RECITALS
I. Smuggler Consolidated Mines, LLC (hereafter, the "Applicant"), has applied to the Pitkin County
Board of County Commissioners ('BOCC") for a Special Review for Commercial Snow
Trucking/Dumping/Storage in an existing retention pond. 'Ihe Applicant has requested a 5 year
permit with this application.
2. The parcel is located at 100 Smuggler Mountain Road. PID#: 273707428002 (Legal Description,
Attachment A).
3. The Applicant received a 5 year permit from the BOCC pursuant to Resolution No. I9-2011.
Pursuant to Subsection 4-30-50(L) of the Pitkin County Land Use Code, standards have been
developed to address the impacts of snow storage areas. The BOCC finds that the Applicant has
shown compliance with these standards.
4. The BOCC finds that a 5 year permit is appropriate Subject to annual soil testing which shall be
conducted each spring and results provided to the Community Development Department.
5. Pursuant to condition 4-30-50(L)(14), the proposed site is within 50' from a property line. The BOCC
finds that the because the 50' setback standard was unn�ented to address runoff onto an adjacent
property, and because the proposed snow dump site has been sited within an existing retention pond,
there is very limited chance for the runoff to reach an adjacent property. 'Therefore, the BOCC finds that
siting the proposed snow dump within the 50' setback is acceptable.
6. The BOCC heard the request at a regularly scheduled and duly noticed public hearing on December
T°, 2016 at which time evidence and testimony were presented with respect to this application.
NOW THEREFORE BE IT RESOLVED by the BOCC that it hereby approves the Smuggler
Consolidated Mines, LLC Special Review for Commercial Snow Truckimg/Dumping/Storage subject to
the conditions outlined below:
I. The Applicant shall adhere to all material representations made in, or in connection with, the
application.
2. Debris shall not be allowed to accumulate on the snow storage/dumping site. All debris
remaining after the melt out will be treated as waste and removed.
3. This approval shall expire afte-the 2020/2021 winter and a new permit is required to continue the
commercial snow dump.
4. The Applicant shall provide the Community Development Director with soil test results each
year, no later than by the end of September, in accordance with Land Use Code Section 4 -30 -
Pagel f4
50(L). If soil testing results do not meet the thresholds established in effect at the time of testing,
the Applicant shall not dump snow at this site.
5. If the snow storage site does not comply with the adopted soil testing standards and snow can no
longer be accepted in the approved location, remediation of the site, which may include
excavation and removal of tainted soils, shall be conducted within 60 days of receipt of soil
testing results. Remediation shall be in accordance with Pitkin County Environmental health
protocol and inspected by County staff for completion.
6. The Applicant shall comply with all other reporting requirements.
7. Snow storage operations shall only be conducted between the hours of 7:00 AM to 7:00 P vL
Monday through Saturday.
8. Trucking to and from the site shall not disrupt reereationalists on Smuggler Mountain Road.
9. Dust from trucking shall be kept to a minimum. Mud shall not be tracked onto City streets.
10. The Applicant shall revegetale the storage areas in accordance with Community Development
Department standards, if necessary. Weeds shall be managed appropriately under Pitkin County
Land Management guidelines. Staff shall conduct a site inspection of the snow storage site in the
spring to ensure compliance with this condition.

utilized to remove sediment and other contaminants from melt water and promote infiltration
rather than runoff.
12. Failure to comply with the conditions of approval may result in revocation of this permit.

