...The Aspen/Pitkin Environmental Health Department has reviewed the
details .of this application for two Affordable Housing units under
the authority of the Pitkin County Code, title II, Land Use Code and
has the following-comments..
ADEQUATE PROVISIONS FOR WATER NEEDS: Sections-2-170 and-3-110.4:
"It .is the policy of theCountyto insure the availability-of .a water
supply of adequate quality, quantity, pressure and dependability for
fire protection and,support of a proposed land use prior to,apprbval
of the use. The County shall require land uses to-hook up to existing
public systems if•service.is available."
This parcel is-located close to the water supply line for the Brush
Creek Subdivision District,. A condition of approval is that the
applicant must have a.letter from the water District stating that the
District will.or will not/cannot provide water'to"this development.
If this development is out of the District and the District cannot-
serve this project, then.a well maybe drilled. This Department will .
need adequate.. information on the quantity and the.quality of water
available for domestic use. 'The well's yield can be determined by a
.water engineer's or well driller'.s pump report and'the results
submitted to.this department for our analysis. The bacterial quality
is'determined by having a water sample tested.by.a laboratory such as.
the Snowmass Water ;and Sanitation'District or Aspen.Consolidated
Sanitation District.., Should the laboratory report for the. water
sample indicate levels of-bacteria of concern, this department can
advise .the applicants on remediation methods. Beforea septic permit"
can be issued, the well must be drilled-to assure that setback
requirements from the well to the sewage disposal system.can'be
maintained. Pitkin County Land Use,Code requires that the well site
•'be.within the building envelope.
Then,. a condition of approval for this application i the
receipt of information documenting that the location of the
'well(s) meet setback requirements and can be placed within.the
building envelope and that the quantity and quality'of the well
water are adequate. without meeting these requirements a sewage
disposal system permit and building permit cannot be issued.:

SEWAGE TREATMENT AND.COLLECTION: Sections 2-180 and 3-110.5:
,It is the policy of. the County to ensure.that adequate.sewage.
treatment :facilities •are available to serve' existing. and new
developments:,. Public and private sewage disposal.systems. and
connections iso such.systems: shall comply with,the sewage'-.disposal
guidelines. of Pitkin County's Individual Sewage Disposal System
Regulation."
Lots in the Brush Creek area are served by individual sewage.
disposal.systems. All'.,such systems installed within Pitkin County
--require septic permits issued by the Environmental Health Department.,
and must c,oinply with the County's sewage disposal regulations To
receive'a septic permit, the applicant will need to submit a septic
permit-application•and appropriate fee with a completed .Soil Data
Form including percolation test.results.and profile hole information.
It must-be possible to-design an adequate sewage disposal system
before.a building permit can be issued.
The Aspen/Pitkin Environmental Health Department will design the
system for the applicant as part of.the permit fee, if an engineered'
system is not required.. We will do a site visit, advise the
applicant about the-best location for'.the'system:and provide a system
design. We will determine'if.an engineered system is needed based on
Ail soil test re"sults. Aengineered system is 'required if any one of
the following conditions exists.: a percolation rate faster than 5 mpi
or.slower than 60 mpi;-maximum seasonal level.of the groundwater.
table or bedrock less'.than four feet below the bottom of the proposed
absorption system;.or a slope in.excess.of 30%.' Prior to initiating
any tests at the site, the applicant should contact this office.for.a
pre-application conference. It is highlyrecommended that percolation
tests be performed between April 15 and November,l5.. This department
does not feel confident accepting winter soils tests and will
determine their validity'on a case by case.basis. :

