Amendment to License No 386.12A-Pitkin County
AMENDMENT TO ACCESS LICENSE
THIS AMENDMENT TO LICENSE AGREEMENT ("Amendment')is made and
entered into, effectiveOC`1-40c=1— ( 8" 2016, by and between THE ROARING FORK
TRANSPORTATION AUTHORITY (RFTA), hereinafter called the "Licensor" or
"RFTA" and the BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY,
COLORADO, hereinafter called the"Licensee."
Grantor and Grantee entered into a "Access License" on June 16, 2016, recorded in
the records of the Clerk and Recorders Office of Pitkin County, Colorado, under reception
number 630278 on June 28, 2016; and
Grantor and Grantee agree to amend the Access License solely to correct the Corridor
width as described in the WITNESSETH paragraph, being the 2nd paragraph on page 1 of the
Access License;
Grantor and Grantee agree to replace the WITNESSETH paragraph in its entirety with
the following.
"WITNESSETH,that RFTA,for and in consideration of the covenants and agreements
of the Licensee contained herein and upon the terms and conditions stated, hereby licenses and
permits the maintenance and use of a non-exclusive access road ("Access Road"), the Corridor
being 100 feet wide, that is to say 50 feet on each side of the center line of the railroad tracks as
they were laid in 1886, adjacent to the Licensee's property at 99 Lower River Road, Snowmass,
CO 81654.The Access Road is more particularly described as a 16 foot-wide driveway extending
southerly from Lower River Road and along and within the Corridor to permit ingress and egress
to and from the Licensee's property located on the south side of the Corridor (Exhibit A), as
constructed and in place at approximate mile marker 386.12 and an agricultural use area
("Agricultural Area')the Corridor being 200 feet wide, that is to say 100 feet on each side of the
center line of the railroad tracks as they were laid in 1886, adjacent to the Licensee's property at
99 Lower River Road, Snowmass,CO 81654 where the agricultural use is located within RFTA's
Railroad Corridor("Corridor"). The Agricultural Area is as depicted on Exhibit C."
Except as modified by this Amendment the Parties ratify and confirm the Access License.
