Vos Caudill, Pitkin County, CO ADMINISTRATIVE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF PI'TKIN COUNTY, COLORADO, APPROVING THE CB REAL ESTATE HOLDINGS, LLC MINOR AMENDMENT TO SITE PLAN Administrative Decision No;39-2016 RECITALS 1. CB Real Estate Holdings, LLC ("Applicant") has applied to the Community Development Director of Pitkin County, Colorado ("Director") to amend the approved Site Plan and Activity Envelope to construct a privacy fence around the lot and to install landscaping in the northwest comer of the lot. 2. The property is located at 979 Red Mountain Road, and is described as Lot 2, Randall Subdivision. 3. The lot contains 42,637 square feet and is a conforming size lot in the R-30 zone district. 4. The BOCC approved the Randall Subdivision in 1972; the plat was recorded in Plat Book 4 at Page 256 and an amended plat was recorded in Plat Book 37 at Page 40. 5. The Community Development Director approved the Activity Envelope and Site Plan Review for the lot, pursuant to Administrative Decision No. 2-2012. The Activity Envelope and Site Plan is recorded in Plat Book 99 at Page 61. 6. The Director finds that the proposed amendments comply with the applicable provisions of the Land Use Code, and will not change the use of the proposed development or the basic character of the land, are consistent with action taken during the original review, do not increase off-site impacts or the allowable floor area, and will not endanger the public health, safety or welfare. 7. The Director further finds that the property is not within active or field -verified bighorn sheep, elk or mule deer habitat areas, and, therefore, that it is appropriate to eliminate any restrictions on construction of a wooden fence. 8. The Director further finds that the fence will be partially screened from Red Mountain Road by existing trees and shrubs. The wooden fence boards will be stained in a dark, earth tone. 9. The Director further finds that the fence will be set back on the driveway to allow a vehicle entering the property to be clear of Red Mountain Road. The fence will not obscure the downvalley sight line for vehicles turning onto Red Mountain Road off of Wright's Road, will not shade the surface of Wright's Road, and will leave adequate area for snow stacking. 10. The Director further finds that it is appropriate to amend the Site Plan to allow additional landscaping in the northwest corner of the lot, as this area was included in the previously approved Landscape Envelope and was disturbed during development of the lot, but landscaping was not shown on the Site Adminisirarrve Decision No. _-2016 Page 2 Plan for revegetation of this area. The slopes in this area exceed 45%, but the proposed landscaping will stabilize the slope and does not include any re -grading of this area. THE DIRECTOR DOES HEREBY APPROVE the CB Real Estate Holdings, LLC Minor Amendment, subject to the following conditions, which shall run with the land and be binding on all successors in interest: All conditions of Administrative Decision No. 2-2012 shall remain in full force and effect, except as amended herein. 2. Prior to submission of any development permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development an amended Site Plan in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation of them. The amended Site Plan shall depict the additional landscaping and the privacy fence. 3. Condition #12.H.] of Administrative Decision No. 2-2012 is hereby eliminated. Condition #12.H.2 and 12.H.3 shall remain in full force and effect. 4. The wooden privacy fence shall be less than 6' in height. 5. The additional landscaping in the northwest comer shall comply with the defensible space standards in Condition #10.A of Administrative Decision No. 2-2012, particularly the requirement to prune the limbs on the lower one-third of the trees. 6. This land use application (the "Application") is submitted on behalf of CB Real Estate Holdings, LLC, a Colorado limited liability company (the "Applicant'). This Application requests approvals for a Minor Amendment to Administrative Determination No. 02-2012 with respect to: (1) certain fencing restrictions applicable to the Subject Property which are provided for therein in order to accommodate the Applicant's desire to install a privacy and security fence on the Subject Property; and (2) with respect to Applicant's desire to provide for the installation of certain landscaping and related irrigation equipment in the Subject Property's northwestern corner. Attached to this Application as Exhibit A is a written consent of the Applicant authorizing attorney Curtis B. Sanders, Esq., Sherman & Howard L.L.C., 730 East Durant Avenue, Second Floor, Aspen, Colorado 81611 to act as Applicant's representative with respect to the Application. The Applicant is the owner of an improved property located at 979 Red Mountain Road, Aspen, Colorado 81611, and legally described as Lot 2, Randall Subdivision, according to the plat thereof recorded June 16, 1972 in Plat Book 4 at Page 256 