AGENDA ITEM SUMMARY WORK SESSION DATE: November 1, 2016 AGENDA ITEM TITLE: Energy Code Addendum STAFF RESPONSIBLE: Brian Pawl, Pitkin County Chief Building Official ISSUE STATEMENT: The purpose of this work session is to discuss the proposed local Energy Addendum as an accompaniment to the recently adopted 2015 International Energy Conservation code (IECC). A series of work sessions began on June 28th with a Matrix of energy code options and strategies that was created to aid in the discussion process and became the structure for the Matrix rewind. (Attachment#1) A Renewable Energy Mitigation Program(REMP) focused presentation was the topic of the July 19`h work session which laid out the initial ground work for the overall REMP discussion which was continued at the August 9th work session. (Attachment#2) Today we will be discussing the culmination of the previous work session topics to create an adoptable ordinance that enhances the current 2015 International Energy Conservation Code, supersedes the Efficient Building code and updates the Renewable Energy Mitigation Program ordinance. BACKGROUND: The BOCC reviewed the introduction and slides of the Matrix at the 6/28/2016 work session stopping before the Mechanical Systems slide. The Review continued on 7/12/2016 from the Mechanical System slide to the REMP overview slide. The REMP discussion at the 7/19/2016 work session covered the background on how the program functions today and some areas that could be the focus of future changes based on the BOCC direction. The 8/9/2016 discussion covered sections of the REMP program that the Energy Addendum group would like to update or create. LINK TO STRATEGIC PLAN: Flourishing and Natural Environment/Conserve natural resources and the environment. KEY DISCUSSION ITEMS: 1. A brief recap of the August 9, 2016 work session and the further Round table discussion that followed with members of CORE, a Consultant, City Staff and County Staff. 2. Staff would like to dedicate the Energy Addendum in memoriam to a local champion of Energy and Sustainability, Michael Augello: "The main thing we want to stress is there is an alternative to throwing everything in the dumpster and taking it to the landfill. The Matrix rewind. Staff has attempted to compile a working document from the direction received from the BOCC and the Addendum Team's desire to produce a functional and effective above code ordinance that demonstrates Pitkin County's commitment to energy efficiency and sustainable construction methods. 4. REMP definition..."The intent of the REMP program is to encourage on- site offset of energy used for energy uses including: houses over 5000 square feet,snowmelt,pools, and spas. If a project opts not to install renewable energy systems on-site to mitigate energy use, a fee equivalent to the cost of offsetting that energy consumption for a period of 20 years is to be paid into the REMP fund. These fees are to be used to install renewable energy production in other locations and provide funding for renewable or efficiency projects throughout the Roaring Fork Valley through collaboration and partnerships." - Energy Addendum Team 5. REMP ordinance edit. Staff has updated sections of the REMP program to reflect an adjustment to the original document using similar logic paths. The intended goal was to analyze the existing credit and offset calculations and revise them as well as addressing items such as existing system credits, house size and heat tape system offsets. 6. The Landfill White Paper on construction waste—summary. 7. 2015 IECC cost study for Colorado - summary. BUDGETARY IMPACT: Use of a Community Grant from CORE for Training, Education, Public Outreach and associated Staff Time. RECOMMENDED BOCC ACTION: Staff's recommendation is for the Board of Commissioners to participate in a discussion of this initial draft and offer guidance and direction regarding goals and concerns. Staff will further refine key decision points as the review continues based on the BOCC direction with public input and present a completed ordinance at a future regular meeting. RE-EXISTING SYSTEMS Pre-e 's ' g snowmelt, pools or spas Installed prior to Aspen Pitkin Energy Conservation Code (APEC adopted in 1995) which are being replaced, overhauled or renovated qualify for exterior energy credit. This credit can only be applied towards an installation of exterior energy on the same parcel. The calculation of the credit shall be based on section 301. The maximum allowable replacement credit shall be 6000 square feet of snowmelt (or 240,000,000 BTU's). The replacement credit may be applied to other exterior energy consumption. Systems installed after the adoption of APECC 1995 without permit approval are not eligible for replacement credit and are subject to all applicable fees. AH: This clause is allowing grandfathering, I 7 of 30 understood the BOCC wanted this deleted. Additionally, remodels/additions should be clarified as any credit being be pro-rated based on the date of CO, as a ratio of the 20 year period. I too thought we were eliminating the grandfathering of older systems when they were getting upgraded, enlarged, etc. The BOCC also suggested some sort of inspection of proper functioning for exterior energy systems (boiler plants etc.) and renewable energy systems upon transfer of properties. Should that go here? Could that be part of the inspection prior to sale? Section 105 -Residential repairs. SECTION 104 PRE-EXISTING SYSTEMS Pre-existing snowmelt, pools or spas installed 20 years prior to the date of permit submission will be eligible for a credit towards the calculated REMP fee. This credit will be a pro-rated based upon the portion of 20 years that have passed since original installation. For example, a system installed 12 years prior would be eligible for a credit of 8 of 20, or 8/20 = .4 of the fee as calculated in Section 201. (NOTE: THIS PRO-RATING ADDRESSES FEES, BUT DOES NOT ADDRESS ISSUES SURROUNDING EXISTING SYSTEMS THAT ARE LARGER THAN THE 6,000FT2 MAXIMUM.) 