The applicant will need to adhere to minimum horizontal setback
requirements for placement of septic system components which.should
be no problem on this lot. Assuming a 4 bedroom house over 2,000 sq
ft and less than 6,000 sq feet in size,. the leach field will need to
be located a minimum of 132 feet from the applicant's well and from
any neighboring wells.
The area for she leach field should be located in an area.of no
traffic, planted with dry land grass, and should not be watered. It
is desirable to.locate the system downhill from the house so that the
system can operate by gravity instead of mechanical parts which
require periodic maintenance and adjustment. The applicant should
refer to the Pitkin County Individual Sewage Disposal System -
Regulation for detailed inf.otmation, -and call our office to discuss
this site.
Because of the limited area in the building envelope due to steep
slopes, the applicant has requested to do a combined absorption field
for the two houses. We require that each house. has its individual
septic tank located on its own property. The effluent could then be
piped through a common pipe to one absorption field. However that
area for the field would have to be legally owned by the two ADU
lots, or some other legal method such as an easement to the area that
would be dedicated to the absorption field.
Based on -the slowest percolation rate'of 60 mpi and assuming a house
with 4 potential bedrooms and a sq footage of greater than 2,000, but
less than 6,000 sq ft. the overall area that would be required for
the absorption filed would be an area of 60 ft X 80 ft.for each
house. This square footage is based on constructing 3 foot wide
trenches 8.0 feet long and maintaining a minimum of 6 foot wide
separation of undisturbed soil between each trench and allowing a 30%
reduction in size for using deep gravel or a gravelless chamber.

A condition of approval for this application is the receipt and
approval of the sewage disposal permit by the Environmental
Health -Department before a building permit can be issued. The
application must comply with all requirements of the sewage
'disposal; permitting process before a permit will be issued.
WATER QUALITY IMPACTS: Sections 2-140 and -T-70.5 and 3-70.10:
"It is the policy of the County to preserve and protect its present
water resources, recognizing the County's semi -arid character, and.
that significant transmountain and transbasin diversions and the
vested rights of senior appropriators in the basin have materially
curtailed the availability of an already scarce water resource. To.
.this end it is the policy of the County that no land use be initiated
which would adversely affect the quantity, quality, or, accessibility
of the County's water resources; or which would occur at the expense
of established water-dependent agricultural activities; or,which
would result in increased salinization of water resources, loss of
minimum stream flows, further destruction of wildlife habitat, or
major expenditures to reacquire or redistribute.major water
resources. It is also the policy of the County-to maintain a natural
vegetative buffer along its surface waters such that the surface and
groundwaters of the area are not encroached upon by land uses or
other human activities which could cause deterioration of water
quality or impair the natural treatment processes provided by meadows
and wetlands."
The Environmental Health Department is charged.with preserving and
.protecting the quality of Pitkin'.County's water resources. Since a
large percentage of.the population is-dependent upon water from
wells, elimination of groundwater pollution., and protection of
aquifers and their drainage areas are of utmost.importance. Roofs and
asphalt driveways can be nonpoint sources of water,discharge which
can contaminate water supplies. This Department recommends that
nonpoint so.urces- of discharge must be retained on.the property bf
origin which can be accomplished through landscaping, drainage
patterns, detention ponds, and dry wells for water runoff from
buildings,
Surface.water and groundwater contamination can also be.caused by
..inadequate setback distances'from sewage disposal systems to,
proximate wells, rivers,-creeks, ponds, and reservoirs. Minimum
horizontal distances between components of a sewage disposal system
and physical features, must be in accordance with the Pitkin. County
Sewage.Regulation.
AIR QUALITY: Sections 2-130 and 3-602:
"Only that'development is permitted which will not'contribute
significantly to degradation of.air quality."
This Department has met with Bruce Hazzard to discuss what mitigation
measures will be adequate to prevent significant increases in traffic
or PM10 in .the nonattainment area from this application and for the
application for. the 5 single family lots
We have determined the average number of trips generated from both•
development based on trip generation rates in the 5th edition of the
ITE book-on Trip. Generation.
5 single family homes will each generate 9.5.5 trips per day and the 2
affordable housing units will each generate.6.55 trips.per day. The..
average trip length in the non-attainment area has been established
to be 5 miles. Therefore, 61 trips or.8.,5 lbs of PM10 need.to be
mitigated.