and First Amended Plat of Randall Subdivision recorded May 30, 1995 in Plat Book 37 at Page 40 (the "Subject Property"). Attached to this Application as Exhibit B is written proof of the Applicant's ownership of the Subject Property. LAND USE APPLICATION FOR MINOR AMENDMENT TO ADMINISTRATIVE DETERMINATION 979 Red Mountain Road, Aspen, Colorado 81611, Lot 2, Randall Subdivision, Pitkin County, Colorado Parcel ID 2737-063-07-001 000003"s RE/5892277.1 Pitkin County has assigned the Subject Property a parcel identification number of 2737- 063-07-001. The Subject Property is zoned R-30 and is situated within the City of Aspen's designated Urban Growth Property ("UGB"). The Subject Property is part of the two -lot Randall Subdivision, which is located on the inside of the narrow intersection of Red Mountain Road and Wright's Road. Attached to this Application as Exhibit C is a vicinity map depicting the general location of the Subject Property in relation to surrounding properties in its immediate vicinity. Attached to this Application as Exhibit D is the Pitkin County Pre -Application Conference Summary prepared by Pitkin County Assistant Community Development Director Lance Clarke on November 23, 2015. Also attached to this Application as Exhibit E is the Applicant's executed Agreement for Payment of Land Use Application Fees. Exhibit F attached hereto sets forth copies of the documents comprising the existing land use approvals in connection with the Subject Property. Exhibit G is a depiction of the proposed location of a privacy and security fence which the Applicant desires to construct on the Subject Property. Exhibit H is a depiction of the proposed landscaping plan with respect to Applicant's proposed installation of certain landscaping and related irrigation equipment in the northwestern corner of the Subject Property. This Application is submitted pursuant to the following Section of the Pitkin County Land Use Code (the "Code"): Sec. 2-20-150 (Minor Plat Amendment). This Section I of this Application provides a brief introduction and summary of the Application, while Section II sets forth an overview of the surrounding neighborhood and the Subject Property's existing conditions. Section III describes the Applicant's proposed development, and Section IV identifies the relevant review criteria of the Code and provides responses demonstrating the Applicant's compliance and/or consistency with each standard, as applicable. All of the supporting documents which accompany this Application include the following: Exhibit A: Consent from Owner to Process Application and Authorizing Representative. Exhibit B: Proof of Ownership of Subject Property. Exhibit C: Vicinity Map. Exhibit D: Pitkin County Pre -Application Conference Summary. While the Applicant has attempted to address all relevant provisions of the Code and provide sufficient information to enable a complete evaluation of the Application, questions may arise which require further information and/or clarification. Upon request, Sherman & Howard L.L.C. will provide such additional information as may be required in the course of Pitkin County's review of the Application. II. EXISTING CONDITIONS. As noted above, the Subject Property is Lot 2, Randall Subdivision, according to the plat thereof recorded June 16, 1972 in Plat Book 4 at Page 256 and LAND USE APPLICATION FOR MINOR AMENDMENT TO ADMINISTRATIVE DETERMINATION 979 Red Mountain Road, Aspen, Colorado 81611, Lot 2, Randall Subdivision, Pitkin County, Colorado Parcel ID 2737-063-07-001 BU5_RF/5892277.1 000004 First Amended Plat of Randall Subdivision recorded May 30, 1995 in Plat Book 37 at Page 40. The Randall Subdivision was approved by the Pitkin County Board of County Commissioners as a two -lot subdivision on May 22, 1972. In 2012, 979 Aspen LLC, as the then -owner of the Property, obtained Activity Envelope Approval, Site Plan Review Approval, and GMQS Exemption Approval as provided for in Pitkin County Administrative Decision No. 2-2012, together with the Resolution of the Pitkin County Colorado Board of Adjustment Granting a one For Height Variance for Lot 2, Randall Subdivision, Resolution No. 04-2012 recorded March 13, 2012 as Reception No. 587391 with respect to certain retaining walls on the Subject Property (the "2012 Approvals"), and pursuant to the 2012 Approvals, 979 Aspen LLC provided for the recording of the 979 Red Mountain Road Activity Envelope & Site Plan on March 29, 2013, in Plat Book 99 at Page 61, Reception No. 587830, Pitkin County, Colorado (the "2012 Site Plan"). Pursuant to the 2012 Approvals and the 2012 Site Plan, an existing single-family residence has been constructed on the Property. The Applicant's principal has occupied the residence since 2014, and in connection with such occupancy, the Applicant's principal has become concerned with the extent to which large areas of the Property are visible to automobile traffic, and in particular, automobile traffic on Wright's Road, which is located on the steep hillside above the residence, on the Subject