BACKGROUND and REQUEST: In 2010 and 2011, legislation was adopted to address the siting and
environmental impacts of commercial Snow Dumping/Trucking/Storage. Land Use Code standards
include required setbacks from property lines and water ways, soil testing requirements, and consistency
with adopted master plans. In 2011, the Applicant received Special Review approval for a commercial
snow dump in the existing retention pond at the Smuggler Mine pursuant to BOCC Resolution No. 018-
2011 (See Attachment 5 of the Applicant's submittal). This approval granted a 5 year permit and the
need to apply for a new permit after 2015/2016 winter if snow dumping operations are proposed to
continue. A requirement of the 5 year permit from the BOCC was to provide soil testing results to the
Community Development Department for review using the adopted soil testing standards. The Smuggler
Mine Snow Dump has been in good standing since 2011 and has operated within the parameters of the
permit.
Two issues that were raised at the 2011 BOCC meeting were concerns regarding: (1) Smuggler Mountain
Road is an unpaved road and there is potential for trucks carrying snow to track mud onto City streets;
and (2) impact of trucking on recreationalists using Smuggler Mountain Road. The BOCC addressed
these concerns with a conditional approval that required that trucking not disrupt recreationalists on
Smuggler Mountain Road and that mud not be tracked onto City Streets.
REFERRAL COMMENTS: City of Aspen - no comments received. Pitkin County Environmental
Health — comments received and no issue with the proposal.
STAFF COMMENTS:
Special Review for a Snow Storage Area
A snow storage area/dump is listed as a special review use in the AR-10/TR-2 zone district and therefore must
comply with the following standards (see Subsection 2-30-30):
A. The special review use shall consider the applicable County Master Plan.
Staff Response: A snow storage site/dump is not a use prohibited in 2012 Aspen Area Community Plan.
B. The special review use shall not conflict with any applicable sections of the Pitkin County Land Use
Code, including the County Land Use Policies in Chapter 1.
Staff Response: The use is consistent with the Pitkin County Land Use Code and the Land Use Policies.
C. The proposed development must not materially endanger the public health, safety or welfare.
Staff Response: Standards were developed in order to safely and effectively site these storage areas.
Impacts, including off-site impacts, are considered and Staff has no reason to believe that the continued use
will endanger the public health, safety or welfare.
D. The proposed development must not substantially injure the value of adjoining or abutting property.
Staff Response: If standards and conditions in the attached draft resolution are adhered to, the snow storage
area should not substantially injure adjoining or abutting property.
E. The special review use shall be consistent with the intent of the zone district in which it is
proposed to be located.

Staff Response: The snow storage area is consistent and is a special review use in the AR- l 0/TR-2 Zone
Districts.
F. The special review use shall be compatible with the character of the immediate vicinity of the
parcel proposed for development and surrounding land uses, or shall enhance the mixture of
complimentary uses and activities in the immediate vicinity of the parcel proposed for
development.
Staff Response: The snow storage area is located within a mining area and snow will be dumped into an
existing retention pond. Trucking and dumping of snow within an existing mining area is a use consistent
with the parcel.
G. The location, size, design and operating characteristics of the proposed special review use must
be in harmony with the surrounding area and minimize adverse effects, including visual impacts,
impacts on pedestrian and vehicular circulation, traffic generation, parking, trash, service
delivery, air/water pollution or other impacts on natural resources, noise, vibrations and odor on
surrounding properties.
Staff Response: With compliance with the use specific standards outlined below, adverse impacts should
be minimal for the snow dump.
H. There must be adequate public facilities and services to serve the special review use, including
but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection,
emergency medical services, hospital and medical services, drainage systems, and schools.
Staff Response: Staff has no reason to believe that public facilities and services will be compromised
and the use can be accommodated.
1. The proposed special review use must comply with any additional standards or requirements
stated for such use in Sec. 4-30 and/or 2-40-20.
Staff Response: Code Section 4-30-50(1) will be addressed below.
Use Specific Standards for Snow Storage Areas/Dumps
Section 4-30-50(1) is the applicable section of the Code for review of snow storage areas. The applicant shall
comply with the following conditions:
(1) Setbacks
a. Setbacks shall be regulated by Section 7-20-80 and Chapter 5.
Staff Response: Section 7-20-80 regulates development within setbacks of creeks, streams, and
rivers. None of these waterways are located on this parcel.
(2) Slopes
a. Slopes in excess of 10% shall be avoided.
Staff Response: The proposed site has not been located on slopes in excess of 10%.

