Changes must be approved by this Department and the engineer prior to construction. This system will consist of a tank for each building (2000 gallon for main home, 1000 for CDU), each 2 compartment concrete tank must be accessiblefrom grade and have an effluent filter in the outlet tee. Each tank will flow to splitter box that is level and accessible from grape. This will flow to a level manifold which will evenly distribute effluent to each of the 5 trenches. Each trench will consist of 14 chambers, observation ports must be installed at each end of each trench. Field area must be at least 116' from any well,; and at least 100' from a stream. This Permit must be kept on-s"te during installation. The engineer must do a final inspection of the installation and submit an "as -built" letter to this Department within 30 days of the final inspection, unless a longer period of time has been agreed upon, in writing. This Department must also be called for the final inspection with a minimum of 48 hours notice. Minimum horizontal distances between components of the system and physical features shall conform to the requirements of the Pitkin County OWTS Regulation. This Permit is conditioned upon the property owner(s) providing for regular inspection, cleaning, and maintenance of the system by qualified personnel, in accordance with the manufacturer's recommendations and the requirements of the Pitkin County OWTS Regulation. Issuance of this OWTS Construction Permit does not constitute a guarantee, warranty, or representation by the Department that the system will operate properly or will not fail. Issuance of this permit does not imply compliance with Pitkin County building and/or land use regulations, nor guarantee issuance of building and/or land use permits. OWTS Construction Approval Letter, Permit # 00592015PRBK The proposed WTS field design at 484 Little Woody Creek Road, Pitkin County, has been installed per the approved aid permitted plans. The installation contractor was Avalanche Excavation, 2007 Chickadee Ct. Silt, CO. The chambers ere trenched down to the tested soil elevation and installed on native material that was reviewed prior to the chambers being installed. The soils were consistent through the chamber trenches as per what was described within the geotechnical report prepared by HP Geotech dated 4-24-15. The fields are locat d in their general area of design and have proper separation from trench to trench. The fields are equal to the required 70 chambers infiltration area per the design. The chamber 2" pipes were run through the upper ports on the end caps and through the chambers with the piping being attached to the top of the chambers per dosing requirements. The inspection ports were installed on both ends of the chamber runs. The ports that were installed were brought to above grade as required. The new septics tank meets sizing requirements and pump requirements per the design and has an inlet drop per design. The tank and manifold were moved down the hill toward the field and also enter the field from the st instead of the west. The internal dosing pump was reviewed by Valley Precast, the installer of the pump and tank system, and has been approved as functioning per design per the attached letter. The tank lids have been raised to the proper elevation above grade and backfilling of the trench and septic tank dig have been completed. Please see attahed photos of the installation. The project site is shown on Figure 1. The purpose of the study was to develop recommendations for foundation design. The study was conducted in accordance with our proposal for geotechnical engineering services to Divide Creek Builders dated February 20, 2015. A field exploration program consisting of exploratory borings was conducted to obtain information on the subsurface conditions. Samples of the subsoils obtained during the field exploration were tested in the laboratory to determine their classification, compressibility and other engineering characteristics. The results of the field exploration and laboratory testing were analyzed to develop recommendations for foundation types, depths and allowable pressures for the proposed building foundation. This report summarizes the data obtained during this study and presents our conclusions, design recommendations and other geotechnical engineering considerations. PROPOSED CONSTRUCTION The new residence will be located east of -the existing house, see Figure 1. The residence will be a two story wood frame structure over crawlspace with an attached garage. The garage floor will be slab -on -grade. The CDU will be a one story wood frame structure over a crawlspace. The existing house will be razed. Grading for the structures is assumed to be relatively minor with cut depths between about 4 to 6 feet. We assume relatively light foundation loadings, typical of the proposed type of construction. If foundation loadings, location or grading plans change significantly from those described above, we should be notified to re-evaluate the recommendations contained in this report. Job No. H5 064A C&Ptech L_:� L7 I -2- SITE CONDITIONS The property slopes generally down to the south-southwest at grades of 5 to 10 percent. The terrain has been graded relatively flat in the eastern part of the new residence where there previously was a tennis court. Little Woody Creek crosses the property to the west of the proposed buildings. Elevation difference across the building areas is 5 to 7 feet. The building areas are presently pasture and corral area vegetated with