Pitkin County Environmental Health Office City Hall. 130 South Galena, Aspen. Co. 81642 Sirss On July 26, 1980s Dr. William J. Green, of Arvada, Coloradog excavated for foundation and septic system on the lot just to the east of our house/lot in the Miller Nichols Property, North Fork, Frying Pan River, Pitkin County, On August 2 he set a plastic septic tank and started form- ing for footings. At that time he showed me his house plans which, as required by covenant in the deed to property up heret had been reviewed and approved by Mr. Nichols of Kansas City, Mo. At this stage of Dr. Green's construction I was greatly concerned that the septic tank might not meet County spec- ifications, and that the effluent from the tank was to be discharged into an underground rock pile, and, on August 5 I went to the Court House to inquire of the Sanatarian if this system had been approved.... Mr. Paddock advised me to take up this matter at City Hall with Mr. Nelson, nvi- ronmental Health Office, and he also advised me that Dr. Green did not have a building permit. Later, MX,;Nelson's office advised me that Dr. Green had not taken out a septic system permit. I understood, at that time, that Mr. Yaldock and Mr. Nelson would consult on this matter. Dr. Green had equipment come in on August 9 to improve his roads backfill his forma, and cover the septic sysstem4 and on August 11 I talked to Mr. Nelson on the phone, re- emphasizing my concern regarding the possible rollution from Dr. Green's septic system (uphill from our property about 100 feet). Mr. Nelson assured me that either he, or Mr. Paddock, would "red tag" this project. Although no evidence of the "red tag" was ever apparent to me, Mr. Paddock, on august 1901(,that this had been done, and implied to Mrs. Miller and me urther action to sbop this work would be init4ateu. aJvN�j - 1 - M N 2 On August 21 concrete for footings was poured# and on August 30 a concrete -block foundation was started. it is apparent that this construction is proceeding without re- gard to :;ounty regulations. I think it unfair to those of us who have previously built here and complied with the law for :ounty authorities to allow this unlawful con- struct%nf in addition to my moral objection, I am par- ticularly fearful that a septic system, improperly con- structed, could create an offl)fise to us, and possibly con- taminate our well -water source. Recognizing that our location in the far corner of Pitkin County makes surveillance and enforcement unhandy for your offices, I felt inclined to be involved enough to observe and report to you. At this point, although I do not wish to be an obstructionist to Dr. Green's plans, after all, he will be my next-door neighbor, I am dis- pleased with official efforts to bring Dr. Green's project into conformity with County standards.
