Vos Caudill, Pitkin County, CO ADMINISTRATIVE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF PITKIN COUNTY, COLORADO, APPROVING 645 HUNTER CREEK LLC ACTIVITY ENVELOPE AND SITE PLAN REVIEW Administrative Decision No. 5� -2016 RECITALS 1. 645 Hunter Creek, LLC ("Applicant') has applied to the Community Development Director of Pitkin County ("Director") to designate an Activity Envelope and obtain Site Plan Review approval to demolish an existing single family residence and replace it with a new single family residence of approximately 7,925 square feet of floor area. A Transferrable Development Right (TDR) will also be utilized to accomplish floor area above the Growth Management Quota Systems Exemption (GMQS) of 5,750 square feet. 2. The Lot is located at 645 Hunter Creek LLC, and is legally described as Block 4, Lot 8 of the BOCC approved Red Mountain Ranch Subdivision. 3. The Lot contains approximately 33,349 square feet in size and is within the R-30 zone district. The Lot is located within the Aspen Urban Growth Boundary (UGB). 4. No previous land use decisions apply to the property. 5. Existing sewer service is provided by the Aspen Consolidated Sanitation District. Water service is provided by the City of Aspen. All utilities will follow the same alignment that serves the existing residence. 6. The public notice was mailed on March 16, 2016. Public notice was published in the Aspen Times Weekly on March 1 T", 2016. No objections were received. 7. The proposed Activity Envelope and Site Plan are consistent with the applicable requirements of the Code, as follows: A. The Director finds that an Activity Envelope/Site Plan has been proposed that shows that redevelopment of the site will effectively be in an identical location and manner as the existing residence. Redevelopment of the residence will not contain slopes in excess of 30%. The existing driveway leading to the residence utilizes boulder retaining walls both on the uphill and downhill sides. Tall retaining walls also exist on the eastern side of the lot. These retaining walls are steep, and at the time of the site visit, were well vegetated. The Applicant has included these retaining walls within the Activity Envelope plan in effort to provide maintenance and repairs to the walls. Though the walls do not meet current retaining wall guidelines pursuant to Section 7-20-20(ex5) of the Code, reconstruction of the walls to meet Code standards will more than likely not be possible. Inclusion of the retaining walls within the proposed Activity Envelope for maintenance and repair is consistent with Land Use Code Section 7-20-20(b). B. The Director further finds that because it is unknown if the retaining wall have been engineered, stability of the wall is in question. Further reports shall be submitted for review to address this potential hazard. Improvement/stability controls may be required. Administrative Decision No. s� -2016 Page 2 C. The wildfire hazard is rated as "severe" and the Applicant has proposed to comply with the Land Use Code standards for development in a "severe" hazard area pursuant to the provisions of Sec. 7-20- 60(c) of the Code. D. The proposed residence is consistent with the criteria for development within the Scenic View Protection Area and will not obstruct a ridgeline as viewed from Hwy 82. 8. The Director further finds that pursuant to Section 6-30-50(b)(1), the use of one (1) TDR to develop up to approximately 7,925 square feet of floor area is exempt from "Special Review" and may be reviewed administratively. APPROVED by the Director, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made during the application process. 2. Prior to submission of any future building permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2. 1.1 and 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation of them. 3. At building permit submittal, the Applicant shall: A. Obtain an access/driveway permit from Planning/Zoning for substantial improvements to the driveway. Given the steepness of the Lot and existing retaining walls, the driveway may not comply with current County standards. B. Obtain a fireplace/woodstove permit from the Community Development Department, if necessary. C. Submit a site specific drainage and erosion control plan prepared by a qualified engineer or geologist for review and approval by Planning/Zoning. D. Pay the applicable road and employee housing impact fees. E. Submit a construction management plan for review and approval by Planning/Zoning. No parking shall occur on County Roads. F. Submit a detailed revegetation plan for disturbed areas with appropriate seed mixes. G. Submit a landscaping and tree replacement plan. Landscaping shall be substantially consistent with the landscaping shown on the site plan. Landscaping shall be completed prior to issuance of the Certificate of Occupancy for the residence. H. Submit a lighting plan that is consistent the Land Use Code. I. Submit an engineering report prepared by a licensed Engineer in the State of Colorado that provides an analysis of the integrity and stability of the retaining walls associated with the driveway and on the eastern lot line. The report shall make engineering findings and provide a recommendation for any needed upgrades to ensure the walls have the ability to accommodate the approved redevelopment of the site. Recommendations made by the engineer shall be considered conditions of this approval. 