Vos Caudill, Pitkin County, CO RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, GRANTING ANNUAL REVIEW APPROVAL TO THE ELAM GRAVEL PIT SPECIAL REVIEW PERMIT Resolution No. 016 -2016 RECITALS 1. By Resolution No. 88-47, the Board of County Commissioners of Pitkin County, Colorado (BOCC), granted a special review use permit to Elam Construction, Incorporated (Applicant) for the Elam Sand and Gravel Pit and Asphalt /Hot Mix/Concrete plant. Legal Description, Attachment A. 2. By Resolution No. 99-69, the BOCC extended the special review approval for 10 years, until April 14, 2009. 3. By Resolution No. 129 -2006, the BOCC permitted an expansion of the pit and an extension of the permit for 20 years, until 2026. This Resolution was subsequently vacated by judicial proceeding pursuant to District Court Order Case Number P06 CV 230 and remanded to the BOCC for further findings. 4. On March 25, 2009, the BOCC amended Resolution No. 99-69 to extend its expiration date to allow Elam operations to continue. 5. Resolution No. 99-69 requires an annual review of the Elam operations at a public hearing for compliance with all terms and conditions of the resolution and subsequent resolutions. 6. Resolution No. 052-2009 approved the Phase 2 expansion and an extension of the permit for 20 years. BOCC Resolution No. 36-2012 (Rec. No. 588258) approved an amendment to the mining sequence at the pit. 7. On March 23`d, 2016, the BOCC held the annual review of the Elam Sand and Gravel Pit Special Review Permit for the operation year of 2015 where members of the public had opportunity to voice their comments. 8. The BOCC has determined that the Applicant has been operating in compliance with the terms of Resolution No. 99-69, Resolution No 052-2009, and 038-2015, specifically condition #3 which required that a landscaping plan be developed and approved by all parties and implemented, subject to certain standards. 9. The BOCC further determines that the Applicant has satisfied the requirements of BOCC Resolution No. 052-2009 and BOCC Resolution No. 038-2015. BOCC Resolution No. el6 2016 Page I of 4 10. The BOCC further determines that Elam has acknowledged that a 700' setback distance measured linearly from the Braun residence will be adhered to for the 2016 mining season. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners of Pitkin County, Colorado, hereby accepts the Elam Construction, Incorporated 2015 Annual Review Report and requires the following measures in order to find Elam in compliance with terms and conditions of approval: 1. All material representations made by the Applicant in the application, in subsequent correspondence, and at the public hearing shall be adhered to and considered conditions of approval. 2. The Applicant shall continue to be bound by all conditions of Res. No. 99-69 and Resolution No. 052-2009, as amended. 3. The Applicant shall continue to implement the thistle and noxious weed elimination plan. This applicator of the herbicide shall be licensed and avoid spraying near waterways, drainage courses, and ditches. The applicator shall abide by State of Colorado and Pitkin County regulations regarding use of specific herbicides. 4. The truck parking area adjacent to the RV parking area shall have no more than 12 trucks parked on site, at one time, and there shall be no more than 12 plug-in block heaters. Idle time shall be limited to the length of time necessary to properly prepare the vehicle for use. 5. The Applicant shall continue to monitor soil and water pursuant to Resolution No. 52-2009 and Resolution No. 105-2000 with monthly tests conducted on the standing water in the pit through October 2016, and the results shall be submitted with the 2016 annual review. The Environmental Health Department shall review the sampling process. 6. For the 2016 mining season, mining shall not occur any closer than 700' from the Braun residence located at 0401 Woody Creek Road. The measurement shall be linear and be taken from the closest point of the main residence to the Phase 2 mining area. Prior to any mining by the Applicant past the 1,000' setback line which was surveyed and staked in the field in 2015, the Applicant shall survey, stake, and mark with colored flagging the 700' setback line from the Braun residence. 7. The term "camper" in Condition #8 BOCC Resolution 052-2009 shall mean a recreational vehicle used for short term housing for an Elam employee who lives in the recreational vehicle for the duration of a mining season. Mobile home structures near the southern property boundary shall not be used for habitation. BOCC Resolution No. 2016 Page 2 of 4 8. For the duration of 2016, Elam shall continue discussions and conduct meetings with Pitkin County Staff and the Brauns regarding a master plan for the Elam property. A master plan would be generated by Elam that includes, but is not limited, to the following: A. Development of a post mined land use of the property. This will involve exploration and analysis of alternatives for Elam to consider the highest and best possible uses that are compatible with both the Pitkin County Land Use Code and the Woody Creek Master Plan. Selected alternative(s) will be presented to the Woody Creek Caucus for consideration and for possible incorporation into the Woody Creek Master Plan; B. Final grading and concept landscaping plans and scenic perspectives from Highway 82 and locations within Woody Creek including the Braun residence; C. Exploration of a conservation easement on the property (specifically on the North side of the property), provided the conservation easement is compatible with highest and best use alternatives presented in the Plan; D. Exploration and consideration of leaving a natural berm on the north side of the currently approved mining boundary, feasibility yet to be determined; E. Analysis of the potential for substitution of gravel deposits to the South of the Elam property thereby increasing the mining boundary from the Braun residence beyond the currently approved 480' setback. If feasible and agreed upon, then amendment applications would be made to the mining boundary; F. If the master plan is . completed by January 15, 2016, it shall be provided to the BOCC for consideration at the 2016 Annual Review hearing. 