RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO GRANTING APPROVAL FOR
MINOR ADJUSTMENTS TO THE WILDCAT RANCH SUBDIVISION EXEMPTION
FINAL PLAT AND BOCC CONDITIONS, AND GRANTING APPROVAL OF
1041 HAZARD REVIEW

RECITALS:
1. Wildcat Ranch, Ltd. , hereinafter "Applicant" , has applied to
Pitkin County to request several changes to the approved
Subdivision Exemption Plat, 1041 Review Plats, and BOCC Resolution
#90-154 .
2 . The Applicant hac ----2 - tsly received general submission, 1041

Commissioners, pp Dard" , pursuant to Resolution 90-154
on a 6400+ acre a(f2 known as the Wildcat Parcel and more
specifically dE bit 'A' , attached.
3 . The Applic 'specifically includes amendments to
the 1041 Hazard _ . _-.. approval for the Ranch Manager' s parcel more
specifically described in Exhibit 'B' , attached.
4 . On June 16, 1992 , at a regular public meeting, the Planning
and Zoning Commission of Pitkin County, Colorado, hereinafter
"Commission" , on a vote of 5-0, moved to recommend approval of all
aspects of the proposed application, except the condition
modifications to Resolution #90-154 pertaining to a dog
prohibition, which was tabled for further discussion to July 21,
1992 .
5. On July 21, 1992 , at a regular public meeting, the Commission

voted to recommend an amendment to BOCC Resolution 90-154 , allowing
dogs onsite subject to the provisions of proposed Fourth Amendments
to the protective covenants.
6 . The Commission found that the application for lot line
adjustments and condition modifications are minor in nature and are
harmonious with the intent of all earlier approvals and
representations made by the applicant, and are in conformance with
the pertinent provisions of the Land Use Code.
7 . The Commission found that the 1041 hazard review for the
expansion of the Ranch Manager's Parcel was appropriate, subject
to mitigation.
8. The Commission found that the rezoning application is
reasonable and consistent with the policies and provisions of the
Land Use Code.
9 . The Commission found that dogs need not be prohibited from the
property and that wildlife can be adequately protected through
revised covenants as proposed by the applicant, and with a
condition modification allowing for the restricted allowance of
dogs on the site.
10. The Applicants ' requests were considered by the Board at a
duly noticed public hearing on September 15, 1992 , at which time
the Board found that those portions of the application listed below
meet the requirements of the Land Use Code, if the approved
conditions are adhered to by the Applicant.

11. The Applicants' request concerning condition modification to
Resolution 90-154 pertaining to a dog prohibition was continued to
September 29, 1992 , and continued again to October 13 , 1992 , for
final consideration.
NOW, THEREFORE, BE IT RESOLVED that the Commission does hereby
grant approval of the following requests, subject to the listed
conditions of approval:
- Minor adjustments to the Wildcat Ranch Subdivision Exemption
Plat, including Lot Line Adjustments between the Ranch Manager
parcel and lots 8 and 10, respectively; and
- 1041 Hazard Review for the enlargement of the Ranch Manager' s
Parcel;
- Amendment to 1041 Hazard Review approval for envelopes and
recreational easements located adjacent to Wildcat Lake;
- Amendments to conditions of Board Resolution 90-154 and Ranch
Covenants regarding Fire Protection commitments and restrictions.
Conditions of Approval:
1. A 100 wide foot natural buffer shall be provided along each
side of the Wildcat Creek within the ranch center complex
expansion area with the exception of an existing corral
enclosure for horses. The current state of the stream buffer
shall be enhanced/restored through revegetation efforts
utilizing native plant materials. Wildcat' s ecological
consultant shall provide the buffer establishment plans to the
County's consultant for review and approval prior to
recordation of the lot line adjustments and 1041 plat. The
actual implementation of the buffer shall occur prior to the
construction of any new structures or uses within the expanded

ranch center complex area. Maintenance of the stream buffer
shall be incorporated into the wildlife management plans to
be reviewed annually. No domestic livestock shall be allowed
to graze within the stream buffer, with the exception of the
existing horse corral as provided above.
2 . Spill containment structures shall be provided around all
above ground fuel tanks located on the Wildcat Ranch property.
Said containment structures shall be subject to review and
inspection by the Environmental Health Departments prior to
recordation of the lot line adjustments and 1041 plat.
3 . The applicant shall submit revised final plats for the
subdivision exemptions and 1041 Hazard Review approvals,
subject to the standards for plat preparations contained in
the Land Use Code.
4 . The applicant shall submit covenant amendments for review and
approval by the Planning Office and the County Attorney as
represented in the application and amended by these
conditions.
5. The existing recreational development envelope on the
northeast side of Wildcat Lake, and the newly proposed
envelope on the west end of the dam shall be limited to low-
impact recreational uses and amenities. The combined square
footage of restroom and maintenance equipment storage shall
not exceed 500 sq. ft. ; and shall be located in a single
structure. The boat storage facility shall consist of an open
sided shed type structure, not limited in size.
- Rest Room/locker structure;
- Limited boat storage;
- Picnic area with dock; and
- Lake maintenance equipment storage.
Access to the new envelope on the west end of the dam shall
follow the approved alignment to Lot 7 . A total of twelve
parking spaces shall be provided at the recreational
envelopes, to be allocated per envelope at the discretion of
the applicant.
6. Conditions 3 and 7 of BOCC Resolution 90-154 are hereby
amended as follows:
a) Guest houses and employee dwelling units shall be
sprinklered in addition to primary residences;

b) Wildcat shall provide 10, 000 square feet of space at the
northern-most tip of the Ranch Manager' s parcel where the Fire
District will construct a substation at their own expense when
needed;
c) Wildcat shall provide a $60, 000 matching fund donation to
the District for the purpose of purchasing a piece of
fire/rescue equipment.
7 . Automobile access to the picnic and boat landing recreational
easements on Lot 7 shall be prohibited.
8 . All material representations made by the applicant in the
application and public meetings shall be adhered to unless
amended by other conditions contained herein.
