The results of observations indicate the OWS is operating adequately. Observation of the drain field during our visit indicated no surfacing of effluent nor condition that would suggest the system is not functioning properly. We encountered areas within the drain field that had above average moisture contents due to irrigation of the drain field. Although not recommended, we understand the field area was being irrigated to establish vegetation, and will not be irrigated on a long-term basis. In the paragraph describing EXISTING CONSTRUCTION, the sewage loading for a 4 bedroom structure with 2400 SF is indicated on be based on 130 gallons per day (GPD) , where it should be 100 GPD. The loading is indicated to be 1040 GPD, whereas it should be 800 GPD. The other correction is on page 2. in RECOMMENDATIONS where the exi_st- inq septic tank is described as a 750 gallon tank. Ms. MacKenzie indicated the as -built drawing indicate the tank is a 1000 gallon tank. For septic tank capacity, we recommend 30 hour retention of the peak loading volume of 1400 GPD which is 1680 gallons. Therefore the 1250 gallon 2 compartment tank indicated in our letter is correct. We did not indicate several sewer lines on our As - Built Drawing. We have prepared another As -Built Drawing, which is presented as Figure 1. Please substitute this letter for the letter dated November 30, 1998. We observed the installation of the Onsite Wastewater System (OWS) for the subject site. The system was designed in our report dated August 21, 1997 revised September 15, 1997 and August 18, 1998 under Job No. 6913. The OWS was installed to serve a four-bedroom single family residence. The OWS consists of the existing 750 -gallon septic tank, a new 1250 -gallon two-compartment pre -cast concrete septic tank with an effluent pump in a biotube vault, the existing evapotranspiration drain field, and 8080 square feet of new drip irrigation drain field. The pump control panel was installed at the time of our second site visit. Power to the control panel was also installed. The components of the OWS were installed in conformance with the plans and specifications except for minor changes in locations of the OWS components. The revisions relate to: 1. distribution to trenches in each section, and 2. pump specifi- cations. We visited the site on August 27, 1998 during construction of the drip irrigation field and met with Draeger Excavating. During our site visit we observed six installed trenches and two under construction. The trenches in each section were not installed level relative to each other due to the slope. We recommend installing the manifolds similar to Fig. 1. We recommend installing the manifold parallel to contour and in undisturbed soils to ensure equal distribu- tion to each trench in each section. There is approximately a 55 foot vertical distance between the septic tanks and the proposed distribution valve or surge tank location. A pump sized for 60 feet of head at 30 gallons per minute yield be in- stalled. We recommend dosing be set at 200 gallons due to drain back from the pump line. This.is an alternative method of'wastewater disposal not provided for in the Pitkin County Regulations. As such, it has been declared an experimental system and the.installation of a total of eight such systems have been approved. Attached is a copy of Resolution #967134 which was -adopted by the Pitkin County Board of Commissioners, acting as the Pitkin County Board of Health. We request that you read the -conditions of the resolution and sign the bottom of this letter stating that you understand these conditions. We have taken these precautions because Drip Irrigation is an experimental system in this area. Several hundred of these systems have been installed on the Eastern Slope. However, we do not have historical data to know how the system will perform at this altitude and in the extreme and varying weather conditions we experience. Some conditions that must be met before we can issue your septic permit areas follows: • If a "water balance " method of calculating waste load is applied, a monitoring plan must be.submitted.to determine saturation status of soils. • A bond.must be posted to assure the system is installed, has a final inspection performed by the design engineer, and that a final `as -built' drawing is provided to this department. It has been determined that'the bond must.be,for one and a half (1-1/2) times the amount of the installation cost of the system.. RECITALS - - 1. The Pitkin County Board of Commissioners has declared in the Pitkin County Individual Sewage Disposal System Regulation (Regulation), support for alternative methods of wastewater disposal not otherwise provided for in the Regulation. In this case such an alternative system commonly known as Drip Irrigation shall be declared "experimental". 2. The Pitkin County Board of Commissioners has declared in the Regulation that the experimental system must be designed by a Registered Professional Engineer prior to submittal to the Aspen/Pitkin Environmental Health Department for review. 3. The Pitkin County Board of Commissioners, acting as the Pitkin County Board of Health (PCBOH) recognizes, and the Regulation states: "The Local Board of Health may not arbitrarily deny any person the right to consideration of an application for such a system and shall apply reasonable performance standards in determining whether to approve an application." NOW, THEREFORE BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado, that the use of "Drip Imgation" as an experimental wastewater disposal system in Pitkin County meets the conditions of the Regulation to be declared experimental, and sitting as the Pitkin County Board of Health declare approval for installation of a total of eight (8) such systems in the County with the following conditions: 1. Any permit for installation of a Drip Irrigation wastewater disposal system must be issued in the name(s) of the legal owners of the property involved, must contain an accurate description of the property, and must conspicuously display the requirements in Section 4-20 of the Regulation, titled; "Experimental Systems". 2 2. The Pitkin County Board of Health and the Aspen/Pitkin Environmental Health Department will assume no liability in the act of issuing a permit for a Drip Irrigation wastewater disposal system, either for design or performance. 3. The permit issued for a Drip Irrigation wastewater disposal system shall be recorded in real estate records for the property served by the system. This recording is for the purpose of putting future purchasers on notice that an experimental sewage disposal system serves their property. 4. The applicant must commit to follow the recommendations of the Aspen/Pitkin Environmental Health Department (Department), and those of the Registered Professional Engineer consultant to the Department if approval is given to install the experimental system. 