Vos Caudill, Pitkin County, CO ADMINISTRATIVE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF PITHIN COUNTY, COLORADO, APPROVING THE PARKER ACTIVITY ENVELOPE AND SITE PLAN REVIEW Administrative Decision NoCU-2016 1 RECITALS 1) David and Priscilla Parker (hereafter "Applicant") have applied to the Community Development Director of Pitkin County (hereafter "Director") to establish an Activity Envelope and obtain Site Plan Review approval to develop a single family residence. 2) The property is located off of Emma Road and East Fork Lane, and is more specifically described as Lot 2, Happy Day Ranch. 3) The lot contains 25.5 acres and is conforming in size in the AR -10 zone district. 4) The Board of County Commissioners approved the Happy Day Ranch Low Impact Subdivision pursuant to Resolution Nos. 88-137 and 89-59; the Final Plat was recorded in Plat Book 22 at Page 80. A building envelope was designated on the plat; the proposed Activity Envelope corresponds to the building envelope shown on the plat. Lot 2 is labeled on the plat as "deed restricted." It is restricted against further subdivision (the Low Impact Subdivision regulations required each lot to contain 2% times the lot area required in the zone district) and development is limited to the building envelope shown on the plat. 5) The Director finds that the proposed Activity Envelope and Site Plan complies with the Land Use Code ("Code") as follows: A. The wildfire hazard is rated as low in the pasture where the Activity Envelope is sited, and the hazard can be mitigated. The hillside on the western portion of the lot is rated as severe hazard; no development will occur in this area. B. The Activity Envelope is comprised of slopes of less than 301/6. C. There are no known or mapped watercourses or water features on the site. An irrigation ditch runs below the lot along the northern boundary, but will not be affected by the development. D. The steep western portion of the lot is within mapped elk winter range and mule deer winter range and severe winter range. Sec. 7-20-70(d) of the Land Use Code ("Code") requires a ''A mile buffer between any building and severe winter range, unless a different buffer is appropriate "due to unusual wildlife factors or other unique features of the property, and the alternative is approved through the Site Planning process." The envelope is within the buffer, but the envelope was sited when the property was subdivided and the location was supported by the then Colorado Division of Wildlife. The proposed residence is proximate to an existing residence (400'), and, therefore, is within the Zone of Influence for that residence (180m). The lot to the north (Lot 1) will not be developed and is protected by Conservation Easement with Aspen Valley Land Trust, which provides a buffer to the north. E. The Activity Envelope is sited in a non -irrigated pasture. F. The residence will be served by a well on Lot 1 A of Happy Day Ranch that is permitted by the Colorado Division of Water Resources to serve up to three single family dwellings (Well Permit #32635). The well currently serves two dwellings, and the proposed residence will be the third. Administrative Decision No.,ag, -2016 Page 2 G. An on-site wastewater treatment system ("OWTS") can be accommodated within the Activity Envelope. H. The lot is within the mapped Scenic View Protection Area. The residence will be visible from Emma Road, but only from a distance (approximately % mile). The residence is sited at the back edge of the pasture at the toe of the hillside, and the hillside and existing vegetation provide a backdrop. The size (2,175 square feet) and siting of the residence minimize the visual impacts. The residence is located adjacent to the existing residence and will share a driveway with Lot 3. 1. The existing driveway to Lot 3 will be extended to Lot 2. The main access road through the ranch meets the 20' width, all-weather criteria for an access serving more than 3 buildings, and is acceptable to the Basalt Fire Marshal. On-site water supply for fire -fighting is required. APPROVED by the Director, subject to the following conditions, which shall run with the land and be binding on all successors in interest: I . The Applicant shall adhere to all material representations made in the application and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. Prior to submission of any building permit applications for the residence, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation of them. 3. With the building permit application for the residence, the Applicant shall: A. Provide proof of an adequate water supply (in terms of quantity and availability) for domestic and fire protection purposes, and for irrigation purposes, if applicable. B. Submit a site specific drainage and erosion control plan prepared by a qualified engineer or geologist for review and approval by the Planning Engineer. If the project disturbs more than one acre, a State Stormwater Permit shall be obtained prior to permit issuance. All historic and natural drainage patterns shall be maintained. C. Submit a construction management plan for review and approval by the Planning Engineer. D. Submit a landscape plan and a revegetation plan for disturbed areas with appropriate seed mixes. Provide a plan for irrigation, since the well permit does not permit irrigation. E. Submit an exterior lighting plan. 4. Prior to issuance of a building permit for the residence, the Applicant shall: A. Obtain an On -Site Wastewater Treatment System ("OWTS") Construction Permit application from Environmental Health. B. Pay the applicable County road and employee housing impact fees. C. Obtain a County access/driveway permit for the driveway. The permit shall be approved by the Planning Engineer and the Basalt Fire Department. D. Obtain a fireplace/woodstove permit from the Community Development Department, if necessary. 