This OWTS Construction Permit is approved on the condition of compliance with the engineer design as submitted with the application and the specifications
cited above. Changes must be approved by this Department and the engineer prior to construction.
This system is for the main house and includes the bunk room with 6 beds (3 bedrooms total, at 2 persons/bedroom; for sizing
purposes) and the game room for a total of 9 bedrooms. The office and exercise room in the master suite are not to be used
as bedrooms. The sizing also includes 45 gpd to allow for future expansion for a bathroom in a barn.
The system consists of sewage flowing via gravity through a 4" pipe to a 2000 -gallon concrete, single -compartment tank. The
effluent from this tank them flows into a second, 1500 -gallon, two-compartment tank. A dosing pump will be installed in the
second compartment of the 1500 -gallon tank and will pump effluent to an Orenco automatic distributing valve. The effluent will
then be distributed to a 41'X58' (2378 ft2) sand mound soil treatment area.
The soil treatment area shall be a minimum of 236 feet to any well, 186 feet to any unlined pond or stream, and 161 feet to the
dry gulch, and 4 feet above the groundwater.
This Permit must be kept on-site during installation. The engineer must do a final inspection of the installation and submit an "as -built" letter to this
Department within 30 days of the final inspection, unless a longer period of time has been agreed upon, in writing. This Department must also be called for
the final inspection with a minimum of 48 hours notice.
Minimum horizontal distances between components of the system and physical features shall conform to the requirements of the Pitkin County OWTS
Regulation.
This Permit is conditioned upon the property owner(s) providing for regular inspection, cleaning, and maintenance of the system by qualified personnel, in
accordance with the manufacturer's recommendations and the requirements of the Pitkin County OWTS Regulation. Issuance of this OWTS Construction
Permit does not constitute a guarantee, warranty, or representation by the Department that the system will operate properly or will not fail. Issuance of this
permit does not imply compliance with Pitkin County building and/or land use regulations, nor guarantee issuance of building and/or land use permits.
THIS PERMIT IS EXPRESSLY CONDITIONED UPON COMPLIANCE WITH ALL REQUIREMENTS OF THE PITKIN
COUNTY OWTS REGULATION, INCLUDING BUT NOT LIMITED TO THOSE CONDITIONS SPECIFIED ABOVE.
Plans and specifications for the proposed OWTS have been reviewed and are considered satisfactory. Permission is hereby
given to the property owner(s) to perform the work indicated in accordance with the Pitkin County OWTS Regulation. This
Permit will expire 1 year from the date of issuance unless construction on the system has commenced. An "as -built" drawing
must be submitted and approved by EH before final approval of the system will be issued.

Subsurface Review and Planning Recommendations for Upgrade Onsite Wastewater System

ALL SERVICE septic, LLC conducted a percolation test for the subject property, and prepared
preliminary onsite wastewater system (OWS) layouts for the proposed subject residence. The
property is located outside of Aspen, CO in an area where OWS are necessary.
SITE CONDITIONS
A residence and several barns/sheds exist on the property. As we understand a new 7 bedroom
residence, having approximately 15,000 SF is proposed. The current structures and existing OWS
will be removed and/or abandoned. The property is 10.3 acres and has grassy undulating meadows.
There are several drainages flowing through or next to the property which must be considered during
OWS design. The property will be served by an onsite well.
Based on the size of the proposed structure, the setback distance from the OWS drain field to wells is
188 feet, and the setback distance from the OWS drain field to any surface water drainage is 138 feet.
A surface drainage may be lined with PVC liner and reduce setback to 10 feet.
SUBSURFACE
The subsurface was investigated by digging 4 percolation holes in two different areas as indicated on
attached plan. Materials encountered in the percolation holes consisted of very loamy sandy clay to the
maximum depth explored of 4 feet. Groundwater was encountered in Percolation holes 3 and 4 at 2 feet.
Percolation rates ranged from 10 to 40 minutes per inch (MPI). A 28 MPI, or an application rate of
0.95 Gals/SF/day rate will be used to design the OWS.