(3) Groundwater
a. Snow storage and/or dumps shall not be located in areas of high groundwater
b. It must be demonstrated that the groundwater high water mark is 4 feet or more below
snow storage area.
Staff Response: The Applicant has provided an engineering report that states groundwater is
approximately 80' from the surface of the adjacent mine shaft. This location is approximately 50'
from the snow Dump site.
(4) Floodplain
a. Snow storage areas shall not be located within the 100- year floodplain
Staff Response: The snow storage area is not located within the 100 -year floodplain.
(5) Surface Runoff
a. Snow storage shall not result in surface runoff unless best management practices are
utilized to remove sediment and other contaminants from melt water and promote
infiltration vs. runoff.
Staff Response: Because the snow storage area is proposed in a disturbed mining area within a
retention pond, surface run-off is not an issue.
(6) Dumping into waterway or water -body
a. Snow storage areas shall comply with section 7-20-80(d).
b. Snow shall not be pushed or dumped into any waterway or water — body at any time.
Staff Response: The Applicant has committed to not dumping into a waterway or water -body and
will comply with reclamation standards outlined in 7-20-80(d), if necessary.
(7) Refuse removal/disposal
a. It will be a condition of approval that at the end of each winter season (when all snowmelt
is complete) that documented cleanup occurs at the site to remove non -snow refuse from
the storage site.
Staff Response: The Applicant commits to removal of debris.
(8) Scenic Impact Consideration
a. Potential scenic impacts of the location ofproposed snow storage areas shall be addressed
in the application.
Staff Response: The snow storage area will be visible from Smuggler Mountain Road, a County
Road, when at a higher elevation and looking down on the Mine.
(9) Revegetation
a. If a snow storage area is abandoned for more than two years, revegetation of the site
(where necessary) is required.
Staff Response: The snow storage area will be required to be revegetated when the snow storage
operation ceases, if necessary.

(10) Trips
a. The Applicant shall present a dumping schedule for consideration that includes hours of
operation and estimated number of trucks per hour/day.
Staff Response: The Applicant has stated that snow dumping is proposed to occur from 6:OOAM to
6:OOPM. Staff feels that the hours of operation for this snow storage operation should be consistent
with the hours of operation for County construction, which are Monday through Saturday, 7 AM to
7 PM. This was a condition of the 2011 approval. Staff feels that, if approved, the request should be
consistent with the previous approval. The Applicant has provided dumping schedules since 2011.
The majority of snow received by the Smuggler Mine comes from private property.
(11) A log shall be created of the criteria outlined in condition #10(a) and submitted for review to
the Community Development Department, annually, when soil monitoring tests are submitted.
Staff Response: The Applicant will continue to be required to submit this documentation along with
soil testing results.
(12) Noxious Weed Control
a. The Applicant is required to control for noxious weeds.
Staff Response: The Applicant will be required to manage noxious weeds, if necessary.
(13) Wells
a. Snow dump sites shall be sited at least 200' feet from private wells and public water
systems. The 200' setback from a public water system shall be measured from the source
from which water is collected for the public water system
Staff Response: The Applicant has provided a map that illustrates a 200' setback area from the
retention pond. Data provided shows that no wells or public water systems exist within this setback.
(14) A snow dump site shall be located at least fifty feet (50 ) from a property line. The BOCC may
increase this setback if it is found that runoff or other negative impacts may implicate an
adjacent property. The BOCC may decrease this setback if it is found that runoff or other
negative impacts will not implicate an adjacent property.
Staff Response: The snow dump site is not located at least 50' from a property line. The proposed
snow dump site is located within an existing retention pond that was constructed to promote infiltration
and contain runoff. According to the map submitted by the Applicant, the retention pond is located only
a few feet from the south west property.
The purpose of this requirement is to ensure that meltwater runoff does not cross onto another property.
Because snow will be dumped into this retention pond that was designed to contain runoff, staff feels that
the BOCC can make a finding to decrease the required setback.
(15) Soil Testing
An Applicant for an existing snow dumping site shall test soil annually in the spring, after the
dumping site has melted. An Applicant for an initial snow dumping site shall provide soil test
results in their application to the Community Development Department. In both cases, the
following contaminants shall be tested:

