Dear Mr. Bedell:
As requested by you, a representative of I lepworth-Pawlak Geotechnical, Inc. performed
percolation testing of the subject site. i
A profile pit and three percolation test holes were dug on October 22, 1946 at the
locations shown on Fig. 1. Percolation holes were hand dug and soaked iu the bottom of
the percolation test pits. The percolation test holes were protected front freezing
overnight with insulation. Percolation testing was performed on October 23, 1996 by a
representative ofhlepworth-Pawlak Geotechnical, inc.
The subsoils encountered in the profile pit consisted of about %z foot of ttlpsoil overlying
sandy silt and clay with scattered lenses of gravel and cobbles to the maximum depth
explored, 8 feet. No free water was encountered in the profile pit and the subsoils were
slightly moist.
The percolation test results are summarized on Table 1. The percolation test results
indicate an infiltration rate:between:6:and-20:minutes:pee-inch? Cobbles were encounter I
in test hole 1 resulting in a slower percolation rate. A.rote oiabout' 10 nlinutes-perincb' 1

Based on the subsurface conditions encountered and percolation test results, the tested site
appears suitable for a conventional infiltration septic disposal system. We recommend the

The above entitled application was filed on April 6, 1977, and was
referred to the undersigned as Water Referee for. Water Division No. 5, State
of Colorado, by the Water Judge of said Court on the 15th day of May, 1977,
in accordance with Article 92 of Chapter. 37, Colorado Revised Statutes 1973,
known as The Water Rights Determination and Administration Act of 1969.
And the undersigned Referee having made such investigations as are
necessary to determine whether or not the statements in the application are
true and having become fully advised with respect to the subject matter of
the application does hereby make the following determination and ruling as
the Referee in this matter, to -wit:
I. The statements in the application are true.
2. The name of the structure is Grueter Well No. 1.
3. The name of the claimant and address is Robert P. Grueter; P.O.
Box 4226; Aspen, Colorado.
4. The source of the water is a well having a depth of 37 feet, and
being tributary to Woody Creek, tributary to the Roaring Fork River.

6. The use of the water is domestic and irrigation.
7. The date of initiation of appropriation is March 15, 1976.
8. The amount of water claimed is 0.055 cubic foot of water per
second of time, absolute.
9. On March 19, 1976, the Office of the State Engineer issued Permit
No. 020702-F, for household use, domestic and irrigation purposes, subject
to the following conditions:
This well shall be used in such a way as to cause no material injury
to existing water rights. The issuance of the permit does not assure the
applicant that no injury will occur to another 'vested water right or preclude
another owner of a vested water right from seeking relief in a civil court
action.
1) A decree for this appropriation must be obtained from the
District Court in and for. Water Division No. 5, State of Colorado, prior to
the use of this well.
2) The pumping rate of this well shall be limited to 25 gallons
per minute or the actual yield of the aquifer, whichever is less. I�

,10. The well was completed and the water applied to beneficial use
for domestic use and for the irrigation of 4 acres of land on April 22, 1976.
The Referee does therefore conclude that the above entitled applica-
tion should be granted and that 0.055 cubic foot of water per second of
time is hereby awarded to the Grueter Well No. 1, for irrigation and domes-
tic uses, with appropriation date of the 15th day of March, 1976, absolutely
and unconditionally; subject, however, to all earlier priority rights of
others and to the integration and tabulation by the Division Engineer of
such priorities and changes of rights in accordance with law, and further
subject to the conditions of approval of the drilling permit as described
in paragraph 9 above.
It is accordingly ORDERED that this ruling shall be filed with the
Water Cleric and shall become effective upon such filing, subject to Judicial
review pursuant to Section 37-92-304 CRS 1973.
It is further ORDERED that a copy of this ruling shall be filed with
the appropriate Division Engineer and the Stare Engineer.