grass with cottonwood trees, spruce trees and brush along the creek. There was 6 to 12 inches of snow cover at the time of our field exploration. FIELD EXPLORATION The field exploration for the project was conducted on March 3 and 6, 2015. Six exploratory borings were drilled at the locations shown on Figure 1 to evaluate the subsurface conditions. The borings were advanced with 4 inch diameter continuous flight augers powered by a truck -mounted CME -45B drill rig. The borings were logged by a representative of Hepworth-Pawlak Geotechnical, Inc. Samples of the subsoils were taken with 1% inch and 2 inch I.D. spoon samplers. The samplers were driven into the subsoils at various depths with blows from a 140 pound hammer falling 30 inches. This test is similar to the standard penetration test described by ASTM Method D-1586. The penetration resistance values are an indication of the relative density or consistency of the subsoils. Depths at which the samples were taken and the penetration resistance values are shown on the Logs .of Exploratory Borings, Figure 2. The samples were returned to our laboratory for review by the project engineer and testing. SUBSURFACE CONDITIONS Graphic logs of the subsurface conditions encountered at the site are shown on Figure 2. The subsoils encountered, below up to 2 feet of topsoil or till, consisted of about 5 to 14 Job No. 115 064A G& rtech U -3- feet Of loose to medium dense, silty sand and sandy silt overlying medium dense to dense, silty $and and gravel with scattered cobbles. the maximum drilled depth of 21 feet. The sand and gravel soils extended down to Laboratory testing performed on samples obtained from the borings included natural mors a content and density, and gradation analyses. Results of swell -consolidation test' g performed on relatively undisturbed drive samples of the upper sand and silt soils, presented on Figures 4 to 6, indicate low to moderate compressibility under conditions of loadi;rg and wetting with a minor collapse potential (settlement under constant load) when wetteo, . Results of gradation analyses performed on small diameter drive samples (minus 1 %2 inch fraction) of the deeper coarse granular subsoils are shown on Figures 7 to 9. The laboratory testing is summarized in Table 1. Free *ater was encountered in the borings at depths of 8 to 14 feet at the time of drilling and at 7%2 to 11 feet when checked one day later. The upper soils were moist. DESIGN RECOMMENDATIONS FOUNDATIONS Considering the subsurface conditions encountered in the exploratory borings and the naturei of the proposed construction, we recommend the residence and CDU buildings be foundd with spread footings bearing on the natural granular soils. Due to the relatively shallow groundwater, basement levels are not recommended. The existing teams court surface, fill materials and topsoil should be removed from within building areas. The deign and construction criteria presented below should be observed for a spread footing foundation system. 1) Footings placed on the undisturbed natural granular soils should be designed for an allowable bearing pressure of 1,500 psf. Based on experience, we expect initial settlement of footings designed and Job No. 115 064A GeXtech H ale constructed as discussed in this section will be about 1 inch or less. There could be potential for additional settlement of about %2 inch if the upper finer grained soils are wetted. 2) The footings should have a minimum width of 18 inches for continuous walls and 2 feet for isolated pads. 3) Exterior footings and footings beneath unheated areas should be provided with adequate soil cover above their bearing elevation for frost protection. Placement of foundations at least 42 inches below exterior grade is typically used in this area. 4) Continuous foundation walls should be reinforced top and bottom to span local anomalies such as by assuming an unsupported length of at least 12 feet. Foundation walls acting as retaining structures should also be designed to resist lateral earth pressures as discussed in the "Foundation and Retaining Walls" section of this report. 5} All existing fill, topsoil, debris from prior development and any loose or disturbed soils should be removed and the footing bearing level extended down to the natural granular soils. The exposed soils in footing area should then be moisture adjusted to near optimum and compacted. If water seepage is encountered, the footing areas should be dewatered before concrete placement. 6) A representative of the geotechnical engineer should observe all footing excavations prior to concrete placement to evaluate bearing conditions. FOUNDATION AND RETAINING WALLS Foundation walls and retaining structures which are laterally supported and can be expected to undergo only a slight amount of deflection should be designed for a lateral earth pressure computed on the basis of an equivalent fluid unit weight of at least 50 pcf for backfill consisting of the on-site soils. Cantilevered retaining structures which are separate from the buildings and can be expected to deflect sufficiently to mobilize the full active earth pressure condition should be designed for a lateral earth pressure computed Job No. 115 064A Ge&ech E -5- on the basis of an equivalent fluid unit weight of at least 45 pcf for backfill consisting of the o$ -site soils. All foundation and retaining structures should be designed for appropriate hydrostatic and surcharge pressures such as adjacent footings, traffic, construction materials and equipment. The pressures recommended