• Volatile Petroleum Hydrocarbons (VPH)
• Extractable Petroleum Hydrocarbons (EPH)
• B-tex Test
• Oil and Grease
Staff Response: The Applicant has tested for these contaminants and has provided the results to the
Community Development Department for the past 5 years. Test results show compliance with the
established threshold standards. Soil test results have also been provided with the current application.
a. Sampling testing shall occur on each snow dump site. If a dumping site is larger than 1
acre, every acre of the snow dump site shall be tested.
Staff Response: The Applicant has indicated that the soil samples were taken in the middle of
the retention pond.
b. Testing shall occur on the down gradient of the site, and the test sample should be taken
from an eight (8) inch depth.
Staff Response: The Applicant has indicated that the soil samples were taken in the middle of
the retention pond, which is the furthest down gradient point of the snow dump site.
C. The threshold levels for the B-tex test shall be as follows:
Benzene = 1ppm
Toluene = 1000 ppm
Ethylbenzene = 1000 ppm
Xylene = 280 ppm
Staff Response: The Applicant's lab results for the snow dump site show that the B-tex test is in
compliance with these threshold standards.
d. The threshold levels for Total Petroleum Hydrocarbons (TPH) shall be 500ppm. TPH is
the sum of VPH, EPH, and Oil and Grease.
Staff Response: Lab results show that the TPH test (sum of VPH, EPH, and the Oil and Grease
tests) is below 500 ppm.
e. If testing shows that a site is over any of the thresholds mentioned above, the Applicant
shall not be allowed to dump snow at that site. In order to continue dumping snow at that site,
additional testing shall be required as determined by the Community Development Director.
Staff Response: N/A
RECOMMENDATION: Staff recommends the BOCC adopt a motion to approve the Smuggler Mine
Special Review for a Snow Storage Area subject to the conditions of the attached Resolution.

Dear Mike:
Please find enclosed five (5) sets of the land use application for Special Review for
Commercial Snow Storage. As requested, two (2) sets are unbound. This application is
submitted on behalf of Smuggler Consolidated Mines, LLC, the operator of the snow storage
operations at the Smuggler Mine. The owner of the Smuggler Mine, Aspen Green Mountain
LLC, has provided their consent for Smuggler Consolidated Mines, LLC to make this
application.
The forerunner of Smuggler Consolidated Mines, LLC, The New Smuggler Mine Corporation,
Inc., received approval for Commercial Snow Trucking/Dumping/Storage by BOCC
Resolution 018-2011. This approval expired after the 2015/2016 winter. In the five years since
approval, the Smuggler Mine property has been utilized for snow storage with the
applicant/operator submitting soil test results each season as required by Resolution 018-2011.
While the ownership of the mine has changed hands, the snow storage operations will
continue as before and be administered by the some individuals and in the same careful
manner.

Overview
On behalf of Smuggler Consolidated Mines, LLC (the "Applicant") and as authorized by Aspen
Green Mountain LLC (the "Property Owner"), this application seeks approval for Special Review
for Commercial Snow Storage to utilize a portion of the Smuggler Mine property for snow
dumping and storage. The subject property is a 29.7 acre parcel which lies in both the AR -10
and TR zone districts.
The area designated for snow storage and dumping has been used for this purpose for many
years. The Applicant's site is ideal for snow storage because it contains an existing water
retention pond with significant storage capacity. The water retention pond is located below,
existing grade, thus ensuring minimal scenic impacts.
The proposed snow storage site is located more than 200' from private wells and is considerably
removed from the public water system intakes located up Castle Creek and at wells in the
Shadow Mountain area. The Applicant has arranged for the required soil testing and will submit
the results prior to the BOCC hearing. Further, the Applicant is prepared to adhere to the
monitoring protocols on an annual basis as has been approved.
The Applicant has provided a map prepared by Pitkin County GIS which identifies the 200'
perimeter from the proposed snow dump site, identifies abutting parcels to the New Smuggler
Mine Corp.'s property, and locates well heads using the County -wide Wells Layer. This map not
only shows that no wells are located within 200' of the proposed snow storage site but also .
illustrates the lack of residential activity located within 200' of the snow dump site. Commercial
snow storage operations on the subject property will create relatively minimal impacts to the
community while providing a necessary community service.

