I might add that I am quite pleased with the wooden fence -like barrier around the area to keep traffic off the disposal bed. One possible problem which I think you might keep an eye on is that of snow melt and run-off from the steep bank on the West side of the bed. There was a situation with sewage surfacing underneath the stairway in the apartment building furthest down stream. There is a piece of plastic pipe that goes under that driveway, bends with a 45 degree cast iron elbow, and goes straight down. I can't tell whether there is a dry well there or if the septic runs into the river or what. I couldn't find anyone home in any of the four units --12, 13, 14, or 15. I did dye the wet well for the "Jet" tank in back pretty heavily. I will check on it again later to see if there is any dye surfacing from that wet well or being discharged into the river. I should dye each unit in addition and find out if perhaps we don't have a problem with one unit going into a smaller septic tank and then discharging into the river or discharging into a s aller dry well right into the river. Either way I am not pleasecaith the situation. I will send a notice to Gassman a:)out the situation. A seep of this nature should have the dye surfacing within a half hour from the time it goes down the toilet. I don't think unit 15 is tied into it. I still can't figure out what we have here. My first impression is that there is an old septic tank that was probably put in before the "Jet" tanks and runs into a small gravel dry well or leach field. Based on what I have seen so far, units 12 and 15 are served by the "Jet" tank which is tied into an open sump wet well for pumping into a leach field; you can watch the well fill. We will probably have to start where the pipe daylights, with a backhoe dig it all up, and find out what is in there. The notice has been mailed to the owner. The investi- gation revealed that this was, in fact, the case. You are therefore notified that this is a violation of Section 3.01 of the Pitkin County Individual Sewage Disposal Regulations. Please consider this official notice to make cor- rections within 10 days of receipt of this letter. COLORADO 81611 On July 6, 1976, I met with Health Officer Bob Nelson concerning Gassman's sewage disposal problems at the Silversmith Apartments. Bop informed me that although he had informed Gassman in May that the system was not in compliance, he has not informed Gassman of what type of system is required. Bob further informed me that Peter Gonzales, Gassman's manager, called Bob and told him that they were ready to do whatever was required to bring the system into compliance. On this basis, Bob is going to meet with Gonzales on July 7, 1976 to discuss the matter. Gassman has applied for a repair permit and Bob tells me that although some further tests are necessary, he is quite sure that the system Gassman proposes in this application will not be sufficient. If this is true and Bob denies the repair permit, he and this office will use the following procedure: a. Gassman will be told exactly what kind of system will be required. b. Furthermore, he will be told that he has two business days to apply for a repair permit providing for the type of system Nelson recommends. c. If this permit is applied for and the specs of the proposed system meet with Nelson's approval, he will issue a repair E July 6, 1976 Page two rj and emergency use permit. In this permit will be a specific time period in which the required system must be completed. At the end of this time period, Nelson will inspect the system and if it is in compliance, we will not proceed with the cease and desist order. If not in compliance at this time, we then will hold a hearing as soon as possible on the appropriateness of the cease and desist order. d. Furthermore, if Gassman does not apply for a repair permit within the specified two days, we will then immediately move for a cease and desist order irrespective of whether or not he makes the necessary application at a later time. Also, if the specs required do not meet Nelson's approval, we will thereupon immediately move for a cease and desist order As mentioned, Nelson is meeting with Gonzales on July 7, 1976 and therefore by early in the week of July 12, 1976, we should have some further progress to report in this matter. The letter resulted from my interviewing Mr. Rosenzweig, a tenant in Silversmith Apartments. • 13031925-5232 I am advised also that a couple of the apartments in this develop- ment are subject to sewage flooding and that flooding has caused damage to the contents of occupants who have since moved. In addition, the building is reported to periodically experience natural gas backups in two or three of the other units. If we have been holding the hand of this development in the past, I think that we have been doing wrong. The time has ccme -- if these facts are true -- to close the place and not permit it to be reopened until a complete correction occurs and a security deposit is made to guarantee