4. The exterior of all buildings shall utilize indigenous earth tone materials or colors and the roofs shall have a non -reflective color or composition. Reflective roof materials, with the exception of materials associated with solar or photovoltaic equipment, shall not be used unless the materials are treated to Administrative Decision No. 5-2016 Page 3 eliminate reflectivity prior to installation. Material samples for the exterior of the residence shall be submitted at building permit submittal. All exterior lighting shall comply with the lighting code. S. The Lot is exempt from Growth Management Quota System (GMQS) for residential development up to 5,750 square feet of gross floor area. Additional floor area above 5,750 square feet requires use of a TDR. At building permit application, the Applicant shall surrender one (1) original TDR Certificate and a copy of the deed(s) evidencing the Applicant's acquisition of the Certificates (if applicable), in order to develop floor area up to approximately 7,925 square feet. Because gross floor area cannot exceed this amount, the balance of the TDR cannot be utilized in the future. 6. The Applicant shall comply with the following standards for Development in a Severe Wildfire Hazard Area: A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows: 1. Brush, debris and non -ornamental vegetation shall be removed within a minimum ten - foot (10') perimeter around all structures. 2. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a minimum of a thirty (30) foot perimeter around a structure built on flat ground. Spacing between clumps of brush and vegetation up to the thirty (30) foot perimeter shall be a minimum of two (2) times the height of the fuel. Maximum diameter of the clumps shall be equal to the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. 3. All branches from trees and brush within the thirty (30) foot perimeter shall be pruned to a height of ten (10) feet above the ground with removal of ladder fuels from around trees and brush. 4. Tree crown separation within the thirty (30) foot perimeters shall have a minimum of ten (10) feet between the edges of the crowns, except for mature stands of aspen trees where ladder fuels have been removed. In areas of aspen regeneration, understory shrubs and down and dead materials shall be removed. 5. All branches that extend over the roof eaves shall be trimmed and all branches within fifteen (15) feet of chimneys shall be removed. 6. The density of fuels up to a one hundred (100) foot perimeter of the structures shall be reduced where natural reduction has not already occurred. 7. All deadfall up to a one hundred (100) foot perimeter shall be removed. 8. No new conifer trees shall be planted within ten (10) feet of a residence. 9. No flammable mulches shall be placed within two (2) feet of a residence. 10. The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Roofing Materials: Class A covering or Class A assembly as defined by the currently adopted Building Code. No wood shakes or shingles. All other adopted Building Code compliant Administrative Decision No. b -2016 Page 4 methods and materials permitted. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: 1) All roof coverings shall be constructed of non-combustible materials and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing roof debris. 3) Protrusions above the roofline, such as parapets, shall be prohibited. 4) Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of 1:48. 5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. C. Roof Venting: 1) Soffit venting shall be located in the outer 1/31 portion of the overhang. 2) Attic, soffit and other roof venting shall be of non -corrosive metal mesh with maximum Y4" openings. D. Projections at the Roofline, including Soffits, Rafters, Porch or Deck Roofs, Fascias, or Other: 1) One hour rated material or any material underlain by 5/8" Type X gypboard or equal, or 2) "Type IV" Heavy Timber materials, per the currently adopted building code. E. Decks, Decking, Cantilevered Floors, or Other Projections Below the Roofline: 1) Construction with noncombustible or one (1) hour rated material, or material with flame spread Q.5 (tested to ASTM E84 and listed for exterior use), or 2) Conventionally framed deck with waterproof surface and underside protected with 5/8" Type X gypboard or equal (decking as "1" above), or 3) "Type IV" Heavy Timber materials: joist and beams minimum 6"x10", columns minimum 8"x8", decking minimum 4" in depth, or decking as 1" above; or equivalent log construction, or 4) Enclose projection vertically to ground with one hour fire resistive materials. Decking as "1" above. F. Railings: Railings must be constructed of noncombustible or "Type N" Heavy Timber materials. G. Exterior of the Structure, Including All Walls: 1) One (1) hour fire resistive rated materials, or 2) 5/8" gypboard underlying combustible materials, or 3) Cement stucco, minimum 1/4" thickness. 