(1) General
An application for One -Step Review shall be approved if it complies with (a) all applicable provisions
of this Land Use Code, (b) all applicable Land Use Policies listed in Sec. 1-60, and (c) all prior
development approvals applicable to the subject property.
The Board of County Commissioners (the "BOCC") has found in previous approvals that
amendments to the code which permit commercial snow storage/dumping are
consistent with the County's goals and policies regarding land use and development in
the County. Further, the BOCC has also found that commercial snow storage/dumping is
consistent with the County's Master Plans. The proposed commercial snow storage use
will comply with all applicable provisions of the Land Use Code, all policies listed in the
General Land Use Policies, Sec. 1-60, and all prior development approvals applicable to
the subject property.
(2) Special Review Uses or Activities
The BOCC, the Hearing Officer and/or the Community Development Director shall only approve the
proposed special review use or activity if it finds that all of the following criteria are met:
(a) The special review use shall be consistent with the applicable County Master Plan.
The special review use is not inconsistent with the Aspen Area Community Plan, which
is the applicable County Master Plan for this location.
(b) The special review use shall not conflict with any applicable sections of the Pitkin County Land
Use Code, including the County Land Use Policies in Chapter 1.

(c) The proposed development must not materially endanger the public health, safety or welfare.

commissioned in accordance with BOCC directives for this application and for

(d) The proposed development must not substantially injure the value of adjoining or abutting
property.

grade, minimizing visual impacts and c6ntaining the snow storage operations. All
sediment, debris, and garbage will be managed and treated as waste and will be
removed at the end of the snow storage operational period.
(e) The special review use shall be consistent with the intent of the zone district in which it is
proposed to be located.
The special review use is consistent with the intent of the TR and AR -10 zone districts in
which the property is located, and snow dumping and storage is listed as an
accessory use requiring special review.
(i) The special review use shall be compatible with the character of the immediate vicinity of the
parcel proposed for development and the surrounding land uses, or shall enhance the mixture of
complimentary uses and activities in the immediate vicinity of the parcel proposed for
development.

(g) The location, size, design and operating characteristics of the proposed special review use must
be in harmony with the surrounding area and minimize adverse effects, including visual impacts,
impacts on pedestrian and vehicular circulation, traffic generation, parking, trash, service
delivery, air/water pollution or other impacts on natural resources, noise, vibrations and odor on
surrounding properties.
The location, size, design, and operating characteristics of the proposed snow
storage operations will be in harmony with the surrounding area and minimize
adverse effects, including visual impacts, impacts on pedestrian and vehicular
circulation, traffic generation, parking, trash, service delivery, air/water pollution or
other impacts on natural resources, noise, vibrations, and odor on surrounding

pond and the height of the snow will be kept below or near the surrounding grade.

removed at the end of the snow storage operational period.
(h) There must be adequate public facilities and services to serve the special review use, including
but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection,
emergency medical services, hospital and medical services, drainage systems, and schools.

(i) The proposed special review use must comply with any additional standards or requirements
stated for such use in Sec.4-30 and/or Sec. 240-20.

cessation of operation is due to demolition or destruction through any manner not willfully
accomplished by the owner, uses/structures may be restored as of right pursuant to Sec. 9-30-70
of the Land Use Code.
If the snow storage operations cease or the permitted time period ends, all uses and
structures will immediately be brought into conformance with the underlying zone
district regulations.

Sec. 4-30-50(m): Snow Dumping/Trucking/Storage
When a special review is requested for a snow storage area, the applicant shall comply with the following
conditions when siting the storage area:
(1) Setbacks
a. Setbacks shall be regulated by Section 7-20-80 and Chapter 5.
Setbacks will conform to the standards set forth by Sec. 7-20-80 and Chapter 5.
(2) Slopes
a. Slopes in excess of 10% shall be avoided.
Slopes in excess of 10% are not present at the proposed snow dump location. The snow
storage site is located on an existing retention pond on the Smuggler Mine site and is
surrounded by flat areas suitable for truck staging and unloading operations.
(3) Groundwater
a. Snow storage and/or dumps shall not be located in areas of high groundwater
Snow storage and/or dumps are not to be located in areas of high groundwater.
b. It must be demonstrated that the groundwater high water mark is 4 feet or more below storage
area.
Please see Attachment 8 of this application which is a letter from Resource Engineering
confirming that the seasonal high groundwater is approximately 80 feet below the
bottom of the snow storage basin.
(4) Floodplain
a. Snow storage areas shall not be located within the 100 -year floodplain