above assume drained conditions behind the walls and a horizontal backfill surface. The buildup of water behind a wall or an upward sloping backfill surface will increase the lateral pressure imposed on a foundation wall or retaining structure. An underdrain should be provided to prevent hydrostatic pressure buildup behind walls. Backfill should be placed in uniform lifts and compacted to at least 90% of the maximum standard Proctor density at a moisture content near optimum. Backfill in pavement and walkway areas should be compacted to at least 95% of the maximum standard Proctor density. Care should be taken not to overcompact the backfill or use large equipment near the wall, since this could cause excessive lateral pressure on the wall. Some settlement of deep foundation wall backfill should be expected, even if the material is placed correctly, and could result in distress to facilities constructed on the backfill. The lateral resistance of foundation or retaining wall footings will be a combination of the sliding resistance of the footing on the foundation materials and passive earth pressure against the side of the footing. Resistance to sliding at the bottoms of the footings can be calculated based on a coefficient of friction of 0.45. Passive pressure of compacted backfill against the sides of the footings can be calculated using an equivalent fluid unit weight of 325 pcf. The coefficient of friction and passive pressure values recommended above assume ultimate soil strength. Suitable factors of safety should be included in the design to limit the strain which will occur at the ultimate strength, particularly in the case of pas ive resistance. Fill placed against the sides of the footings to resist lateral loads should be compacted to at least 95% of the maximum standard Proctor density at a content near optimum. Job No. I I5 064A G V&ech 0 • Kom FLOOR SLABS The natural on-site soils, exclusive of old fill and topsoil, are suitable to support lightly loaded slab -on -grade construction. To reduce the effects of some differential movement, floor slabs should be separated from all bearing walls and columns with expansion joints which allow unrestrained vertical movement. Floor slab control joints should be used to reduce damage due to shrinkage cracking. The requirements for joint spacing and slab reinforcement should be established by the designer based on experience and the intended slab use. A minimum 4 inch layer of free -draining gravel should be placed beneath interior slabs to facilitate drainage. This material should consist of minus 2 inch aggregate with at least 50% retained on the No. 4 sieve and less than 2% passing the No. 200 sieve. All fill materials for support of floor slabs should be compacted to at least 95%' of maximum standard Proctor density at a moisture content near optimum. Required fill can consist of the on-site granular soils devoid of vegetation, topsoil and oversized rock. UNDERDRAIN SYSTEM Free water was encountered during our exploration and it has been our experience in this area that groundwater can be relatively shallow during spring runoff and irrigation season. Frozen ground during spring runoff can also create a perched condition. We recommend below -grade construction, such as retaining walls and crawlspace areas, be protected from wetting and hydrostatic pressure buildup by an underdrain system. The drains should consist of drainpipe placed in the bottom of the wall backfill surrounded above the invert level with free -draining granular material. The drain should be placed at each level of excavation and at least I foot below lowest adjacent finish grade and sloped at a minimum I % to a suitable gravity outlet. Free -draining granular material used in the underdrain system should contain less than 2% passing the No. 200 sieve, less than 50% passing the No. 4 sieve and have a maximum size of 2 inches. The drain gravel backfill should be at least 2 feet deep. Job No. 115 064A Gecitech v -7- SURFACE DRAINAGE The Olowing drainage precautions should be observed during construction and maintained at all times after the residence and CDU have been completed: 1) Inundation of the foundation excavations and underslab areas should be avoided during construction. 2) Exterior backfill should be adjusted to near optimum moisture and compacted to at least 95% of the maximum standard Proctor density in pavement and slab areas and to at least 90% of the maximum standard Proctor density in landscape areas. 3) The ground surface surrounding the exterior of the building should be sloped to drain away from the foundation in all directions. We recommend a minimum slope of 12 inches in the first 10 feet in unpaved areas and a minimum slope of 3 inches in the first 10 feet in paved areas. Free -draining wall backfill should be capped with about 2 feet of the on- site finer graded soils to reduce surface water infiltration. 