9. Condition #8 of BOCC Resolution No. 052-2009 requires that only one (1) employee and his family may remain onsite at the pit year round for security. Elam has represented that from time to time, two (2) RV campers may be located at the pit so that two (2) employees can split time monitoring the pit for security. Two (2) employees are needed so that when a security employee has a day off, coverage can still be maintained. The BOCC acknowledges that this is acceptable. STAFF MEMO MEMORANDUM TO: Pitkin County Board of County Commissioners THRU: Cindy Houben, Community Development Director FROM: Mike Kraemer, Plannerl"niMK-- SUBJECT: Elam Construction, Incorporated, Special Use Permit Annual Review for the 2015 Operating Season DATE: March 23rd, 2016 SUMMARY: On October 11, 2006, the Board of County Commissioners approved a 16 acre expansion and a 20 year extension of the Special Use Permit for the Elam Construction, Sand and Gravel Pit and Asphalt/ Hot Mix/ Concrete Plant pursuant to BOCC Resolution No 129-2006 (Rec. No. 530725). This expansion area is called Phase 2. As a condition of this permit, the County required an annual public hearing for the operator to demonstrate compliance with the conditions of the permit, for the County to require corrective measures or to impose new conditions, and to provide an opportunity for citizen comment on the operations. This 2006 approval was subsequently vacated by a judicial proceeding and remanded to the BOCC for further findings due to the presence and unaddressed impact to a residence owned by the Brauns that exists 480' from the expansion area (District Court Order Case Number P06 CV 230). In 2009, the BOCC heard the request for an expansion of the Vagneur Pit and to maintain the terms of the operation for 20 years. This resulted in BOCC Resolution No. 052-2009 (Rec. No. 563795) which granted approval of the request, specifically addressing District Court Order Case Number P06 CV 230. BOCC Resolution made specific findings regarding a 1000' setback requirement from the residence that is 480' from the expansion area. Resolution No. 052-2009 required some additional items be addressed at the annual review for Phase 2 of the operation. The pit received two separate BOCC approvals in 2012. Due to multiple paving projects awarded to Elam in 2012, the Applicant requested that the approved mining method in the expansion area be amended so that mining could occur at a faster rate. Specifically, the Applicant requested to use a larger dozer and track hoe to mine material at a faster rate. The BOCC approved this amendment pursuant to BOCC Resolution No. 36-2012 (Rec. No. 588258). The Applicant has also received 5 year Special Review approval for a commercial snow dump operation that will expire this winter season, pursuant to BOCC Resolution No. 16-2011. As required by the Resolution, soil testing results were submitted and the snow dump was found to be not in compliance with adopted standards and Elam did not operate as a commercial snow dump for the 2015/2016 winter season. The Elam 5 year snow dump permit expires at the conclusion of the 2016 winter and a new snow dump permit is required to operate next winter. APPLICANT: Elam Construction, Incorporated. 9/10 APPLICANT'S REPRESENTATIVE: Jon Mueller and Mark Gavell LOCATION: Elam Construction Sand and Gravel Pit and Asphalt/Hot Mix/ Concrete Plant, 7911 Upper River Road, Woody Creek. ZONING: RS -20. PROCESS: This review is to assess Elam's year 2015 compliance with the standards set in Resolution No. 0052-2009 and last year's annual review approved pursuant to BOCC Resolution No.038-2015. REFERRAL COMMENTS: This item was referred to the Woody Creek Caucus and the Environmental Health Department (EH). Woody Creek Planning Commission Comments can be viewed as Attachment A. EH comments will be viewed as Attachment C. ANNUAL REVIEW CRITERIA: Resolution 052-2009 requires review of the following_ 1) Condition 5A - Submit a drainage plan for the eastern edge of the Phase 2 mining area Staff Response: This has been done and approved by the Planning Engineer in 2010. 2) Condition 18 states: "The Applicant shall control dust to be substantially the same or less than 14.0 pg/cu. meter of dust at the 480' residence under normal operating conditions. To ensure this, the Applicant shall water haul roads 4 times per day during dry conditions and water the northern portion of Phase 2 within 1000' of the residence, as needed during mining operations ". Staff Response: Staff did not receive any dust complaints in 2015. Staff has no reason to believe that watering of the haul roads is not occurring. 3) Condition 19 states: "To mitigate additional noise impact, the Applicant shall maintain a 15'— 25' natural berm along the eastern facing slope isolating the mining area from the 480' residence to reduce noise. The Applicant shall also limit the use of the Cat 966 loader or similar machine to at or below the 7403 elevation in the northern area of Phase 2, where the former topsoil stockpile was to be located, or whatever elevation is necessary to ensure the noise at the 480' residence does not exceed 48dB(A) ". Pursuant to BOCC Resolution No. 36-2012 (Rec. No. 588258) The following language was added to condition # 19 of BOCC Resolution No. 052-2009: A. The Applicant shall be allowed to mine material in Phase 2 expansion area using the following machines: 1. One (1) Cat 345 B Track hoe and three (3) Volvo A30 rock trucks, Or 2. One (1) Cat 966 loader and one(]) Cat D9N Dozer. Page 2 of 6 h B. The following stipulations shall apply to these machines to ensure that the 48dB(A) noise level at the residence that is 480' from the Phase 2 expansion area is not exceeded: 1. When using the Cat 345 Track Hoe, the middle of the radiator of the machine shall always be a minimum of 9.5 vertical feet from the top of the natural berm, as the excavation moves toward the north limit of the permit area. 2. When using the Cat 966 Loader, the middle of the radiator of the machine shall always be a minimum of 18 vertical feet from the top of the natural berm, as the excavation moves toward the north limit of the permit. 