The Fine Washed Tailings (sand filter) material name description was changed at the gravel plant to 1/4" Chip, which according to the plant operator is the same material. 2.) The location of the septic tank has been changed to the front of the residence as shown on the as -built plan. 3.) The Septic Tank is a Norwesco,1500 gallon Plastic tank, which shall be covered with approximately 3" of cover material, overlain with a metal sheet and then weighted with large boulders to counter weight the plastic tank when the tank is being pumped out. 4.) The depth of filter material under the north end of the leach field is approximately 2'-3" in depth below the bottom of the Infiltrator and 3' + in depth at the south end of the system. Results for the percolation tests was found to be 26 min/in. The following are the results of the percolation testing. A soil profile hole was also excavated at the site. The profile hole was approximately 10.5' in depth. There was no ground water present at this time. The soils consisted of l' of topsoil underlain by large boulders, river alluvium and decomposed granite materials. STAFF ANALYSIS OF PROPOSAL: The following is a summary review and /0 1� 0 0 analysis of the applicant's proposal relative to the most applicable policies and standards of the Land Use Code. Geologic Hazard Areas - The parcel contains slopes of less than 5 percent, except for that portion of the property which contains the steep bank of the Frying Pan River. There are no other known geologic hazards on the subject property. Wildfire Hazards - The State Forest Service has rated the wildfire hazard as low for this parcel. Vince Urbina has two specific mitigation recommendations that will be included as conditions of approval. Staff will also include the applicable standards of Code Section 3-80.70 as conditions. Wildlife Habitat - The applicant has indicated to Staff that the Division of Wildlife has visited the site and has determined that there will be no significant impacts on wildlife as a result of the proposed residential development. Staff has not been able to contact the DOW for written comments, at this writing. Mike Villa, the County's Wildlife Biologist, has determined that wildlife activity areas will not be significantly impacted by construction and habitation of a residence on the subject property. Mr. Villa did recommend that one kenneled dog be allowed on the property. Staff will also recommend that a building envelope be established that is at least 20 feet from the top of the riverbank to preserve the riparian habitat along the river. Floodplain - Temple Glassier, County Floodplain Administrator, points out that the 100 -year floodplain is not mapped in this area of Pitkin County. However, where the 100 -year floodplain or intermediate regional flood has not been established, regulation 3-80.40 of the Pitkin Country Land Use Code shall apply to all land within an area which is twenty (20) horizontal or five (5) vertical feet (whichever is greater) from the exiting high water line on any river, stream or material drainage channel. The high water line of the river is not depicted on the submitted site plans. The low water line is depicted to be approximately 11 vertical feet below the elevation of the proposed residence and approximately 28 horizontal feet from the residence. The high water line appears to Staff to be approximately 6 feet below the elevation of the residence. Pursuant to the criteria of Code Section 3-80.40, the proposed development is not within the 100 -year floodplain of the Frying Pan River. FM E All development in Pitkin County must show compatibility with and consideration for a set of guiding policies and minimal standards set out in Article 2 of the Land Use Code. It is staff's opinion that the applicant can comply with these policies and standards. The site plan depicts a well location on the east side of the property just beyond the top of the riverbank. Staff does not feel that the well needs to be in the building envelope in this case. A water line extension of approximately 30 feet will be necessary, but there are no 1041 concerns in this portion of the parcel. The Environmental Health Department will require that the applicant demonstrate the quality and quantity of the water supply, prior to the issuance of a septic permit. The applicant depicts a leach field to be located in the northwest portion of the parcel. The Environmental Health Department states that an engineer -designed system is required, and that with careful planning, a system can be designed to fit on the lot and meet all setback requirements. Staff recommends that a septic field construction envelope be established in order to accommodate the septic field. If the primary building envelope were to be extended to accommodate the septic field, then a Board of Adjustment variance to the front yard setback would be required. The Zoning Office does not classify a septic field as a structure within a setback, as long as there will not be a change in existing grade exceeding 30". Staff is recommending that a building envelope be established that complies with the front, side and rear yard setbacks (see attached site plan). The location of the proposed residence will have to be altered slightly to remain within the envelope. If the applicant cannot move the residence, then a Board of Adjustment variance to the rear yard setback will be required. RECOMMENDATION: Staff recommends that the Hearing Officer approve the Thomas 1041 Hazard Review, subject to the following conditions: The Applicant shall adhere to all material representations made in the application and in the public meetings. 