17 of 30 I Section 105 -Residential repairs. Repairs to building components, systems, or equipment which do not increase their pre-existing energy consumption need not comply with RREMP. All replacement mechanical equipment shall be Energy Star©rated. Section 106 Residential Renewable Energy Mitigation Program(RREMP) for houses 5,000 square feet and more. A new residence 5,000 sq ft or more in area(as defined by the building code), or a residence receiving an addition which brings the area of the residence to 5,000 sq ft or more, is required to offset a portion of its fossil fuel energy consumption through the use of on- site renewable energy or through a fee payment to REMP. In 2015 C&D comprised 55% of the waste entering the Pitkin County Landfill. Avoidance of landfilling C&D provides a greater degree of environmental protection, a smarter use of natural resources, energy savings, savings of landfill air space, and a net decrease in greenhouse gas emissions. This report summarizes the benefits of diverting C&D to assess the potential for recycling and waste diversion in Pitkin County. The report also summarizes potential opportunities for reuse based on resources and facilities located at the Pitkin County Solid Waste Center (SWC) and throughout the Roaring Fork Valley. Pitkin County Landfill Construction and Demolition Debris/Waste Composition The Pitkin County Landfill has an estimated 14 years of landfill capacity remaining. In 2015 the landfill accepted 41,318 tons or 137,272 cubic yards of C&D material, which makes up 55% of the incoming buried waste stream. C&D primarily consists of drywall, lumber, plywood, fixtures, metal framing, and cardboard, plastic sheeting, roofing shingles, concrete, and windows. From 2006 through 2015, 80% of the C&D was ground and used for alternative daily cover in the landfill working face. Building contractors could claim a beneficial reuse credit for ground C&D because of its use as alternative daily cover on the landfill. In December 2015, operations changed and the C&D was no longer ground for use as alternative daily cover; it is now compacted into the landfill. Due to potential air quality issues and the expense of operating a C&D grinder, Pitkin County opted to cease grinding operations and chose to purchase a larger landfill compactor to achieve equal or higher compaction rates for the waste. C&D material for disposal closely follows the economy and building permits. As the economy improves, the number of building and demo permits increases, thus increasing the amount of C&D waste generated. Staff are projecting a decline in the amount of C&D, which closely mimics the drop in construction and demolition permits issued, over the next few years. Even with the decrease in the amount of C&D generated, there is still an abnormally high amount of C&D waste to manage. The County is looking into ways to divert and recycle a bulk of this waste. Existing County Programs for C&D Diversion Pitkin County has a 40%waste diversion rate, as referenced in the 2016 Roaring Fork Valley Waste Diversion Plan. Phase I of the waste diversion study looked at traditional municipal solid waste and recycling; C&D was not studied in detail. The SWC has little in the ways of diversion and recycling opportunities for C&D waste. The SWC currently houses the "Drop and Swap" area where usable materials and furniture can be diverted for no charge. However, the Drop and Swap facility is uncovered and space is limited. The SWC also diverts scrap metal for recycling. However, in many cases, once the C&D arrives at the SWC as trash, it is unrecoverable for any reuse or recycling opportunities. The Roaring Fork Valley is also home to a robust Habitat for Humanity program, with two warehouse facilities in Basalt and Glenwood Springs. Habitat offers the best reuse opportunity of materials and furnishings salvaged from remodels and demolitions. However, the owner and the contractors must make a concerted effort to capture and properly handle those materials before they are sent to the landfill. 27 of 30 During Phase II of the Roaring Fork Valley Waste Diversion Plan, staff will research recycling opportunities that are economically viable for our region. One such solution is to study the effectiveness of adding ground drywall material into the composting stream. Markets for used lumber and other building materials will be researched. Future C&D Waste Diversion Planning Efforts Pitkin County is taking active steps to improve C&D waste diversion efforts. Planning is underway to study more closely the C&D waste stream through a visual waste sort. The composition of the County's C&D waste will be included in Phase II of the Roaring Fork Waste Diversion Plan. In addition to the composition of the C&D waste stream, recommendations for diversion and recycling will be included. Staff also intend to propose an expanded, covered Drop and Swap area in the 2017 budget. The proposed expanded facility will include a covered pole barn type structure, lighting, and staffing to manage the facility. In addition, inventory will be managed and scrutinized for value and reuse opportunity. Staff are researching facility designs and costs to make the most out of the available area and space. The expanded Drop and Swap will be closely modeled after Habitat for Humanity, Monterey, California's Last Chance Mercantile, and Boulder, Colorado's Charm facility. These reuse facilities mimic retail store set ups, and are operated based on profits generated. Materials that come in to the Drop and Swap will be hard goods such as furniture, fixtures, doors, lumber, tile, flooring, reusable construction materials. The expanded Drop and Swap will not accept upholstered furniture or mattresses, electronics, or clothing/textiles. Materials will be inspected by a staff person and managed through an inventory system. Summary The Pitkin County Landfill sees an abnormally high amount of C&D entering the waste stream, this has to do with our unique tourist economy, home values, and limited vacant land for building. Residents, mostly second homeowners, choose to demo existing structures and rebuild. There is very little incentive to encourage homeowners and businesses to de-construct structures to divert waste for reuse opportunities. Through a combination of diversion incentives and regulations, improving diversion facilities at the SWC, and partnerships with local reuse organizations, the County would likely see a decrease in the amount of C&D material from being buried in the landfill.