against recurrence. To date, the only thing I have heard about this apartment is that "it was a problem" but I have not been advised that the problems are as outrageous as are reported. I would appreciate immediate action on this and the involvement of the District Attorney, if possible, at the earliest date. Please report on this at the next Commissioners meeting. MAIN • 8VLXx8300 ASPEN, CO 81611 June 24, 1976 RE: Rosenzweig, Kenneth - Constructive Eviction Dear Bob: • (303) 925-5232 In connection with some legal aid work that I am doing for the Bar Association, I was contacted by Kenneth Rosenzweig concerning the rental to him of a unit in Silversmith Apartments for the period of May 20th to July 1st for $200.00, which was paid in advance. Mr. Rosenzweig advises me that the plumbing backed -up shortly after he took possession and that he has had no plumbing for approximately three weeks. Further, the toilet has been removed and the shower drain plug, apparently at your instructions. I advised Mr. Rosenzweig that he has been "constructively evicted" from the premises and that you owe him the rental that he paid from the date when the premise became uninhabitable. Mr. Rosenzweig is without funds and this is the reason for his contacting the free services of legal aid. In addition to that, however, I am shocked that you would permit a condition like this to exist. It may be that you will have further dealings with the County, and I personally will not savor anything you do unless you provide ample security to assure against a repetition of this kind of indifference. Futhermore, I have requested Bob Nelson, County Sanitarian, to bring this matter before the County Board of Health to close your apartment building immediately, or as soon as possible, and not to permit its rental or occupancy until sufficient corrective work has been done to bring it within Code. In addition, security deposits and the like should be placed with the County to permit the County to make these corrections should this kind of indifference and affirmatively dangerous health condition be permitted to occur by you again. The repairs done have not been approved and were done without the squired permit. This department has still be unable to determine the origin and purpose of the line which created the original sewage violation. Makeshift repairs done by your manager and acting agent, Peter Gonzolas, while alleviating the immediate public health and water pollution hazards, are deemed by this writer to be insufficient and fail to comply with Pitkin County Individual Sewage Disposal Regulations. Apparantly the aerated treatment systems installed in 1971 or '72 are no longer functioning as intended. We remind you that Section 3.03 L requires you as the user to maintain and operate the planz in accordance with regulations and :manufacturer's specifications and maintain a service policy while the plant is in use. It will therefore be necessary for you to make appropriate repairs on the aerated systems which apparently serve the building in which units 17.-15 are located. Bob Gassman, the owner, was not home this morning and could not make our meeting. Basically what I found was that they had dug the line discharging on the bank back to the point where they determined that it was an overflow for the leach field. Peter then constructed a dry well --a very shallow dry well --about 25 feet from the river on the other side of the embankmant. It is only a temporary repair and I certainly don't sanction it. In fact, I told Gonzolas that it must be repaired right. I told them they would have to fill out a repair permit and that we definitely need to find out exactly what the situation was there and where it was coming from. I still suspect a septic tank effluent line is creating the problem there. Based on what I saw this morning, it is possible that the middle unit septic tank is connected to this line, perhaps as a dry well overflow. The water that was standing on one edge of the parking lot that I noted on another activity report has gone down and analysis of a sample of that water indicated that it was algae rather than dye. Makeshift repairs will be torn up and appropriate steps will be taken to make sure that that line does, in fact, go to the leach field. I will try and get in touch with Ruggles, who supposedly did the work, to see what he knows. Inasmuch as repairs have not been affected within the maximum allowable thirty (30) days and no final approval issued by this department, as required by Section 3.10 of the Pitkin County Individual Sewage Disposal Regulations, we are going to hold a hearing on Tuesday, October 5, 1976, at 11:00 a.m. in the Environmental Health office, Pitkin County Courthouse, for the purpose of giving interested parties the opportunity to show cause why a cease and desist order should not be issued. This would, of course, necessitate vacating the property should the order become effective, inasmuch as no residence without a proper sewage disposal system can be occupied.