Property's northern boundary. The visibility of the Subject Property from adjacent public roads has caused the Applicant's principal to become concerned with her privacy and security, and as a result, the Applicant desires to construct a wooden privacy and security fence, and gate in the vicinity of the Subject Property's boundaries. With respect to existing fencing restrictions provided for in the 2012 Approvals, there are no active, field -verified bighorn sheep, elk or mule deer winter range, severe winter range, winter concentration areas, migration corridors or production areas adjacent to the Subject Property, and the Subject Property is not located within any such mapped areas. Therefore, while the 2012 Approvals reflect the general standards of Sections 7-20-70(c)(3), (4), and (5) of the Land Use Code regarding fencing, the 2012 Approvals and the 2012 Site Plan do not otherwise specifically restrict the construction of a privacy and security fence on the Subject Property in connection with wildlife concerns. With respect to the installation of fencing on the Subject Property, the 2012 Approvals provide as follows: "12. The Applicant shall comply with the following conditions regarding wildlife:.. . H. Fencing shall comply with the following, except for fencing immediately adjacent to the buildings to contain pets or livestock: 1) Wood fencing shall employ three rails or less, be the round or split rail type, shall not exceed 48 inches in height above ground level and 12 inches in width (top view), and shall have at least 18 inches between two of the rails. LAND USE APPLICATION FOR MINOR AMENDMENT TO ADMINISTRATIVE DETERMINATION 979 Red Mountain Road, Aspen, Colorado 81611, Lot 2, Randall Subdivision, Pitkin County, Colorado Parcel ID 2737-063-07-001 4 BUS-RE/5892277.1 000005 2) Wire fencing shall consist of no more than 3 strands of smooth wire and shall not exceed 42 inches in height. 3) Mesh or woven wire fences are prohibited; except when used for protection around isolated trees or clumps of trees." Based upon the foregoing, under the 2012 Approvals, the Applicant may construct wooden fencing on the Subject Property in areas which are both within and without the Subject Property's setbacks, provided that if such fencing is made of wood, it may mot be attached to structures on the Subject Property, it must be round or split -rail -type fencing, and such fencing is subject to a height limitation and a limitation upon the width of the top of the fence. Additionally, Note 9 of the 2012 Site Plan states "Entire Property is Landscape Envelope per Site/Landscape Plan (sheet 2 hereon, as may be limited by setback requirements". Nonetheless, presumably because the Subject Property's northwestern corner contains slopes in excess of 45% grade, such area is not included in the Subject Property's designated Activity Envelope. Furthermore, the landscaping plan set forth on page 2 of the 2012 Site Plat does not depict the installation of landscaping in the Subject Property's northwestern comer. Currently, such area is completely bare of vegetation. In connection with Applicant's principal's occupancy of the residence on the Subject Property, the Applicant's principal has concluded that she desires to provide for landscaping in such area for purposes of re-establishing trees and a native grass understory in this area which were previously removed when the Subject Property was recently developed, and Applicant's principal is committed to do so in a manner which will help stabilize the steep slope in this area of the Subject Property. Therefore, as apparently contemplated by the provisions of Note 9 of the 2012 Site Plan, the Applicant desires to install certain landscaping and vegetation in the only portion of the Subject Property which remains un - landscaped, and to utilize the entire Subject Property as a "Landscape Envelope". III. APPLICANT'S PROPOSAL. As noted above, this Application requests a Minor Amendment to the 2012 Approvals with respect to the construction of a wooden privacy and security fence, and gate on the Subject Property, and for the installation of certain vegetation in the Subject Property's northwestern comer. In particular, the Applicant desires to install a wooden fence in the location depicted on Exhibit G, "Fence Layout' attached hereto and made a part hereof. As depicted on the Fence Layout, in the vicinity of Red Mountain Road, along the Subject Property's southeasterly boundary, the fence will be placed behind existing shrubs and other vegetation which would screen portions of the fence from Red Mountain Road. In the vicinity of Wright's Road, along the Subject Property's northerly boundary, while the fence will be in proximity to Wright's Road, given the steep grade of the hillside on the Subject Property below Wright's Road, the fence will not obscure the southerly views from Wright's Road, except with respect to views looking down to the Subject Property from Wright's Road. Additionally, the fence will be located a sufficient from Wright's Road in order to