36" Rocky Sandy -Clay (4"-)
24" Sandy -Clay, cemented layer
36"+ Sandy -Clay, uncemented, loose
Total depth of hole = 12 feet
The improvements constructed include a new 1,000 -gallon polyethylene septic tank, 300 -
gallon poly -sphere pumping chamber, 2" SCH40 force main with 72" cover up the bank to the
pit. Said pit contains two, 3" perforated drop -pipes, 6' apart with a 4" riser and removable cap
on one pipe.
The pump was not installed at the time of the July 1 site visit, however, the pump specified for
installation was a Hydromatic model SPD50H, 1/2 Hp, 10 230V, 2" NPT discharge.
Accessories to include a 2" check -valve and 2" coupling placed above the water line for pump
removal.
Said observed construction is in substantial conformance with the design criteria specified to
the contractor (Meldor) and letter dated June 25, 1999, faxed to your office.

The General Contractor for the above home construction called today to inform me that the
leachfield for the existing residence was not located as originally described. It was initially
disclosed that it might be under the existing driveway. He "found" it during the excavation of
the proposed caretaker's residence (southwest corner), in which the end of the leachfield was
damaged.
I instructed the owner's son (Robert Hardy, 927-3357) that the septic tank should be pumped
out to avoid any further discharge to the leachfield. This would also permit the residents to use
the facilities over the weekend without incident. In the meantime, the owner will use the
temporary construction privy until the system is repaired.
The owner would like to completely replace the existing ISDS and relocate it to the north and
east of the existing residence. This installation will require a pumping station. The soils
appear to be similar to those tested for the caretaker's residence and that the same dry -well
design could be used for the existing house (3 bedrooms). Said replacement system would
be installed as soon as possible (see attached sketch).
The General Contractor also informed me that they raised the caretaker's residence five feet
and the proposed pump chamber for that system may not be necessary.
Please call me and we can discuss the above in more detail. This is an emergency repair,
however, there wasn't any effluent flowing anywhere and no apparent health risk.

Yes issue the permit. The original approval does not state that the septic
has to be in the approved building envelope, although our land use code has
changed and required it now. However, Lance, Joanna, and myself have made
the determination that they can go forward without a land use review and
put the septic outside of their building envelope.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the permit does
not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested water right
from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402.2, unless approval of a
variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in
accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(2) on the condition that the well be operated in accordance with the Richard and Andrea
Panichi Augmentation Plan approved by the Division 5 Water Courtin case no. 98CW10. If the well is not operated in accordance
with the terms of said decree, it will be subject to administration including orders to cease diverting water.
4) Approved for the use of an existing unpermitted well. This well is to be located on a residential site of 23 acres described as a
portion of the S'k Sec. 27, Twp. 8 South, Rng. 86 West of the 6th P.M., Pitkin County.
5) The use of ground water from this well is limited to fire protection, ordinary household purposes inside one single family dwelling,
and the irrigation of up to 3,300 square feet of lawns and gardens.
6) The maximum pumping rate shall not exceed 2 GPM.
7) The annual amount of ground water to be withdrawn shall not exceed 0.6 acre-foot.
8) The return flow from the use of the well must be through an individual waste water disposal system of the non -evaporative type
where the water is returned to tha same stream system in which the well is located.
9) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all diversions
must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request.
10) This well shall be located not more than 200 feet from the location specified on this permit.
11) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case number(s)
as appropriate. The owner shall take necessary means and precautions to preserve these markings.
12) This permit has been approved for a pumping rate of 2.0 GPM pursuant to the terms of case no. 98CW10 (the permit application
indicated 2.5 GPM). You are hereby notified that you have the right to appeal the issuance of this permit, by filing a written
request with this office within sixty (60) days of the date of issuance, pursuant to the State Administrative Procedures Act. (See

The above -entitled Application was filed on January 30, 1998, and was referred to the
undersigned as Water Referee for Water Division No. 5, State of Colorado, by the Water Judge
of said Court in accordance with Article 92 of Chapter 37, C.R.S. 1973, known as the Water
Right Determination and Administration Act of 1969.
The undersigned Referee, having made such investigations as are necessary to determine
whether or not the statements in the Application are true, and having become fully advised with
respect to the subject matter in the Application, does hereby make the following Findings of Fact,
Conclusions of Law and Ruling as the Referee in this [natter:

3. A Statement of Opposition was filed in this matter by the Snowmass Water and Sanitation
District. The time for filing Statements of Opposition has expired. Applicant and Objector
have entered into a Stipulation under which Objector's Statement of Opposition is deemed
withdrawn upon entry of this decree.
4. The Applicants request confirmation of a conditional water right for Panichi Well No. I,
described as follows:

from the West section line of said Section 27.
C. Source: Groundwater tributary to Snowmass Creek, tributary to the Roaring Fork
River, tributary to the Colorado River.
D. Depth: Approximately 85 feet.
E. Appropriation date: September 27, 1986.

