Management Agreement

This agreement is entered into this � day of January 2017 by and between Pitkin County,
Colorado ("PC") and the Aspen/Pitkin County Housing Authority (`APCI IA").
1. The purpose of this agreement is to identify the terms and cunditions by which PC and
APCHA will manage deed restricted affordable housing units within thejurisdictiou of
PC.
2. PC grants management authority of affordable housing units to APCHA at its sole
discretion.
3. When PC identifies a new unit for management by APCHA, written notice will be given
by submitting the New Unit Information Form (Attachment A). PC will provide keys to
the unit at the time of the written notice.
4. Prior to advertising the unit as available for rent, the unit must be inspected by the
designated APCI IA Property Manager and the APCHA Maintenance Supervisor. Any and
all work that is needed to bring the unit to APCHA rental standards will be noted and
submitted in writing to PC. PC will assign responsibilities for such work.
5. PC will be charged directly for the cost of time and materials for work performed by
APCIIA maintenance. Staff time is charged at the actual pay rate and includes travel
time and associated benefits. If maintenance is called after hours, on holidays or on
weekends, PC will be charged one and one half times the pay rate. For units beyond the
Airport Business Center, a flat h ip charge of $30 will be assessed to cover the round-trip
fuelucosts and use of the City of Aspen vehicle. 1
G. Notwithstanding Paragraph 5 above, PC will not be charged for the cost of time and
materials for work performed by APCHA made necessary, or resulting lion, APCHA's
failure to property maintain a unit or otherwise resulting from APCHA's negligence.
APCHA will be solely responsible for repairing and replacing any damage to an
individual unit resulting from APCHA's negligence or failure to properly maintain a unit
as set foth herein.
7. Tenants will be subject to the standard APCHA Lease Agreement for a tern of one year,
unless PC advises APCHA in writing requesting a month-to-month agreement or six-
month agreement. APCHA utilizes Yardi, a property management tool, to monitor tenant
lease terms and rent transactions.

8. PC will pay APCl1A 12% of gross tents for adminish'ative and management fees whether
the units are rented to PC employees mto (lie public. This fee will be evaluated on an
annual basis.
9. Any and all comtnunicaliuns regarding file tenial unit will go du'ough the designated
APCI-IA Property Manager. PC units and tenants will follow APCIIA guidelines and
Community Rules unless expressly directed otherwise by PC in writing prim' to lease
signing.
10. PC has reviewed the Fair Housing Act (Title VIII of the Civil Rights Act of 1968, as
a�pepded by the Pair Housing Amendments Act of 1988).
