Dear Mike:
Richard and Emily Simeone are the owners of a home at 2049 McLain Flats Road which is the
subject of this land use application requesting approval for the remodeling of the single family
residence on a currently developed lot. The development plan includes a complete exterior and
interior remodel of the existing home, a reduction of the footprint by eliminating the large
exterior entry stairway and a shortening of the driveway to add more lawn and landscaped areas.
Attachment 1 is a vicinity map which depicts the location of the property generally described as
Lot 15, Block 2, White Horse Springs.
This application is divided in to the following sections which address the concerns identified by

EXISTING CONDITIONS
The subject property contains 6.55 acres and is a metes and bounds parcel generally described as
Lot 15, Block 2, White Horse Springs. The site is zoned RS-20, a residential zone district within
Pitkin County intended for low density single family and accessory residential development
while preserving agricultural, environmental and scenic resources. The minimum lot size in the
RS-20 zone district is 20 acres and the 6.55 acre property parcel is a legal, but substandard sized
lot in the zone district. The existing primary residence meets the applicable 50 feet front yard
setback and the 30 foot side and 30 foot rear yard setbacks.
Please refer to the topographical survey of the property in Attachment 3 and the slope analysis in
Attachment 4 which depicts slopes ranging from 0-15%, 15-30%, 30-45%and over 45%. As
shown, slopes rise steeply behind the existing house and falls more gently below the existing
private access drive. The Onsite Wastewater Treatment System (OWTS) is located on a level
area east of the house as shown on the survey. The private drive and the level sections of the
property shown in the slope analysis were created years ago,probably around 1964 to 1965 when
the White Horse Springs neighborhood, the private drive and the White Horse Springs Water and
Sanitation District were first established.
The subject is accessed via McLain Flats Road, Sunnyside Lane and a gravel private driveway.
The 30 foot private driveway which accesses the subject property and the adjacent property to
the northwest (Lot 9 White Horse Springs)has crossed the subject property for years, even prior
to the development of the home in 1992-1994. The easement for this driveway was vacated
when the Applicant purchased the property in 1994 (see Attachment 5)
Wildfire hazard on the site is mapped as severe and there is severe elk winter range.

II
BACKGROUND
The White Horse Springs Water and Sanitation District was created in 1965. Attachment 6 gives
the document establishing the Water and Sanitation District with an attachment that shows the
parcels and tracts covered by the District, including the subject parcel. On January 3, 1989 the
Pitkin County Planning and Zoning Commission granted approval to the subject property(then
owned by Peter and Margaret Dictenberg) for a 1041 Environmental (Geologic) Hazard Review
pursuant to Resolution PZ-89-05 found in Attachment 7. The Dictenberg 1041 Hazard Review
Map in Attachment 8 (recorded at Book 22,page 32) reflects that approval. Later that year, on
June 13, 1989,the Board of County Commissioners approved an amendment to expand the
building envelope to the south and east. This Resolution No. 89-56 is found in Attachment 9 and
the corresponding recorded 1041 Map (recorded at Book 25, 98) is found in Attachment 10. The
Planning and Zoning Commissioners granted a third land use approval when General Submission
and 1041 Hazard Review approval was granted to the Dictenberg property on January 7, 1992
pursuant to Resolution PZ 92-01 and the Dictenberg 1041 Hazard Review Map (recorded at
Book 28, Page 97) found in Attachments 11 and 12.
III
PROJECT DESCRIPTION
Attachment 13 is the proposed Simeone Activity Envelope and Site Plan("Site Plan"). The
Applicant is seeking to establish an Activity Envelope and Site Plan to allow a:
• Remodel of the home;
• Removal of the large exterior front entry staircase;
• Shortening of the existing driveway;
• Landscaping improvements around the property particularly where the entry staircase and
driveway are removed; and
• Complete fire protection mitigation due to the wildfire hazard on the property.
IV.
LAND USE CODE REVIEW
This section of the application demonstrates compliance with the following Land Use Code
standards identified by the Community Development Department in the Pre-Application
Conference Summary in Attachment 2. Land Use Standards appear in bold followed by the
Applicant's responses to the standards.

