Permission is hereby granted to Dr. Rob Krakovitz/Rocky Mtn. Health Ranch
of Meredith, CO 81642
hereinafter called the permittee, to use subject to the conditions set out below the following described
lands or improvements for the period of 20 years�il�t@t� ending December 31, 2007.
Two tracts of National Forest land in the W'S of Sec. 6, T.9S., R.82W., 6th P.M.,
as more specifically shown on the 1" = 400' map dated 11/87, by PB, attached to
and made a part of this permit as Exhibit "A".
This permit covers 43 acres and is issued for the purpose of:
1. Operation and maintenance of a recreation resort and related facilities including
a lodge and cabins, holding pasture, corrals and barns, water system, sewer
system, roads, parking areas and other appurtenant facilities.
2. Provide outdoor recreation opportunities on National Forest lands.
1. Construction or occupancy and use under this permit shall begin within N/.4 months, and
construction, if any, shall be completed within N/A months, from the date of the permit. This
use shall be actually exercised at least 180 days each year, unless otherwise authorized
in writing.
2. In consideration for this use, the permittee shall pay to the Forest Service, U.S. Department of Agri-
culture, the sum of Five Hundred Fifty-FivEDollars (S 555.00 ) for the period from
January 1 19 88 , to December 31 1988 ,and thereafter
annually on January 1

Provided, however, That the charges for this use shall be readjusted as of, and effective on, the beginning
of each 3 -year period from the due date of the first annual payment in order to Place the charges on a basis

Dear Jim:
This letter is in response to your letter of April 14,
1975, recommending certain revisions to the proposed sewage
treatment system. It seems necessary to more fully explain
our reasoning during the design process.
Your recommendation that the inlet splitter box be
eliminated would completely alter the design concept of the
system. Due to the frequent periods of reduced occupancy,
therefore reduced flow, we have tried to provide a system
which can fluctuate with demand. The system as designed
provides for adequate, yet economical, treatment of sewage
under the wide range of conditions anticipated. For periods
of sustained low flow, such as the beginning and end of each
season, one plant can be closed off. This will permit more
uniform sewage strength. For periods when the sewage flow
exceeds the capacity of one plant, the second plant can be
put on line with a minimum of trouble. The second major
reason for the combined system is to provide a minimum level
of service for short periods when an aeration unit malfunctions.
All effluent can be routed through one plant while repairs
are completed. The third reason for splitting the combined
flow is to direct a more uniform sewage to each plant. The
cabins would have only bathroom wastes, therefore being very
dilute, while the lodge would have all food wastes.
If, on the other hand, the inlet splitter box is
eliminated, each system must function independently. Sewage
strength and flow will vary directly with occupancy. It would
furthermore be very difficult to rationally balance the two

system. The second major fallacy I foresee with the dual
systems is that should one plant need repair, that system
would receive no treatment whatsoever.
The system has been designed with the inexperienced
owner -operator in mind. There is only minor routine
maintenance required for normal operation. This maintenance
would consist of checking the control lights to ensure aerator
operation, checking the trash rack and splitter box for
accumulated material, and occasionally checking the grease
trap. This does not seem excessively complex. To assure that
the operator can tell which motors are operating, we have
designed indicator lights on each motor circuit which are
energized only when the motor is operating.
With regard to Item 2, I do not feel that there is a more
suitable location which can feasibly be utilized for the
small leaching field. The area directly in front of the dining
room represents the only other reasonable alternative. We,
of course, looked at this possibility. Although the field
would be slightly farther from the well, the natural ground
elevations are such that the depth of the bed would far exceed
the requirements of Pitkin County. Of secondary consideration
is the disruption of the main entrance to the lodge. Further,
we do not feel that the 115 foot separation from the well
represents any potential hazard to the water supply. The
anticipated soil conditions are such that lateral migration
should be minimal. To further minimize any risk, we would be
agreeable to installing a chlorinator in the outlet splitter
box and providing sufficient contact time, if it is required
by the State Health Department.
Quite frankly, I am still very puzzled by your third
comment. As I explained to you on April 7, when Bob Nelson of
your office and I walked the site on September 25, 1974, we very
specifically looked for the type of septic tank failure you
mention. He seemed well satisfied that there were no cabins,
other than those five on the hill above the lodge, for which the
septic tank systems had failed. Particular attention was given
to those cabins below the lodge.
If, as you suggest, there is a septic tank system below the
lodge which is obviously failing, Frasier & Gingery, Inc., will,
of course, provide to Boots Adams the design for a replacement
system. There is no desire or intent to ignore any septic tank
system in non-compliance with applicable regulations. If such a
system is located below the main lodge, however, this would not
have affected and still would not affect the design we have

submitted. Due to the difference in elevation, a pump would
be required to return any effluent to the presently designed
unit. We would rather install a separate system for the cabin
than pump back uphill to the central system.
I hope this more satisfactorily explains our ideas
concerning the proposed sewage treatment system for Horseshoe
Bend Guest Ranch. If you still have questions or desire