The OWS design will based on 7 -bedrooms and an average sewage load of 1400 GPD. The
installation will include a tank capacity of approximately 2500 gallons, and a drain field consisting of
chambers. Secondary treatment may be added which would allow for considerable drain field size
reductions.
The soil investigation yielded ground water at 2 feet, therefore a partial mound must be installed. The
mound may be graded such that it is `blended' in with current topography.
OPTION 1 — (W1) — Utilize secondary treatment. Place drain field in one of two areas shown,
depending on `lining' of water courses.
OPTION 2 — (W2) — No secondary treatment. Place drain field in one of two areas shown, depending
on `lining' of water courses.
It should be more cost effective, based on subsurface conditions, to implement secondary treatment
and install a smaller drain field. This will also reduce impact on landscape.
The OWS options proposed can be constructed in the proposed activity envelope. Both options
are viable. The final OWS location decision may be made in the future prior to building permit
application.
Construction must be according to the Pitkin County Health Department OWS regulations, the OWS
Construction Permit provided by the county, and this design.
LIMITS:
The design is based on information submitted. If soil conditions encountered are different from
conditions described in report, ALL SERVICE septic, LLC should be notified. All OWS construction
must be according to the county regulations. Requirements not specified in this report must follow
county regulations. The installer should have documented and demonstrated knowledge of the
requirements and regulations of the county in which they are working.

PITKIN COUNTY, COLORADO, APPROVING THE K2 FAMILY PROPERTY LLC MINOR
AMENDMENT TO SITE PLAN TO INCLUDE A BARN

RECITALS
1. Pursuant to Section 2-20-150(b) of the Land Use Code, K2 Family Property LLC ("Applicant") has
applied to the Community Development Director of Pitkin County, Colorado ("Director") to amend
the Site Plan approved pursuant to Hearing Officer Determination No. 05-2011 to add a barn at the
north end of the residence. The proposed barn is within the previously approved Activity Envelope.
2. The lot is located at 1370 Owl Creek Road, and more described as Parcel E, Stapleton Subdivision.
3. The lot contains 10.31 acres and is a conforming size lot in the AR -10 zone district.
4. The BOCC approved the Stapleton Subdivision via the Agricultural Lot Split Subdivision
Exemption, pursuant to Resolution Nos. 83-122 and 84-116, the final plat was recorded in Plat Book
20 at Page 31. Parcel E is improved with a single family residence built in 1967, a detached garage
and agricultural outbuildings. Parcel W is unimproved.
5. The Community Development Director approved building envelopes on both parcels pursuant to
Administrative Decision No. 65-2006; the 1041 site plan was recorded in Plat Book 80 at Page 96.
The vested rights expired on July 11, 2009. The Community Development Director approved
activity envelopes on both parcels pursuant to Administrative Decision No. 47-2009: the Activity
Envelope Plan was recorded in Plat Book 91 at Page 71. The 2009 approval replaced the prior 1041
approval.
6. The Hearing Officer approved Determination No. 05-2011, which granted Site Plan Review approval to
construct a new single family residence, Special Review and GMQS Exemption to utilize four TDRs to
develop up to 15,000 square feet of floor area, amendments to the previously approved Activity
Envelope, and GMQS Exemption for a replacement residence. The Site Plan has not been recorded.
7. The Director finds that the proposed amendment complies with the applicable provisions of the Land
Use Code, and will not change the use of the proposed development or the basic character of the land,
is consistent with action taken during the original review, does not increase off-site impacts or the
allowable floor area, and will not endanger the public health, safety or welfare.
8. The Director further finds that the proposed barn complies with the provisions of Sec. 5-20-70(i) of the
Land Use Code, Floor Area Exemption for Agricultural Buildings, as follows:
A. The proposed barn is designed to house field equipment for on-site haying.

C. The parcel contains less than 20 acres, therefore, the barn is exempt from floor area up to 1,160
square feet.
D. The proposed barn contains mechanical, electrical and plumbing equipment.
E. The toilet room (toilet and lavatory only) will not exceed 20 square feet.
F. The proposed barn will not contain any office space or human amenities.
9. The Director further finds that the barn complies with Sec. 7-20-120 of the Code, Scenic View
Protection Areas, and is consistent with the development previously approved on the site. The barn is to
the north of and contiguous with the approved garage and has the same height and width as the garage,
so will blend with the existing structures on the site.
THE DIRECTOR DOES HEREBY APPROVE the K2 Family Property LLC Minor
Amendment for a barn, subject to the following conditions, which shall run with the land and be binding on
all successors in interest:
1. All conditions of Hearing Officer Determination No. 05-2011 shall remain in full force and effect,
except as amended herein.
2. Prior to submission of a building permit application for the barn, the Applicant shall be required to
submit for approval by the County Attorney and Community Development an amended Site Plan in
accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The
above referenced approvals shall be a condition precedent to finalization and recordation of them.
Prior to issuance of a building permit for the barn, the Applicant shall record an Occupancy Covenant
and Agreement in a form acceptable to the County Attorney in which the Applicant agrees that the
exempt floor area may only be used in association with the raising, producing, or keeping of plants or
livestock, or cultivation and management of other crops or farm products, and that any area not
consistent with those uses would count as floor area. The Occupancy Covenant and Agreement shall
also allow the County to inspect the agricultural building at any time for compliance with the
specified use limitations, subject to the provision of reasonable notice to the property owner.
4. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements
have been conducted. These requirements will be considered at the time of building permit. Any
structures represented in the application may not be permitted under building and zoning regulations.
5. The Applicant shall adhere to all material representations made in the application.