Activity Envelope and Site Plan
Section 7-10-50 & 60
(a) The intent of this Chapter 7 is to allow activities and development to take place where
they comply with the provisions of this Land Use Code and with the Pitkin County
Comprehensive Plan for the area. Compliance will generally involve avoidance of
"Constrained Areas" through the identification of an "Activity Envelope," as well as
approval of a Site Plan. For purposes of Chapter 7, "Constrained Areas" include all areas
included in each of the following categories, as defined and regulated by this Land Use
Code: (i) Areas of Statewide Interest listed in C.R.S. 24-65.1-101 et. seq.), (ii) steep and
potentially unstable slopes, (iii) water courses, drainage channels, and areas subject to
erosion, (iv) floodplain hazard areas, (v) geological hazard areas, (vi) severe or low to
moderate wildfire hazard areas, (vii) wildlife habitat areas, (viii) river and stream
corridors and wetlands (ix) irrigated lands for food or crop production, (x) historic
preservation areas, and (xi) archeological resource areas.
(b) The Site Plan process incorporates an "Activity Envelope" approach in which the
County staff works with the applicant to determine which portions of the site (if any) would
permit the proposed activity or development to be conducted in compliance with this Land
Use Code and in conformity with the Comprehensive Plan for the area. In general, this
process will involve both a determination of(i) which portions of the site are not available
for development because of the existence of Constrained Areas, and (ii) of the remaining
portions of the site, which areas would accommodate the activity or development so as to
minimize impacts on surrounding properties, maximize compliance with the requirements
of the development standards in this Chapter 7, and maximize compliance with the
Comprehensive Plan goals and objectives.
(c) In general, the defined Activity Envelope for development of primary uses shall be
large enough to accommodate the proposed principal use of the property and traditional
permitted accessory structures, infrastructure (roads and septic systems), and uses, but
should not be significantly larger than the area needed for such structures. In the case of a
site with few Constrained Areas, the defined Activity Envelope may include more than one
potential building site for a new single family home. The defined Activity Envelope may
include non-contiguous areas (including separate areas for septic fields, landscaping,
driveways to public roads, mitigation measures required in connection with any provision
of this Chapter 7, and/or areas to be disturbed only during construction on the property—
including staging areas and materials storage areas). Construction of trails will not require
an Activity Envelope analysis except as required by Sec. 7-20-50.

(d) Clearing, grading, grubbing, earthmoving that exceeds fifty (50) cubic yards, or
changes in the natural drainage of the site shall occur only after an Activity Envelope has
been defined and all applicable local, state and federal permits have been obtained. In
addition, Site Plan Approval is required if these activities will occur on a property within a
Scenic View Protection Area.
(e) Activity Envelope and Site Plan Review for a Stream Restoration Project shall adhere
to all development standards in 7-20-40 and 7-20-80 and shall be reviewed by the BOCC as
set forth in Table 2-1.
(f) Once an Activity Envelope has been defined, the natural grade, topography, vegetation
and drainage of areas outside the defined areas shall not be disturbed except as specifically
permitted in this Land Use Code. Prior to any development activity on the parcel, the
boundaries of the Activity Envelope shall be identified with construction fencing, and such
fencing shall remain in place until development has been completed.
(g) While it is preferable to obtain approval of an Activity Envelope as part of the Site Plan
approval process, applicants who are not prepared to submit a Site Plan for a specific
structure may request approval of an Activity Envelope separately. Prior to the issuance of
a Development Permit, the applicant shall be required to apply for and obtain approval of
a Site Plan confirming that the proposed development is consistent with the defined
Activity Envelope and with other standards in this Land Use Code not considered at the
time the Activity Envelope was defined.
(h) The standards in this Chapter 7 shall be used (i) to identify the Activity Envelope on a
property, (ii) to review and approve the Site Plan for proposed development, and (iii) to
regulate development within the Activity Envelope pursuant to the Site Plan. Development
Standards in this Chapter 7 which are to be reviewed as part of Activity Envelope and Site
Plan review are set forth in Table7.1.
The proposed Simeone Activity Envelope and Site Plan are shown in Attachment 13. The
Activity Envelope includes the level portions of the property in and around the existing home.
Although a building envelope was approved in 1989, amended in 1989 and again approved in
1992 through the 1041 Hazard Review process in effect at that time, the currently proposed Site
Plan will bring the Activity Envelope and Site Plan into compliance with current regulations and
requirements. The proposed Activity Envelope encompasses the existing house and proposed
expansions, the new alignment of a shorten driveway, removal of the large exterior entry
stairway and landscaping improvements. The Activity Envelope is relatively flat as shown in the
slope analysis in Attachment 4.
All the above requirements were considered when developing the Activity Envelope and Site
Plans and the proposal complies with Code standards. The Applicant has evaluated the
applicable constraints including slope, wildfire, wildlife and scenic view concerns and has
addressed them when necessary or applicable. Areas outside the Activity Envelopes will not be
disturbed except as specifically permitted in the Land Use Code. Prior to any development
activity on the property, the boundaries of the Activity Envelope will be identified with