construction of well.

vi. Use: Generation of electricity, irrigation, domestic, municipal
stockwatering, piscatorial and industrial purposes.
C. '"Proposed change: Applicants have requested a decree establishing an alternate
or additional point of diversion for 0.004 c.f.s. (2 gpm) of the water right
decreed to the Basalt Conduit to be diverted at Panichi Well No. 1, as described
above. Applicants asserted in their Application that prior to entry of a decree
awarding the change of water right requested herein, the Application would be
supplemented with a final Water Allotment Contract with the Basalt Water
Conservancy District confirming Applicants' interest in the Basalt Conduit.
Said Contract has been awarded and a copy filed with this Court. Under the
Contract, the Applicants are entitled to receive and apply to beneficial use
0.004 c.f.s of water under the Basalt Water Conservancy District's Basalt
Conduit water right described in paragraph 5 above and 0.3 acre feet of water
from Ruedi Reservoir under the water right described in paragraph 6.13. below.
D. Applicants own the land upon which Panichi Well No. 1 is located; the point of
diversion for the Basalt Conduit is located on land owned by the United States
of America, c/o Bureau of Reclamation, Eastern Colorado Projects Office, 11056
West County Road 18E, Loveland, CO 80537.
E. The Court finds that, provided it is exercised in accordance with the terms and
conditions of this Decree, the change of water right requested in the Application
will not injuriously affect the owner of, or persons entitled to use water under, a
vested water right or decreed conditional water right.
6. Applicants made a Third Claim requesting approval of the following -described plan for
augmentation, including exchange, under which out -of -priority depletions from Panichi
Well No. l will be replaced with water released from Reudi Reservoir pursuant to the Water
Allotment Contract between Applicants and the Basalt Water Conservancy District:
A. Name of structure to be augmented: Panichi Well No. I, described in Paragraph 4
above.
B. Water rights to be used for augmentation: Ruedi Reservoir, originally decreed for
140,697.3 acre feet in Civil Action No. 4613, Garfield County District Court on
June 20, 1958, with an appropriation date of July 29, 1957, for hydroelectric power
generation, irrigation, municipal, domestic, industrial, piscatorial and stockwatering
uses. In case No. W-789-76, Water Division No. 5, the quantity of water decreed
for storage in Ruedi Reservoir was reduced to 101,369 acre feet.
C. Statement of plan for augmentation: Water produced from Panichi Well No. 1

will be used to provide a domestic water supply, including irrigation and fire
protection, for a single family residence located in the NEI/4 SWI/4 Sec. 27,
T8S, R86W of the 6" P.M. Exhibit "B" attached hereto sets forth calculations of
water demand and consumption on a monthly basis. Based upon year around
'occupancy of 4 persons with daily demand of 80 gallons per person per day, and
3300 square feet of lawn and garden irrigation, total annual diversions are
expected to be 0.601 acre feet. Assuming rates of consumptive use of 15% for in-
house uses and 80% for irrigation, total annual depletions are expected to be 0.213
acre feet.
D. The full quantity of depletions resulting from the operation of Panichi Well No. 1
will be replaced under this plan for augmentation. Whenever the Well is unable
to divert water under its own priority or as an alternate point of diversion for the
Basalt Conduit, water will be released from Ruedi Reservoir pursuant to
Applicant's Water Allotment Contract with the Basalt Water Conservancy
District. Water released from Ruedi Reservoir pursuant to the plan will be
exchanged from the confluence of the Roaring Fork and Frying Pan Rivers to the
point of depletion.
E. The proposed plan for augmentation meets the statutory criteria for a plan for
augmentation set forth in C.R.S. § 37-92-103(9), -302(1), and —305(8), as one
contemplated by law and, if operated in accordance with the terms and conditions of
this Ruling, the use of water from Panichi Well No. 1 pursuant to this plan for
augmentation will not injuriously affect the owner of, or persons entitled to use
water under, a vested waterright or decreed conditional water right.
CONCLUSIONS OF LAW
7. The Application filed herein is complete, covering all applicable matters required under
C.R.S. §37-92-302.
8. All notices required by law have been given, and no further notice need be given.
9. The Court has jurisdiction of this matter and of all persons, whether they have appeared
or not. C.R.S. §37-92-301(2) and -303(1).
10. This Court has authority to confirm the water rights and to approve the change of water
right and augmentation plan, including the practice of substitution and exchange,
requested in this application. C.R.S. §§37-92-301(2), -302 and -303(1).
11. A change of water right or plan for augmentation, including water exchange project, shall
be approved if it will not injuriously affect the owner or persons entitled to use water

