Title Officer __ Contract#119 2017 Revision 02/13/2017kkm Budget Lme Item#166 63 00928 82007 V 91TKIN COUNTY • PITKIN COUNTY CONTRACT FOR PROVISION OF SERVICES PROFESSIONAL CUSTODIAL SERVICES THIS CONTRACT, made May 30, 2017 by and between the Board of County Commissioners of Pitkin County, Colorado, 123 Emma Rd., Suite #106, Basalt, CO 81621, (hereinafter called the "County") and US Cleaning Professionals, P.O Box 1285, Dillon, CO 80435 (hereinafter called the "Contractor") to perform the following work: Pitkin County Library Professional Cleaning Services ("Project"). 1 Term of Contract: The tens of this contract is from June 1,2017 to December 31,2017. At the expiration of the initial term, the contract may be extended for three (3) additional terms of one (1 ) year by the express written consent of both parties. II. Contractor's Obligations. Contractor shall provide custodial services to the Pitkin County Library ("Library"), located at 120 N. Mill St. Aspen, CO 81611, seven (7) days a week. Contractor shall supply all equipment required to fulfill the work described hereinafter. County shall supply all consumable supplies with the exception of trash can and recycle bin liners. All supplies, chemicals and other solutions shall be shared with Contractor and supplied on a regular basis to the Contractor staff. Any requested changes in chemicals or supplies shall be communicated to the County Representative or County Facilities Custodial Supervisor, for approval Services shall include but are not limited to the below, (Exhibit A for full scope, frequency and expectations beyond what is described below): Empty trash receptacles. Clean drinking fountains Sweep and damp mop or scrub bathrooms. Clean all toilet fixtures and replenish toilet supplies. Dispose of all trash and garbage generated in or about the building Sweep floors and vacuum carpets in entrances, lobbies, stairs, elevators, meeting rooms, and corridors Dust horizontal surfaces. Vacuum all carpets Spray huff resilient floors m kitchen, bathrooms and entrances Thoroughly dust furniture. Sweep storage space. Spot clean all wall surfaces within 70 inches of the floor. Wash all trashcans in offices, public areas, break room(s), eating and sending area(s), and all hallway trashcans. Damp wipe toilet wastepaper receptacles, stall partitions, doors, windowsills, and frames. Wash all interior windows on entryways. Strip and apply four coats of finish to resilient floors in toilets. Strip and refinish main entryways and kitchen and other heavily trafficked areas. Wash all blinds and then dust six months from washing. Vacuum or dust all surfaces in the building up to 70 inches from the floor, including light fixtures. Vacuum all furniture in place. Spot clean carpets in public areas, elevators, stairways, offices and lobbies Clean balconies, handrails, ledges, areaways, and public counters. As agreed a set schedule will be as follows unless otherwise pre-approved by the County. The work schedule for this location shall be seven(7) days per week, 365 days per year,and Contractor shall provide supervision and crew members for ten(10)hours per day, seven days per week, including most holidays and an additional periodic cleaning of 12 hrs. per week in accoidance with Proposal: Monday - Thursday 8:30 p.m. —3.30 a m (1/2 lunch) Friday— Sunday 6:30 p.m.— 1:30 a.m. (1/2 lunch) Contractor shall provide an on-site shift supervisor/leader, fluent in English, to work with custodial staff each day, monitoring progress throughout the facility. County prefers at least one worker speak, read and understand English and/or one English speaking on-site supervisor/leader must be available for translation for fire department or other County employees as needed. Security. Library cleaning staff will be assigned a personal door code to the facilities shop, located at 485 Rio Grande Place #101, Aspen, where they are expected to start and end their shift. Two sets of keys will be provided to the contractor, and will be kept at the facilities shop to be picked up each day Supervisory staff will also have a personal door code to access to the facilities shop to pick up keys or meet with the County. Personal access codes shall not be shared by any employee to any other person or persons, including hut not limited to county staff If a code has been compromised, the county shall be notified within 2-hrs, regardless of day or time, so that the access can be blocked and a new code assigned as needed. Replacement of keys shall be a charge of$50 per key, per event. Holidays the Library is open to the public year-round. Custodial services will be required on all national and local holidays except Christmas and New Year's Day unless otherwise negotiated prior to execution of the contract. Training: Any