Colorado 81611 I d )(D G 6 37�1- PITHIN COUNTY HEALTH 0 0 r . 4i To: Lance Clarke, Community Development CC: Miles Stotts, Deputy Director, Public Works From: Carla Block, Environmental Health Data: 05/29/03 Re: The Runaway Shovel, 0121 Rainbow Lane The Environmental Health Department received a copy of a letter dated May 12, 2003 from Cheryl Sovich, owner of the Runaway Shovel, to Joanna Schaffner, Pitkin County Zoning Officer, regarding the continuation of her gardening business at 0121 Rainbow Lane. The following items are environmental health concerns and should be taken into consideration: Function and location of the septic system: The only documents filed with the Environmental Health Department are an Application for Approval of Location for Septic Tank Systems and a Declaration of Covenants approving a location for a septic tank "for the treatment of domestic sewage on a temporary basis." Both documents are from 1971. This department does not have any record of the sizing of the system, the location of the system, and if it was ever completed to include an absorption area. If the greenhouse will remain in place, we will need confirmation that the greenhouse has not been placed on top of any portion of the system. Cheryl stated in a phone conversation on May 29, 2003 that B&R Septic Service would provide documentation on their knowledge of the system function, components, size and location. The Sovich letter states there were 12 employees last year. During the May 29 phone conversation, Cheryl clarified that her employees do not use the toilet facilities within her house. They are on the property for only short periods of time and use toilet facilities at otherjob sites throughout the workday. It is important to keep in mind that uncertainty about the sizing, components, and age of the system, any excess use could have potential negative impacts that may contribute to a failure of the system. Well water: The Division of Water Resources has no record of the well that currently exists on the lot. Most likely, it was drilled prior to the permitting process which went into effect in 1972. The owner has the ability to late record the historic use of the well, however, use of that well for commercial landscaping purposes would not qualify as an accepted use. According to the well commissioner, wells in that area are only permitted for domestic use unless there is approval of an augmentation plan. Cheryl stated she would contact the Division of Water Resources to better understand permitted uses for her existing well. Noise: According to Pitkin County Ordinance 99-38, Title VIII Noise Abatement, maximum permissible sound levels in residential zones may not exceed 55dB(A) from 7am-7pm and 50dB from 7pm-lam. 0 THE RUNAWAY SHOVEL 1 A : May 12, 2003 Joanna Schaffner, Zoning Officer Pitkin County Community Development Department 130 South Galena Street Aspen, CO 81611 Dear Joanna ^A L wCl pxh ►vu � -10-- xtrh( RE: NOTICE OF VIOLATION AND REMEDY - GARDENING BUSINESS AT 0121 RAINBOW LANE I am sending you this letter in response to the Notice of Violation letter that I received from your office dated March 25, 2003 and as an attachment to the building permit application I have submitted to the County for the greenhouse located on my property. As you know, I have also been contacted by several of my neighbors regarding this issue. First, let me apologize for any inconvenience to you and for any disturbance or distress I may have caused my neighbors as a result of this matter. I have sent a copy of this letter to them to inform them of my proposal on the use of my property at 0121 Rainbow Lane as a staging area for my gardening business. Please understand that when I purchased this property I was under the impression that operating my business from this site was an acceptable use under the County's regulations. I was also unaware of the protective covenants that limits this property to residential use and the raising of farm animals and other farm products. I acknowledge that my inexperience in land use and planning matters may have gotten me into this situation but I also want to express that it has always been my intent to be a good neighbor and to comply with all regulations and restrictions governing my property. After receiving your letter, complaints from neighbors, and consulting with a land use professional, I understand to the best of my knowledge that my business does not suitably comply with the County's land use regulations or the covenants of the Sterling Subdivision. This issue has been very distressing for me as I purchased this property, at great expense to me, with the intent of utilizing lt to make a living through my gardening business, as well as a wonderful area to raise my children. In addition, I am currently going through a divorce, which is creating other financial hardships. Given these circumstances, my main concern is to be able to continue operating my business while transitioning to another location. The process of relocating my business will involve finding a suitable location, negotiating the necessary lease or purchase for the site, as well as planning for and relocating my stock and equipment and setting up the necessary hoop houses for my plant material. In recent weeks, I have been working vigorously on the task of finding a site but, at this point, I don't have anything that would qualify as an immanent solution. Therefore, I am proposing the following strategy for transitioning my gardening business from my property at 0121 Rainbow Lane to a location as yet to be determined. I request that I be allowed to confinue to operate my business from 0121 Rainbow Lane, under certain voluntary conditions listed below, for a period of up to six months while I prepare for the relocation. During this time, I will act diligently to find a site and make the necessary preparations to accommodate my business. I will also agree to the following modifications on the operation of my business at 0121 Rainbow Lane in order to reduce the impact on my neighbors: i— 0 • Page 2 May 12, 2003 -Reduce the number of employees working on-site ( plant watering and loading or unloading trucks, planting containers) from 12 last year, to 2 plus myself on weekdays and 1 plus myself on the weekends; Limit the hours of operation from 7.30am to 7.30prn, instead of 10pm; - Limit the number of vehicles to my vehicle and the company truck and van with 2 trailers. In addition the two employees would park their personal vehicles for the day on site. This is a reduction from the 4 — 7 vehicles parked on site last season; - Pay for the repair of Rainbow Lane at the end of the 2003 season; - Remove all structures, other than the greenhouse, used for the operating of the business at the end of the 2003 season, in addition the white car port has been removed; - Limit the number of semi trucks to 10, a reduction from 15 from last year, for the delivery of plant material to the site at 0121 Rainbow Lane. In order to expedite the deliveries and not have the trucks on site for longer that necessary I would request we have 8 employees and myself offloading the trucks. I also commit to make every effort to further minimize noise and disturbance associated with my operation over these six months by encouraging my employees to be mindful of the disturbance they generate while working on the site and driving on the subdivision roads. If I am able to find a suitable site and make the necessary preparations for relocation sooner than sok months I will do so! I hope this proposal is acceptable to the County and to my neighbors on Rainbow Lane and the contents of this letter provides you with the information you need to consider the building permit application for my greenhouse. If you have any questions regarding the conterds of this letter or require any further information please feel free to contact me.