4) Roof downspouts and drains should discharge well beyond the limits of all backfill. SEPTIC FIELD The location of the Profile Boring drilled to the south of the proposed residence is shown on Figure 1. The log of the Profile Boring is shown on Figure 2 and indicates that, below the tennis court pavement and fill, the natural soils consist of (USDA Classification) very gravelly sand. Based on the subsurface conditions encountered, the area south of the residence should be suitable for a conventional infiltration septic disposal system. We recommend that a civil engineer design the infiltration septic disposal system. Additional profile hole exploration and percolation testing may be required. LIMITATIONS This study has been conducted in accordance with generally accepted geotechnical engineering principles and practices in this area at this time. The conclusions and recommendations submitted in this report are based upon the data obtained from the exploratory borings drilled at the locations indicated on Figure 1, the proposed type of construction and our experience in the area. Our services do not include determining the presence, prevention or possibility of mold or other biological contaminants (MOBC) developing in the future. If the client is concerned about MOBC, then a professional in this special field of practice should be consulted. Our findings include interpolation and extrapolation of the subsurface conditions identified at the exploratory borings and variations in the subsurface conditions may not become evident until excavation is performed. If conditions encountered during construction appear different from those described in this report, we should be notified so that re-evaluation of the recommendations may be made. This report has been prepared for the exclusive use by our client for design purposes. We are not responsible for technical interpretations by others of our information. As the project evolves, we should provide continued consultation and field services during construction to review and monitor the implementation of our recommendations, and to verify that the recommendations have been appropriately interpreted. Significant design changes may require additional analysis or modifications to the recommendations presented herein. We recommend on-site observation of excavations and foundation bearing strata and testing of structural fill by a representative of the geotechnical engineer. Vos Caudill, Pitkin County, CO DETERMINATION OF THE HEARING OFFICER OF THE COMMUNITY DEVELOPMENT DEPARTMENT OF PITKIN COUNTY, COLORADO, APPROVING THE HUFFMAN LLC AND MARIA HUFFMAN ACTIVITY ENVELOPE AND SITE PLAN REVIEW, AND SPECIAL REVIEW AND GMQS EXEMPTIONS FOR A TDR RECEIVER SITE AND A CARETAKER DWELLING UNIT Determination No.a-2015 RECITALS 1) Huffinan LLC and Maria Huffman (hereafter "Applicant") have applied to the Pitkin County Hearing Officer (hereafter "Hearing Officer") to establish an Activity Envelope around the existing and proposed improvements and to obtain Site Plan approval to construct a single-family residence and a caretaker dwelling unit. The'Applicant is requesting special review approval and GMQS exemption to utilize one TDR to develop up to a total of 8,250 square feet of floor area. 2) The property is located at 484 Little Woody Creek Road, and is more specifically described in Exhibit A. 3) The parcel contains 28.75 acres and is a conforming size lot in the RS -20 zone district. 4) The existing residence was built in 1962. The parcel originally contained 2 acres. The parcel was expanded to 28.75 acres in 1974 through a subdivision exemption approved by Board of County Commissioners Resolution No. 74-39. The Resolution states that the "real property proposed for transfer is intended for use as a pasture and not intended for any development purposes...." The Resolution was approved with the condition of "there being no change in use of or development of the exempted parcel without compliance with or waiver of application of any applicable Pitkin County land use regulations." 5) The Hearing Officer heard this application at a duly noticed public hearing on May 19, 2015, at which time evidence and testimony was presented with respect to this application. 6) The Hearing Officer finds that the Activity Envelope and Site Plan complies with the applicable standards in the Land Use Code ("Code"), as follow: A) Little Woody Creek runs through the property. The new residence and caretaker dwelling unit will comply with the 100' setback from the high water line of Little Woody Creek. B) The existing agricultural buildings are legal, nonconforming structures, since they are located within the 100' setback from Little Woody Creek. Any redevelopment of these structures will be subject to the provisions of Secs. 9-40 and 9-50 of the Code. C) The 100 year floodplain for Little Woody Creek is not mapped on the 2004 FIRM maps, therefore, the limits of the floodplain are not known. Given that the Applicant is siting the new residence and caretaker dwelling unit a minimum of 100' from Little Woody Creek; and that the existing house within 15' of the creek will be removed and that area will be restored with native vegetation, the County's Floodplain Administrator has determined that a Hydrology and Hydraulics study is not necessary at this time. However, any fiiture development within the 100' setback, including redevelopment of the existing agricultural buildings, may require a Hydrology and Hydraulics study Determination No. a-201.1 Page 2 to determine the limits of the floodplain, and any buildings within the limits of the floodplain would have to be elevated. D) The wildfire hazard is rated as low, and can be mitigated pursuant to the provisions of See. 7-20- 60(c) of the Code. E) The activity envelope primarily contains slopes of less than 30%. "There are small areas of slopes in excess of 30% within the envelope, which are the result of landscaping associated with the development of the existing residence, and comply with the exception in Sec. 7-20-20(c)(3). These slopes will be recontoured after the residence is demolished. F) The parcel is adjacent to mapped mule deer winter range and elk winter range. Replacement