avoid snow -stacking and shading of the LAND USE APPLICATION FOR MINOR AMENDMENT TO ADMINISTRATIVE DETERMINATION 979 Red Mountain Road, Aspen, Colorado 81611, Lot 2, Randall Subdivision, Pitkin County, Colorado Parcel ID 2737-063-07-001 BUS_RE/5892277.1 000006 roadway surface on the southerly (downhill) shoulder of Wright's Road. Finally, with respect to the Subject Property's westerly boundary (the common boundary with Lot 1, Randall Subdivision), the fence will be installed among existing mature trees, and will help screen the Subject Property from the driveway to Lot 1 Randall Subdivision, as depicted and provide for on the recorded "951 Red Mountain Road Activity Envelop and Site Plan for the Lot 1, Randall Subdivision Property", which provides for a driveway on Lot 1, Randall Subdivision which is situated within close proximity (i.e., within 5 —10 feet in certain locations) to the common boundary with the Subject Property. As also depicted on the Fence Layout, the proposed fence will be constructed entirely within the Subject Property's existing Activity Envelope, will consist of wooden fence boards stained in a dark, earth tone, which fence boards are 5 1/2" and 3 1/2" tall, with 1/2" of separation between the fence boards. The fence boards will be approximately 6' long, and mounted on steel posts which will be 6' apart. The fence will be slightly less than 6' in height. The small amount of separation between the fence boards is necessary both with respect to the privacy purpose of the fence, and also to prevent the fence from being climbed. On a related note, the a will not have a top cap, also in order to prevent the fence from being climbed. Based upon Applicant's principal's privacy and security concerns, and the fact that the Subject Property is not located within any mapped wildlife areas, the Applicant requests an amendment to Section 12.1-1 of the Existing Approvals to eliminate any restrictions upon the construction of a wooden fence on the Subject Property. Further, Applicant's principal desires to install certain landscaping and vegetation in the northwestern corner of the Subject Property as more fully depicted on Exhibit H, "Landscapine Plan" attached hereto and made a part hereof. Therefore, the Applicant further requests an amendment to the Existing Approvals to amend the Subject Property's existing Activity Envelope in order to provide for the installation of certain landscaping and vegetation in the Subject Property's northwestern corner as depicted on Exhibit H, "Landscapin2 Plan. IV. REVIEW REQUIREMENTS. The relevant review standards of the Code are addressed in this Section of the application and in the following order: A. Amendments to Development Applications and Permits (Sec. 2-320-150)(b)). A. Amendments to Development Applications and Permits (Sec. 2-320- 150)(b)l. The Applicant is seeking a Minor Amendment to the Existing Approvals for the construction of a wooden privacy and security fence, and gate on the Subject Property, and the installation of certain landscaping and vegetation in the Subject Property's northwestern comer. Section 2-20-150(b) of the Land Use Code provides the following criteria for the approval of a Minor Amendment to development applications: "(b) Minor Amendments Defined LAND USE APPLICATION FOR MINOR AMENDMENT TO ADMINISTRATIVE DETERMINATION 979 Red Mountain Road, Aspen, Colorado 81611, Lot 2, Randall Subdivision, Pitkin County, Colorado Parcel ID 2737-063-07-001 BUS-RE/5892277.1 000001 A minor amendment to any development application or permit is one that meets the following criteria, as determined by the Community Development Director: (1) Is consistent with actions) taken during previous development approvals for the property; and (2) Does not change the use of the proposed development between residential, commercial and tourist accommodation uses; and (3) Does not change the basic character of the approved use of land on which the activity occurs, including basic visual appearance and method of operation; and (4) Does not constitute a new land development activity, and (5) Does not increase off-site impacts in the surrounding neighborhood, and (6) Does not endanger the public health, safety or welfare; and (7) Does not violate any Land Use Code standard, and (8) Does not substantially increase the need for on-site parking or utilities, or affect affordable housing generation; and (9) Does not increase the floor area of the use by more than five (S) percent or decrease the open space on the site by more than five (5) percent." Applicant responds to each of the criteria specified in Section 2-20-150(b) of the Land Use Code as follows: Standard: "A minor amendment to any development application or permit is one that ... (1) [1Js consistent with action(s) taken during previous development approvals for the property; " Applicant's Response: Applicant's proposed installation of a privacy and security fence, and gate on the Subject Property, and installation of certain landscaping and related irrigation equipment in the Subject