under a vested water right or decreed conditional water right. C.R.S. §37-92-305(3).
12. Any decree approving a change of water right or plan for augmentation must be
conditioned upon the retained jurisdiction of the Court for a period necessary or desirable
to preclude or remedy any injury to the vested rights of others. C.R.S. §37-92-304(6).
RULING OF THE REFEREE
13. The foregoing Findings of Fact and Conclusions of Law are incorporated herein by this
reference, and the Referee concludes that the Application should be granted.
14. The Court hereby confirms the conditional underground water right for Panichi Well No.
1, described in Paragraph 4 above. The water right confirmed herein is a conditional
water right. Should the Applicants desire to maintain the conditional water right
confirmed herein, an Application for Reasonable Diligence shall be filed in the same
month of the sixth calendar year following entry of this decree, unless a determination has
been made prior to that date that such conditional right has been made absolute by reason
of the completion of the appropriation, or is otherwise disposed of.
15. The Court hereby approves the change of water right described in Paragraph 5 above,
subject to the terms and conditions set forth herein. Pursuant to Applicants' stipulation
with Snowmass Water and Sanitation District, Applicants shall not exercise the Basalt
Conduit water right to place a call upon any Snowmass Creek water right which is
senior to the date of the Application herein.
16. The plan for augmentation, including exchange, described in Paragraph 6 above is
hereby approved, subject to the terms and conditions set forth herein.
17. Any use of water from the Basalt Conduit or Ruedi Reservoir pursuant to this decree
shall be contingent upon the existence of a contract between the owner or user of the
Panichi Well No. I and the Basalt Water Conservancy District made pursuant to the
District's policies and procedures.
18. The augmentation plan approved herein is expressly contingent upon a contract between
the owner or user of the Panichi Well No. I and the Basalt Water Conservancy District,
such as that previously filed with the Court in this case. A copy of said Contract shall
be provided to the State Engineer showing that augmentation water will be provided to
the Colorado River as is consistent with this decree and as approved by the Division
Engineer.
19. Applicants shall install measuring devices, provide accounting, and supply calculations
regarding the timing of depletions as required by the Division Engineer for tite

and shall provide an annual report summarizing diversions and replacements made

20. The approval of the change of water right and augmentation plan shall be subject to
reconsideration by the Water Judge on the question of injury to the vested rights of
others for a period of two calendar years following the date of entry of this decree. In
determining the period of reconsideration, the Court has taken into account the
historical and proposed future use of the subject water rights.
21. Pursuant to Section 37-92-305(8), C.R.S., in administering the augmentation plan
approved herein, the State Engineer shall curtail all out -of -priority diversions, the
depletions from which are not so replaced as to prevent injury to vested water rights.
22. The State Engineer's Office shall issue a well permit for the Panichi Well No. 1 subject to
the requirements of Section 37-90-137, C.R.S. 1973, as amended.
It is ORDERED that this Ruling shall be filed with the Water Clerk subject to Judicial review.

Subject: Subsoil Study for Foundation Design and Percolation Test, Proposed
Employee Housing Unit, 0406 Snowmass Creek Road, Pitkin County,
Colorado.
Dear Ms. Panichi:
As requested, Hepworth-Pawlak Geotechnical, Inc. performed a subsoil study and
percolation test for foundation and septic disposal designs at the subject site. The study
was conducted in accordance with our agreement for geotechnical engineering services
to you dated October 19, 1998. The data obtained and our recommendations based on
the proposed construction and subsurface conditions encountered are presented in this
report. Evaluation of potential geologic hazard impacts on the site are beyond the scope
of this study.
Proposed Construction: The proposed unit will be a two story wood frame structure
located on the site as shown on Fig. 1. The lower level will contain a garage area.
Ground floors are proposed to be slab -on -grade. Cut depths are expected to range up to
about 5 feet. Foundation loadings for this type of construction are assumed to be
relatively light and typical of the proposed type of construction. The septic disposal
system is proposed to be located north of the unit.
If building conditions or foundation loadings are significantly different from those
described above, we should be notified to re-evaluate the recommendations presented in
this report.
Site Conditions: The site is located on a west facing hillside and uphill of Snowmass
Creek Road. The building area is located on a relatively flat man-made topographic
bench with steep slopes above and below. The area is sparsely vegetated with grasses
and weeds. The site is currently occupied with a one story wood frame residence.
Subsurface Conditions: The subsurface conditions at the site were evaluated by
excavating two exploratory pits in the building area and one profile pit in the septic
disposal area at the approximate locations shown on Fig. 1. The logs of the pits are
presented on Fig. 2. The subsoils encountered, below about 1 foot of topsoil, consist of
silty sand and gravel with cobbles and small boulder size rock fragments. Two to three
feet of man -placed fill was observed in Pit 1 and the Profile Pit. Results of a gradation
analyses performed on a sample of gravels (minus 3 to 5 inch fraction) obtained from
the site are presented on Fig. 3. No free water was observed in the pits at the time of
excavation and the soils were slightly moist to moist.