The applicant has agreed to mitigate the impact
this development by contributing to_funds established by the Parks
Department. They will earmark these•towards:. (1)construction or
linking of bike paths or (2) paving a portion of -a parking lot..
.A condition of approval should be that the exact'method•and cost to
offset'B.5 lbs.of PM10 will be determined before final plat and
approved by 'the Environmental Health Department and that the.dollar.,
contribution will be made before the plat is recorded.
Activities such as road building and landscaping require a Fugitive
Dust'. Plan. This plan would need to include, but is not limited -to,.
fencing,.watering of"haul roads and disturbed areas, daily cleaning
of. adjacent paved roads to.remove mud.that:has been carried out,
speed limits, or other -measures necessary to.prevent windblown dust
from crossing the property line or causing a•.nuisance.
A condition should be approval by the Aspen/Pitkin Environmental
Health Department of the fugitive dust control plan, containing
enough measures to ensure that dust does not become a nuisance
or blow onto adjacent property..
The-applicant•must`file a fireplace•/wbodstove permit with the
Environmental.Health Department before the building -permit will be
issued.
The 'less densely populated parts of Pitkin County like Brush Creek.

'have two devices 'per building:.a maximum of one wood burning
fireplace,.and a. -second device which can be either a gaslog fireplace
or- a.,certified woodstove. in addition,, unlimited numbers of

A condition of approval for this application is the receipt and

Pursuant to our meeting in your office last week, the Applicant on the above referenced
project is willing to mitigate the minor PM -10 impacts of the project through a reasonable
cash -in -lieu payment to Pitkin County. The Applicant's interest lies in these monies going
toward the future construction or paving of new trails within Pitkin County. Your help in
determining the reasonable nature of this amount is appreciated.

1. In reviewing my notes of 8/12 regarding the Affordable Housing units, I indicated
that I had no information if the well permit allowed the well to be a shared well for 2
homes or if it is'for a single home
2. Earliest mitigation measures were dedication or purchase of bike paths and the
length and the cost varied by project (lot length, steepness, etc varied but the amount
purchased offset the numbers of trips the project generated. Costs varied from
$2,520/lot to $11,220.
To see if these amounts were reasonable, we compared them with the cost to maintain 1
mile of bike path: -
One residential lot generates, say, an average of 9 trips/day
About 1/2 mile section of busy bike path plowing might allow 20 people to
walk/bike
$11,220 pays for over 5 years worth of plowing.

The Cougar Canyon development will generate 61 trips or 8.5 lbs of PM10 so a
contribution similar to that of Red Butte is appropriate. Red Butte generated 57 trips or
8 lbs of PM10.
$ 78,540 would maintain one mile of bike path, summer and winter, for 5 years.
$ 78,540 would mitigate around 60 trips or 81bs of PM10.
$ 78,540 would construct 4/10ths of a mile of multi -use trail @ $40/ lineal ft
In general a contribution could be based on the following, the contribution being used
to acquire easements for trails, maintain bikepaths, or construct trails.
$78,540 / 57trips = $1,380 would mitigate 1 _trip or 5VMT
$78,540 / 8 lb = $9,820 would mitigate 1 lb of PM10 -
Therefore for Cougar Canyon to mitigate their impact of 61 trips:
61 trips X $1,380 = $84,180 Contribution
$84,180 contribution divided between the 5 free market lots = $16,800/lot
Since there is no adverse impact until the homes are constructed, the payments need
not be made until building permits are issued.

