The Contract "For Provision of Services -- Pitkin County Library Expansion Pre-Construction Services"
(the "Agreement") dated October 30, 2013 between the Board of County Commissioners of Pitkin
County(the"County")and FCI Constructors, Inc. (the"Contractor"), is hereby amended as follows:

AMENDMENT#2 TO,P1TK1N COUNTY,LIBRARY EXPANSION
PRE-CONSTRUCTION SERVICES CONTRACT DATED OCTOBER 30, 2013
The above Contract is:Iiereby amended to clarify certain previous.pre-construction services
with more•d'etail, and`to inettideahe'following additional services:
1. Owner has decided to permit and construct the-project in two.phases.i.e.,=Phase 1 being
Garage Work East Addition,and Phase 2 being Interior'Renovations. Based on project
phasing,,FCI shall prepare-a Guaranteed Maximum,Price (GMP) Schedule of Values and
Master Construction Schedule with`Milestone Dates for;the two phases for approval by
Owner.
2. Continue to provide updated:construction cost estimates and schedules of increasing
detail and refinement as'the:designs progress for each'project phase.
• 3. Continue to work with the:Architect.and Project Design Team to provide value
engineering recommendations, and review Architect's drawings and specifications for
completeness,constructability,•Work sequencing and.scheduling.
4. Continue to coordinate with the Architect and Project.Design Team in submitting and
processing the required;Building Permits for the project:phases.
5. Work with Owner and'Owner's Representative to provide.information,as requested by the
Owner's Representative, iri the preparation of the Construction and Operating Agreements
between the Library &City:
6. Continue to coordinate:and communicate with the.City,ofAspen Galena Plaza Project
Team on a coordinatedconstruction plan and schedule between the Library.Expansion
Project and the Galena Plaza.Project.

Preconstruction Services
Request for Additional Preconstruction Services
The scope of preconstruction services on the Pitkin County Library ends with pricing of the
100% Contract Documents and arriving at a GMP , producing a project schedule, and a
schedule of values, more or less. While we have not completed all of our pre-construction
services because we have yet to receive 100% CD drawings, the project has taken more of a
"fast track" approach where portions of the work are released over time to benefit the project.
To date we have released the steel package and the re-roofing of the existing building. We
expect the Addition drawings on Oct. 15, 2014 and the Renovation drawings on or about Jan.
15th, 2015.
In addition, I think everyone on the team would agree that the amount of effort to date on this
project has been greater than anyone would have anticipated.
At the time of contracting Preconstruction Services, including Amendment A, this multiple
package bidding process was not contemplated and neither was the amount of time the project
would be in preconstruction. Preconstruction services were to be completed by Sept. 9th, 2014.
It now looks like the preconstruction services will not be complete until sometime in January of
2015 due to the delay on issuing the documents.
As a result there has been or will be more time spent meeting, soliciting, scheduling, bidding ,
and finally arriving at a GMP on multiple packages. In effect, we are doing the process twice,
not counting the early steel or re-roof. We are requesting additional funds to cover the change
in scope, however, what is most important to FCI is that Pitkin County is very satisfied with the
service we have provided and that they firmly believe that the cost for the services are fair and
reasonable. Accordingly, if you do not agree with the service or cost please advise us
accordingly and we will drop this request.
The Original FCI proposal for Precon services through 50% DD documents was $13,250.
Amendment A added precon services through a GMP for an added $11,250, resulting with a
total of$24,500. Please consider increasing our preconstruction service contract by$11,250,
which is equal to and similar in scope to Amendment 1. Just so you know, we do not make
preconstruction services a profitable task for FCI but we do hope to offset most of the cost. We
are a builder and plan to make our overhead/profit on the building. To date, with only Mike

Davis's time charged to the account, we have spent$31,921.00 on Precon services. This
request will not cover all of the cost for Preconstruction Services but will sure help.
Once again, If Pitkin County does not believe this to be a fair and reasonable request, please
disregard it. Thank you for your time.