RECITALS
1) K2 Family Property LLC (hereafter "Applicant') has applied to the Pitkin County Hearing Officer

The Applicant is requesting special review approval and GMQS exemption to utilize four TDRs to

7) The Hearing Officer finds that the Site Plan and Amended Activity Envelopes comply with the
applicable standards in the Land Use Code ("Code").
8) The Hearing Officer further finds that the proposed development is consistent with the criteria for
development within the Scenic View Protection Area. The residence has been sited, designed and
landscaped to minimize the visual impact as seen from Owl Creek Road,
9) The Hearing Officer further finds that the use of four TDRs on the site is appropriate, given the siting
of the residence, the support in the Owl Creek Master Plan for the use of TDRs for additional floor
area, and compliance with the other special review criteria.

NOW, THEREFORE, BE IT RESOLVED by the Pitkin County Community Development
Hearing Officer that he does hereby approve the K2 Family Property LLC Site Plan Review, Activity
Envelope Amendment, Special Review for TDR Receiver Site, and GMQS Exemptions, subject to the
following conditions, which shall run with the land and be binding on all successors in interest:
1. The Applicant shall adhere to all material representations made in the current or prior applications or in
public meetings or hearings and shall consider those representations to be conditions of approval, unless
amended by other conditions.
2. The conditions of Administrative Decision No. 47-2009 shall remain in full force and effect, unless
amended by other conditions herein.
3. The Applicant shall comply with all standards for development within Scenic View Protection Areas
as represented in the application and approved in this Determination. The exterior of the structures
shall utilize indigenous earth tone materials or colors and the roofs shall have a non -reflective color or
composition. Reflective roof materials shall not be used unless the materials are treated prior to
installation to eliminate reflectivity, with the exception of materials associated with solar or
photovoltaic equipment. Samples of exterior materials shall be reviewed and approved by
Community Development prior to building permit application. Driveway lighting is prohibited and
all other lighting shall comply with the lighting code.
4. Prior to submission of any future building permit applications for the residence, the Applicant shall be
required to submit for approval by the County Attorney and Community Development a Site Plan in
accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above
referenced approvals shall be a condition precedent to finalization and recordation of them.
Prior to recordation of the Site Plan, the Community Development Department shall conduct an
evaluation to determine if the resulting land use or character of the land is or will be essentially and
primarily residential, commercial, or another use or character other than agricultural, and, thereby
determine if a covenant prohibiting commercial agricultural activity shall be required. The
Community Development Department's determination shall be memorialized in an Administrative
Decision.
6. The lot is exempt from Growth Management for up to 5,750 square feet of floor area. At building
permit application for the new residence, the Applicant shall surrender four TDR Certificates and a
copy of the deed(s) evidencing the Applicant's acquisition of the Certificates (if applicable), in order
to develop up to 15,000 square feet of floor area.
7. The property line of Parcel E is within '/z mile radius of the Buttermilk Metro District's service area.
Therefore, prior to submission of building permits for the residence, the Applicant shall comply with
Sec. 7-50-20(c)(2) of the Code.
8. Prior to issuance of building permits for the residence, the Applicant shall:
A. Provide proof of an adequate water supply (in terms of quantity and availability) for domestic and
fire protection purposes, and for irrigation purposes, if applicable.
B. Complete a fireplace/woodstove registration form with the Community Development
Department, if necessary.