changes in staffing for the Library cleaning service, the County requires notification within 3 days of any changes in staffing, including required documentation and security clearances. III. Compensation and Expenses, Invoicing, Payment and Offset. The County shall compensate Contractor for its services in accordance with the Project Budget and Schedule set out in Paragraph II. It is expressly understood and agreed that in no event will the total compensation and reimbursement to be paid hereunder exceed the sum of eighty thousand dollars and zero cents ($80,000 00) for all services rendered. By contract or amendment, the County and Contractor may reallocate the budget among project tasks if the total budget amount remains unchanged Contractor shall invoice for the project monthly based on hours worked, with payment expected within thirty (30) days of invoice Any payment by the County may be offset by any amount the Contractor owes the County for any reason. IV County's Exclusive Ownership of Work Product. Drawings, specifications, guidelines and other documents prepared by Contractor in connection with this contract shall he the property of the County. However, Contractor shall have the right to utilize such documents in the course of its marketing, professional presentations, and for other business purposes. Contractor assigns to County the copyrights to all work prepared, developed, or created pursuant to this contract, including the right to: 1) reproduce the work; 2) prepare derivative works, 3) distribute copies to the public: 4) perform the works publicly, and 5) to display the work publicly. Contractor shall have right to use materials produced in the course of this contract for marketing purposes and piofcssional presentations, articles, speeches and other business purposes V Pitkin County's Obligations. Pitkin County shall administer this contract through a County Representative. Jodi Smith, Facilities Director will manage the project as the County's Representative. in the event that Jodi Smith is not available, Raimondo Martinez, Facilities Custodial Supervisor shall assume the County Representative's 3 Contract#119 2017 Revision 02"13P017trm Budget Line Item# 166 63.00928 82007 duties The services provided and products delivered by the Contractor under this contract will be subject to review by the County's Representatives, or a designee, for compliance with Contractor's obligations prior to final payment. VI. Termination Prior to Expiration of Contract Term The County has the right to terminate this contract,with or without cause,by giving written notice to the Contractor of such termination and specifying the effective date thereof Such notice shall be given at least ten (1W days before the effective date of such termination. In such event all finished or unfinished documents, data. studies and reports prepared by the Contractor pursuant to this contract shall become the County's property. Contractor shall be entitled to receive compensation in accordance with the contract for any satisfactory work completed pursuant to the terms of this contract prior to the date of termination. Notwithstanding the above, Contractor shall not he relieved of liability to the County for damages sustained by the County by virtue of any breach of the contract by the Contractor. VII Independent Contractor Status A. The parties to this contract intend that the relationship between them contemplated by the contract is that of independent contractor. Contractor, and any agent, employee, or servant of Contractor shall not be deemed to be an employee, agent, or servant of Pitkin County. B Contractor is not required to offer his services exclusively to Pitkin County under this contract. Contractor may choose to work for other individuals or entities during the term of this contract, provided that the basic services and deliverable products required under this contract are submitted in the manner and on the schedule defined under this contract. C Contractor warrants that all work produced will conform to all applicable industry standard of care, skill and diligence in the performance of Contractor's obligations under this contract. D Contractor shall not attempt to oversee or supervise the work or actions of any Pitkin County employee, servant or agent in the course of completing work under this contract. E. Contractor is not entitled to any Workers' Compensation benefits through Pitkin County and is responsible for payment of any federal, state, FICA and other income taxes VIII Assignability. This contract is not assignable by either party. Any use of subcontractors by the Contractor for performance of this contract must he accepted in writing by the County. IX. Severability. Intea.ration and Modification. A This contract represents the