5. 5,750 square feet of gross floor area is exempt from growth management without the use of TDRs or growth management allotments for additional floor area 6. The Applicant shall comply with the following standards to mitigate for development in a low wildfire hazard area: Administrative Decision No. /-2016 Page 3 A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation pattems have already fulfilled these conditions): 1) Brush, debris, and non -ornamental vegetation shall be removed within a minimum 10 foot perimeter around the structures. 2) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a 30 foot perimeter around the structures. 3) Spacing between clumps of brush and vegetation within the 30 foot perimeters shall be a minimum of two times the height of the fuel. Maximum diameter of the clumps shall not exceed 10 feet. All measurements shall be from the edges of the crowns of the fuel. 4) All branches from trees and brush within the 30 foot perimeter shall be pruned to a height of 10 feet above the ground and ladder fuels from around trees and brush shall be removed. 5) Tree crown separation within the 30 foot perimeters shall have a minimum of 10 feet between the edges of the crowns. 6) All branches which extend over the roof eaves shall be trimmed and all branches within 15 feet of the chimneys shall be removed. 7) The density of fuels within a 100 foot perimeter of the structure shall be reduced. 8) All deadfall within the 100 foot perimeter shall be removed. 9) Low vegetation shall be maintained within a 10 foot perimeter around all structures. 10) The Applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Roofing Materials: Roofs shall be constructed with a Class A roof covering or a Class A assembly as defined in the building code. Wood shake/shingle roof coverings are prohibited. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: I ) All roof coverings shall be constructed of non-combustible materials and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing the roof. 3) Protrusions above the roofline, such as parapets, shall be prohibited. 4) Roofs shall be installed as required by the approved building code and shall have a minimum slope of 1:48. 5) All roof designs, coverings or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. C. Maintenance and Miscellaneous Requirements 1) Roofs and gutters shall be kept clear of debris. 2) Yards shall be kept clear of all litter, slash, and flammable debris. 3) All flammable materials and firewood/wood piles shall be stored on a parallel contour a minimum of 15 feet away from any structure. 4) Weeds and grasses within the fifteen -foot (IT) perimeter and under trees shall be maintained to a height of not more than six inches (6"). 5) Fences shall be kept clear of brush and debris. 6) Wood fences shall not connect to the structure. 7) Fuel tanks shall be installed underground with an approved container. Administrative Decision No. ( /-2016 Page 4 8) Propane tanks shall be installed according to NFPA 58 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any above -ground tank. Any wood enclosure around the tank shall be constructed with materials approved for 2 hour fire -resistive construction on the exterior side of the walls. 9) Each structure shall have a minimum of one 10 pound approved ABC fire extinguisher placed in a visible and accessible location. 10) Addresses shall be clearly marked with 2 inch non-combustible letters and shall be visible at the primary point of access from the public or common access road and installed on a non- combustible post. 11) New utility lines shall be buried within the driveway. The Applicant shall comply with all standards for development within Scenic View Protection Areas as represented in the application and approved in this Decision. The exterior of the residence shall utilize earth tone materials or colors that are indigenous to the site and the roofs shall have a non - reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflectivity, with the exception of materials associated with solar or photovoltaic equipment. Driveway lighting is prohibited and all other lighting shall comply with the lighting code. 8. The Applicant shall comply with the following measures to mitigate impacts to wildlife: A. Native vegetation shall be maintained outside of the activity envelope. B. Trash/garbage shall be kept in an approved bear resistant container or enclosure, pursuant to the County's Wildlife Protection Ordinance. Verification of compliance shall be provided prior to issuance of a certificate of occupancy. C. Fencing shall comply with the following, except for fencing immediately adjacent to the buildings to contain pets or livestock: 1) Wood fencing shall employ three rails or less, be the round or split rail type, shall not exceed 48 inches in height above ground level and 12 inches in width (top view), and shall have at least 18 inches between two of the rails. 2) Wire fencing shall consist of no more than 3 strands of smooth wive and shall not exceed 42 inches in height. 3) Mesh or woven wire fences are prohibited, except when used for protection around isolated trees or clumps of trees. D. Avoid fruit -bearing trees and shrubs in any landscaping. E. Construction workers shall be prohibited from bringing dogs on-site during construction. F. All outside doors shall utilize only solid round handled door knobs unless another type is required by the applicable building code for disabled accessibility purposes. G. Bird feeders, including hummingbird feeders, shall be hung away from any deck or window, and shall be at least 10' from the ground suspended between 2 trees or posts. All seed feeders shall include a seed catchment pan to catch discarded seeds. Bird feeders should be removed from April through November. 