RECITALS
1. Aspen Skiing Company (hereafter referred to as "Applicant") has applied to Pitkin County
Community Development Director ("Director") for a Minor Amendment to a Development Permit
for "further review" pursuant to BOCC Resolution No. 97-199 for two (2) separate additions to the
existing Aspen Highlands Ski Patrol Headquarters. The existing building is approximately 1,523
square feet. A basement addition of approximately 380 square feet and a bathroom addition of
approximately 135 square feet, for a total of 515 square feet, are proposed. Final floor area for the
building is 2,293 square feet. The proposed additions can be viewed as Attachment B.
2. The property is located at 6005 Aspen Highlands Road, at the terminal of the Loge Lift. The
building is located on United States Forest Service Property. PID#: 273513400901. The
property is zoned Ski-Rec and legally described in Attachment A. The United States Forest
Service has provided a letter stating approval for processing the subject application.
3. The original Master Plan for the Aspen Highlands Ski area was approved in 1997 pursuant to
BOCC Resolution No. 97-199. This Master Plan identified short and long term plans for the ski
area. Numerous structures are present within the ski area boundary. The Master Plan specifically
states that expansions of buildings by more than 10% or 1,000 square feet requires "further review".
The subject application constitutes "further review".
4. The Director finds that the proposed additional will not violate any standard located in Land Use
Code Section 2-20-150(b) and the amendment request can be approved. Specifically, the request
is consistent with previous actions taken, does not change the use of the land, does not constitute
a new land development activity, does not endanger the health, safety, or welfare of the public,
and does not violate any other Land Use Code Standard.
5. The Director further finds that the additions will not be any greater in height than the existing
building and the additions will mimic the green color of the existing building. Pursuant to Land
Use Code Section 7-20-120(d), the additions will have no additional scenic impact.
6. The Director further finds that the additions will be located in compliance with Chapter 7 of the
Land Use Code and will not be located in any constrained areas.
7. The Director further finds that pursuant to Land Use Code Section 6-30-150, the additions are less
than 1,000 square feet, will not create any additional employees and are therefore exempt from the
Commercial Growth Management Quota System (GMQS).

1. The Applicant shall adhere to all material representations made in the current or prior applications or
in public meetings or hearings, and shall consider those representations to be conditions of approval,
unless amended by other conditions.
2. The Applicant shall obtain all appropriate building permits for the additions.
3. The additions shall mimic the green color of the existing building and utilize non -reflective
roofing.
4. Failure to comply with the conditions of this approval may result in revocation of this approval, or
any subsequent permit(s) or approval(s) related to this property, or vested rights associated with
this property.

Description of Project/Development: The Applicant requests "further review" pursuant to BOCC Resolution No. 97-199,

Headquarters Remodel
Dear Michael,
This cover letter summarizes Aspen Skiing Company's (ASC) request to submit a Minor
Amendment to a Development Permit Application for the Aspen Highlands Patrol Headquarters
(PHQ) Remodel.
During the Pre -Application Conference on December 8, 2016, I described the proposal to include
2 small additions (380s.f for the Basement, 135s.f. for the Restroom) for a total of 515s.f. of
additional floor area, onto the total existing PHQ floor area of 1,523s.f., or total F.A.R. of
2,293s.f. (which includes the deck).
I also described that the project is necessary because this past year ASC worked with the USFS
and Kara Silbemagel & Co to complete the Emergency Communication Antenna/Radioroom
upgrade on Loge Peak, which is now up and running and the fact that the floor space for the
expanded radioroom came from existing floor space in the PHQ basement. While Mac Smith and
Kevin Hagerty agreed to give up this space for the radioroom, the plan was to replace that lost
space (needed for storage, patrol operations, boot -packer meetings, etc.) this coming summer
with an actual addition of equal size lost (+/-).
And, in conjunction with this space addition, it seemed that adding 2 additional public restroom
compartments (to the existing SINGLE stall), with improved access, as a much needed guest
amenity was warranted.
Your attached Pre -Application Summary identifies the "Minor Amendment to a Development
Permit" as the appropriate Land Use Application process. Enclosed with this cover letter are:
1) An 11"xl7" and 24" x 36" Site Plan showing existing improvements and proposed
additions;
2) A rendering of the existing building and proposed additions.
3) Disclosure and proof of ownership of the property, consisting of a current certificate from a

AGREEMENT FOR PAYMENT OF LAND USE APPLICATION FEES
PITKIN COUNTY (hereinafter COUNTY) and Aspen Skiing Company
(hereinafter APPLICANT) AGREE AS FOLLOWS:
APPLICANT has submitted to COUNTY an application for Aspen Highlands PHQ Remodel
, THE PROJECT).
2. APPLICANT understands and agrees that Pitkin County Ordinance No. 030-2009 establishes a
fee structure for land use applications and the payment of all processing fees is a condition precedent to a
determination of application completeness. The fee structure is based on the County's policy that development
shall pay, in full, the cost of development review in Pitkin County. Fees have been set to be consistent and fair
to the public and to reflect the expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it may not be possible at the time of application to ascertain the full extent of the costs involved in
processing the application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications
shall accumulate if an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County
Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally
required findings for project approval, unless current billings are paid in full prior to decision.
6. . Therefore, APPLICANT agrees that in consideration of the COUNTY's waiver of its right to
collect full fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the
amount of $ 975 which is based on 3 hours of staff time, and if actual time spent by staff to process the
application exceeds the average number of hours by more than 20%, then the COUNTY will bill the
APPLICANT quarterly for the additional time spent. Such periodic payments shall be made within 30 days of
the billing date. APPLICANT further agrees that failure to pay such accrued costs shall be grounds for
suspension of processing.

Dear Michael,
With regard to the proposed improvements at Aspen Highlands Ski Area, Loge Peak Ski Patrol
Headquarters- Aspen Skiing Company (ASC) has completed an environmental review in
accordance with the National Environmental Policy Act (NEPA) and was issued a Decision
Memo "Loge Peak Communications Site Improvements Project" in July of 2016. The approved
projects are described and are included in the 2013 Master Development Plan for Aspen
Highlands Ski Area, accepted by the United States Forest Service (USFS).
As the holder of the land at Loge Peak, the USFS hereby gives approval for ASC to proceed with
the Pitkin County processes of application and review of improvements as described in the
7/2016 Loge Peak Decision Memo. Further, the USFS designates Victor Gerdin, Director of
Mountain Planning -Aspen Skiing Company as an authorized representative to submit a "Minor
Amendment to a Development Permit" with Pitkin County.
Aspen Skiing Company will be working closely with my staff during the design and build phases
of this project to ensure Project Design Criteria stated in the 7/2016 Decision Memo are

Skiing Company.