entire and integrated contract between the County and the Contractor and supersedes all prior negotiations, epresentations, or contract, either written or oral. This contract may be amended only by written contract signed by both the County and the Contractor. B. The County may, from time to time,request changes in the scope of services of the Contractor to he performed hereunder Such changes, including the increase of decrease in the amount of the Contractor's compensation, which are mutually agreed upon between the County and the Contractor, shall be in writing and upon execution shall become part of this contract. XI Indemnity. A. The Contractor agrees to indemnify, hold harmless and, not excluding the County's right to participate, defend the County, its subsidiary, parent, associated and/or affiliated entities, successors, or assigns, its elected officials, trustees, employees, agents, volunteers, and any jurisdiction or agency issuing permits for any work included in the project, hereinafter referred to as indemnitee, from all suits and claims, including attorney's fees and cost of litigation, actions. loss, damage. expense, cost or claims of any character or any nature arising out of the work done in fulfillment of the terms of this Contract or on account of any act,claim or amount arising or recovered under workers' compensation law or arising out of the failure of the Contractor to conform to any statutes, ordinances, regulation, law or court decree It is agreed that the Contractor will he responsible for primary loss investigation, defense and judgment costs where this contract of indemnity applies. In consideration of the award of this contract, the Contractor agrees to waive all rights of subrogation against the County its subsidiary, parent, associated and/or affiliated entities, successors, or assigns, its elected officials, trustees, employees, agents,and volunteers for losses arising from the work performed by the Contractor for the County. R The Contractor further shall investigate, process, respond to, adjust, provide defense for and defend,pay or settle all claims, demands, or lawsuits related hereto at its sole expense and shall bear all other costs and expenses related thereto, even if the claim, demand or lawsuit is groundless, false or fraudulent XII. Insurance. The County in no way warrants that the minimum limits contained herein are sufficient to protect the Contractor from liabilities that might arise out of the performance of the work under this Contract by the Contractor, its agents, representatives, employees, or subcontractors. The Contractor shall assess its own risks and if it deems appropriate and/or prudent,maintain higher limits and/or broader coverages The Contractor is not relieved of any liability or other obligations assumed or pursuant to the Contract by reason of its failure to obtain or maintain insurance in sufficient amounts, duration, or types. XIV. Records The Contractor shall maintain comprehensive, complete and accurate hooks, records, and documents concerning its performance relating to this contract for a period of three (3) years after final payment under the contract and the County shall have the right within the three(3) year period to inspect and audit these books, records and documents, upon demand, in a reasonable manse! and at reasonable times, for the purpose of determining, by accepted accounting and auditing standards, compliance with all provisions of the contract and applicable Law. 8 Contract U 119 2017 aewsoon 02/73/2017am Budget Line Item#166.63 00928 82007 XV Contract Made in Colorado The patties agree that this contract was made in accordance with the laws of the State of Colorado and shall be so construed. Venue is agreed to he exclusively in the courts of Pitkin County, Colorado. XVI. Attorney's Fees. In the event that legal action is necessary to enforce any of the provisions of this contract, the substantially prevailing party shall be entitled to its costs and reasonable attorney's fees XVII. Governmental Immunity. Contractor agrees and understands that Pitkin County is relying on and does not waive, by any provision of this contract, the monetary limitations or terms (presently $150,000 per person and $600,000 per occurrence) or any other rights, immunities, and protections provided by the Colorado Governmental Immunity Act, 24-10-101, et seq., C'.R.S., as from time to time amended, or otherwise available to Pitkin County or any of its officers, agents or employees. Further, nothing m this contract shall be construed or interpreted to require or provide for indemnification of the Contractor by the County for any injury to any person or any property damage whatsoever which is caused by the negligence or other misconduct of the County or its agent or