3. When using the Cat D9 Dozer, the middle of the radiator of the machine shall always be a minimum of 47.8 vertical feet from the top of the natural berm, as the excavation moves toward the north limit of the permit. These numbers were calculated using the best engineering methods to obtain the required limit of 48 d(B)A at the residence 480' from the Phase 1 expansion area. If later measurements show that the estimates are inaccurate, the Cat 966 or the Cat D9 machines could move up or down slightly to ensure that the 48 d(B)A threshold is not exceeded at the subject residence. Staff Response: Staff has been on site and viewed the expansion area and the "berm". Staff has no reason to believe the loader and track hoe are not being used at the approved elevation level. The Applicant has tested noise at Elam property lines in accordance with the County approved monitoring protocol. The noise test results are affixed to the application. The maximum dB(A) at the property line for the Elam operation is 55 dB(A). Many test results showed that readings were incompliance with the 55dB(A) requirement. Some test results, specifically at points 5, 6, 7, 8, and 9, exceeded the 55dB(A). The Applicant states that some of the elevated noise readings are attributable to spring runoff, increased flows of Woody Creek, high winds, lawn equipment being operated at the neighboring property, and construction of the Source Gas pipeline. The remaining tests were in compliance with the 55 dB(A) requirement at the Elam property line. Monthly averages were below the maximum threshold except for the month of May at location 3. Staff did not receive any noise complaints in 2015, though the 480' neighbor to the north did state that equipment can be heard. Elam representatives will be available at the hearing to speak to this aspect of the review. 4) Condition 20 states: "To mitigate additional noise impact the Applicant shall mine the expansion area from south to north and always push materials down to the existing pit area leaving the east facing slope intact until the end of the life of the expansion area ". Staff Response: It is evident this is occurring. 5) Condition 21 states: "To mitigate the additional noise and visual impact the Applicant shall mine the expansion area from west to east leaving the east facing slope intact until the end of the life of the expansion area ". Page 3 of 6 I� Staff Response: It is evident this is occurring. BOCC Resolution 038-2015 also required the following action items from previous years: Condition 3 states: On or around May 30, 2015, a landscape plan will be presented by Elam to be reviewed by the "Braun's" (neighbors living within 480' of the permitted mining area with an address of 0401 Woody Creek Road) and Pitkin County. The final details of the landscaping plan and the timeframe will be agreed upon by the affected parties on or before June 30, 2015 or the affect parties will bring the matter back to the BOCC This landscape plan will be developed and oversight administered by Kim Bock Certified Arborist, Prima Plant Service. Elam and the Braun's acknowledge Kim Bock as a reputable expert arborist and agree to consider her recommendations for the landscape plan. The plan shall contain the following, and be installed in accordance with a schedule recommended by Kim Bock. a. A planting plan of evergreen or other screening type vegetation in the bottomlands or wetlands area directly adjacent to the Braun property will be agreed upon; b. Dead or dying trees will be removed for wildfire safety concerns to the extent recommended to also allow for the continuance of a reasonable level wildlife habitat; c. Kim Bock shall be hired to provide contractor oversight and continued monitoring of planting establishment on a frequency required to ensure successful establishment. d. A planting plan along the north side of the mining area directly in front of the Braun property, generally along the access road at the base of the future mining area, shall be agreed upon. This planting plan shall include trees that are of the estimated height of maturity of trees that were to be planted per the 2009 and revised 2013 Elam landscape plan approved by Pitkin County. If trees of that size are not feasible, or could not survive, given the professional estimation of the landscape professionals, then an alternative plan shall be presented which would include, but not be limited to, an additional amount of trees or a combination of additional trees and other mitigation techniques. Staff Response: Staff met with the Elam representatives and the Brauns extensively in the time between the 2015 and 2016 annual review hearings. A landscaping plan has been developed, approved by all parties, and implemented to satisfy the requirements of this condition. This landscape plan was developed with consultation from Kim Bock, landscape professional, and specifically addressed the maturity requirement in subsection "d" above. A total of 86 exist on site today and are healthy. The final approved landscaping plan can be viewed as Attachment B. Additionally Staff has entered into a separate agreement with Elam for upkeep and maintenance of the landscaping to ensure that the plantings do not fail. Part of this agreement with Elam was to require a cash bond so that if all or portions of the landscaping fail and Elam does not replace the failed trees, Pitkin County has money and access to property to conduct the work. In tandem with the landscaping discussions, Staff, the Brauns, and Elam representatives have also discussed the possibility for Elam to create a long term plan for the pit, which would be called a parcel specific "master