Foundation Recommendations: Considering the subsoil conditions encountered in the
exploratory pits and the nature of the proposed construction, we recommend spread
footings placed on the undisturbed natural soil designed for an allowable soil bearing
pressure of 2,000 psf for support of the proposed building. Footings should be a
minimum width of 16 inches for continuous walls and 2 feet for columns. The building
site is located on a cut/fill bench and existing fill encountered at the foundation bearing
level within the excavation should be removed and the footing bearing level extended
down to the undisturbed natural soils. Exterior footings should be provided with
adequate cover above their bearing elevations for frost protection. Placement of
footings at least 42 inches below the exterior grade is typically used in this area.
Continuous foundation walls should be reinforced top and bottom to span local
anomalies such as by assuming an unsupported length of at least 10 feet.
Floor Slabs: The natural on-site soils, exclusive of topsoil, are suitable to support
lightly loaded slab -on -grade construction. To reduce the effects of some differential
settlement, floor slabs should be separated from all bearing walls and columns with
expansion joints which allow unrestrained vertical movement. Floor slab control joints
should be used to reduce damage due to shrinkage cracking. The requirements for joint
spacing and slab reinforcement should be established by the designer based on
experience and the intended slab use. A minimum 4 inch layer of free -draining gravel
should be placed beneath basement level slabs to facilitate drainage. This material
should consist of minus 2 inch aggregate with less than 50% passing the No. 4 sieve
and less than 2% passing the No. 200 sieve.
All fill materials for support of floor slabs should be compacted to at least 95 % of
maximum standard Proctor density at a moisture content near optimum. Required fill
can consist of the on-site soils devoid of vegetation, topsoil and oversized rock.
Existing fill under the slab area should be removed and replaced as recommended
above.
Surface Drainage: The following drainage precautions should be observed during
construction and maintained at all times after the residence has been completed:
1) Inundation of the foundation excavations and underslab areas should be
avoided during construction.
2) Exterior backfill should be adjusted to near optimum moisture and
compacted to at least 95% of the maximum standard Proctor density in
pavement and slab areas and to at least 90% of the maximum standard
Proctor density in landscape areas. Free -draining wall backfill should be
capped with about 2 feet of the on-site, finer graded soils to reduce
surface water infiltration.

sloped to drain away from the foundation in all directions. We
recommend a minimum slope of 6 inches in the first 10 feet in unpaved
areas and a minimum slope of 3 inches in the first 10 feet in pavement
and walkway areas.
.-4) Roof downspouts and drains should discharge well beyond the limits of
all backfill.
Percolation Testing: Percolation tests were conducted on October 30, 1998 to evaluate
the feasibility of an infiltration septic pit disposal system at the site. A profile pit was
dug at the location shown on Fig. 1. Percolation test holes were located within the pit
at depths of 4, 9 and 12 feet. The pit was excavated to a total depth of 16 feet. The
soils exposed in the Profile Pit are shown on Fig. 2 and consist of 2 to 3 feet of man -
placed fill and topsoil overlying silty sand and gravel with cobbles. The percolation test
holes were soaked and protected from freezing with rigid foam insulation on October
29, 1998. The percolation test results are presented in Table I. Based on the
subsurface conditions encountered and the percolation test results, the tested area should
be suitable for an infiltration septic disposal system. Pitkin County requires a civil
engineer design the septic disposal system.
Limitations: This study has been conducted in accordance with generally accepted
geotechnical engineering principles and practices in this area at this time. We make no
warranty either expressed or implied. The conclusions and recommendations submitted
in this report are based upon the data obtained from the exploratory pits excavated at the
locations indicated on Fig. 1, the proposed type of construction and our experience in
the area. Our findings include interpolation and extrapolation of the subsurface
conditions identified at the exploratory pits and variations in the subsurface conditions
may not become evident until excavation is performed. If conditions encountered
during construction appear different from those described in this report, we should be
notified at once so re-evaluation of the recommendations may be made.
This report has been prepared for the exclusive use by our client for design purposes.
We are not responsible for technical interpretations by others of our information. As
the project evolves, we should provide continued consultation and field services during
construction to review and monitor the implementation of our recommendations, and to
verify that the recommendations have been appropriately interpreted. Significant design
changes may require additional analysis or modifications to the recommendations
presented herein. We recommend on-site observation of excavations and foundation