employees. XVIII. Current Year Obligations.The parties acknowledge and agree that any payments provided for hereunder or requirements for future appropriations shall constitute only currently budgeted expenditures of Pitkin County Pitkin County's obligations under this contract are subject to Pitkin County's annual right to budget and appropriate the sums necessary to provide the services set forth herein. No provisions of the contract shall constitute a mandatory charge or requirement in any ensuing fiscal year beyond the then current fiscal year of Pitkin County No provision of the contract shall be construed or interpreted as creating a multiple-fiscal year director indirect debtor other financial obligation of Pitkin County within the meaning of any constitutional or statutory debt limitation. This contract shall not directly or indirectly obligate Pitkin County to make any payments beyond those appropriated for Pitkin County's then current fiscal year. No provisions of this contract shall be construed to pledge or create a lien on any class or source of Pitkin County's moneys, nor shall any provision of this contract restrict the future issuance of Pitkin County's bonds or any obligations payable from any class or source of Pitkin County's money. XIX. Notice Any notice required or permitted under this Agreement shall he in writing and shall be hand-delivered or sent by registered or certified regular mail, postage pre- paid and via e-mail (electronic delivery) to the mailing and e-mail addresses set forth below. Compliance with the performance of the work to meet these specifications is the sole responsibility of the Contractor and shall he assured by systematic weekly inspection of the premises by a competent employee of the Contractor. Completion of the inspection form provided shall be submitted to the Facilities Custodial Supervisor upon completion of said inspection. Any deficiencies shall be corrected within 24 hours or as agreed upon by the Contractor and the Facilities Custodial Supervisor. The Contractor shall submit a monthly schedule to the Facilities Custodial Supervisor when inspections are to be made so that the Facilities Custodial Supervisor or assigned staff may accompany the Contractor if desired. The Facilities Custodial Supervisor may request additional inspections at any time. Any discrepancies noted either from inspection reports or from Facilities Custodial Supervisor shall be corrected within the next scheduled normal workday period. Services shall be provided in all areas of the premises except those areas specifically excluded by the Contract. When performing any services it is the Contractor's responsibility to ensure due diligence is practiced to insure a complete and thorough job. The Contractor is to provide all the necessary equipment, products and training as required insuring compliance with the contract. Any damage to the premises observed by the Contractor should be reported to the Facilities Custodial Supervisor immediately. Any damage caused by the Contractor shall he repaired, corrected or replaced at the sole expense of the Contractor and in a timely manner. Exclusions: Snow removal, changing light bulbs, Kleenex, carpet replacement, plumbing, electrical or HVAC repairs. 3 RECYCLING Office paper recycling containers arc located throughout Pitkin County Library. Recyclable materials shall he collected daily and deposited into approved collection bins in the alley. The recycle bins and trash cans must be secure and locked after each use. Cardboard shall be stored outside the recycle bins in the alley, the County will haul them to the recycle center as needed. 4 TIME OF SERVICE Services shall not begin nightly at 8-30 pm Monday through Thursday and at 6:30 pm on Friday through Sunday unless otherwise arranged with Facilities Custodial Supervisor pnor to schedule change. The Facilities Custodial Supervisor must have a minimum of seventy-two(72)hours advance notice to coordinate any additional periodic work with appropriate staff. The Library is open to the public veal-round. Custodial services will be required on all national and local holidays except Christmas and New Year's Day, unless otherwise negotiated prior to execution of the contract. LIBRARY EMERGENCY NOTIFICATION Pitkin County Facilities stale shall be responsible tiff emergencies that arise such as broken pipes, over flowing toilets or clogged drains, inoperative heating, etc.,that might occur in the terminal. The Contractor shall be responsible for contacting Facilities staff in the event of such emergencies immediately to prevent damage to the facility. T he Contractor shall notify the County staff by calling 970.920.9310 and asking Facildics to he paged to the Library and indicate the problem or emergency. 