plan". The purpose of this master plan would be to provide Pitkin County and the neighbors a comprehensive look at the future uses for the Elam property and provide a certain degree of certainty as to the intentions of the Elam gravel pit business. This long term plan would include information on possible future expansion areas, possible areas for conservation, and ultimately the final cover and use of the mined pit area. Elam representatives have verbally stated they are working on this Page 4 of 6 y master plan and that it may be available for the annual review hearing. Staff, Elam, and the Brauns will be available to discuss this topic if the Board desires. Condition 4 states: For the duration of the 2015 mining season, no mining shall be allowed beyond the surveyed 1, 000' distance from the Braun residence. It is also acknowledged that mining has already occurred beyond the 1, 000' distance from the Braun residence as depicted in Attachment B Staff Response: Elam complied with this requirement for the 2015 mining season. If the Board accepts the 2016 Elam annual review and finds it in compliance with the conditions of the 2009 and 2015 Resolutions, Elam would be able to mine into the 1000' distance from the Braun residence for the 2016 mining season. Condition 5 states: The Applicant shall continue to implement the thistle elimination plan. Staff Response: The Applicant submitted this plan in 2015 and implemented the thistle reduction measures. The thistle has been treated and has been greatly reduced. The Woody Creek Caucus has commented on the application and had concerns with the type of pesticides being used to eradicate thistle. Staff has passed along the Caucus's comments to the Pitkin County Weed Specialist for comment. Condition 6 states: "The truck parking area adjacent to the RV parking area shall have no more than 12 trucks parked on site, at one time, and there shall be no more than 12 plug-in block heaters. Idle time shall be limited to the length of time necessary to properly prepare the vehicle for use. " Staff Response: Staff has not received any complaints regarding this requirement. There are only 12 plugs in blocks at the RV parking area. Condition 47 states: "In accordance with Environmental Health regulations, the leaking 3rd septic tank servicing the trailer park for seasonal workers shall be addressed prior to workers arriving for the 2015 mining season. " Staff Response: The Applicant has submitted a report and has documented that the tank was removed prior to the 2015 mining season. Condition #8 states: "The Applicant shall continue to monitor soil and water pursuant to Resolution No. 52-2009 and Resolution No. 105-2000 with monthly tests conducted on the standing water in the pit through October 2015, and the results shall be submitted with the 2016 annual review. The Environmental Health Department shall review the sampling process. " Staff Response: The Applicant has submitted surface water and import soil testing results for the 2015 season. The results are located within the Applicant's submittal packet. Soil samples have been reviewed and show that the import soils taken into reclaim the mined area (Phase 1) are in compliance with the established thresholds. Page 5 of 6 Standing surface water samples are in compliance with the established threshold limits. None of the tests showed any water samples out of compliance with established threshold standards. It should be noted that the Caucus has concerns regarding the potential for neighborhood well water contamination. The Caucus recommends that wells in the surrounding area be tested. RECOMMENDATION: Staff recommends that the Board approve the following motion, "accept the Elam annual report for 2015 operations", subject to the draft resolution. ATTACHMENTS: A. By Resolution No. 129 -2006, the BOCC permitted an expansion of the pit and an extension of the permit for 20 years, until 2026. This Resolution was subsequently vacated by judicial proceeding pursuant to District Court Order Case Number P06 CV 230 and remanded to the BOCC for further findings. 4. On March 25, 2009, the BOCC amended Resolution No. 99-69 to extend its expiration date to allow Elam operations to continue. 5. Resolution No. 99-69 requires an annual review of the Elam operations at a public hearing for compliance with all terms and conditions of the resolution and subsequent resolutions. 6. Resolution No. 052-2009 approved the Phase 2 expansion and an extension of the permit for 20 years. BOCC Resolution No. 36-2012 (Rec. No. 588258) approved an amendment to the mining sequence at the pit. BOCC Resolution No. 66-2012 (Rec. No. 591220) approved extended nighttime operations for the 2012 mining season only. 7. On March 23rd, 2016, the BOCC held the annual review of the Elam Sand and Gravel Pit Special Review Permit for the operation year of 2015 where members of the public had opportunity to voice their comments. 8. The BOCC determined that the Applicant has been operating in general compliance with the terms of Resolution No. 99-69, Resolution No 052-2009, and 038-2015, specifically condition #3 which required that a landscaping plan be developed and approved by all parties and implemented, subject to certain standards. 