2. Prior to building permit application, the Applicant shall record a 24 x 36 inch mylar 1041 Hazard Review Site Plan which meets the approval of the Community Development Department and County Attorney. The Site Plan shall also be submitted in digital format on a 3.5" diskette to the Community Development Department, prior to the issuance of a building permit. The Site Plan shall include the following 1041 Hazard Review Warning and Disclaimer: ATM 0 0 "The provisions of these regulations do not in any way assure or imply that areas outside of designated hazard areas will be free from hazards, or that approved mitigation measures will guarantee the safety of any property." a. The Site Plan shall depict a building envelope and a septic field construction envelope, as recommended by Staff. 3. Outside illumination shall comply with County lighting standards in effect at the time of building permit issuance. 4. The Applicant shall comply with the following wildlife mitigation measures: a. One kenneled dog shall be allowed on this parcel. b. Native vegetation shall not be disturbed outside the building envelope, except as required for the access driveway and the implementation wildfire mitigation measures. Vegetation within the envelope shall be preserved as much as possible. 5. Wildfire mitigation shall be as follows: a. All vegetation shall be removed within 10 feet of proposed structures. This "defensible space" area shall be maintained in mowed grass or non- flammable material, such as decorative rock or gravel. b. All branches from remaining evergreen trees shall be pruned to a height of 10 feet above the ground or up to half the total height of the trees, whichever is least. C. All branches which extend over the roof eaves shall be trimmed and all branches within 15 feet of the chimneys shall be removed. d. Roofs and gutters shall be kept clear of debris. e. Yards shall be kept clear of all litter, slash, and flammable debris. f. Firewood shall be stacked on a parallel contour a minimum of 15 feet away from any structure. g. At least one ten pound approved ABC class fire extinguisher shall be placed in a visible and accessible location for each structure. h. Fences shall be kept clear of brush and debris. C9 4 E Wood fences shall not be connected to the structure. Fuel tanks shall be installed underground with an approved container. k. Roof construction shall be Class A, non-combustible material with no flat roofs. All vents shall be screened with corrosive resistant wire mesh of one quarter inch (1/4") maximum. M. Addresses shall be clearly marked and visible with minimum 2" letters. n. Maintenance of the "defensible space" shall be required in order to retain it's value as wildfire mitigation. o. Any additional buildings shall incorporate wildfire mitigation measures. 6. Prior to issuance of a septic permit, the Applicant shall provide documentation of an adequate domestic water supply. Quantity and quality of said supply shall meet the approval of the Environmental Health Department. The septic system designed for the site shall meet the approval of the Environmental Health Department. The Applicant shall obtain such approval prior to the issuance of a building permit. 8. The Applicant shall obtain a fireplace/woodstove permit from Environmental Health Department, prior to the issuance of a building permit. 9. The disturbed areas within the building site shall be revegetated with native grasses to limit water consumption and additional runoff, immediately following project completion. 10. All development, included grading and landscaping, shall occur within the building envelope, except for grading necessary to construct the access driveway. The septic field shall be confined within the approved septic field construction envelope. No other development can take place in the septic field envelope. 12. The Applicant shall obtain an access permit from the County Engineer, prior to commencement of any construction. 13. ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-17 and 3-1104: "It is the policy of the County to insure the availability of a water supply of adequate quality, quantity, pressure and dependability for fire protection and support of a proposed land use prior to approval of the use. The County shall require land uses to hook up to e)dsting public systems if service is available." This Department needs adequate information on the quantity and the quality of water available. This can be done from tests of wells present on-site by a water engineer's or well driller's report. The applicant must ensure that the water quality is acceptable by having it tested by a lab such as the Snowmass Water and Sanitation District or Aspen Consolidated Sanitation District. Water of acceptable quality and quantity has been obtained in other lots in this area. Before a septic permit can be issued, the well must be drilled to assure that setback requirements from the well to the septic system can be maintained. Pitkin County Land Use Code requires that the well site be within the building envelope. Mr. Thomas has told me that the well has recently been drilled and that there is adequate water, and he will provide this department with the well drillers report by next week. A condition of approval for this application is the receipt of information documenting that the location of the well meets setback requirements and can be placed within the building envelope and that quantity/quality of the well nine 1 w Rattled p.p.. a �I 0 0 water are adequate. Without meeting these requirements a septic permit and