6. KEY POLICY A. The successful Contractor will provide the required employee information to the Pitkin County Facilities Custodial Supervisor. A minimum of two (2) days will he required before any employee may report to work. B. Pitkin County and or the Facilities Custodial Supervisor retain the right to have any Contractor's employee removed from the premises for any reason. Said reason does not have to be disclosed to the Contractor, C. All keys and access Lards are and will remain the property of Pitkin County. POLISH The refurbishing of special surface finishes, such as metal, woods, etc , by the rubbing of the surface with the appropriate approved utensil and chemical agent to produce a high degree of luster and surface protection RECYCLING The collection of office paper,magazines, aluminum cans and plastic bottles as a means of diverting these items from the County's waste stream. REFINISII The application of material to any surface. REPLENISH The placement of consumable supplies in appropriate dispensers. SANITIZE The application of an appropriate approved germicidal cleaning agent either as an integral step in the cleaning process or as a post application after cleaning. SHAMPOO The restorative cleaning of carpet or upholstery including the application of protective treatment by means of dry or wet chemicals and approved techniques SPRAY BUFF The spraying of a light coating of finish on a floor surface while agitating with a buffing machine with appropuate pads, to provide a luster finish. SPOT ('LEAN A spot is a foreign substance on the surface of the carpet fibers and can be removed by approved chemical or mechanical action The removal of any foreign substance from small areas of carpeted floor surfaces, as needed, by means of approved carpet cleaning methods and cleaning products. Spot cleaning is to be performed in all areas of the facility on a daily basis. SPOT REMOVAL Spots are to be removed from any carpeted area on a daily basis using only pre-approved methods and chemicals. UPHOLSTERY The removal of stains and soiled spots on upholstered furniture by means of the appropriate approved method and cleaning agents. OTHER SURFACES The removal of soil from walls, switch plates, glass, door Jambs, doors, etc., by means of sponge and mild cleaning agents SWEEP The removal of loose dirt and debris from masonry, composition, tile or other non-carpeted floor surfaces by means of brooms or vacuuming. IOPSCRUB/SCRUB The removal of top layer of finish and application of a new finish to any surface. TRASH The removal of all discarded materials in wastebaskets and/or other trash receptacles from all areas of the building and depositing in approved trash receptacles outside the building. This includes any and all containers marked trash VACUUM The removal of loose dirt, liquid, and debris from floors or other surfaces by means of vacuum cleaner and appropriate attachments. WASH The cleaning of an item by dipping, scrubbing, and rinsing in water with appropriate chemical agents added. WET MOP The removal of adhered dirt or other material from masonry, composition, tile, or other non-carpeted floor surfaces by means of sponge or string mops using mild cleaning agents dissolved in water. QUARTERLY 4 times per year; cleaning services must commence during the first week of September, December, March and June. SEMI-ANNUAL 2 times per year; cleaning services must commence during the first week of November and April ANNUAL Cleaning services must commence one time per year. 8. METHOD OF PAYMENT The Contractor will be paid on a monthly basis in arrears Invoices must contain the contract number. Disputed claims will be negotiated by the Contractor and the Facilities Custodial Supervisor and resolved prior to approval of the invoice by Pitkin County for payment. Purchase card account payments may also be set up with Pitkin County. CONTRACTOR'S PERFORMANCE A. REQUIREMENTS The Contractor shall furnish all necessary trained personnel, supervision, scheduling, equipment, cleaning chemicals, vacuums, supplies, bathroom supplies and other accessories required to perform the custodial services at the at the County Library as designated in the Scope of this RFP and all ATTACHMENTS. All work shall be performed in strict accordance with the conditions, provisions, standards, and specifications described herein. B QUALITY AND ACCEPTABILITY OF WORK The County Facilities Custodial Supervisor or their authorized representative shall decide all questions, which may arise as to the quality and acceptability of any work, performed under the resultant contract. If, in the opinion of the County Facilities Custodial Supervisor performance becomes unsatisfactory, the County shall notify the Contractor, its authorized representatives, or agents. C. UNSATISFACTORY