construction fencing and the fencing will remain in place until development is complete. The
applicant will comply with the requirements of this section of the Code.
Site Preparation and Grading
Section 7-20-10
(a) Grading and Fill Placement
Grading and filling on a site shall take place only within a defined Activity Envelope. All
grading and fill placement that exceeds fifty (50) cubic yards shall be indicated on the Site
Plan.
All grading and filling on the site will take place only within the designated Activity Envelope.
Any grading and fill exceeding 50 cubic yards will be indicated on the Site Plan submitted with
the Access and Earthmoving permit. Conceptual grading is included on the Site Plan in
Attachment 13 and a final grading plan will be submitted with the Earthmoving Permit and
Access permit application.
(b) Clearing, Grubbing, and Vegetation Removal
Clearing or grubbing of land, or removal of vegetation shall take place only within an
approved Activity Envelope, except removal of noxious weeds and 10 or fewer dead or
diseased trees of a caliper of 6" d.b.h. or greater within a 12 month time period that create
a hazard may occur outside of an Activity Envelope. Disposal of dead or diseased trees
shall be in accordance with the Land Management Department's policy. Trees removed
that contain active mountain pine beetles shall not be stored for firewood. Each Site Plan
shall document compliance with the requirements of this Sec. 7-20-10(b) and Sec. 7-20-130.
Clearing or grubbing of land or removal of vegetation will all take place within the approved
Activity Envelope, except as provided for weeds and dead or diseased trees as specified. The
Applicant will comply with all these requirements. The Applicant will plant enough trees to
compensate for the loss of any healthy trees of a caliper of 6" d.b.h. which may be removed in
association with site development. The Applicant has surveyed all of the trees on the property
and will submit surveyed trees counts and a detailed tree mitigation plan with the earthmoving
and access permit for the property.
(c) Tree Removal and Mitigation
Each tree with six (6) inches or larger diameter at breast height (D.B.H.) that is removed
within the Activity Envelope shall be replaced with one (1) or more trees with total D.B.H.
at least equal to the caliper(s) of the tree(s) removed, to the maximum extent practicable.
Any tree that (i) is diseased, or (ii) is required to be removed pursuant to the provisions of
Sec. 7-20-60, as those requirements may be varied by a wildfire expert approved by the
County, may be removed and no replacement shall be required. All revegetation shall also
comply with the Pitkin County Revegetation Guidelines. Required replacement trees that
do not survive for at least one (1) year after installation shall be replaced at the owner's

expense, and the County may require financial security for such replacement pursuant to
Sec. 7-20-130(b)(7).
The proposed development will comply with all the above requirements regarding the removal or
replacement of trees and re-vegetation.
(d) Protection of Natural Terrain
The County Planning Engineer or Community Development Director shall suggest and
may require design and construction techniques that lessen or mitigate any physical and
visual damage caused by the proposed activity or development to Constrained Areas or to
the natural terrain, stream vegetation, and other natural features of the landscape within
the Activity Envelope. Techniques shall include, but are not limited to:
(1) Revegetation
Revegetation and reforestation utilizing native or similar horticultural material, to
be completed during the first planting season after construction; where vegetation is
removed, it shall be replaced with vegetation that will reach similar density and
height to that removed within two (2) years following conclusion of construction.
(2) Topsoil
Removing and saving topsoil prior to any grading or excavating and replacement
for revegetation.
(3) Weed Prevention
Weed prevention, thistle management, and prohibition of non-native plants,which
may include reducing animal damage to vegetation cover, as determined by the
United States Soil Conservation Service Soil Survey.
(4) Utility Installation
Locating and installing utilities in a manner minimizing damage to the natural
environment and scenic quality.
(5) Erosion, Sedimentation, and Stormwater Management
(a) Land uses shall:
(1) Not cause erosion problems and, if practicable, retain all soil on
site;
(2) Minimize disturbance of natural vegetation and soil cover;