9. The BOCC further determines that the Applicant has satisfied the requirements of the 2015 annual review. The reports of application of these herbicides are all erroneously labelled Pesticide Application Records. We see no mention in the reports regarding the currently accepted methods of reclamation of weed -infested areas, which involve various combinations of reseeding with competitive grasses and plants, mulching, watering, fertlizing and shading. Many authorities warn that weed seeds have surprising longevity, into the hundreds of years, and that excessive application of herbicides may encourage the evolution of resistant varieties. At least one of the herbicides, Milestone, could interfere with revegetation plans already required by the County, since it prevents growth of wide -leaf plants for several years. We note the reports of testing of the surface soil and water, but this does nothing to allay our concern for contamination of the well water being used at the the Woody Creek Mobile Home Park and other wells in the area, near to and below the gravel pit. We recommend testing of these surrounding wells, although years of misguided use of herbicides could be difficult to remedy. DISCUSSION: The Pitkin County Environmental Health Department has reviewed the details of the 2016 Annual Report for the Vagneur Gravel Pit under the authority of the Pitkin County Land Use Code and the Pitkin County OWTS Regulation. Resolution No. 052-2009, "Approving the Elam Construction, Inc. Special Review to Expand the Vagneur Pit," outlines conditions of approval. A site visit was conducted on March 17, 2016 with Mike Kraemer, Pitkin County Community Development Department, Kurt Dahl, Pitkin County Environmental Health, and Elam Construction staff. --- WATER SUPPLY: Bottled water for drinking is brought in for employees. Water is hauled in from Mid -Valley Metro for plumbing within the office trailer. There is a well (Colorado Division of Water Resources Well Permit Number 41824 -F -R) on the lower part of the property, but is used for dust suppression; no potable uses. The well is permitted for pumping that shall not exceed 230 GPM and use is limited to industrial and irrigation purposes. --- SEWAGE TREATMENT AND COLLECTION: Individual Sewage Disposal System (ISDS) Permit 89018 documents a system was approved for use of the office by 6 employees. This system consists of one 1000 gallon tank and two deep gravel trenches totaling approximately 100 square feet of absorption area. ISDS Permit 98063 documents the system was approved for use by 20 RV units during summer months. This system utilizes a 2000 gallon tank installed in 1998 and two existing 1250 gallon tanks with effluent distributed via a distribution box to 8 deep gravel trenches for a total of 1820 square feet of absorption area. The area over the absorption field was seeded in the fall of 2008, and large boulders were placed around it to prohibit vehicles from driving over the area. _ Prinlen on Rory le] Pape, ' q The OWTS serving the RV Camp previously consisted of 3 separate tanks. The third tank in series was found to be leaking at the 2014 inspection. Based on the current OWTS Regulations, the total tank capacity of the system was oversized and the system would still meet the sizing requirements if the leaking tank was removed. Elam decided to abandon the leaking tank "in- place" instead of repairing it and a letter from CBO, INC, dated April 26, 2015, indicated the tank was properly abandoned and the effluent filter from that tank was installed on the outlet of the second tank. --- AIR QUALITY: The Environmental Health Office did not receive an air quality complaint in the last year. Emissions Permits issued by the Colorado Department of Public Health and Environment include: X610 Crusher: 97PO0820 V-755 Asphalt Plant: 09PI1168 Vagneur Pit: 13PI388-5 --- NOISE: The Environmental Health Office did not receive a noise complaint in the last year. Elam does have a noise sampling protocol and performs daily readings at the northern most points of the property. Elam staff has previously confirmed in conversation that the company's noise meter is calibrated each year. The application indicates there were a few exceedances of the noise regulations and attributes those spikes to the installation of the natural gas pipe along the western property line. This is a reasonable statement and conforms to the timeline of the installation and construction of the pipe. The EH Department issued a noise variance permit to Rocky Mountain Natural Gas, LLC on September 23, 2015 for testing and moisture removal of the completed pipe. WATER RESOURCES The area of the pit used for snow dumping in the winter is on a reclaimed area on the north end of the pit and is permitted separately from the annual review. Elam has developed a protocol for sampling both soil and water as part of Elam's Water Resource Protection Plan. Soil Sampling: One composite sample is taken for each 20,000 cubic yards of soil. The soil is tested for the following constituents: • Total Recoverable Petroleum Hydrocarbons (TRPH) • Benzene, toluene, ethylebenzene, and xylenes (BTEX) • Total RCRA Metals Pdnw m R W Peyer /5 Water Sampling: Water samples are taken from surface water within the floor of the gravel pit. As you probably know our land is adjacent to the gravel pit separated from it only by Raceway Drive road that runs between. We would like to remind the Elam group of the agreement that no one is to live permanently on site except the site manager and specifically no others are allowed to live on site between December 1 and April 1. Based on observations from this past winter (2015-16) as can currently be seen (it is not yet April 1), there is at least three mobile home -type trailers/RVs parked in the lot near the water tower and there has been activity there throughout the winter including the addition via crane of one of at least two propane tanks situated to serve individual trailers. I believe the site manager lives in the permanent structure at the entrance to the pit and not in one of the trailers/RVs and not in the lot where the trailers sit. These observations tend toward the conclusion that the Elam group is not compliant with the agreement. In 2007 you granted approval for an expansion of the gravel pit to a point that is 480 lineal feet from the Braun residence. Every year Gail and I have to come in to the annual review of the Elam Special Use Permit and complain about the problems experienced that year. Last year, we pointed out that once again (the third time, I believe) the landscaping that was supposed to provide a visual buffer had largely died. You approved Resolution 038-2015 which provided that Elam would not mine closer than 1,000 to the Braun residence for the 2015 mining season. And you instructed staff and