Property's northwestern corner are consistent with action(s) taken during previous development approvals for the Subject Property in that Applicant's proposed privacy and security fence, and gate on the Subject Property will not constitute "Development" as such term is defined by the LUC, and will be constructed entirely within the Subject Property's existing Activity Envelope. Although Applicant's privacy and security fence, and gate do not comply with the provisions of Section 12.H.1 of the Land Use Approvals, one of the purposes of this Application is to amend or delete such provision of the Land Use Approvals regarding the required configuration of wooden fences on the Subject Property. LAND USE APPLICATION FOR MINOR AMENDMENT TO ADMINISTRATIVE DETERMINATION 979 Red Mountain Road, Aspen, Colorado 81611, Lot 2, Randall Subdivision, Pitkin County, Colorado Parcel ID 2737-063-07-001 000001 US_RE/5892277.1 With respect to Applicant's proposed installation of certain landscaping and related irrigation equipment in the Subject Property's northwestern comer, as previously noted elsewhere herein, Note 9 of the 2012 Site Plan appears to have contemplated that the entirety of the Subject Property would be treated as a "Landscape Envelope ". Therefore, while the Applicant desires to amend the 2012 Site Plan to expressly provide for Applicant's installation of landscaping and related irrigation equipment in the Subject Property's northwestern comer, Applicant believes that the provisions of Note 9 of the 2012 Site Plan, coupled with Applicant's assurance of performing such work in a manner which will help stabilize the steep hillside in this portion of the Subject Property, is consistent with "action(s) taken during previous development approvals for the property. " Standard: "A minor amendment to any development application or permit is one that... (2) Does not change the use of the proposed development between residential, commercial and tourist accommodation uses; and Aoolicant's Resoonse: Applicant's proposed installation of a privacy and security fence, and gate on the Subject Property, and installation of certain landscaping and related irrigation equipment in the Subject Property's northwestern corner will not result in a change in the use of the Subject Property between residential, commercial or tourist accommodation uses, and in connection with such matters, that Applicant will continue to utilize the Subject Property solely for residential uses. Standard: "A minor amendment to any development application or permit is one that. . . (3) Does not change the basic character of the approved use of land on which the activity occurs, including basic visual appearance and method of operation; and Aoolicant's Response: Applicant submits that the "basic character" of the Subject Property is as a residential property, including a residential structure and related amenities, and certain landscaping and landforms, all as contemplated by, and provided for, in the 2012 Approvals and the 2012 Site Plan. Applicant's proposed installation of a privacy and security fence, and gate on the Subject Property is directly related to Applicant's utilization of the Subject Property in connection with its "basic character", to wit, as a private residence which affords Applicant's principal with privacy and security. Applicant's proposed Applicant's proposed privacy and security fence, and gate have been designed in a manner to minimize their visual impacts upon surrounding properties, and the safe usage of Wright's Road and Red Mountain Road by automobiles, while at the same time, incorporating certain design features which prevent persons from climbing the fence and which limit views into the residence on the Subject Property from surrounding areas. Applicant's proposed installation of certain landscaping and related irrigation equipment in the Subject Property's northwestern corner is intended to complete and complement the Subject Property's existing landscaping, including the landscaping that was previously installed pursuant to Sheet 2 of the 2012 Site Plan. It is Applicant's assumption that this portion of the Subject Property was not included within the depiction of landscaping shown on the 2012 Site LAND USE APPLICATION FOR MINOR AMENDMENT TO ADMINISTRATIVE DETERMINATION 979 Red Mountain Road, Aspen, Colorado 81611, Lot 2, Randall Subdivision, Pitkin County, Colorado Parcel ID 2737-063-07-001 8 RFJ5892277.1 v 0 O O 0 1US_ Plan due to the existence of steep slopes, but Applicant nonetheless believes that with the property plant species, such area can and should be landscaped both for aesthetic purposes, but also for purposes of stabilization of the hillside and the area lying immediately below Wright's Road. Standard: "A minor amendment to any development application or permit is one that. . . The turning radii at the entrance to Red Mountain Road shall be 29 feet on each side of the driveway and any culvert areas beneath the driveway entrance shall have the capacity to support 54,000 pounds on two axles. Stamped engineered drawings demonstrating compliance with the applicable standards shall be submitted with the permit application. D. Complete a £replace/woodstove registration form with the Community Development Department, if necessary. E. Pay the applicable road and employee housing impact fees. F. Submit a tree mitigation plan and a landscape plan. O. Submit a detailed revegetation plan for disturbed areas with appropriate seed mixes. The plan shall specifically address the revegetation of steep slopes. H. Submit a lighting plan. 5. Following construction and prior to issuance of a Certificate of Occupancy for the residence, the Applicant shall submit a letter from a wildfire expert approving the as-built/installed wildfire mitigation. 