of the residence and construction of the caretaker dwelling unit will have minimal additional impacts on wildlife. G) The parcel is within the mapped Scenic View Protection Area. The proposed residence will only be visible from Woody Creek Road for a short segment of the road and at a distance of approximately %z mile. In order to comply with the 100' setback from Little Woody Creek, the residence is sited in a more open area that is not screened by natural vegetation. Existing structures and an embankment to the southeast limit the arca from which the residence is visible. H) As the residence is part of a ranch compound, the Applicant may utilize white clapboard siding, rather than an indigenous earth tone material or color. Dark shutters and other design features will lessen the visual impact of the white siding. The white siding and dark shutters on the residence will replicate the style of the original residence built in 1962. I) The Applicant will widen the existing driveways to a 16' width within the property boundary. The northern driveway will be the main entry point for emergency service vehicles as it has a wider entry off of Little Woody Creek Road. A 20,000 gallon water tank will be installed for fire -fighting. 7) The Hearing Officer further finds that the use of one additional TDR on the site to develop up to 8,250 square feet of floor area is appropriate, given the siting and design of the residence, the compatibility of the residence with the residences in the surrounding area, and'compliance with the other special review criteria. 8) The Hearing Officer further finds that the proposed development is consistent with Resolution No. 74-39, based on the following: (1) there is no change in use; and (2) the redevelopment complies with the applicable Code provisions, and, in particular, the 100' setback from Little Woody Creek. 9) The Hearing Officer further finds that the caretaker dwelling unit complies with the special review and GMQS exemption provisions of the Code. NOW, THEREFORE, BE IT RESOLVED by the Pitkin County Community Development Hearing Officer that he does hereby approve the Huffman LLC and Maria Huffman Activity Envelope and Site Plan Review, and Special Review and GMQS Exemption for a TDR Receiver Site and Caretaker Dwelling Unit, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the current or prior applications or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. Prior to submission of any building or development permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The parcel is exempt from Growth Management for up to 8,250 square feet of floor area. At building permit application for the new residence, the Applicant shall surrender one TDR Certificate and a copy of the deed(s) evidencing the Applicant's acquisition of the Certificate (if applicable), in order to develop in excess and up to 8,250 square feet of floor area. The proposed development contains less than 8,250 square feet of floor area: approximately 6,187 square feet for the residence and 1,000 square feet for the caretaker dwelling unit. The approximately 1,063 square feet of unused floor area is available for future use without further special review, but subject to Site Plan Review, as applicable. 4. With the building permit applications for the residence and the caretaker dwelling unit, the Applicant shall: A. Provide proof of an adequate water supply (in tenors of quantity and availability) for domestic and fire protection purposes for each dwelling unit. B. Complete a fireplace/woodstove registration form with the Community Development Department, if necessary. C. Submit a drainage and erosion control plan for review and approval by the Planning Engineer. If the total development disturbs one (1) acre or more, the Applicant shall apply for and obtain a State Stormwater Permit. All historic and natural drainage patterns shall be maintained. Storuwater shall be detained onsite and allow infiltration of runoff prior to discharge. D. Submit a detailed "large scale" construction management plan for review and approval by the Planning Engineer. L. Submit a detailed revegetation plan for disturbed areas for review and approval by the Planning Engineer. The plan shall also address revegetation of the area of the demolished residence with riparian vegetation. F. Submit a tree mitigation plan for the removal of any trees larger than 6 inch DBH. G. Submit a detailed landscaping plan. H. Submit a detailed exterior lighting plan. 5. Prior to issuance of building permits for the residence and the caretaker dwelling unit, the Applicant shall: A. Pay the applicable road and employee housing impact fees. B. Obtain an On -Site Wastewater Treatment System construction permit from Environmental Health. C. Obtain a County access/driveway permit for the extension and improvement of the driveway, which shall be reviewed and approved by the Aspen Fire Protection District and the Planning Engineer. Where utilities are to be extended within the driveway, utility line locations shall be shown on the drawings. D. Obtain a permit to -remove the dwelling unit attached to the barn. If the Applicant can demonstrate that the space was legally created, then the Applicant shall render the dwelling unit uninhabitable. if the Applicant cannot demonstrate that the space was legally created, then the Applicant shall demolish the space. The Applicant shall obtain an Earthmoving/Clearing/Grubbing Permit for any and all hardscape, retaining walls, earthwork, utility installation, water tank burial and landscaping. 