C. Obtain a County access/driveway permit for any major improvements to the driveway, which
shall be reviewed and approved by the Aspen Fire Protection District and Planning/Zoning.
D. Submit a drainage and erosion control plan for review and approval by Planning/Zoning. If the total
development disturbs one (1) acre or more, the Applicant shall apply for and obtain a State
Stonnwater Permit. All historic and natural drainage patterns shall be maintained. Stormwater shall
be detained onsite and allow infiltration of runoff prior to discharge.
E. Submit a construction management plan for review and approval by Planning/Zoning.
F. Pay the applicable road and employee housing impact fees.
G. Obtain an On -Site Wastewater Treatment System construction permit from Environmental
Health. Secondary treatment is encouraged due to high ground water conditions. The drainage ditch
adjacent to Owl Creek Road shall be lined or converted in order to meet minimum setbacks to the
proposed absorption area.
H. Submit a detailed revegetation plan for disturbed areas with appropriate seed mixes. The plan shall
specify the native seed mix to be used, the rate at which it will be applied and the method of
cover.
1. Submit a tree mitigation plan for the removal of any trees larger than 6 inch DBH.
J. Submit a detailed landscaping plan.
K. Submit a detailed exterior lighting plan.
9. The Applicant shall submit an earthmoving permit for the pond and water features, for review and
approval by Planning/Zoning, Verification of adequate water rights shall be provided. The permit
application shall include engineering for all overflow and outlet structures, recirculation systems, etc.
If the pond is to be stocked with fish, the Applicant shall obtain a private lake license and stocking permit
from the DOW. The pond can only be stocked with certified whirling disease free fish.
10. Landscaping shall be substantially consistent with the landscaping shown on the site plan. Areas
disturbed by construction shall be re -vegetated within one growing season of the project's
completion. Landscaping shall be completed prior to issuance of the Certificate of Occupancy for the
residence.
11. No development in excess of 30" above or below natural grade shall occur within the setbacks of the
lot, with the exception of driveways and associated retaining walls of up to 6' above or below natural
grade and fencing. Landscaping in the form of berms shall not exceed four feet from the most
restrictive grade. Any development located within setbacks mandated by County zoning regulations
that does not comply with these restrictions shall require a variance from the Board of Adjustment.
Approval of an activity envelope within such setbacks does not assure approval of a variance.
12. The Applicant shall comply with all of the codes and requirements of the Aspen Fire Protection District,
including but not limited to access, turning around of fire apparatus, installation of approved fire sprinkler
systems in all structures, and a minimum 20,000 gallon water supply for fire fighting or confirmation of
an accessible hydrant in the vicinity.
13. No development shall occur outside of the approved activity envelopes, with the exception of
vegetation removal necessary to comply with the wildfire mitigation measures described above.

Elizabeth and Sam Stapleton Family, ("Applicant') has applied to the Pitkin County Community
Development Director ("Director") for 1041 Hazard Review approval to establish building envelopes
on two lots, within which to construct new single family residences. The envelope on Parcel E
encompasses the existing residence and outbuildings; the envelope on Parcel W would replace the
"Proposed House Site" on the Plat.
2. The lots are located at 1370 Owl Creek Road, and are described as Parcels E and W, Stapleton
Subdivision.
3, The property is zoned AFIZ14 Parcel E; contains 10,3068 acres and Parcel W contains 10.0294 acres,
4. The BOCC granted General Submission and Detailed Submission/Final Plat approval for the Stapleton
Lot Split pursuant to Resolution Nos. 83-133 and 84-116. The plat was recorded in Plat Book 20 at

5. The Applicant submitted a complete application prior to July 6, 2006, therefore, the application is
being considered pursuant to the 1994 Land Use Code, as amended.
6. The Applicant provided notice of the application to the adjacent property owners, as required pursuant
to Section 5-80-010(J) of the Land Use Code ("Code"). No objections were received within 30 days
from the date the notice was postmarked (June 1, 2006).

7. The Director finds that the wildfire;.hazard within the envelopes is rated as low and can be mitigated;
that the envelopes are located on slopes- of less than 15%i.and that the property is not within any
mapped wildlife: habitat areas.
THE DIRECTOR DOES HEREBY APPROVE the Stapleton 1041 Hazard Review, subject to
the following conditions, which shall run with the land and be binding on all successors in interest:
I . Prior to submission of any building permit applications for new development, the Applicant shall
a submit a 1041 Hazard Review Site Plan to the Community Development Department for approval and
recording. The mylar copy of the site plan must be signed by the owner prior to submittal for recording.
The site plan shall be amended as follows_

6. The Applicant shall comply with the following additional wildfire mitigation standards:
A. Roofs shall be constructed with a Class A roof covering or a Class A assembly as defined in the
International Building Code (TBC) Section 1505.2. Wood shake/shingle roof coverings are
prohibited. Roofs with less than a 3:12 pitch are not permitted unless they comply with the
following:
1) All roof coverings shall be noncombustible materials and installed on a Class A roof assembly.
2) All roof coverings shall have a surface that shall facilitate the natural process of clearing the
roof.
3) All roof designs shall facilitate the natural process of clearing roof debris. Protrusions above
the roofline, such as parapets, shall be prohibited.
4) Roofs shall be installed as required by the adopted building code and shall have a minimum
slope of 1:48.
5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire
Marshal prior to submittal of a building permit application,
B. Vents shall be screened with corrosive resistant wire mesh with mesh '/4 inch maximum.
C. Roofs and gutters shall be kept clear of debris.

