COUNTY,COLORADO,AMENDING ALL PREVIOUS RESOLUTIONS
CONCERNING RATES FOR ACCEPTING EXCAVATION MATERIALS FROM THE
SMUGGLER MOUNTAIN SUPERFUND SITE.
RESOLUTION NO. a 50 -2016
1. WHEREAS, THE Board wishes to protect resident homeowners in the Smuggler Mountain
Superfund Site's ability to redevelop their property without unreasonable fees associated with
the Superfund Site; and
2. WHEREAS, the Colorado Department of Public Health and Environment, Hazardous Waste
and Waste Management Division, has approved the use of Smuggler Mountain Superfund Site
excavated soils for daily cover without prior testing in the "Engineering Design and
Operations Plan Pitkin County Landfill"; and
3. WHEREAS, the Pitkin County Landfill has the authority, through the Board, to set tipping
fees for all materials entering the landfill, including soil;
NOW, THEREFORE, be it resolved by the Board of County Commissioners of Pitkin County,
Colorado that fees for the disposal of excavated soils from the Smuggler Mountain Superfund
Site shall be set in accordance with "Engineering Design and Operations Plan, Pitkin County
Landfill".

S.II Mining and Mill Tailings Wastes
Mining and mill tailings wastes may be disposed of in the landfill on a ease-by-ease basis.with
appropriate testing results and prior approval by CDPIIE. These wastes would not he used as daily
cover and would be covered with a minimum of IS centimeters of soil at the end of each working
day.
5.12 Lead-Contatnlaaled Soils
Lead-contaminated soils from foundation excavation or other similar residential and commercial
development projects within the Smuggler Superfund Site will be accepted at the landfill without
prior testing requirements. This material may also be used for daily cover.
5.13 Fluorescent light Bulbs/Ballasts
Fluorescent light bulbs and ballasts are accepted at the landfill with certain conditions.
Waste acceptance guidelines for individual elements arc provided below.
Fluorescent Light Bulbs will be accepted in quantities less than 25 bulbs at a time without prior
approval or testing. These bulbs are managed as part of the I t• .....Id Hazardous Waste Program.
Pitkin County Solid Waste Center will recommend that generators of larger quantities of fluorescein
bulbs, high intensity discharge (IIID) lamps, or mercury vapor bulbs ship thcir bulbs to an
appropriate recycling(inn. Alternatively,generators of larger quantities of fluorescent bulbs must
characterize their waste to verify that the bulbs are nonhazardous for TCLP mercury and cadmium
prior to acceptance al the landfill.
Ballasts must be segregated by PCB content. The generator must determine whether the ballasts to
be disposed of are PCB-containing or non-PCB-containing ballasts. If the ballasts were
manufactured prior to 1979 and not labeled"non-PCB,"it should be assumed the ballasts(amain
PCBs. If the ballasts were manufactured after 1979 they most likely have a label reading"non-PCB"
and can be managed as solid waste. The generator must provide photocopies of the label indicating
"non-PCB."