building permit can not be issued. SEWAGE TREATMENT AND COLLECTION: Sections 2-18 and 3-1105: "It is the policy of the County to. ensure that adequate sewage treatment facilities are available to serve existing and new developments. Public and private sewage disposal systems and connections to such systems shall comply with the sewage disposal guidelines of Pitkin County's Individual Sewage Disposal System Regulation." Lots in the area are served by individual septic disposal systems(ISDS). Allsuch systems installed within Pitkin County require septic permits issued by the Environmental Health Department, and must comply with the County's septic regulations. To receive a septic permit, the applicant will need to submit a septic permit application and appropriate fee with a completed Soil Data Form including percolation test results and profile hole information. It must be possible to design an adequate septic system before a building permit can be issued. Site specific soil data will have to be obtained. The applicant will need to adhere to minimum horizontal setback requirements for placement of septic system components which can be difficult on small lots. I met at the site with Mr. Thomas this summer and confirmed that it is possible to fit the well and the ISDS on this lot. For this 3 bedroom house with a square footage of over 2,000 sq. ft., the leach field site will need to be a minimum of 100 feet from their well and from any neighboring wells. The applicant is aware of this requirement and understands that meeting this setback will require careful planning and accurate placement of all components. The applicant has contacted the engineering firm of Jerome Gamba and Associates to do soil tests. The perc test results indicated that an engineer designed system is required and Gamba and Associates has said that they can design a system that will fit on the lot and meet all setback requirements. A condition of approval for this application is the receipt and approval of the septic permit by the Environmental Health Department before a building permit can be issued. WATER QUALITY IMPACTS: Sections 2-14 and 3-705 and 3-710: "It is the policy of the County to preserve and protect its present water resources. To this end it is the policy of the County that no land use be initiated which would adversely affect the quantity, quality, or accessibility of the County's water resources; or which would occur at the expense of established water -dependent agricultural activities; or which would result in increased salinization of water resources, loss of minimum stream flows, further destruction of wildlife habitat, or major expenditures to reacquire or redistribute major water resources. It is also the policy of the County to maintain a natural vegetative buffer along its surface waters such that the surface and groundwaters of the area are not encroached upon by land uses or other human activities which could cause deterioration of water quality or impair the natural treatment processes provided by meadows and wetlands." I w The Environmental Health Department will be addressing water quality impacts on down stream water quality. This application is not expected to impact down stream water quality if the minimum horizontal distances between components of the system and physical features are in accordance with the Pitkin County Sewage Regulations. The Environmental Health Department is charged with preserving and protecting the quality of Pitkin County's water resources. Since a large percentage of the population is dependent upon water from wells, elimination of groundwater pollution, and protection of aquifers and their drainage areas are of utmost importance. Roofs and asphalt areas can be nonpoint sources of water discharge which can contaminate water supplies. This Department recommends that nonpoint sources of discharge be retained on the property of origin which can be accomplished through landscaping, drainage patterns, detention ponds, and dry wells for water runoff from buildings. AIR QUALITY: Sections 2-13 and 3-602: "Only that development is permitted which will not contribute significantly to degradation of air quality in Pitkin County. Developments may not constitute an indirect or direct air pollution source under Federal, State or County regulations." This project is not expected to contribute significantly to degradation of air quality in Pitkin County. FUGITIVE DUST Activities such as road building and landscaping require a Fugitive Dust Plan. This plan would need to include, but is not limited to, fencing, watering of haul roads and disturbed areas, daily cleaning of adjacent paved roads to remove mud that has been carried out, speed limits, or other measures necessary to prevent windblown dust from crossing the property line or causing a nuisance. A condition should be approval by the Aspen/Pitkin Environmental Health Department of the fugitive dust control plan, containing enough measures to ensure that dust does not become a nuisance or blow onto adjacent property. FIREPLACE The applicant must file a fireplace/woodstove permit with the Environmental Health Department before the building permit will be issued.. The less densely populated parts of the county like this site may have two devices per building: a maximum of one wood burning fireplace and a second device which can be RrN .R."e Repel M i 0 either a gas log fireplace or a certified woodstove. In addition, unlimited numbers of decorative gas appliances are allowed. Coal may not be burned in any device. No wood burning device may be installed in barns or agricultural buildings.