(5) Surface Runoff
a. Snow storage shall not result in surface runoff unless best management practices are utilized to
remove sediment and other contaminants from melt water and promote infiltration vs. runoff.
The snow storage site is located at an existing unlined retention pond on the Smuggler
Mine site, and snow storage operations will not result in surface runoff.
(6) Dumping into waterway or water -body
a. Snow shall not be pushed or dumped into any waterway or water body at anytime.
No snow will be pushed or dumped into any waterway or water body at any time.
(7) Refuse removal/disposal
a. It will be a condition of approval that at the end of each winter season (when all snowmelt is
complete) that documented cleanup occurs at the site to remove non -snow refuse from the
storage site.
All sediment, debris, and garbage will be managed and treated as waste and will be
removed at the end of the snow storage operational period. Applicant believes that a

10 -year vesting for this Special Review Approval is justified and in the public interest.
Waste removal will be completed following every snow storage operational period
during this requested 10 -year vesting period.
(8) Scenic Impact Consideration
a. Potential scenic impacts of the location of proposed snow storage areas shall be addressed in the
application.
The snow storage operations will be limited to an existing water retention pond and the
height of the snow will be kept below or near the surrounding grade. The site has been
operated as a snow storage facility for many years.
(9) Revegetation
a. If a snow storage area is abandoned for more than two years, revegetation of the site (where
necessary) is required.
Revegetation of the site will be performed by applicant, when necessary, to comply with
all applicable Pitkin County regulations regarding vegetation.
(10) Trips
a. The Applicant shall present a dumping schedule for consideration that includes hours of
operation and estimate number of trucks per hour/day.
Hours of operation are proposed to be from 6 am to 6 pm accommodating four (4) to six
(6) trucks per hour for three (3) to four (4) hours per day.
(11) Noxious Weed Control
a. The Applicant is required to control for noxious weeds.
Noxious weed control measures will be implemented in conformance with applicable
Pitkin County regulations regarding noxious weeds.
(13) Snow dump sites shall be sited at least 200 feet from private wells and public water systems. The
200 foot setback from a public water system shall be measured from the source from which water is
collected for the public water system.
No private wells or public water systems are located within 200' of the snow dump
operations. The snow dump operations will be located in an existing water
retention pond with significant storage capacity.
(14) A snow dump site shall be located at least fifty feet (50') from a property line. The BOCC may
increase this setback if it is found that runoff or other negative impacts may implicate an
adjacent property. The BOCC may decrease this setback if it is found that runoff or other
negative impacts will not implicate an adjacent property.
The snow dump site is located at least 50' from the property line. No negative
impacts to neighboring propoertie4s are anticipated that would require
increasing this setback.
(15) An Applicant for an existing snow dumping site shall test soil annually in the spring, or after
the dumping site has melted. An applicant for an initial snow dumping site shall provide soil

test results in their application to the Community Development Department. In both cases,
the following contaminants shall be tested.
The Applicant has and will continue to test soil annually in the spring or after the
dumping site has melted. At the time of preparing this application, soil testing for
this year is pending and will be forwarded immediately upon receipt. The
Applicant has teste for the contaminants as provided below.
• Volatile Petroleum Hydrocarbons (VPH)
• Extractable Petroleum Hydrocarbons (EPH)
• B -Tex Test
• Oil and Grease
(a) Sampling testing shall occur on each snow dump site. Hadumping site is larger
than one (1) acre every acre of the snow dump site shall be tested.
(b) Testing shall occur on the down gradient of the site, and the test sample should
be taken from an eight (8) inch depth.
(C) The threshold levels for the B-tex test shall be as follows:
Benzene =1ppm
Toluene =1000 ppm
Ethylbenzene =1000 ppm
Xylene = 280 ppm
d. The threshold levels for Total Petroleum Hydrocarbonds (TPH) shall be 500
ppm. TPH is the sum of VPH, EPH, and Oil and Grease.