Dear Mr. Burnett:
This letter is regarding the proposed sewage disposal plans
for the Horeshoe Bend Guest Ranch, located on the Frying Pan River
in Pitkin County. After reviewing the plans for the sewage disposal
system, the following recommendations are submitted for your consideration:
(1) It is recommended that the inlet splitter box be eliminated,
and the two plants plumbed so that each plant gets approximately one
half of the flow. I feel this is necessary to avoid plugging or partial
plugging of the incoming splitter box, which would cause perhaps
a large portion of the sewage to flow into one plant. Also, it
would eliminate additional routine maintenance chores of that splitter
box.
(2) Move the small leaching field to a point as far away from
the well as possible. 115 feet does not appear to be adequate when
the well is only 40 feet deep, and the percolation rate is 13 minutes
to the inch. In conjunction with the forgoing, I think it reasonable
to require a chlorinator for effluent from the sewage treatment plant.
(3) As we discussed on the phone on April 7, there is a
malfunctioning sewage disposal system for the cabin located directly
below the lodge, to which no one has addressed repair. The system
consists of a steel septic tank located 15 or 20 feet off of the
northwest corner of the cabin, the effluent from which is running upon
the surface of the ground, dust below the tank. This system must also
be brought into compliance with the regulations.
As you will note, I am forwarding a copy of this letter to
Richard Bowman, District Engineer for the Water Quality Control
Division, along with the plans, for his review and comment. Should
you have any further question in this regard, do not hesitate to contact
either Mr. Bowman or myself.

The following report and sewage disposal system have been
repared in accordance with the requirements of the Pitkin
ounty Individual Sewage Disposal Regulations, effective

Backqround:
In 1974, the Forest Service required that the existing
disposal system be upgraded to comply with the requirements of
Pitkin County Environmental Health Department. This requirement
was to be made a part of a new use permit for public lands.
The system must be capable of handling the effluent from
the kitchen, lodge, and four cabins. It is anticipated that
there will be an automatic washing machine.
Percolation Tests:
On October 10, 1974, personnel from this office conducted
percolation tests in accordance with the requirements of Pitkin
County and the Colorado Department of Health. These test holes
were used in each of the anticipated field locations. The
results of those tests were as follows:

For the purposes of field design calculations, rates of
5 minutes per inch and 12.9 minutes per inch for Fields A
and B respectively were used.
Inspection Hole:
Inspection holes were dug in each field site to a depth
of 8 feet in accordance with the Pitkin County regulations.
The material was river alluvium gravel and silt with cobbles
to 18" diameter. No bedrock or other impervious material was
encountered. The hole remained dry. There was no indication
of ground water ever existing at the bottom of the hole.
Aerated Treatment System:
Due to the rapid percolation rates, limited disposal
area and the proximity of the Frying Pan River, an aerated
treatment system was selected. The design loading for the
treatment units has been calculated to be 4875 gallons per day
based on a peak daily factor of 1.5 times the average daily
flow of 3250 gallons per day. The unit called for in the
specifications consists of two prefabricated 2500 gallon per
day Cavitette plants situated in a parallel arrangement with
a splitter box to direct flow to either or both units,
depending on the needs of the system.
Absorption Beds:
The absorption beds have been designed to adequately
dispose of the anticipated sewage effluent based on the perco-
lation rates determined by test. The beds are to be constructed
in accordance with applicable Pitkin County regulations.
The total loading of 3250 gpd rather than the maximum flow
of 4875 gpd has been used to calculate the required area.
Pitkin County regulations permit a 20% reduction of the maximum
flow where aerated treatment is utilized. It is felt that the
fields can readily withstand temporary short term overloading
which might result, and would quickly renew their absorptive
capacity.
Two beds have been designed with capacities of 925 gpd
and 2325 gpd. Flow distribution to the two beds is by means
of a splitter box utilizing proportional overflow weirs.
Copies of the calculations for the bed designs are included
as an appendix to this report.

Conclusions:
The sewage disposal system has been designed and can be
constructed in accordance with the Pitkin County Individual
Sewage Disposal Regulations, effective March 25, 1974, using
two aerated treatment units and absorption beds totalling
1741 square feet. The units and beds should be located as
shown on the Plans, sheets 2 and 3 of 3.
The aerated treatment units must be located a minimum of
10 feet from any potable water supply line and 10 feet from
any dwelling or other occupied building. The dispersal fields
must be located a minimum of 25 feet from any potable water
supply and 20 feet from any dwelling or occupied building.