CLEANING PERFORMANCE Upon notice of unsatisfactory cleaning performance, the Contractor will have twenty-four(24) hours from that time to initiate corrective action in any specific instance of unsatisfactory cleaning performance In the event the Contractor has not responded within the allotted ninety (90) minutes to telephone contact, or the Contractor has not initiated corrective action for the unsatisfactory cleaning performance within the twenty-four 124)-hour time frame after notification as described above, the County has the right to immediately complete the work to its satisfaction, through use of County employees at a rate equal to the employee's hourly rate plus twenty-percent (20%) for County administrative costs, or through use of outside Contractor at the rate charged to the County plus twenty-percent (20%) and shall deduct that amount from any balances due or which may become due to the Contractor D SHORTAGE OF CLEANING SUPPLIES Should the Contractor not furnish the proper supplies, the County will make a one-time purchase of the needed supplies and charge them against the Contractor's invoice at the County's cost plus twenty percent (20° )). If the Contractor does not provide proper supplies after this action, then the Contractor will be in danger of default 12. DEFAULT A. Repeated incidents of unsatisfactory cleaning performance, shortage of hours, or failure to comply with other terms of the contract will result in a recommendation for termination for default by the Facilities Custodial Supervisor. B. If the Contractor receives three (3) or more deductions, adjustments or applications of liquidated damages within any thirty(30) workday periods or more than a total of twenty (20) deductions during a twelve (12)month period, the contract may be automatically terminated for default. C. Termination for default of any portion of the contract shall result in termination of the entire contract for default. 13. ADDITIONAL COUNTY REQUESTED CUSTODIAL SERVICES In the event that other Custodial Services, in addition to or separate from the services specified herein, may he deemed necessary by the Facilities Custodial Supervisor or authorized representative, the Contractor may he requested to perform the additional or special service. The County on the basis of the hourly labor rate specified by the Contract will reimburse the Contractor. Proposal Price Schedule, plus the cost of the materials needed for the cleaning services beyond those required for regularly scheduled services. 14. CONTRACTOR'S EMPLOYEES A All employees and representatives of the Contractor's company must be fluent enough in the English language to read and understand chemical labels and signs as well as converse intelligibly with County management and other personnel. The Contractor's supervisor,'leader must be fluent in the English language; both verbally and in writing B. The Contractor hereby agrees that any of its employees who may be assigned to the Pitkin County buildings to satisfy Contractor's obligations under this Contract shall be used exclusively for that purpose during the hours when they arc working in areas cos ered by this contract and shall perform no other custodial work at Pitkin County facilities for this contract. In the event that other custodial services, in addition to or separate from the service specified herein, may be deemed necessary by the Facilities Custodial Supervisor or his authorized representative, the Contractor may be requested to perform the additional or special service. The Contractor will be reimbursed by the County on the basis of the hourly labor rate specified by the Contractor in the Proposal Price Schedule of this agreement, plus the cost of the materials needed for the additional cleaning services. 15. TYPE OF WORK SUPERVISION The Contractor shall provide on-site supervision to assure competent performance of the work during the scheduled hours Also the Contractor or authorized agent will make sufficient routine inspections to ensure that the work is performed as required by this Contract. The supervisor/leader must be literate and fluent in the English language, because of the necessity to read chemical labels, job instructions and signs, as well as the need for conversing with Library personnel 16. INSPECTIONS A The Facilities Custodial Supervisor or designee will conduct random inspections of the area covered under this contract. B. The Facilities Custodial Supervisor and the Contractor Supervisor or higher official shall conduct joint inspections of each location on a monthly basis. The date and time shall be mutually agreed upon. 18. DELIVERY OF SUPPLIES Because the County is providing services, which involve the health, safety, and welfare of the general public, delivery time is of the essence. Delivery must be made in accordance with the delivery schedule promised by the Contractor and agreed to by the Facilities Custodial Supervisor. 