RECITALS
The New Smuggler Mine Corporation, Inc. (hereafter, the "Applicant"), has applied to the Pitkin
County Board of County Commissioners (`BOCC") for a Special Review for Commercial Snow
Trucking/Dumping/Storage in an existing retention pond. The Applicant has requested a 10 year
permit with this application.
2. The parcel is located at 100 Smuggler Mountain Road. PID#: 2737-074-28-002 (Legal Description,
Attachment A).
3. Snow Trucking/Dumping/Storage is a necessary community service that must be accommodated
within the County. Pursuant to Subsection 4-30-50(1) of the 2006 Pitkin County Land Use Code,
standards have been developed to address the impacts of snow storage areas. The BOCC finds that
the Applicant has shown compliance with these standards.
4. Because the future is uncertain for how the Code will be amended for snow dumps, the BOCC finds that
a 5 year permit is more appropriate as long as annual soil testing is conducted each spring and results
provided to the Community Development Department.
5. Pursuant to condition 4-30-50(1x13)(b), the proposed site is within 50' from a property line. The BOCC
finds that the because the 50' standard was implemented to address runoff onto an adjacent property, and
because the proposed snow dump site has been sited within an existing retention pond, there is very
limited chance for the run-off to reach an adjacent property. Therefore, the BOCC finds that siting the
proposed snow dump in this location is acceptable.
6. The BOCC heard the request at a regularly scheduled and duly noticed public hearing on January 26,
2011 at which time evidence and testimony were presented with respect to this application.
NOW THEREFORE BE IT RESOLVED by the BOCC that it hereby approves the New Smuggler Mine
Corporation, Special Review for Commercial Snow Trucking/Dumping/Storage subject to the conditions
outlined below:
1. The Applicant shall adhere to all material representations made in, or in connection with, the
application.
2. Debris shall not be allowed to accumulate on the snow storage/dumping site. All debris
remaining after the melt out will be treated as waste and removed.
3. This approval shall expire after the 2015/2016 winter.
4. The Applicant shall provide the Community Development Director with soil test results each
year, no later than by the end of September, in accordance with the Land Use Code that

establishes soil testing parameters in effect each September 1 st. If soil testing results do not meet
the thresholds established in effect at the time of testing, the Applicant shall not dump snow at
this site.
5. The Applicant shall comply with all other reporting requirements as may be subsequently
adopted.
6. Snow storage operations shall only be conducted between the hours of 7:00 AM to 7:00 PM,
Monday through Saturday.
7. Trucking to the site shall not disrupt recreationalists on Smuggler Mountain Road.
8. Dust from trucking shall be kept to a minimum. Mud shall not be tracked onto City streets.
9. The Applicant shall revegetate the storage areas in accordance with Community Development
Department standards, if necessary. Weeds shall be managed appropriately under Pitkin County
Land Management guidelines.
10. There shall be no surface runoff from storage/dumping sites unless best management practices are
utilized to remove sediment and other contaminants from melt water and promote infiltration
rather than runoff.
11. Failure to comply with the conditions of approval may result in revocation of this permit.

Public Hearing: Yes. The Applicant shall post a public notice sign on the property at least 15 days prior to the hearing
and shall mail notice to all property owners within 300' of the subject property at least 30 prior to the hearing with the
return address of the Community Development Department (copy of the notice to be obtained from the Community
Development Department). The names and addresses shall be those on the current tax records of Pitkin County as they
appear no more than 60 days prior to the date of the public hearing.
FEES: $1,484
• Planning Office flat fee: $1,300 non-refundable; based on 4 hours of staff time. If staff review time exceeds 4.8 hours, the
Applicant will be charged for additional time above 4 hours at a rate of $325/hour)