E. All flammable materials and firewood/wood piles shall be stored on a parallel contour a minimum
of 15 feet away from any structure.
F. Weeds and grasses within a 30 foot perimeter of all structures shall be maintained to a height of
not more than 6 inches.
G. Swimming pools or ponds shall be accessible to Fire Department vehicles.
H. Fences shall be kept clear of brush and debris.

J. Fuel tanks shall be installed underground with an approved container.
K. Propane tanks shall be installed according to NFPA 48 standards and on a contour away from the

addition, the City must approve any change to the District "service area." During
the Agreement negotiations, the City was opposed to any increased service to
Parcel E through the District/City water system.
2. Environmental impacts would be greater by connecting to the District/City
public system.
The City supplies water to the District through a "master meter" tap which
is located by the Airport. The District then needs to pump this water in a
pressurized system uphill to serve the uses in its service area. The energy costs to
pump and lift this water uphill and service Parcel E are far greater than the
pumping costs in an individual well located within feet of the residence.
In addition, the City water comes from direct diversions out of Maroon
and Castle Creeks, surface sources which are over appropriated and subject to
many competing uses, including environmental instream flows held by the
Colorado Water Conservation Board. The proposed well water for Parcel E will
come from the underground aquifer tributary to Owl Creek. The K2 well will
largely utilize recharge water from ditch irrigation diversions which will occur
with or without the well, i.e., any well diversions are primarily a "successive" use
and re -use of the deep groundwater percolation and return flows from irrigation.
Considering these factors, it is arguable that connection to the District/City water
system causes more environmental impact than using an individual on-site well.
3. State law allows for an exempt well permit in this situation and K2 is
entitled to rely on such permit.
K2 is vested with an "exempt" well permit for Parcel E, issued pursuant to
C.R.S. 37-92-602. Issuance of an exempt well permit is, by definition, a
determination that "other water supplies are not available" to this Property since
such exempt permit could not be granted otherwise. Required connection to a
nearby (but out -of -boundary) public provider is inconsistent with the State statute
and policy allowing for reliance on an exempt well permit in this scenario.
In conclusion, we believe K2 has complied with Section 7-50-20(c)(2).
Connection to the District/City public system is not required because service is
not available to Parcel E and any such requirement would be contrary to State
statutes which allow exempt well permits and prohibit compelled connection in
this situation. Moreover, the basis for requiring such a connection under the Code
(i.e., less environmental impact) is not present here.

This letter is intended to fulfill the Pitkin County requirements for the certification of construction of
the Onsite Wastewater Treatment System (OWTS) for the K2 Ranch property located at 1370 Owl
Creek Road, Pitkin County, CO. This work was completed under Pitkin County Onsite Wastewater
Treatment System (OWTS) Construction Permit No. 0011.2013.powt. The observations made by
SGM of the OWTS installation have been completed pursuant to plans and specifications prepared
by SGM.
SGM conducted a site visit on 9/11/2013 to observe installation of the sand mound, pipe and gravel
distribution system, automatic distributing valve and flushing assemblies. SGM conducted another
site visit on 11/17/2015 to observe operation of pumps and ensure installation of controls and
alarms. Due to changes in architectural and plumbing design, it was not possible to get the
wastewater to flow to the septic tank via gravity. Thus, a concrete lift station with duplex grinder
pumps was added between the house and first tank. Other installed components included a 2,000
gallon septic tank followed by a 1,500 -gal two-compartment septic tank with duplex effluent
pumping system, piping to the automatic distribution valve, absorption field piping, and the sand
mound system with pressure distribution laterals and flushing assemblies. The control panels and
alarms were installed within sight of the system, including strobes, and were connected to the
house's central control and alarm system.
The attached record drawings show the installation of the system was generally completed per
plan. As -built survey points were obtained by SGM and are provided on the plan with GPS
coordinates for critical design elements.
The intent of this letter, along with the attached record drawing, is to provide adequate information
to convey that the installation of the OWTS improvements for the K2 Ranch property were