4) All glazing to be tempered glazing or equivalent to protect windows from shattering under extreme heat, with the exception of windows on the north side of the house; and 5) Doors to be metal or wood l %" thick minimum, or tempered glass. Foundations: Foundations, skirting, and crawl space openings shall be fully enclosed and constructed with materials approved for one (1) hour fire -resistive construction on the exterior side of the walls and shall extend from the top of grade to the underside of the floor decking or walls. I. Maintenance and Miscellaneous Requirements 1) Roofs and gutters shall be kept clear of debris. 2) Roof vents shall be screened with corrosive resistant wire mesh, with mesh one-fourth ('/,) inch maximum. 3) Any outbuilding shall adhere to the same wildfire requirements. 4) Yards shall be kept clear of all litter, slash and flammable debris. 5) All flammable materials shall be stored on a parallel contour a minimum of fifteen (15) feet away from any structure. 6) Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more than six (6) inches. 7) Firewood/wood piles shall be stacked on a parallel contour a minimum of fifteen (15) feet away from the structure. 8) Swimming pools and ponds shall be accessible by the local fire district. 9) Fences shall be kept clear of brush and debris. 10) Wood fences shall not connect to other structures. 11) Fuel tanks shall be installed underground with an approved container. 12) Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for two (2) hour fire -resistive construction on the exterior side of the walls. 13) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher. 14) Addresses shall be clearly marked with two (2) inch non-combustible letters and shall be visible at the primary point of access from the public or common access road and installed on a non-combustible post. 15) Utilities shall be extended underground. 16) All structures shall be sprinklered. 7. The Applicant shall comply with the applicable codes and requirements of the Aspen Fire Protection District, including but not limited to access, turning around of fire apparatus, installation of an approved fire sprinkler system and an on-site water supply for fire fighting (20,000 gallons on-site or confirmation of the operability of the fire hydrant at the end of the driveway to the satisfaction of the Fire Marshal). 8. Native vegetation shall be maintained outside of the Activity Envelope, except to comply with the wildfire mitigation measures described above. 9. Trash/garbage shall be kept in an approved bear resistant container or enclosure, pursuant to the County's Wildlife Protection Ordinance. Verification of compliance shall be provided prior to issuance of a certificate of occupancy. Round handled door knobs shall be installed on all exterior doors. Administrative Decision No. 5-2016 Page 6 10. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the corners of the activity envelope and install construction fencing around/along the perimeter of the activity envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy. 11. No structural development in excess of 30" above or below natural grade shall occur within the setbacks of the lot, with the exception of driveways and associated retaining walls of up to 6' above or below natural grade and fencing. Landscaping in the form of berms shall not exceed four feet from the most restrictive grade. Any development located within setbacks mandated by County zoning regulations that does not comply with these restrictions shall require a variance from the Board of Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. 12. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted with regard to the replacement home. These requirements will be considered at the time of building permit. Any structures represented in the application may not be permitted under building and zoning regulations. 13. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code § 2-20-170 and C.R.S. § 24-68-105. The statutory vested rights granted herein shall expire on -lune r'Zi 2019. 14. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. INTRODUCTION. Applicant, 645 Hunter Creek, LLC, the owner of Lot 8, Block 4, Red Mountain Ranch, seeks activity envelope and site plan approval pursuant to Section 2-30-20(g)(2) and (3) of the Pitkin County Land Use Code. Proof of ownership is appended hereto as Attachment 1, comprised of the Warranty Deed by which the Applicant took title to the property, Applicant's attorney's Certification of Ownership and the Pitkin County Assessor records for the property. Also attached in Attachment 1 is the Statement of Authority evidencing Mark Friedland's authority to act on behalf of the Applicant. The Red Mountain Ranch Subdivision Plat covering the subject real property was recorded in Plat Book 4 at Page 123 on July 24, 1970. The undersigned has been appointed as the authorized representative of the property owner for the purposes of processing this Application as evidenced by the Authorization to Represent letter appended hereto as Attachment 2. The property is presently developed with a single-family residence and related improvements. The land area is comprised of approximately 33,349 square feet of land. There are no prior land use approvals for the property. The driveway serving the property is directly off of Hunter Creek Road, a County road. The property has legal access to a public right-of-way. Domestic water service will be provided by the City of Aspen. Existing service is located in Hunter Creek Road and is available to the property. The property is served by the Aspen Consolidated Sanitation District for waste water purposes. No modifications to the water or waste water systems/connections are proposed. Existing conditions on the site, including the location of the driveway and easements, are depicted on the Land Survey Plat appended as Attachment 3. As required by Land Use Code §7-10-50, the development site and proposed activity envelope avoid all constrained areas. The area of development for the new residence is the same as was previously developed. The property is not impacted by any river or stream corridors or any riparian areas. The development proposed for the site fits appropriately within the activity envelope. The proposed activity envelope is depicted on the Draft Activity Envelope and Site Plan appended hereto as Attachment 4. The Applicant's proposed improvements, including landscape improvements outside the building envelope are depicted on the draft development plan appended hereto as Attachment 5. The activity envelope is immediately adjacent to and Page I of 5 000004 includes the access driveway. The Applicant proposes to define the Activity Envelope for the site by the County setbacks as to the Building Envelope and the property boundaries for future landscaping purposes. There are no areas of development as depicted on the draft Activity Envelope and Site Plan that exceed slopes of 30%. The areas of slope in excess of 30% are pre- existing developed portions of the property with retaining walls associated with landscaping and the existing driveway access. The Applicant does not propose development in any areas of 30% or greater slopes. The Activity Envelope and Site Plan will comply with all requirements of Land Use Code §7-10-50. SITE PREPARATION AND GRADING, § 7-20-10. Site conditions, grading plan, floor plans and elevations are depicted in Attachment 5. The entire building envelope is located on slopes of less than 30% grade. All grading and filling on the Lot will take place within the defined activity envelope as depicted in Attachment 5. The driveway serving the property enters off of Hunter Creek Road in an area where the slopes are less than 30%. The site is vegetated primarily with grasses and shrubs, scrub oak, aspen and spruce trees. Following site work and clearing, including removal of vegetation necessary to comply with the requirements of wildfire mitigation, the Applicant will revegetate the site in accordance with Pitkin County Revegetation Guidelines with native grasses and vegetation, as depicted on the landscape plan. The site is within a "high" wildfire hazard area. Applicant will comply with Pitkin County's standard condition regarding development in high wildfire hazard areas. All recontouring of the site will result in positive drainage away from the building improvements and will tie into existing natural topography and previously constructed retaining walls. The site will be fully revegetated to avoid intrusion of weeds. All revegetation will be in accordance with wildfire mitigation requirements. All utility installations will be underground in the area disturbed for construction. Utilities are currently available on site. The development of the property will not result in significant alteration of natural drainage patterns that will increase water flows or subject adjacent properties to increased erosion. There are no streams, rivers or wetlands/riparian areas on the subject property or in the vicinity. II. STEEP AND POTENTIALLY UNSTABLE SLOPES, §7-20-20. The proposed building envelope avoids slopes in excess of 30%, except for minor, pre- existing man-made anomalies and, thus, fully complies with Land Use Code §7-20-20. Areas outside of the building envelope with slopes in excess of 30% will remain in their existing condition without alterations. Page 2 of 5 000005 