(3) Ensure that all cuts and fills are adequately designed and
vegetated to control erosion as well as stability of the slope area;
(4) Ensure that natural drainage patterns are preserved and
protected from increased water flows that subject existing channels
and adjacent areas to increased erosion; and
(5) Preserve natural vegetation and soil cover within those buffer
distances adjacent to rivers, streams, lakes, reservoirs and
wetlands/riparian areas established in Sec. 7-20-80.
(b) Mitigation measures identified in an approved erosion, sedimentation, or
stormwater management plan shall remain in place until revegetation is
viable.
Site development will comply with all the above requirements for site preparation and grading
including re-vegetation, topsoil, utility installation, weed prevention, erosion, sedimentation
and/or storm water management and the disturbance of natural vegetation.
Steep and Potentially Unstable Slopes
Section 7-20-20
The slope analysis in Attachment 4 shows the slopes found on the property in the categories
required by the Pitkin County Land Use Code: 0-15%, 15-30%, 30-45% and over 45% grades.
Most of the land within the Activity Envelope contains slopes in the 0 to 15% category, largely a
result of driveway construction in the 1960s and home construction prior to 1994. Steeper slopes
exist above and below the home and along a transition up to the OWTS and lawn play area to the
east. The boundaries of the Activity Envelope are defined and limited by the narrow shape of the
parcel in combination with the steeper slopes above and below the existing home. The stability
of the slopes and the existence of the ditch above the property have been considered in the
mitigation plan for slope stability. The proposal will comply with this section of the Land Use
Code.
Wildfire Hazards
Section 7-20-60
The pre-application conference summary indicates that the subject property is mapped as a severe
wildfire hazard area. The Applicant agrees to abide by any standard, reasonable recommendations
or conditions of approval related to the Pitkin County Land Use Code requirements for the
applicable wildfire hazard mitigation. The Activity Envelope has been created to allow for known
standards wildfire mitigation techniques and requirements such as maintaining defensible space
around all structures.

Wildlife Habitat Areas
Section 7-20-70
The wildlife standards of the Pitkin County Code have been considered in our land use analysis.
According to the pre-application conference summary sheet,the property is located within severe
elk winter range. The redevelopment should not further affect elk winter range,though all
standard,reasonable measures as required by the Code for before,during and after construction will
be met. The Applicant will comply with any reasonable standard conditions of approval related to
the wildlife hazard on the Parcel.
Scenic View Protection Areas
Section 7-20-120(d)
McLain Flats Road is the Scenic View Protection Corridor applicable in this review. The subject
property sits just under one quarter mile above McLain Flats Road at the base of the steep slopes
rising above the home and the home is visible from along the view corridor. There are several
homes in front of the subject residence which are in the primary view from McLain Flats Road in
this location. The remodeling of the existing home will not increase visual impacts from this
scenic corridor. In fact, neighbors and citizens have commented on the existing home's
character and design as it sticks out and does not blend well with the rural ranch setting intended
for the RS-20 zone district. The proposed exterior remodel will eliminate the stark white
exterior, large white columns and large exterior entry staircase which may not have been
compatible with the neighborhood. The new exterior will use natural colors and materials such
as native stone along the bottom half. The exterior design is shown in Attachment 14. The
proposed remodeled home will be more compatible with the surrounding neighborhood and will
blend in with ranch character of the vicinity. The location of the home at the base of the slope
will not break a ridgeline. The Applicant has analyzed the site from McLain Flats Road and a
magnified image of the home from McLain Flats Road is found in Attachment 15.
(1)The proposed development shall utilize existing topography and natural vegetation, such
as ridges, hills, and existing trees,to screen buildings to the maximum extent practicable
when viewed from those right-of-way listed in subsection (b) above.
There are several other existing homes between the subject property and McLain Flats Road and
the subject residence is part of the larger view plane of the neighborhood. The home sits slightly
above the Road so it is visible from the Road. The home sits at the base of the steep slopes
above the home. Existing and proposed landscaping will help soften visual impacts from
McLain Flats Road. There will be no disruption to existing vegetation outside the proposed
Activity Envelope and disruption to existing vegetation within the Activity Envelope will be
minimized to the maximum extent possible. The proposed landscaping shown on the Site Plan in
Attachment 13 will enhance the vegetation in place and will further soften the views of the
property. A large area in front of the home, where the driveway is being removed, will be
landscaped and should enhance the view of the home. The exterior remodel will create a home
design of a more compatible, rural,ranch character which blends well with the environment and
should improve scenic impacts. The proposal complies with this standard.

