DISCUSSION: No site visit was conducted for the review of this proposal as EH/NR staff are familiar with the site. The Environmental Health & Natural Resources Department has reviewed the details of the Fabrizio application under the authority of the Pitkin County Land Use Code and has the following substantive comments. RIVER AND STREAM CORRIDORS AND WETLANDS: Section 7-20-80: Applicant proposes changes to Sec. 7-20-80 by addition of language to specifically address micro hydroelectric facilities and their placement within the 100 foot setback to streams. Applicant proposes language that ensures the maintenance of minimum stream flows in any affected reaches to maintain the integrity of the wetlands and riparian habitat along the stream. Applicant did not, however, address minimum stream flows for in -channel habitat protection. Language should be proposed to address the protection of in -channel habitat as well as the riparian and wetland habitats. Staff also discussed this proposal with Bill Blakeslee, Water Commissioner with the State Engineer's office in Glenwood Springs. He was able to offer an example where a micro hydroelectric facility created two separate injuries to the water rights system. He would like to review each application on a case-by-case basis to assist the designers, so that injury does not occur and water can be managed properly during a call, if necessary. (See attached email). Language should be proposed that incorporates working with the State Engineer's office on system design so that water rights can be properly administered. For instance there are some out there now with no communication with Div of Water Resources There is one on Snowmass Creek who takes water from a ditch, which does not recognize hydro as a right, and then dumps the outflow into a pond which has no right and thus has created two injuries. The difference between takeout and return often creates the problem. If the hydro right is not decreed, it can be subject to curtailment when the call goes on. SUMMARY OF RELEVANT PARTS OF APPLICATION: Applicant requests an Activity Envelope and Site Plan approval for placement of a micro -hydroelectric power source on the property. Applicant proposes to divert water in the amount of up to 5.5 cubic feet per second (cfs) from Brush Creek directly above its confluence with the Roaring Fork River. Applicant has provided documentation confirming decreed water rights (conditional) in the amount of 5.5 cfs for generation of hydroelectric power and fire protection (Water Court Case No. 06CW145). The Pitkin County Environmental Health & Natural Resources Department conducted a site visit of the subject property on May 17, 2007 and has reviewed the details of the FaBrizio Family Trust application under the authority of the Pitkin County Land Use Code (LUC) and has the following comments. WATER COURSES AND DRAINAGE: 7-20-30: Applicant has committed to following the conditions of the LUC referring to water courses and drainage. Applicant will be required to submit details for approval relating to drainage and erosion control as a condition of approval for the hydroelectric generation facility and its entire associated infrastructure. Applicant will also be required to submit a detailed revegetation plan for approval, for the areas of disturbance with appropriate seed mixes. (See also Section 7-20- 40(d)(4) and (7). FLOODPLAIN HAZARDS: 7-20-40: Applicant proposes the installation of a water diversion structure, some minor culverts and associated infrastructure within the FEMA mapped 100 -year floodplain. Applicant is required to submit a completed Floodplain Development Permit Application for review of potential effects that this project may have on flood elevations. Applicant will be required to submit detailed plans for the diversion structure and all related components for Printed on Recycled Paper review by the Floodplain Administrator, County Engineer (if necessary), and Land Manager (if necessary). Applicant did not specifically address the requirements of Sec. 7-20-40 of the Code. Applicant will be required to demonstrate that there is no impairment of flow or storage capacity of the floodplain so as to cause foreseeable damage to others. It should be noted that placing structures within the floodplain for hydroelectric purposes cannot result in the loss of wetlands or riparian areas (Sec. 7-20-40 (c)(3)). Applicant, at this point, has not demonstrated compliance with these standards and they should be adequately addressed in the Floodplain Development Permit Application. RIVER AND STREAM CORRIDORS AND WETLANDS: 7-20-80: Applicant proposes the construction of a small power generation structure within the 100 -foot setback to the features identified in section 7-20-80(a)(1) and/or the 25 -foot setback identified in section 7-20-80(a)(2)(b). Applicant represents that there is no feasible alternative location to the proposed alignment. Applicant has identified two specific exceptions to the setback (water diversion facilities and culverts) with applicability to its application. While the exceptions identified would cover the diversion facility at the point of diversion and the culverts required to cross the channel, the hydroelectric generation structure, utilities, and piping are not water diversion facilities or culverts. The proposed location is not permissible under the current LUC. Even decreasing the setback to 50 feet (Sec. 7-20-80(a)(2)(a)) does not allow for placement of the power generation structure in its current proposed location due to proximity to Brush Creek on the north and isolated wetlands on the south. The proposed action will have extensive linear impacts within the 100 foot setback and a significant footprint within the 100 -foot setbacks to both Brush Creek and the Roaring Fork River, though the Applicant has proposed low impact methods for this development. Due to the steep nature of the site, it seems probable that there may be alternative alignments for the micro -hydro components that would be located outside all applicable setbacks to water resources, would cause less impact to water, riparian and wetland resources, and may not adversely impact the Applicant's power generation capacity. Applicant shall identify an alternative location for the additional structures currently proposed within the 100 foot setback. Specifically, the alternative location discussed with Tom Newland west of the septic field and further from Brush Creek should be evaluated. This alternative location appears, on the site plan, to meet both the minimum setback requirements for isolated wetlands (25 feet) and for blue line perennial streams (100 feet). It is the intent of this Code section to protect riparian and wetland corridors and water quality to the maximum extent practicable. Finally, Applicant has not presented detailed mitigation plans for the riparian and wetland areas that may be disturbed. A mitigation plan including wetland/riparian plant list and methods as well as erosion and sediment control methods and locations (Sec. 7-20-30(c)(1)(f)) will be required. This plan should address areas both inside and outside the 100 -year floodplain and can be submitted with the required Floodplain Development Permit application for approval.
