DEVELOPMENT (PUB)OVERLAY
ORDINANCE NO, 0/3 -2017
RECITALS:
I. Andrew and Jeanne Doremus(hereafter "Applicant")has applied to the Board of County
Commissioners of Pitkin County,Colorado("13000")to rezone the property with a Planned Unit
Development(PUD)overlay.
2. I he property k located at 8:+ Glen Garry Drm e and k described as Block I. Lot 15 of the Aspen
Highlands Subdivision,plus the Baldwin Tract. Che State Parcel Identification for the property
is 2735-142-01 007.
3, The property is zoned R-30 and contains 2.35 acres.
4. The Pitkin County Planning and Zoning Commission considered the proposed rezoning at regularly
scheduled meeting on December 131' 2016 and recommended approval by a yore of SM.
5. The 1300C considered the proposed rezoning on lint Leading at a duh noticed public hearing on
February 8'", 2017 and on second reading at a regular meeting on March 8°l 2017
6 The BOCC finds that the proposed land is eligible for rhe PUD overlay designation,pursuant to
Sec.3-7(4)0(c)of the land (Ise Code as it w dl protect desirable open space to the Urban Area.
7. The BOC'(' further finds that the rezoning of the property w ith a PUD overlay\sill not increase
density and will present scenic quality.
8. The BOC C turner finds that the rezoning Is consistent w ith Secs. 2 30-400)and 2-40-10(c)(2)of
the Pitkin County Land Use( ode
NOW, THEREFORE. BE IT ORDAINED by the Board of County Commissioners of Pitkin County,
Colorado that it hereby rezones the Doremus property with a PUD overlay and authorizes the Chair to
sign the Ordinance and upon the satisfaction of the County Attorney as to ;arm.esecule any ether
associated documents necessary to complete this matter,