9. No structural development in excess of 30" above or below natural grade shall occur within the setbacks of the lot, with the exception of driveways and associated retaining walls of up to 6' above or below natural grade and fencing. Landscaping in the form of berms shall not exceed four feet from the most restrictive grade. Any development located within setbacks mandated by County zoning regulations that does not comply with these restrictions shall require a variance from the Board of Administrative Decision Nop-1016 Page 5 Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. 10. No development including grading, excavation, fill placement, berming, landscaping, vegetation removal or disturbance, well or on-site wastewater treatment system shal I occur outside of the approved activity envelope, except as necessary to comply with the wildfire mitigation measures described above. 11. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the comers of the activity envelope and install construction fencing around the construction site within the perimeter of the activity envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy. 12. All areas disturbed by construction shall be re -vegetated with native shrubs and grasses within one growing season of the project's completion. 13. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit. Any structures represented in the application may not be permitted under building and zoning regulations. 14. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. 15. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code § 2-20-170 and C.R.S. § 24-68-105. Access: The driveway will come directly off of the main road through the ranch that meets the 20 foot width all weather criteria for an access serving more than 3 buildings. The driveway itself just needs to meet the Pitkin County Asset Management plan for driveways. Water supply: A water supply for manual firefighting is required for the new premise. Appendix B of the fire code for those areas without a municipal water system references NFPA 1142, Water Supplies for Rural and Suburban Firefighting, to determine supply. The calculated stored supply shall be a minimum of 4000 gallons via dry hydrant assembly either from a pond or tank system. The Fire District has engineered set of plans that the applicant can obtain to base their design choice. The application was forwarded to Caucus members by email. Comments: The Caucus received a few responses from members on this request: all in favor. One member questioned why the property was designated as a 25.5 acre Deed Restricted parcel. A quick review by Suzanne Wolff found this comes from the approval as a "Low Impact Subdivision" apparently intended to restrict against further development/subdivision, although she agreed there may be more to it than that. Consensus: Caucus members are not experts in the Land Use Code and do not keep apprised of recent or pending changes. Assuming the application conforms to the original subdivision approvals for Happy Day Ranch, the Caucus has no concerns with this request. Individual Sewage Disposal System The subsurface soils at the site consist of sandy clay loam with sand and gravels. Groundwater was not encountered during the excavation or at any time as the holes sat open. The percolation rate in the native soils was determined to range from 15 — 30 min/in with a design percolation rate of 30 min/ in. In general, a percolation rate of between 5 to 60 min/in is required for soils to be considered suitable for ISDS. Therefore, based upon the results of the percolation testing, the native soils are generally acceptable for ISDS. In addition to the percolation rate of the subsurface materials, the seasonal high groundwater elevation is an important factor in determining the suitability of the site for ISDS. For ISDS suitability, the seasonal high groundwater should be at least 6 feet below the bottom of the proposed bed which would be excavated into the ground 2 feet (4' separation from SHGW and bottom of bed). No groundwater was encountered in this investigation and this area is not known for high groundwater table. System Instanation The installation of the septic tank, plumbing lines, absorption bed, etc. should be completed in accordance with Pitkin County regulations. In addition, the following construction procedures are recommended: -The septic tank and distribution box should be placed level over native compacted (95% Standard Proctor maximum dry density +/- 2% of optimum moisture content) soils that have been scarified to a depth of 8 to 12 inches and moisture conditioned However, up to 3 inches of washed rock or engineer approved pipe bedding passing the 1 -inch sieve may be used as a leveling course under the septic tank and distribution box. -The bottoms of trenches and backfill around the septic tank and distribution box which will support sewer or effluent lines should be compacted to at least 90% of the standard proctor maximum dry density, within +/- 2% of optimum moisture content. Pipe bedding should have a maximum particle size of 1 inch. am -Vehicular or heavy equipment traffic and placement of structures should not encroach within 10 feet of the septic tank or distribution box. Inspection Schedule DWT & Associates should be retained to monitor the construction of the ISDS. The following schedule of observation and or testing should be followed: -Observe the absorption bed excavation prior to placement of distribution system -Observe the placement of the septic tank, distribution box, and all connecting sewer and effluent lines prior to backfills. Verify proper gradient between inverts. -Observe and verify installation of the distribution system prior to placement of backfill. General Notes The ISDS design was based upon the results of the subsurface investigation and on our local knowledge and expertise of the area. The design is valid only for the proposed construction.