6. Areas disturbed by construction shall be re -vegetated within one growing season of the project's completion. 7. Approval of an activity envelope within such setbacks does not assure approval of a variance. 8. The Applicant shall comply with all standards for development within Scenic View Protection Areas as represented in the application and approved in this Decision. The exterior of the residence shall utilize indigenous earth tone materials or colors and the roofs shall have a non -reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflectivity, with the exception of materials associated with solar or photovoltaic equipment. Driveway lighting is prohibited and all other lighting shall comply with the lighting code. 9. Retaining walls shall be faced with stone or earth -colored materials similar to the surrounding natural landscape. Retaining walls greater than 4 feet in height shall be supported by appropriate engineering. A retaining wall shall not exceed 7 feet in height. Terracing shall be limited to 2 tiers. The width of the terrace between any two 4 foot high vertical retaining walls shall be at least 3 feet. If the retaining walls are higher than 4 feet, then the width of the terrace between the retaining walls shall be at least 5 feet. Terraces created between retaining walls shall be permanently landscaped or revegetated with native vegetation. 10. The Applicant shall comply with the following standards for Development in a Severe Wildfire Hazard Area: A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): 1) For a distance of 15 feet around the proposed residence and beyond the further most projection of combustible construction, the area shall be of primarily noncombustible hardscape surfaces, low growing perennials, flowerbeds, cut grass and deciduous, well -trimmed and irrigated plants. Woody vegetation shall not be planted within this area. The owner may retain trees near the residence, if the 15 foot perimeter is extended outward from the furthest growth expected from the mature tme(s). 2) Beyond the 15 foot perimeter and up to 45 feet around the proposed residence (or to the property line where less than 45 feet), maintain natural and/or irrigated grass at less than 6 inches and thin existing trees and brush into individuals or clusters. Oak and serviceberry should be thinned and clustered. Limbs of trees in this area shall be pruned to one-half the height of the tree, one-third the height of the tree for any conifer, or 10 feet above ground, whichever is less. No brush or shrubs which when mature will be tall enough to act as ladder fuel shall be maintained within this area. Clusters of bushes or shrubs should be separated from each other and from those beyond the 45 foot perimeter by a distance of 2 '/z times the height of the mature vegetation. The diameter of a cluster should be limited to 2 '/a times the height of the mature vegetation. As an example: If the expected mature height of the vegetation is 10 feet, then the diameter of the cluster should be no greater than 25 feet and the distance between clusters should be greater than 25 feet. Most of the shrubs that will be out are vigorous sprouting plants. With the approval of Pitkin County and the property owner, the cut ends may be treated with a product named Garlon or an equivalent by a person licensed to apply herbicides so as to prevent regeneration. Cut material shall be either removed or chipped and spread. 4) Remove or chip all standing dead and deadfall on the property. The area below Wrights Road has a considerable amount of standing dead and deadfall and the removal of this coupled with the thinning of live growth should provide for healthier growth and better slope stability. 5) The applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Roofing Materials: Class A covering or Class A assembly as defined by the currently adopted Building Code. No wood shakes or shingles. All other adopted Building Code compliant methods and materials permitted. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: 1) All roof coverings shall be constructed of non-combustible materials and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing roof debris. 3) Protrusions above the roofline, such as parapets, shall be prohibited, unless specifically approved by the Fire Marshal. 4) Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of 1:48. 5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. C. Roof Venting: I) Soffit venting shall be located in the outer 1/3rd portion of the overhang. 2) Attic, soffit and other roof venting shall be of non -corrosive metal mesh with maximum ''/." openings. D. Projections at the Roofline, including Soffits, Rafters, Porch or Deck Roofs, Fascias, or Other: One hour rated material or any material underlain by 5/8" Type X gypboard or equal, or "Type IV" Heavy Timber materials, per the currently adopted building code. Projections shall be constructed so that they do not trap, hold or retain leaves or debris that may be ignited by burning brands carried by air currents from any fire in the area. E. Railings: Railings must be constructed of noncombustible or "Type IV" Heavy Timber materials. G. Exterior of the Structure, Including All Walls: 1) One (1) hour fire resistive rated materials from ground level to roofline, or 2) 5/8" gypboard underlying combustible materials, or 3) Cement stucco, minimum'/." thickness. 4) Glazed openings shall be provided with closing, solid, exterior non-flammable shutters or shall be or tempered glass; and 5) Doors to be tempered glass, metal, or wood P-3/4" thick minimum. H. Foundations: Foundations, skirting, and crawl space openings shall be fully enclosed and constructed with materials approved for one (I ) hour fire -resistive construction on the exterior side of the walls and shall extend from the top of grade to the underside of the floor decking or walls. 1. Maintenance and Miscellaneous Requirements 1) Roofs and gutters shall be kept clear of debris. 2) Any outbuilding shall adhere to the same wildfire requirements. 3) Yards shall be kept clear of all litter, slash and flammable debris. 4) All flammable materials shall be stored on a parallel contour a minimum of fifteen (15) feet away from any structure. 5) Weeds and grasses within a fifteen (15) foot perimeter and under trees, bushes and brush shall be maintained to a height not more than six (6) inches. 6) Firewood/wood piles shall be stacked on a parallel contour a minimum of fifteen (15) feet away from the structure. 7) Non saltwater swimming pools shall be accessible by the local fire district. 8) Fences shall be kept clear of brush and debris. 9) Wood fences shall not connect to other structures. 10) Fuel tanks shall be installed underground with an approved container. 1 1) Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for two (2) hour fire -resistive construction on the exterior side of the walls. 12) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher. 13) Addresses shall be clearly marked with two (2) inch non-combustible letters and shall be visible at the primary point of access from the public or common access road and installed on a non-combustible post. 14) Utilities shall be extended underground. 11. Manipulation of vegetation outside of the activity envelope is prohibited, except as necessary to comply with the wildfire hazard mitigation measures. B. Fruit bearing trees and shrubs shall be prohibited. C. Tmsh/garbage shall be kept in an approved bear resistant container or enclosure as required by the County's Wildlife Protection Ordinance. D. Construction workers shall be prohibited from bringing dogs on-site. E. All outside doors shall utilize only solid round handled door knobs unless another type is required by the applicable building code for disabled accessibility purposes. F. Bird feeders, including hummingbird feeders, shall be hung away from any deck or window, and shall be at least 10' from the ground suspended between 2 trees or posts. All seed feeders shall include a seed catchment pan to catch discarded seeds. Bird feeders should be removed from April through November. G. Composting shell be restricted to yard waste. H. Fencing shall comply with the following, except for fencing immediately adjacent to the buildings to contain pets or livestock: 1) Wood fencing shall employ three rails or less, be the round or split rail type, shall not exceed 48 inches in height above ground level and 12 inches in width (top view), and shall have at least 18 inches between two of the rails. 2) Wire fencing shall consist of no more than 3 strands of smooth wire and shall not exceed 42 inches in height. 3) Mesh or woven wire fences are prohibited, except when used for protection around isolated trees or clumps of trees. 13. No development shall occur outside of the approved activity envelope, with the exception of vegetation removal necessary to comply with the wildfire mitigation measures described above. 14. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the comers of the activity envelope and install construction fencing around the construction site within the perimeter of the envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy. 15. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit. Any structures represented in the application may not be permitted under building and zoning regulations. 16.