(hereinafter "APPLICANT") AGREE AS FOLLOWS:
I. APPLICANT has submitted to COUNTY an application for _� MM£�i air Si�✓�✓
S zz!7�0_ (hereinafter, the "PROJECT').
2. APPLICANT understands and agrees that Pitkin County Ordinance No. 012-2016 establishes a fee
structure for land use applications and the payment of all processing fees is a condition precedent to a determination of
application completeness. The fee structure is based on the COUNTY'S policy that development shall pay, in full, the
cost of development review in the COUNTY. Fees have been set to be consistent and fair to the public and to reflect the
expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed PROJECT, it
may not be possible at the time of application to ascertain the full extent of the costs involved in processing the
application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications shall
accumulate if an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County Commissioners to
enable the Planning Commission and/or Board of County Commissioners to make legally required findings for project
approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right to collect full
fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the amount of $
which is based on —hours of staff time, and if actual time spent by staff to process the application exceeds the average
number of hours by more than 20%, then the COUNTY will bill the APPLICANT quarterly for the additional time spent.
Such periodic payments shall be made within 30 days of the billing date. APPLICANT further agrees that failure to pay
such accrued costs shall be grounds for suspension of processing.

NOTICE IS HEREBY GIVEN that a public hearing will be held on Wednesday,
December 7, 2016 at a regular meeting to begin at 12:00 PM or as soon thereafter as the
conduct of business allows, before the Board of County Commissioners, Library (William
R. Dunaway) Community Meeting Room, 120 North Mill Street, Aspen to consider an
application submitted by Smuggler Consolidated Mines LLC - operator (420 East Main

establish a snow storage operation. The property is located at 100 Smuggler Mountain

Establish a snow storage operation at 100 Smuggler Mountain Road, by Smuggler Consolidated Mines,
LLC and Aspen Green Mountain LLC
I write in connection with the above application for Special Review. I have examined the application
and I know the site well. I wish to object strongly to the newly proposed operating hours proposed in
the new application for operation of a snow storage operation in this location.
The new application specifies a time of 6:30a - 6:30p, but the previous permit allowed operations
during the hours of 7:30a - 7:30p. Allowable hours of Construction in the City limits should be adhered
to for this operation.
The neighborhoods directly adjacent to the Smuggler Mine Parcel are quiet and proposals should be
considered very carefully: operations involving heavy equipment will damage the character and
peaceful setting of the neighborhood while large truck traffic can overwhelm an immensely popular
local road hike. Consideration should also be taken for the safety of pedestrians on this road and
through this neighborhood. Access to the site will be on narrow neighborhood streets heavily traveled
by pedestrians throughout the snowy portion of the year.
The proposed siting of the operation is particularly ill-considered: it is on a busy road used by many
locals and tourists for recreation and walking dogs, and an operation involving large trucks and heavy
equipment here would both diminish the quiet setting of this area. The repeated cannon blasts in the
early morning hours on the 4th of July and Veterans Day, plus the parties which occurred on the site
this year could be heard and felt throughout all of the surrounding neighborhoods. The elevation of
the Smuggler Mine Parcel allows the sound generated on the site to carry across a long distance.

NOTICE IS HEREBY GIVEN that a public hearing will be held on Wednesday,
December 7, 2016 at a regular meeting to begin at 12:00 PM or as soon thereafter as the
conduct of business allows, before the Board of County Commissioners, Library
(William R. Dunaway) Community Meeting Room, 120 North Mill Street, Aspen to
consider an application submitted by Smuggler Consolidated Mines LLC - operator (420
East Main Street, Suite 210, Aspen, CO 81611) and Aspen Green Mountain LLC - owner
(420 East Main Street, Suite 210, Aspen, CO 81611) requesting Special Review approval
to establish a snow storage operation. The property is located at 100 Smuggler Mountain
Road and is legally described as the Smuggler Mine Parcel in the Smuggler Mine
Subdivision USMS #483278. The State Parcel Identification for this property is 2737-
074-28-002. The application/resolution are available for public inspection in the
Community Development Department, City Hall, 130 S. Galena St., Aspen CO 81611.