The proposed Activity Envelope and Site Plan Plat depicting the contours of the property and the proposed building and development footprint is appended as Attachment 4. The Plat depicts the contours in 2 -foot increments. The new Activity Envelope and Site Plan will conform to the requirements in the Land Use Manual and will provide a graphic depiction of the slope analysis. All development will occur within the approved development envelope. III. WATER COURSES AND DRAINAGE, §7-20-30. There are no streams, rivers or water courses impacting the property. There are no wetlands on the parcel. IV. WILDFIRE HAZARD, §7-20-60. The property is mapped as being located within a high wildfire zone. The Applicant proposes to adhere to the wildfire mitigation standards in accordance with existing County Regulations. Although the property is designated as a high wildfire hazard area, the Applicant has not prepared an independent wildfire hazard report, because of the pre-existing development on the site and the small size of the lot. The lot does not present opportunities for manipulation of vegetation or other wildfire mitigation measures, with the exception of creating defensible spaces and complying with Code requirements with respect to construction techniques and materials and building design. Because the residence will be connected to the municipal water supply, it will be served with a pressurized water system suitable for a building sprinkler system. With the implementation of the Land Use and Building Code requirements for wildfire mitigation and protection, the Applicant respectfully submits that the preparation and submission of an independent wildfire evaluation and report would be superfluous. V. WILDLIFE HABITAT, §7-20-70. The property is not located in any mapped critical wildlife area and does not impact winter habitat or calving areas. To the extent possible, given the size of the parcel, the Applicant will comply with all considerations of Land Use Code §7-20-70. The area outside of the building footprint will remain open and undisturbed, except for contouring and retaining walls as depicted on Attachment 4, allowing for movement of wildlife and connection to wildlife habitat. VI. STANDARDS FOR SCENIC VIEW PROTECTION AREAS, §7-20-120(d). The development on the subject property is visible from Colorado State Highway 82 through the City of Aspen. The proposed residence will be a two-story structure above grade located within the designated building envelope. The structure will compliment the natural landscape and natural features and will not impact any natural ridgeline or silhouette against the sky. The development is sited in conformance with the County's rural character guidelines and will use existing Page 3 of 5 OOOOOG topography and natural vegetation to limit visual impacts. Story poles are in place onsite that depict the maximum height of the proposed residence. The Applicant will use natural materials and coloring, non -reflective materials, and the roofline will compliment the natural form of the hillside upon which it will be located. While the development cannot entirely preserve the existing natural vegetation of the site, the site will be fully revegetated with natural plantings. All utility extensions will be underground. The proposed residence will not be taller than the existing residence and will be set into the hillside to minimize visual impacts. The proposed development site will comply with the Rural Character Guidelines for building location. The scale and height of the development will be subordinate to the natural changes in topography. The use of natural colors and non -reflective materials will cause the structure to blend into the surrounding environment. VII. LANDSCAPING AND VEGETATION PROTECTION, §7-20-130. To the extent permitted by the wildfire restrictions, the Applicant will revegetate all disturbed areas with natural vegetation. The Applicant does not propose to install berms on the site. The area outside the activity envelope will be maintained in its natural, undisturbed condition with the exception of landscaping. All new landscaping will utilize species of naturally occurring plant materials. All landscaping will comply with the requirements of Land Use Code §7-20-13(b). The Applicant will comply with the "Required Landscaping in Rural Areas" sections of the Land Use Code. There will be no satellite dishes or other telecommunications equipment visible from public roads. VIII. LIGHTING, §7-20-140. All lighting for proposed development on the property will comply with the requirements of Land Use Code §7-20-140. IX. TDRs AND UGB, §6-30-50(b)(1). The Applicant proposes a residence with a gross amount of square feet of 7,923. The site has an allowable Floor Area Ratio of 4,331 square feet and is permitted a total of 5,750 square feet of gross building size. Therefore, the Applicant proposes to land a Transferrable Development Right on the property.
