Re: Parsons Activity Envelope and Special Review for a Caretaker
Dwelling Unit with Vested Rights (PID 2643-162-00-058; Case P057-
09)
SUMMARY OF RELEVANT PARTS OF APPLICATION: The applicant is requesting an Activity
Envelope Review with Vesting and detached Caretaker Dwelling Unit (CDU) Special Review in
order to re -develop his single family residence.
DISCUSSION: The Pitkin County Environmental Health & Natural Resources Department has
reviewed the details of the Parsons Activity Envelope and Special Review for a Caretaker
Dwelling Unit application under the authority of the Pitkin County Land Use Code and the Pitkin
County OWTS Regulation and has the following comments.
On June 22, 2009, Mike Kraemer and Carla Ostberg from the Pitkin County Community
Development Department conducted a site visit to the property with Grafton Smith,
representative of the owner.
--- WATER SUPPLY:
The existing residence on the property is served by a private well. The applicant provided a
reference to Well Permit #99493 and State of Colorado Office of the State Engineer Change In
Ownership/Address form in the application. In connection with any Onsite Wastewater
Treatment System (OWTS) Construction Permit for the property, this Department will require
proof of an adequate legal water supply. The well permit must be conditioned to include all
uses on the property, including the single family residence and CDU, if applicable.
--- SEWAGE TREATMENT AND COLLECTION:
The existing OWTS on the property was first permitted in 1978 (Permit #78032) to serve a 1 -
bedroom residence. In 1981, a second system was added when the house was remodeled
(Permit #81002). This permit indicates the systems will serve a total of 5 bedrooms. On the
back of Permit #78032, this Department recorded an as -built of the system addition and
indicated that Permit #78032 served plumbing from 2 upstairs bathrooms, the shower room off
the entry, and the downstairs laundry. Permit #81002 served the kitchen, downstairs bath and
shower, and bar sink.

In 1994, Nelson Environmental and Wastewater Solutions, Ltd. (NEWS) evaluated the existing
system and developed recommendations for the design and construction of a replacement
OWTS, as the 1981 system had failed. The report indicated the house had 4 bedrooms and 3-
'/2 bathrooms upstairs (main unit) and 2 bedrooms and 1 bathroom in the caretaker unit (lower
unit). Individual Sewage Disposal System (ISDS) Permit #94013 was issued in 1994. This
system repair included the two existing 1000 gallon tanks, the drywell from 1978 which has 400
square feet of capacity, and a new drywell with 700 square feet of capacity to accommodate 6
bedrooms in the house.
All OWTSs installed within Pitkin County require an OWTS Construction Permit issued by the
Environmental Health & Natural Resources Department, and must comply with the County's
then -current regulations. The County cannot issue a Building Permit until an OWTS
Construction Permit has been obtained, or the exiting system has been assessed as suitable to
serve the proposed development.