.. The-Aspen/Pitkin Environmental Health Department has conducted a site
visit on 5/2.1/97 and reviewed the details of.the�Cougar Canyon
application under the authority of the Pitkin County Code, Title II,
Lund Use Code -and has the• fol-lowing comments.
ADEQUATE PROVISIONS FOR WATER-NEEDS: Sections 2=17.0 and 3-1.10.4:
"It is the policy.of the-County to insure,the.'availability of a water
supply of adequate quality, quantity, pressure and dependability for
fire protection and support of a proposed.land use prior to approval
of :the-use.,The County shall require land 'uses to hookup to existing
public'systems.if service is available."
Wells test reports on test wells were-conducted-by Samuelson Pump
Company, Inc. and indicate an average _flow rate of 20gpm at an
average depth of 473 feet. It appears from these te.sts.that there
will be adequate water to serve this development..
This Department will need adequate information, on the.quantity.and
the quality ofwater available for domestic use-once the permanent
wells are.drilled., The well'syield can be.determined by a water
.engineer's or well driller's pump report and the results submitted.to
this department for our analysis. The bacterial quality is determined
by,having a water sample tested by a laboratory such as the Snowmass
Water and Sanitation District or Aspen'Consolidated Sanitation '
District. Should the laboratory report for the water sample indicate
levels of bacteria of concern,*this department.can advise-the
applicants on remediation methods.-Before a septic permit can be
issued, the well must be drilled to assure that setback requirements
from the well to ,the sewage disposal system.can'be maintained. Pitkin.-
County Land Use Code:requires that the well site be within.the
building. -envelope. Based on a'house size of•+ 6,000 sq ft with 4
bedrooms and a detached 2 BR caretaker unit, -the required setback of
the well from the.sewage disposal absorption field'will be a minimum
of 238 feet. _
It is recommended that low water landscaping (.xeriscaping) be used `
and that the timing of any sprinkler systems'be decreased for -low
water plants. The.Colorado State University Cooperative Extension
office can be contacted for more information on.xeriscap.i'ng.
A condition of.approval for this application is the receipt'of
information documenting that the location of the well s) meet.

Lots ir.this area are served by individual sewage disposal systems.
All such systems installed within Pitkin County require septic
permits issued by the.Environmental Health Department,'and must
comply with the County"s sewage disposal regulations. To receive a .
septic permit, the applicant will need to submit a septic permit
application and appropriate fee with a completed Soil Data Form
including percolation test.results and profile_ hole information.•
l0 foot preliminary profile borings were drilled on.each lot by
CTL/Thompson;and_indicated no ground water was present,.however. the
tests -were conducted in early October_ Because of the many areas of
wetlands observed during the.site visit,.surface water drainage,, and
the possibility of high ground water near several of the proposed
absorption.fields,'it should be made a condition of that all profile
holes and percolation tests must be conducted `during'the period of
highest ground water and runoff, normally towards the end of May
through early June.
Water drainage from runoff could impair the functioning of the sewage
disposal system by overloading and saturating the soils.• This would.
severely impair the soil's function to absorb and filter water from
the sewage system. Measures to mitigate water drainage could include
but are not limited to culverting or creating diversion swales to
move the water away from:the.sewage system..

Another consideration is.minimum horizontal distances between .
components of a sewage disposal system.and pertinentphysical
features must be in accordance with the Pitkin County Sewage
Regulations. The minimum horizontal.distance required from cut banks.
to.individual sewage disposal system components discharging effluent
into the surrounding soil shall be four time (4) times the'heilght of
the bank, measured from the top edge of the bank: The average :
setback from creeks would be.178 feet..
CTL/'Thompson'S recommended design-percolation rates ranged from 15
MP to 60 mpi based on the preliminary percolation tests conducted on
each lot. Based on the slowest rate, 60.mpi, which would require the
largest- absorption field; the overall area that would'be required for
the.field is 112 ft X 80.ft. This-'square footage is based on
constructing.3-foot.wide trenches 80 feet-long and maintaining a
minimum 6 foot-wide separation of undisturbed soil between each•-
trench and allowing a 30% reduction in size for using deep'gravel or
a gravelless chamber system.
The applicant has requested a separate envelope, outside the building
envelope, on-each lot exclusively for the sewage absorption field.
Based on the preliminary percolation data done by CTL%Thompson, Inc.,,
it-would be difficult to locate the sewage disposal system within the'
building envelope and still-maintain the 238.foot setback.from the
well.
The Aspen/Pitkin Environmental Health.Department will design. the
system for.the applicant as part'of the permit fee,. if an engineered.
system is not required. we will do a site visit, advise the.
applicant about the best location for the''syst,em and provide a system
design.-We will determine if an engineered system is needed based .on
soil test results.--An engineered system is required if any one of
the following conditions exists.: a percolation rate'.faster than 5.mpi,
or.*lower than 60 mpi;'maximum seasonal level of the-groundwater
table or bedrock less-,than four feet below the bottom of the proposed
absorption system;.or a slope,ih excess of 30%. .'Prior to initiating.
--'any tests at the site, the applicant'should contact this office for a
pre-application conference.
The area for the leach field should be located in an area of no