7. Any future development within the 100' setback from Little Woody Creek, including redevelopment of the existing agricultural buildings, may require a Hydrology and Hydraulics study to determine the limits of the floodplain, and any buildings within the limits of the floodplain would have to be elevated. in addition, any redevelopment of the agricultural buildings within the 100' setback will be subject to the provisions of Secs. 9-40 and 9-50 of the Code regarding non -conforming structures. 8. The Applicant shall comply with all standards for development within Scenic View Protection Areas as represented in the application and approved in this Decision. White clapboard siding may be installed on the exterior of the residence. Otherwise, the Applicant shall utilize indigenous earth tone materials or colors and the roofs shall have a non -reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate . reflectivity, with the exception of materials associated with solar or photovoltaic equipment. 9. Landscaping shall be substantially consistent with the landscaping shown on the site plan. Additional landscaping may be required at building permit to soften the visual impact of the southern fagade of the residence. Areas disturbed by constriction shall be re -vegetated within one growing season of the project's completion. Landscaping shall be completed prior to issuance of the Certificate of Occupancy for the residence. 10. The Applicant shall comply with the following measures to mitigate impacts to wildlife: A. Native vegetation shall be maintained outside of the activity envelope. B. Provide waste storage that complies with the County Code regarding bear -proof containers, including during construction. C. Fruit -bearing trees and shrubs are prohibited in any landscaping. D. All outside doors shall utilize only solid round handled door knobs unless another type is required by the applicable building code for disabled accessibility purposes. E. Bird feeders, including hummingbird feeders, shall be hung away from any deck or window, and shall be at least 10' from the ground suspended between 2 trees or posts. All seed feeders shall include a seed catchment pan to catch discarded seeds. F. All haystacks or feed areas shall be fenced with 8' mesh game -proof fencing. G. if poultry are kept on the property, coops shall be fenced with 4' five strand electric fencing with alternating hot -ground wires and a ininimum of 6,000 volts and 0.7 joules. H. Contractors shall be prohibited from bringing dogs on-site during construction. I. Boundary fencing is prohibited. Fencing within the activity envelope shall comply with the following, with the exception of fencing to protect gardens in the immediate vicinity of the residence. 1) Mesh or woven wire fences are prohibited. 2) Wood rail fencing shall employ three (3) rails or less, be the round or split rail type, shall not exceed fifty-four (54) inches in height above ground level, and twelve (12) inches in width (top view), and shall have at least eighteen (18) inches between the lower two (2) rails. 3) Wire fencing must be three (3) strands or less. The top wire should be a twelve -point -five (12.5) gauge twisted barbless type at a maximum height of forty-two (42) inches. The middle strands (which may be barbed) should be located a minimum twelve (12) inches apart and from the top wire preventing entanglement when mule deer jump over. No development in excess of 30" above or below natural grade shall occur within the setbacks of the parcel, with the exception of driveways and associated retaining walls of up to 6' above or below natural grade and fencing. Landscaping in the form of berms shall not exceed four feet from the most restrictive' grade. Any development located within setbacks mandated by County zoning regulations that does not comply with these restrictions shall require a variance from the Board of Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. 12. The Applicant shall comply with all of the codes and requirements of the Aspen Fire Protection District, including but not limited to access, turning around of fire apparatus, installation of approved fire sprinkler systems in all structures, and a minimum 20,000 gallon water supply for fire fighting. 13. The Applicant shall comply with the following landscaping and wildfire defensible space mitigation standards: A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): 1) Brush, debris and non -ornamental vegetation shall be removed within a minimum ten -foot (10') perimeter around all structures. 2) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a minimum of a thirty (30) foot perimeter around a structure built on flat ground. (For greater slopes, reference the CSFS Safety Zone chart in Wildfire Guidelines For Rural Homeowners, which provides general guidelines that may be modified by a wildfire expert acceptable to the County). 3) Spacing between clumps of brush and vegetation up to the thirty (30) foot perimeter shall be a minimum of two (2) times the height of the.fuel. Maximum diameter of the clumps shall be equal to the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. 4) AIII branches from trees and brush within the thirty (3 0) foot perimeter shall be pruned to a height often (10) feet above the ground with removal of ladder fuels from around trees and brush. 5) Tree crown separation within the thirty (30) foot perimeters shall have a minimum of ten (10) feet between the edges of the crowns, except for mature stands of aspen trees where ladder fuels have been removed.