(2) The proposed development shall avoid the location of structures within the Scenic View
Protection Areas, and shall avoid the location of structures within any Viewplane identified
in the State Highway 82 Corridor Master Plan and Down Valley Comprehensive Plan if
possible. If location outside the Scenic View Protection Area and defined Viewplanes is not
practicable, then the proposed development shall not be located on the highest ground or
most visible portion of any site as viewed from those corridors listed in subsection (b)
above.
The proposed improvements are not on the highest point on this site as it sits at the base of steep
slopes, tucked into the hillside. The siting of the existing structure built in 1994 is a relatively
low two story profile, though the exterior materials and colors have been much more visible than
what will result from the proposed exterior remodel with natural colors and materials which will
blend well into the environment and neighborhood. Overall, the remodel has been carefully
planned to minimize visual impacts.
(3) The proposed development's height and bulk shall be designed to avoid, to the
maximum extent practicable, the visibility of buildings from those corridors listed in
subsection (b) above. This may include, but shall not be limited to, breaking the mass of
the building down into a series of smaller forms, articulation of the building façades to
avoid a wall or row effect, and staggering rooflines to avoid a long unbroken plane.
The proposed remodel should soften the visual impacts of the home and allow it to blend in
much better with the surrounding terrain and character of the neighborhood.
(4) The proposed structure shall be placed so it does not project above a ridgeline such
that a structure silhouettes against the sky when viewed from those corridors listed in
subsection (b), unless there are no alternate building sites on the lot or parcel.
The existing and proposed home remodel will not break a ridgeline. It sits at the base of the
steeper slopes above the home.
(5) The proposed development shall be designed to complement the natural topography of
the land through the use of techniques such as earth-sheltered design, the use of natural
materials and coloring, the use of low-reflectance materials, or clustering of structures on
the least visible portions of the site. When a building is proposed near a ridgeline, then its
form (particularly its roof form) shall replicate, parallel, or complement the natural form
of the ridgeline so that it appears to be an element of the natural ridgeline.
The proposed remodel very effectively meets this requirement. The remodeled home has been
designed to complement the natural topography of the land through the use of techniques such as
natural materials and coloring and low reflectance materials. The removal of the exterior
staircase and shortening of the driveway should create a more natural setting as well. The design
will complement the natural topography and landscape and will utilize various techniques and
materials to minimize the visible portions of the home.

(6) The proposed development shall preserve natural vegetation and avoid development
within irrigated meadows, to the maximum extent practicable.
The Applicant will maintain and preserve the existing natural vegetation on the site to the
maximum extent practical.
(7) The proposed development shall install utilities in locations and through procedures
that minimize visual impacts to the maximum extent practicable.
All utilities are place and this will not be applicable.
(8) All satellite dishes in the proposed development shall be located to minimize visibility
from those rights-of-way listed in subsection (b), and shall use earth tone colors and/or
screening to minimize their visual impact.
The Applicant will comply with this standard
(9) The proposed development shall not use earth moving and berms as the primary means
of compliance with these regulations, but earth moving may be utilized in conjunction with
other techniques to comply with standards in this section. Where earth moving techniques
are necessary, man-made forms should be undulating and natural in appearance.
The Applicant understands the intent of this requirement and will comply.
(10) In the Rural Areas only, development shall be located so that activities and
development occur in at least one of the locations specified in subsection (I) as they may
apply to the particular property.
The proposed remodel of an existing home at the base of steeper slopes complies with this
standard.
(11) Earth Tone Materials. The exterior of all development, except development located
and designed in the form of a ranch compound, shall be built or painted with indigenous
earth tone materials or colors. The exterior of a ranch compound should be built or
painted with indigenous earth tone materials, or shall be painted or stained using local,
traditional ranch colors,which shall include shades of red, brown, or white. Paints or
stains that simulate weathered barn wood also shall be permitted.
Earth tone material will be used to replace more inappropriate exterior materials which now
exist. This standard will be met.
(12) Roofs
All roofs shall have a non-reflective color or composition. Reflective roof materials shall
not be used unless the materials are treated prior to installation to eliminate reflection,
with the exception of materials associated with solar or photovoltaic equipment.