Under `General Restriction' -in the proposed Protective Covenants
for Cougar Canyon,.Article•7.27(b) states that the sewage
disposal system may_"not"be located or constructed above
'grade...." This Department does not agree with this condition.

FUGITIVE DUST PLAN
Activities such_as road building and landscaping require a Fugitive.
Dust Plan. 'This Plan i's in the application packet and is acceptable
since it appears to contain enough measures to ensure that dust `does
riot become a nuisance or blow onto adjacent property.
,FIREPLACE/WOODSTOVE
The applicant must file a fireplace/woodstove permit. with the
Environmental.Health Department before the building permit will be
issued.

The Aspen/Pitkin Environmental Health Department has reviewed the details of the
Cougar Canyon application under the authority of the Pitkin County Land Use Code
and has the following. comments.
ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-17 and 3-1104:
"It is the policy of the County, to insure the availability of a water supply of adequate quality, quantity, pressure and dependability
for fire protection and support of a proposed land use prior to approval of the use. The County shall require -land uses to hook up .
to existing public systems if service is available."
This Department will need adequate information on the quantity and the quality of
water available.. Quantity can be evaluated by tests of on-site wells by a water
engineer's or well driller's report. The applicant must ensure that the water quality is
acceptable by having it tested.by a lab such as the Snowmass Water and Sanitation
District or Aspen Consolidated Sanitation District. Water of acceptable quality and
quantity has been obtained in other lots in this area. Before a septic permit can be
issued, the well must be drilled to assure that setback requirements from the well to the
septic system can be maintained within the building envelopes.'Pitkin County Land Use
Code requires that the well site be within the building envelope. Water quality in some
wells in the Brush Creek Village area is somewhat undesirable in that it may. have a
taste or color due to minerals, but quality has been found to be acceptable in terms. of
meeting health standards.
Low water landscaping (xeriscaping) would decrease the amount of water required to
serve these homesites.