Elam to meet with the Brauns to try to work on solutions to the on-going problems. Elam, Staff and we meet several tunes last summer and into the fall. Initially, there was great progress, but there were multiple unavoidable setbacks. In the end, the landscaping issue appears, for now, to be resolved and the County has security to insure the replacement of the landscaping in the event it dies yet again. During last summer and fall there was considerable discussion of a long-range master plan for the gravel pit so that there would be in place a plan that is acceptable for all and so that the Brauns do not have to attend annual review hearings to point out new and continuing problems. We request that you instruct staff and Elam to continue in the discussions started last year so that we may continue work on the Master Planning effort for the Elam gravel pit. Very truly yours, KLEIN COTfrEDWARDS CITRON LLC q MEMORANDUM OF UNDERSTANDING This MEMORANDUM OF UNDERSTANDING (the "Memorandum") sets forth the understanding of Elam Construction, Inc., a Colorado corporation ("Elam") and Pitkin County Colorado ("Pitkin" and together with Elam, the "Parties") regarding the maintenance of planted trees at the Elam gravel pit (the "Gravel Pit"), pursuant to the revised landscape plan attached hereto as Attachment A (the "Landscape Plan"). WHEREAS, Pitkin has previously permitted Elam to maintain its permit at the Gravel Pit pursuant to BOCC Resolution #052-2009, 2009 to plant and maintain trees at the Gravel Pit. This landscape plan has been amended from time to time since this date; WHEREAS, Elam planted the trees required in 2009, and pursuant to a site visit on June 8a' 2015 it was determined that approximately 26 trees have died or were needing replacement with alternative vegetation. Along with an additional planting of 16 "New" trees. Therefore, a total of 86 trees on site. WHEREAS, Elam has agreed to, and has already caused WindRiver Trees ("WindRiver"), to replant the portion of the trees that had died ("Replaced Trees") and Pitkin has required a deposit to be held in trust for the maintenance of the Replaced Trees (the "De sit'); and WHEREAS, this Memorandum sets forth the details that the Parties have discussed and agreed to in relation to the provision of the Deposit. Deposit Terms The Deposit, in the amount of THIRTY-FIVE THOUSAND ($35,000) dollars (Attachment B), will be delivered at the time this Memorandum is executed and will be held in trust for the maintenance of the Replaced Trees. Maintenance Requirements The property owner of the Gravel Pit shall maintain the Replaced Trees in good health in perpetuity. The status of the Replaced Trees will be judged by Kim Bock, Certified Arborist. Release or Use of Deposit The term of the Memorandum shall be THREE (3) years from July 27, 2015 on which the Replaced Trees were planted. Kim Bock will annually inspect the Replaced Trees and determine their viability and consistencies with levels of maturity stated in the Resolution #038-2015 set forth by the Board of County Commissioners (`BOCC"). Kim Bock shall submit landscaping reports to Pitkin within one (1) week of each inspection for review by Pitkin (the "Landscapine Reports'). If the Replaced Trees are deemed viable by Kim Bock, then at the end of the term of this Memorandum, the Deposit will be released. Pitkin will release the deposit to Elam in its entirety, or its remaining balance if used in the replacement of trees. If the Replaced Trees die and need to be replaced based on a Landscaping Report, then Elam may choose to replace any dead Replaced Trees at their own cost and within sixty (60) days of receiving the Landscaping Report. If Elam chooses not to replace any dead Replaced Trees, then Pitkin may replace them using the Deposit to cover any costs incurred for such replacement. Any Deposit remaining after the dead Replaced Trees are replaced, shall be released by Pitkin to Elam. VAGNEUR GRAVEL PIT 2015 ANNUAL REPORT Pitkin County, Colorado January 27, 2016 INTRODUCTION — On August 12, 2009 the Pitkin County Commissioners granted Elam Construction, Inc. a 20 -year extension to the permit allowing continued operation at the Vagneur Gravel Pit, with the approval of Resolution No. 052-2009. One of the conditions contained within the operational permit requires the filing of a written report with the County demonstrating compliance with the conditions of the permit and the County Land Use Code. The report is required to contain an estimate of gravel reserves remaining on the site and an inventory of petroleum products contained on site. In 2012, Elam requested a Minor Amendment to the Phase 2 mining plan for alternate mining methods. In addition to the originally approved mining method of utilizing one (1) Caterpillar D9N Dozer and one (1) Caterpillar 966 loader, Elam requested the use of one (1) Caterpillar 345B Track Hoe and three (3) Volvo A30 rock trucks to haul the mined material to the processing area in Phase 1. Elam was granted this amendment by BOCC Resolution No. 036-2012. In 2015, Elam's 2014 Annual Review Report was accepted and entered the 2015 year under Resolution No. 038-2015 in order to satisfy conditions of the approved Phase 2 expansion area in Resolution No. 052-2009. The condition relayed that a revised landscape plan and planting of evergreen and other screening type vegetation shall be implemented. Major activities, which occurred during 2015 within the existing permitted site include: • Extraction of gravel deposits. Mining occurred during the months of May through November. • Crushing and processing of gravel deposits. Crushing of material occurred during the months of May through November. • Stockpiling of extracted and processed gravel. • Intermittent operation of an asphalt plant. • Operation of a concrete batch plant. • Scale and office facilities. • Re -cycling of asphalt rubble. • Acceptance of snow • Development of landscaping plan and planting of trees in northeast corner of property RECLAMATION — Backfilling and sloping