Dear Dick:
On Friday, June 6, 1975, I made a final inspection of
the sewage disposal facilities for Horseshoe Bend Guest
Ranchi A copy of the inspection report, together with two
P61oroid photos of the inlet splitter box are enclosed.
All construction completed is in accordance with the
plans and specifications as originally prepared or as
revised to meet your requirements. The inlet splitter box
is functioning very well, providing a very even split to
the two plants. The operation of the outlet splitter box
could not be observed, as the weir plates had not been
installed. This is noted on the check list on the inspection
report.
The material encountered in the botton of the infiltration
beds was uniformly fine sand with cobbles. This material
should function very well as a filter media. The beds were
constructed with more gravel than required by the specifi-
cations. A 4" diameter perforated pipe inspection well has
been left in the smaller bed.
We will furnish a start up, shut down procedure sheet
to the new owner and be sure that Dodson Engineered Products
supplies all available information. The new owner of Horse-
shoe Bend is an industrial engineer by training, and is
very interested in proper operation of the plant.

I spoke to Dick Bowman about the Horseshoe Bend Guest
Ranch and Elmer ClayUmb's claim that we have no jurisdiction on systems
of over 2000 gallons. That is apparently the way the law reads. Further,
the system has been covered, leaving only a couple of inspection holes,
which I feel are not adequate. I told him we needed to make a final
inspection. Dick Bowman said that State Water Quality Control is
responsible for systems of over 2000 3allons per day, and they do not
require a final inspection. Rather, they only require the submittal
of a letter of certification stating that the system was installed according
to their design. Bowman does not agree with that position and intends
to pursue it further in his own department. He had indicated that in
the future, as a condition of the site location approval, final inspection
must be made by the local health',or himself.

NARRATIVE:
I visited the Horseshoe Bend Guest Ranch with Dick Bowman.
I took pictures of the malfunctioning system. We discussed the various
problems thatparisen. We met Dave Burnett on the site. He has seen
fit to re -design the splitter box and some of the main service lines.
They are bringing the waste from the lodge into a manhole and the
wastes from the other cabins through two other manholes, joining them
into the first manhole. They'll be mixing both effluent lines in
the manhole some 15 feet from the splitter box. The splitter box
has been re -designed so it will be five feet long. The flow will
come into one end of the box, make a tight curve, and then sweep down
a pre -formed channel to be split at the opposite end and run into
each of the two 2500 gallon Cavitette tanks.
We then looked into the leaching fields, and found that
no profile test hole had been dug. Apparently there was some misunder-
standing about using the exposed cut for the parking lot in the side
of the hill beside the lodge. I said that didn't identify any potential
ground water in the area of the leaching field. They dug us a hole
and found after about 2 feet of soil and rock, the strata was sand.
Finding that sand to a depth of 8 or 9 feet, Bowman felt there would
be very little potential of contamination of the well. I would prefer
to see the perc rate somewhat slower, but we don't have anything to
indicate that there would be a flow of groundwater from the area of
the sewage disposal system towards the well. Frasier and Gingery have
submitted a letter to Dick in which they state they feel, due to the
evidence at hand, there would be very little possibility of contamination
of that well.
I met the new owner, who will take possession in a couple
of days.
Most of the installations have been completed except for
the installation of the two Cavitette systems and the leaching fields.
All the manholes and main service have already been installed.

NARRATIVE:
I talked to Dick Bowman about the sewage disposal system
for Horseshoe Bend. We discussed the designed splitter box,
and my recomendations for no splitter box. He did not like
their splitter box either, add we're requesting that they join
the two different service lines 15 or 20 feet ahead of the
treatment plant so they could be well mixed. Then, through some
kind of a distribution box, have the sewage spread in a different
manner than what Dave Burnett was calling for.
We then discussed the potential problems of water
pollution with their well, with the disposal field being 115
feet from the well. We finally agreed that a site location
inspection was in order. It is tentatively planned for Tuesday
of next week.

Greg Misbach and I went to Horeseshoe Bend Guest Ranth.
No one was there. The cabin that is lowest on the hill towards the lake has
a malfunctioning system. The septic tank cover is right at ground level, and
I could see where the effluent has spilled over. This is apparently below the
bench where they intend to install the sewage disposal system. There has
been no construction of a system there as yet.
We found the next cabin (the first to the right of the lodge
looking towards the lake) also has an unapproved sewage disposal system.