The Applicant will comply with this standard regarding the roof.
(13) Revegetation of Disturbed Areas
Lands disturbed by earth moving or berms should be revegetated using native species that
are already growing on or near the site. Topsoil shall be stockpiled and placed on disturbed
areas. Irrigation shall be provided to the revegetated areas if it is necessary to ensure
survival of planted native species.
The Applicant will comply with this standard.
(14) Driveways Avoid Dividing Meadows and Pastures
To the maximum extent practicable, roads and driveways shall be located to skirt the edge
of and avoid dividing meadows and pastures and to avoid major road cuts. Roads and
driveways should take advantage of the screening potential of natural topography and
existing vegetation. Existing roads and driveways shall be used where practical. To
enhance screening, a row of trees may be planted along the roads or driveways. To the
maximum extent practicable, roads and driveways located around the edge of or in
meadows shall be laid out with soft, curving edges and shall avoid straight line corridors
that are incongruous with the natural setting.
The proposal is to shorten the existing driveway and create a much more accessible entrance
through a new turn around near the new garage location. A large section of the driveway will be
removed. Existing vegetation will significantly buffer the driveway alignment that remains. No
meadow or pasture exists on the property. The proposal meets these County standards and the
project will be in compliance.
Landscaping and Vegetation Protection
Section 7-20-130
As required, all development on the subject property will comply with the Pitkin County
Landscape Guidelines. The Applicant will preserve existing vegetation to the maximum extent
possible. The remodel improvements have been designed to preserve and enhance the rural
character of the area. Proposed landscaping is found on the Site Plan in Attachment 13 and will
comply with the intent and requirements of the Pitkin County Land Use Code ("Code") and
Landscape Guidelines, including restrictions on removal of natural vegetation, and requirements
for revegetation. Some trees and other vegetation will be removed to provide defensible space
for wildfire protection. The applicant will comply with the requirements of the Code and any
applicable conditions of approval pertaining to landscaping and vegetation.

This letter of application has described the existing conditions on the 6.55 acre Simeone Parcel at
2049 McLain Flats Road in White Horse Springs, summarized past Pitkin County land use
approvals and proposed the Richard and Emily Simeone Activity Envelope and Site Plan which

Description of Project/Development: The Applicant is requesting Activity Envelope and Site Plan approval for the
remodeling of a single family residence on a currently developed lot. The development plan would include a small
expansion to the footprint of the existing house and a realignment of the driveway. The 6.6 acre lot is a non-conforming lot

Directors for such district, was duly publiahed in compliance with the Crder
of Court entered the 23rd day of October, 1964, and in accordance with the
requirements of law;
AND IT FURTHER appearing that said election was duly held at the time
and place specified in said Order under the supervision of properly qualified
Judges of election; that at said election 8 ballots were cast FOR the organiza-
tion of the district and NO ballots were cast AGAINST the organization of the

WHEREAS, Peter Dictenberg, hereinafter "Applicant", has � -
applied to the Board of County Commissioner of Pitkin County, •
Colorado, hereinafter "Board", for Subdivision Exemption approval
for an Insubstantial Change to a Recorded Plat pursuant to
Section 2.1(b) of the Land Use Code; and i:'
WHEREAS, the property is zoned RS-20 consisting of
approximately 6.55 acres and located on Lot 15, Block 2 of the
White Horse Springs Subdivision more specifically described in

Environmental Hazard Review and Gneral Submission approval for the
construction of a single-family residence on a metes and bounds
parcel pursuant to Sections 5-400, 6-3 and 10-2 of the Pitkin 4
County Land Use Code; and
WHEREAS, the applicant's parcel is zoned RS-20, contains
approximately 6.55 acres and, due to the presence of geologic
hazards, is located within an area of Local and State Interest e:

AGREEMENT FOR PAYMENT OF LAND USE APPLICATION FEES
PITKIN COUNTY (hereinafter"COUNTY") and Richard and Emily Simeone (hereinafter
"APPLICANT')AGREE AS FOLLOWS:
1. APPLICANT has submitted to COUNTY an application for Activity Envelope and Site Plan, Scenic
Reviews for the remodeling and expansion of a single family road and access driveway.(hereinafter, the"PROJECT').
2. APPLICANT understands and agrees that Pitkin County Ordinance No. 012-2015 establishes a fee
structure for land use applications and the payment of all processing fees is a condition precedent to a determination of
application completeness. The fee structure is based on the COUNTY'S policy that development shall pay, in full, the
cost of development review in the COUNTY. Fees have been set to be consistent and fair to the public and to reflect the
expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed PROJECT, it
may not be possible at the time of application to ascertain the full extent of the costs involved in processing the
application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications shall
accumulate if an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County Commissioners to
enable the Planning Commission and/or Board of County Commissioners to make legally required findings for project
approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right to collect full
fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the amount of $4,848
which is based on 12 hours of staff time, and if actual time spent by staff to process the application exceeds the average
number of hours by more than 20%, then the COUNTY will bill the APPLICANT quarterly for the additional time spent.
Such periodic payments shall be made within 30 days of the billing date. APPLICANT further agrees that failure to pay
such accrued costs shall be grounds for suspension of processing.

The Planning Office has completed its preliminary review of the captioned application. We have determined