efforts began during the summer of 2000 and continue as of this date. Approximately 18 acres in the northerly most portion of the pit are being backfilled and sloped in accordance with the approved reclamation plan. Seeding and Reclamation efforts continued regularly thorough out 2015 with the pipe line that was installed by Source Gas Distribution LLC/Rocky Mountain Natural Gas LLC and the reclamation in the northwestern comer of the property. PID #2643-161-02-010 000017 FUEL STORAGE AREAS — Two primary fuel storage areas are currently located on the site. The first is a 1,200 square foot area adjacent to the main office. Elam Construction anticipates on the removal of these tanks in spring of 2016. The unnecessary tanks will be relocated to facilities that are in need of such resources. Another fuel storage area is near the concrete batch plant that has been designated as a fuel storage facility. An asphalt oil tank is located adjacent to the asphalt plant. Also a diesel fuel tank is located near the portable gravel -crushing unit when on site. All fuel is stored in aboveground tanks and has secondary containment either by constructed metal containment or by lined containment dikes to prevent any discharges of fuel from leaving the site or percolating into the ground. An engineered Spill Prevention, Control and Counter Measure Plan (SPCC) has been developed for this site. A key element of the SPCC plan includes annual training for workers at the facility for spill containment and controls in the event that a spill should occur. Most notable are the surrounding communities' future gravel, asphalt and concrete needs. Other factors include: ❑ Local, State, and Federal Economic Trends ❑ Future Local Growth Trends ❑ Major Public Improvement Projects — Highway & Roads Rail and Airport Major School Major Govemmental Building ❑ Major Commercial Buildings One method in determining the life of an operation is to evaluate the past demand for gravel PID #2643-161-02-010 000018 resources. By using the last five years of production at the Vagneur Gravel Pit in conjunction with the remaining resource, it is forecasted that the gravel within the Phase 1 area was nearly depleted in 2009. The Phase 2 mining expansion area, which was granted in Resolution 052-2009, will provide an additional 20 years of resource beyond 2009, depending on local economy. It should be pointed out that forecasts are based on current and past information. Inherent with any forecast is a degree of uncertainty. STATE MINING AND RECLAMATION PERMIT — Elam maintains a reclamation and mining permit issued by the State Division of Reclamation, Mining and Safety. WOODY CREEK CAUCUS — Representatives from Elam met with members of the Woody Creek Caucus and Planning Commission as needed during 2015. Elam will continue to meet with the Caucus and address concerns regarding pit operations in 2016. NOISE MONITORING — Elam is required to conduct noise monitoring as stated in Condition 5D of BOCC Resolution 052-2009. The County approved Sound Level Monitoring Protocol states the following for frequency of monitoring: Frequency of monitoring: o initial startup or major adjustments to equipment and/or operations — monitoring shall occur on a weekly basis for four (4) consecutive weeks. o Normal operations (beyond initial startup or adjustments) — monitoring shall occur on a monthly basis. o Sound level monitoring is not required during months of non -operation (winter) Since the approval and implementation of the amended mining process in 2012, Elam has made immense strides in collecting readings for noise monitoring by stepping up the testing frequency. Due to concerns of increased noise levels at the Braun residence, noise monitoring occurred on a daily basis at monitoring points 8, 9, and 10, when staff was available (see Figure 1, Appendix A for Vagneur Pit Sound Level Monitoring Locations). These three points were selected due to their close proximity to the Braun Residence. Weekly readings occurred at all 11 monitoring locations when staff was available on site, shown on the map. Elam has continued with this increased monitoring program in 2015 during times of mining and crushing activities. Elam has extensive data to support overall compliance with County Mandated noise levels. Section 6.36.040 of the Land Use Code requires the decibel level at the property line adjacent to residential areas to be a maximum 55 dB(A) during daytime hours and 50 dB(A) during nighttime hours. Figure 2, Appendix A demonstrates the average noise level for each of the 11 location points on a monthly basis. During the 2015 season Source Gas Distribution LLC installed a gas pipeline on the western boundary of the Elam property. Most notable in the sound level chart are some spikes in the monthly readings which are reflected at points 1-6 in Figure 2. This spike in the noise readings are attributed by construction and installation of the pipeline, more specifically the equipment and operating machinery located on the western boundary of the property. Likewise, Woody Creek typically has amplified readings during periods of high run-off as noted in Figure 2 at points 7, 8, and 9. As mentioned above, monitoring points 8, 9, and 10 were collected on a daily basis during times of mining and crushing. Figures 3, 4, and 5, in Appendix A show a daily summary of noise PID #2643-161-02-010 3 000019 monitoring results for these three points for the entire season from May 20, 2015 through November 25. COMPLAINTS — Elam did not receive or was not aware of any formal complaints during the 2015 season. WEED MANAGEMENT — Elam continued implementing the approved weed management through 2015. The site was monitored, and herbicide applied to weeds identified in the Weed Management Plan three times during 2015 (May, August, and October). Elam contracts with a private applicator that is certified through the State of Colorado. See Appendix E. WATER RESOURCE PROTECTION — As part of Elam's Water Resource Protection Plan, Elam has developed and