We found three pipes daylighting on the hillside. One was
from two cabins that goes into a badly corroded septic tank that is
exposed 3"or 4 " out of the surface of the ground. One comes
from a small cabin directly in front of the driveway, and daylights
out of a small cinder block septic tank about 3' up on the tank.
Another daylights 30-40' behind the lodge and seems to carry some Of all
of the waste from the septic tank behind the lodge down the hillside.
The 4 cabins on a lower level appeared to have systems that were
functioning adequately. It was indicated that these systems were
approximately 8 years old, that each was a 500 gallon tank, and
each had a leach field. He didn't know how big the leach fields
were.
My suggestion, considering the down time and possible power
failures, would be a large septic tank, about 3,000 gallons,
tying in the 4 cabins above the lodge, and the lodge itself; and
using an area about 30xl20 to fit in a leach field. This particular
area has already been percolated once. I tested it at 3 1/2
minutes to the inch, but was informed today that it was only
2 hours of pre-soak. Boots Adams indicated that he soaked them
longer and came up with a rate of 6-7 minutes to the inch. This
being the case, it may be possible to handle the effluent in a
field in one general vicinity. The field will, in all probability
have to be 3 1/2' to 4' deep to accomodate all the sewer lines
on grade.

They are planning to replace the cesspools located throughout
the area behind the lodge with a 2500 gallon Cavitette aeriated treat-
ment unit and leach field. I went over the required perc test if
procedure and told them that we would anticipate correction of the problem
within the next 2 to 3 months.
I spoke to the owner of the lodge. He indicated to%e c 44ed fo
do the work around September 15, and would call us in late July or
early August to do the perc test. He wants to make sure all the
guests are cleared out before he begins the excavation.

On May 22, I talked to Gary Rorvig, of the Forest Service.
They stopped at the Horeshoe Bend Guest Rdnch, and made an investigation,
since the property is leased from the Forest Service. They found problems
relating to sewage disposal. It seems that there are at least three
cabins that are presently being served with cesspools. Another couple
of cabins are being served with a septic system that is malfunctioning,
allowing sewage effluent to run upon the surface of the ground. Gary
indicated to the owners that they could have all summer to rectify the
problems. I replied that I would rather see it done in 30 days. He
said that he would contact the jesee and straighten the situation out.
He felt that they would shortly be contacting our roffice for a permi

During a recent field trip to the Horseshoe Bend Guest
Ranch where a 2,500 gallon Gavitett _plant was found on the site,
it was noted that the protective coating on the metal had been ill -
applied in that it did not cover all metal portions of the tank on
the outside. Further, it has come to me that in the past, some of
these tanks have been found to leak. I think it is appropriate to
bring these facts to your attention so that proper action can be taken.
Another problem that has recently arisen concerns the Miller
Iiichols fob. According to Peter Sanderson, he ran the percolation
test himself, and further, no soil profile test hole was dug. I'm
sure that you are aware of the section in the code which calls for
percolation tests to be run by either a competent technician of the
Health Department or a registered professional engineer, and that
a soil profile test hole be dug for each leaching field installed.
Furthermore, on the design sheet which was submitted, you failed
to indicate the presence of a lake in the immediate vicinity of the
sewage treatment system, nor did it indicate a flowing stream, again
in the immediate vicinity of the system. It will be necessary on
any future designed systems to: 1) properly run all of the tests;
2) that all relevant information be given; and 3) that the engineer's
stamp be placed on the proposal. Further, all engineer designed systems
must conform to the regulation by a letter of final inspection by the
designing engineer indicating installation according to his design.

I am in receipt of your letter of the 20th, and I do want to assure
you that the sewage disposal system of the Horseshoe Bend Guest
Ranch will be brought into complete compliance with regulations
so that we may open for the 1975 season.
As you well know, I attempted to bring our system into compliance
with regulations this Fall, but due to the complexity of the
situation, and the local and State regulations, we were unable to
do this before we closed the ranch for the winter.
I have approved preliminary plans submitted to me by Frasier &
Gingery Engineers. I will ask them to let the contract so that
we may begin with the new system at the time I arrive in the
Spring. about May 1. Unless delayed by the contractor, I fully
expect our new system to be in operation well before our usual
summer season which begins June 1.
I understand your concern, and join you in hopes that we can get
our problem taken care of with the least difficulty. Hope you
have a Merry Christmas and a Happy New Year.

RE: Rocky Mountain Health Ranch Water and Sewer Systems
The septic system for the Rocky Mt. Health Ranch main lodge was
designed to include the cabins west of the lodge (with 27
occupants), and for the lodge to be able to serve 50 meals three
times per day. The other cabins have their own septic systems
constructed before permits were required.
There is a 40 feet deep well equiped with a chlorinator for
disinfection. The operator is required to sample the well water
quarterly.