A condition of approval for this application is the receipt of information
documenting that the locations of the wells meet setback requirements and can
be placed within the building envelopes and that quantity/quality of the well
water are adequate. Without meeting these requirements, septic permits and
building permits can not be issued.
SEWAGE TREATMENT AND COLLECTION: Sections 2-18 and 3-1105: "It is the policy of the
County to ensure that -adequate sewage treatment facilities are available to serve existing and new developments. Public and
private sewage disposal systems and connections to such systems shall comply with the sewage disposal guidelines of Pitkin
County's -Individual Sewage Disposal System Regulation."
Lots in the Cougar Canyon area are served by individual septic systems. All such
systems installed within Pitkin County require septic permits issued by the
Environmental Health Department, and must comply with the County's septic
regulations.
The Aspen/Pitkin Environmental Health Department will design the system for the
applicant as part of the permit fee, if an engineered system is not required: We will
do a site visit, advise the applicant about the best location for the system and provide.a'
system design. We will determine if an engineered system is needed based on soil test
results. An engineered system is required if any one of the following conditions occurs:
a percolation rate faster than 5 mpi or slower than. 60 mpi; :maximum seasonal level of
the groundwater table or bedrock, less than four feet below the bottom of the proposed.
absorption system; or a slope in excess of 30%. Prior to initiating any tests at the site,
the applicant should contact this office.
To receive a septic permit, the applicant should contact this office. It must be possible
to design -an adequate septic system before a building permit can be issued: We believe
it will be possible to install either a conventional or -an engineered septic system on
these lots. Areas of over 30 % slope require engineered systems, but the applicant has
located.building envelopes in relatively flat areas. The large.sizes of the houses will,
require large septic systems, with systems of a couple of thousand square feet not
uncommon. While the building envelopes are large, they are not large enough in every
dimension to easily install a large, septic system, 100 ft from the well, and a large house,
without carefully placing the components in the building envelopes.
The area for the leach.fieldshould be located in ani area. of no traffic, planted with dry
land grass, and should not be watered: It is desirable to locate the system below the
house so that the system can operate by gravity.
Measures to mitigate water drainage from runoff may be required, since these steep
slopes often have melt water or spring. water on them a significant part 0f the year.
These could include but are not limited to culverting or creating diversion swales to
move the water away from the septic system.
In regard to the discussion of reduction in density for steep slopes, the land with over a
45% slope could not have septic systems installed on it in any case, with the possible
exception of engineered systems.
A condition of approval for this application is the receipt and approval of the
septic permit by the Environmental Health Department before.a building
. permit can be issued.
WATER QUALITY IMPACTS: Sections 2-14 and 3-705 and 3-710:
"It is the policy of the County to preserve and protect its present water resources. To this end it isthe policy of the County that no
land use be initiated which would adversely affect the quantity; quality, or accessibility of the County's water resources; or which
would occur at the expense of established water -dependent agricultural activities; or which would result in increased salinization
of water resources, loss of minimum stream flows; further destruction of wildlife habitat, or major expenditures to reacquire or
redistribute major water resources. It is also the policy of the County to maintain a natural vegetative buffer along its surface
waters such that the surface and groundwaters of the area are not encroached upon by land uses or other human activities which.
could cause. deterioration of water quality or impair the natural treatment processes provided by meadows and wetlands." .
The Environmental Health Department will be addressing water- quality impacts on
down stream water quality. This application is not expected to impact down stream
water quality if the minimum horizontal distances between components of the septic
systems and physical features are in accordance with the Pitkin County Sewage
Regulations.
There is no. condition of approval for water quality impacts.
AIR QUALITY: Sections 2-13 and 3-602:
"Only that development is permitted which will not contribute significantly to degradation of air quality in Pitkin County.
Developments may not constitute an indirect or direct air pollution source under Federal, State or County _regulations."
This project would contribute to air quality degradation in Pitkin County; especially in
the PM10 norlattainment area, .if mitigation measures were not included. The PM10
emissions from 70 VPD in the nonattainment area must be mitigated. Proposed
mitigation. measures will have to be evaluated to ensure they will fully offset any
increases in traffic or PM -10. The applicant has not discussed or listed any proposed
mitigation measures. Possible measures include provision of bike paths, .paving of
presently unpaved areas, provision of van service, or participation in mass transit.
A condition of approval should be: "prior to -detailed submission, the applicant
must provide a PM10 mitigation program containing. specific, enforceable
control measures, which must be approved bythe Environmental Health
Department. The plan must include documentation showing that the proposed..
mitigation measures will fully mitigate or offset all PM10 increases caused by
the project in the. nonattainment area."
Activities such as road building and landscaping require a Fugitive Dust Plan. This'plan
would need to include, but is not limited to,.fencing, watering of haul roads and
disturbed areas, daily cleaning of adjacent paved roads to remove mud that has been
carried out, speed limits, .or other measures necessary to prevent windblown dust from
crossing the property line or causing a nuisance.
A condition should.be approval by the Aspen/Pitkin Environmental Health
Department of the fugitive dust control plan, containing enough measures to
ensure that dust does not become a nuisance or blow onto adjacent property.
The less densely populated parts of the county like the Cougar Canyon/ Cozy Point
area may have two devices per building: a maximum of one wood burning fireplace
and a second device which can be either a gas log fireplace or a certified woodstove. In
addition, unlimited numbers of decorative gas appliances are allowed. Coal may-not be
burned in any device. No,fireplace or solid fuel burning stove may be installed inbarns
or agricultural buildings.
A-condition of approval for this application is the receipt and approval, of the
fireplace/woodstove permit by the Environmental Health Department before
the building permit can be issued.