implemented soil and water sampling/testing protocol to assure the protection of groundwater. Elam continued the sampling and testing of soil and water throughout the 2015 season. A summary sheet for both soil and water along with the laboratory data sheets are provided in Appendix B. SUPPLEMENTAL INFORMATION — There were several conditions included within Resolution 038-2015 that required action through the 2015 season and/or to be included in this annual report. These conditions are summarized below: Condition 3 On or around May 30, 2015, a landscape plan will be presented by Elam to be reviewed by the "Braun's" and Pitkin County. The final details of the landscaping plan and the timeframe will be agreed upon by the affected parties on or before June 30, 2015 or the affect parties will bring the matter back to the BOCC. This landscape plan will be developed and oversight administered by Kim Bock, Certified Arborist, Prima Plant Service. Elam and the Braun's acknowledge Kim Bock as a reputable expert arborist and agree to consider her recommendations for the landscape plan. The plan shall contain the following, and be installed in accordance with the schedule recommended by Kim Bock. a. A planting plan of evergreen or other screening type vegetation in the bottomlands or wetlands area directly adjacent to the Braun property will be agreed upon; b. Dead or dying trees will be removed for wildfire safety concerns to the extent recommended to also allow for the continuance of reasonable level wildlife habitat; c. Kim Bock shall be hired to provide contractor oversight and continued monitoring of planting establishment on a frequency required to ensure successful establishment. d. A planting plan along the north side of the mining area directly in front of the Braun property, generally along the access road at the base of the future mining area, shall be agreed upon. This planting plan shall include trees that are of the estimated height of maturity of the trees that were to be planted per the 2009 and revised 2013 Elam landscape plan approved by Pitkin County. If the trees of that size are not feasible, or could not survive, given the professional estimation of the landscape professionals, then an alternative plan shall be presented which would include, but not limited to, an additional amount of trees or a combination of additional trees and other mitigation techniques. PiD 92643-161-02-010 000020 Elam representatives, the Braun's, Kim Bock, and Pitkin County representatives met several times throughout the duration of 2015. A landscaping plan was finally agreed upon by all parties as seen in Appendix C after meticulously sorting out what type of species, location, and number by recommendation by Kim Bock, Certified Arborist (Prima Plant Service). The trees were planted during the week starting on July 20, 2015. On July 281^, 2015 the plantings were surveyed for location, description and height and caliber readings as reflected in the landscaping plan. A summary of the site inspection was documented by Kim Bock on June 8th 2015 it was determined that approximately 26 trees have died or were needing replacement with alternative vegetation. Along with an additional planting of 16 "New" trees. Therefore, a total of 86 trees exist on site and continual monitoring of the plantings will be implemented as part of operation per a memorandum with Pitkin County. Condition 4 For the duration of the 2015 mining season, no mining shall be allowed beyond the surveyed 1,000' distance from the Braun residence. It is also acknowledged that mining has already occurred beyond the 1, 000' distance from the Braun residence as depicted in Attachment B. For the duration of the 2015 mining season Elam limited its excavation to mining phase 2.1 as identified in Appendix D of the 2015 Mining Plan Map. Condition 5 The Applicant shall continue to implement the thistle elimination As mentioned above, Elam contracted with a certified herbicide applicator to monitor weeds and apply required herbicide to noxious weeds. Applications were made on May 15, Julyl3 and September 28, 2015, see attached Pesticide Application Records. Condition 7 In accordance with the Environmental Health regulations, the leaking 3rd septic tank servicing the trailer park for seasonal workers shall be addressed prior to workers arriving for the 2015 mining season. Elam removed the tank in question in April 2015 prior to the 2015 mining season. CBO Inc. Appendix E is a synopsis of the events that occurred for the removal of the 3`d septic tank. CONCLUSION — During 2015, Elam Construction, Inc. paved and provided materials for several construction projects that took place in Pitkin County. Elam continues to work hard to provide a quality service to Pitkin County and its residents while limiting the disturbance to neighboring Woody Creek residents. Elam continues to make efforts to remain in compliance with the conditions of the Conditional Use Permit issued by Pitkin County in order to maintain the best interest of the public health and safety. The OWTS serving the RV Camp (Permit 98036) consists of a 2000 -gallon, single compartment septic tank, a 1000 -gallon, single compartment septic tank, and the previously existing 1250 -gallon, two compartment septic tank. The third tank in the series (1250 -gallon tank) had excessive amount debris (concrete, rocks, and dirt) in the tank. At the time of the annual inspection in 2014, it appeared that this tank may be leaking. A decision was made to abandon this septic tank. All septic tanks were pumped by B&R Septic prior to the tank abandonment. The effluent filter was moved from the third septic tank to the outlet of the second septic tank in the series. There is some debris on the bottom of the second septic tank. The third septic tank was abandoned by filling the void with "natural fines" from the pit. Mountain Works abandoned the septic tank. A copy of this letter must be provided to Pitkin County Environmental Health Department to verify abandonment of the septic tank.
