E RESOLUTION OF THE PITKIN COUNTY PLANNING AND ZONING COMMISSION • EXEMPTING A NON -CONFORMING FOUR-PLEX FROM THE ABATEMENT PROVISIONS OF THE PITKIN COUNTY LAND USE CODE Resolution No. 79 - WHEREAS, the Board of County Commissioners of Pitkin County, Colorado, with the adoption of its Resolution No. 78-23, has established a procedure for the consideration of applications for exemption from (or increased amortization periods with respect to) the abatement provisions of the Pitkin County Land Use,Code, and WHEREAS, an application for exemption from abatement has been received from K and Y Partnership for a non -conforming fourplex called Gateway to Snowmass Apartments, and WHEREAS, the Pitkin County Planning and Zoning Commission reviewed the application, referral comments, and heard comments of the Applicant at its regular meeting on September 5, 1979 and determined that: 1. This use currently and in the recent past provided a supply of long-term rental housing available to local employees. 2. It does not contain hazardous building and electrical violations. 3. The water system is adequate at present and potential sewage disposal system problems can be handled through the County's Individual Sewage Disposal Regulations. NOW, THEREFORE, BE IT RESOLVED that the Pitkin County Planning and Zoning Commission, pursuant to the provisions of Section 7-1.11 of the Pitkin County Land Use Code, does recommend that the Gateway to Snowmass Apartments be exempted from the abatement provision of Section 7-1.9 of the Piktin County Land Use Code conditioned upon the applicant committing to leasing the apartments for not less than six-month lease periods. Approved by the Pitkin County Planning and Zcning Commission at its regular meering held September 19, 1979. MAIN STREET ASPEN, COLORADO 81611 TO: Jolene Vrchota Patsy 006t FROM: Bob Nelson DATE:' August 29, 1979- RE: 979 RE: K and Y Partnership, Non -Conforming Use This office has completed an evaluation of the water supply and sewage disposal systems for the referenced four-plex and duplex.• Water is supplied from the Gateway to Snowmass Mesa Subdivision well which conforms to the minimum standards of the Colorado Department' of Health drinking water regulations. The sewage disposal systems consists of aerated treatment plants and absorption fields. None of the plants were operational when we inspected them and are in need of repair and maintenance. This is required by Section 8.03 I of the Pitkin County Individual Sewage Disposal Regulations. The absorption systems seem to be functioning normally. '-1cCoy: On October 3, 1073, I made a field visit to your property at the confluence of the Capital and Snawmass Rivers. ?.n inspec- tion was made for the purpose of determining the feasiblity of the installation of sewage disposal system. There is presently a sewage disposal system is the area of the dwelling. But since the dwelling is to be located on the river bottom land, it is felt by this office, that the absorption area should be relocated on the bench of land above the dwelling. This letter in no way relieves the owner of the responsiblity of obtaining the proper permits and adhering to the applicable regulations.