19. SAMPLES/DEMONSTRATION The Contractor may be required to furnish a sample of the goods and/or demonstration of the services to be provided. Any sample submitted and/or demonstration performed shall create an express warranty that the whole of the goods/services shall conform to the sample demonstration. All samples become the property of the County unless designated otherwise by the Contractor. 20 ENERGY CONSERVATION The Contractor shall practice energy conservation and all lights must he turned off when finished in each area and before leaving the building at night, all windows and doors shall be closed if found open when cleaning. Do not turn on computers or use other electronic equipment owned by the county. 21 STORAGE SPACE A. The Contractor may store supplies, materials and equipment in storage arca on the Pitkin County facility premises designated by the County The Contractor agrees to keep its portion of this storage area in accordance with all applicable fire regulations The use of County storage facilities will be on a space aN affable basis and subject to the approval of the Facilities Custodial Supervisor. B. No materials or equipment shall be stored or temporarily set in restrooms or other spaces accessible to the public. 22 END OF CONTRACT REVIEW A Approximately ten 1101 days prior to the end of the contract, the Contractors representative and the Facilities Custodial Supervisor will schedule a walk through inspection of the facilities to review cleanliness B If the cleanliness level of a facility is below that of the cleanliness standards established by the tents, conditions, and provisions of the contract, the County will hold the last monthly payment for that facility until the cleanliness standards are met 23 SAFETY MEASURES The Contractor must certify that all employees and representatives are trained to recognize and understand the Universal Safety Symbols The Contractor's supervisor shall be fluent in the English language, and the language of the custodians. 23 PROPERTY DAMAGE The Contractor shall be responsible for repair of any damage to County property and restoration of any facility damage beyond normal wear and tear, caused by Contractor's Custodial activities, Repair and restoration shall he to the satisfaction of the Facilities Custodial Supervisor. Any repair or restoration of these damages shall be pertirnned at no cost to the County. 25 OSHA and EPA GUIDELINE COMPLIANCE A. OSHA GUIDELINES HAZARDOUS COMMUNICATIONS The Contractor shall comply with the current OSHA Standards on I lazardous Communications as it pertains to the training, safety, and equipment needed for all employees engaged in custodial service. The Contractor shall be iesponsible for compliance on date of Contract acceptance and shall provide proof to the Facilities Custodial Supervisor at the Pre-Start lip Meeting. B. MATERIAL SAFETY DATA SIIEPTS The Contractor shall furnish to the Facilities Custodial Supervisor or designee copies of Material Safety Data Sheets for all pioduels used pnor to beginning service in any facility. The Material Safety Data Sheets must be organized and include an index. These Material Surety Data Sheets must he in compliance to the OSIIA Guidelines C. LABELING OF HAZARDOUS MATERIALS The Contractor shall comply with the OSHA tiuideline, concerning the labeling of all chemical containers. D. CAUTION SIGNS The Contractor shall provide and use "caution signs" as required by OSI IA Guidelines E. OSHA GUIDELINES BLOOD PATHOGENS The Contractor shall comply with the OSHA Standard"Blood borne Pathogens" as it pertains to the training, safety, and equipment needed fit all employees engaged in Custodial service. The Contractor shall he responsible for compliance on trate of Contract acceptance and shall provide proof to the Facilities Custodial Supervisor at the pre-start up meeting. F. EPA The Conti actor is responsible for cleaning bodily fluid spills of a two (2) foot square area, or less. Immediately notify the Facilities Custodial Supervisor or designee for any bodily fluid spills larger than two (2) feet square. It is the sole responsibility of the Contractor to comply with any and all Fnvironmental Protection Agency(EPA) regulations. (For example: proper labeling, storage and or disposal of any products used by the Contractor ) Should the EPA have any additional requirements, it is the sole responsibility of the Contractor to insure compliance. Should the Facilities Custodial Supervisor or designee determine noncompliance, the Facilities Custodial Supervisor or designee retains the right to take any and all actions deemed necessary to comply with EPA regulations?