5. As is stated in the Pitkin County ISDS Regulation, Section 4-20; The applicant must provide for a "... timely installation of a backup system of a type described in this regulation if the experimental system fails." The lot on which a Drip Irrigation system is to be installed must be large enough to accommodate a traditional Individual Sewage Disposal System (ISDS) so that if the Drip Irrigation system fails and cannot be repaired, the owner will have room to construct a replacement system. This is consistent with previous PCBOH actions on experimental systems as found in Section 12-8.1 of the ISDS Regulation. 6. If a "water balance" method of calculating waste load is applied, the applicant must provide a monitoring plan to determine the saturation status of soils, especially in the early spring months when the leaching bed is at its peak storage. 7. The applicant must provide a written report to the Environmental Health Department documenting maintenance on the system (such as when the filters are changed and when the valve regulating field use is activated). The soil saturation data requested in condition 6 above must also be reported. The reporting must continue for a period of five (5) years, and be submitted to the Environmental Health Department in January of each year. 8. The installation of a filter after the final septic tank to remove any material which may remain to clog the distribution line ports will be required. 9. Since Drip Irrigation is promoted as an ISDS that is suitable for poor percolating soils, it assumes the form of a modified evapotranspiration (ET) system In some cases it may be an evaotranspiration/absorption system using both air and plant evaporation with minimal soil absorption. Section 12-6.4 of the Pitkin County ISDS Regulation requires placement of these type systems, "...in an area where there is exposure to sunshine enough days per year and hours per day to allow for adequate functioning of the system, and must take into account the number of months per year in which the area is covered with snow. ET systems may not be used in shaded north -facing areas in valleys, for example, but must be in areas that are open to sunshine and exposed to sufficient breezes." 0 3 10. Pitkin County ISDS Regulation requires a water flow "peaking factor" in the design of ISDS. However, since no "daily peaking factor" is figured in the calculation of the Drip Irrigation wastewater disposal system, and this is a significant variation from the Regulation, this requirement is waived with the condition that only a total of eight (8) systems using this modification be allowed in Pitkin County until it can be verified that the public health of residents, and the environmental health of surface and ground water is not compromised. 11. The owner will be required to post a bond to assure the system is installed and has a final inspection performed by the design engineer, and that a final "as - built" drawing is provided to the Environmental Health Department. The purpose of our revision is to design the OWS based on a four bedroom sewage load. SITE. CONDITIONS - The site is a 2.14 acre lot in a rural subdivision of Pitkin County, Colorado. The location of the residence and the proposed repair OWS are presented on Fig. 1. The slope at the pro- M posed field area is 15% to 20% to the northwest. The ground surface has a moderate cover of small shrubs and sparse cover of native grass- es. The site is not in a confined drainage area and has moderate solar exposure and good wind exposure.�a EXISTING CONSTRUCTION - A residence exists at the site. The number of bedrooms has varied and based on a Pitkin County Environmental Health county, there are four bedrooms. The OWS has been sized based on the residence being a 2400 square foot (SF) with four bedroom structure. o The sewage loading for a four bedroom dwelling is 1-0.40, gallons per day /Oct (GPD), based on two people per bedroom and -13-&-.jGPD per person. The design loading includes a garbage grinder, dish washer and washing machine. The site will be served water by public water service. There is an onsite well located to the east of the residence. Another well is located to the north of the proposed filed area. Discharge from any water softener, spas or pool should not be directed to the OWS. EXPERIMENTAL DRIP IRRIGATION SYSTEM - The proposed drip irrigation OWS has been authorized as an experimental OWS in Pitkin County. As a part of the authorization, there will be conditions of the permit which are not typical of a permit in Pitkin County. The primary condition which will affect you is hav- ing a bond posted for installation. With respect to the remaining conditions: 1. you must agree to the terms of the permit; 2. a backup design is a sand ETA design over the proposed drip -irrigation field; 3. monitoring as described later in this letter will be required which will include an annual report; 4. a filter is a part of this design; 5. the site has been reviewed as described under Site Conditions and found suitable for installation of a drip irrigation OWS, 6. the De- partment will allow the construction of the OWS without a 1.5 peaking factor, and 8. requires the bonding of the installation cost. Another drip irrigation system has been installed in Pitkin County, in the same subdivision, so we expect the OWS to perform well. The alterna- tive and backup to a drip irrigation system is a sand evapotranspirat- ion and absorption (ETA) system. SUBSURFACE CONDITIONS - Subsurface conditions were investigated by Nelson. Subsurface conditions consisted of 3 inches of dark gray silty topsoil underlain to 9.5 feet by gray silty clay. No free water was encountered nor was observed 1 day after excavation in the profile pit. Percolation rates exceed 180 minutes per inch (MPI). We believe percolation rates of greater than 180 MPI reflect a 180 MPI percola- tion rate. GEOLOGIC CONDITIONS - The site is underlain by gray silty clay accord- 111nq to Nelson. Based on the results of the percolation test and our experience, we believe there is a low risk of contamination of the well to the well located onsite and the well located to the north of the proposed field area. The proposed OWS is designed for ETA which minimizes the risk of contamination of the wells. The additional setback is mandated Pitkin County above the State of Colorado setback requirement of 100 feet. RECOMMENDATIONS - The system is proposed to the west of residence with two septic tanks, lift station, and a drip irrigation field, as indi- cated on Fig. 2. We recommend including the existing 750 gallon septic tank and the installation of one 1250 gallon two compartment precast concrete septic tank with an Orenco Screened Basket lift station. Pitkin County may require the removal of the baffle in the 750 gallon septic tank. If required, the contractor has the option of removing the baffle or installing a 1250 gallon two compartment septic tank and a separate 1000 gallon septic tank for the .lift station. We recommend the existing field remain connected to the system via an overflow in the case of a power outage or pump failure. The field area is based on 1040 GPD loading for a four bedroom home, 32 inches of lake evaporation per year based on the US Department of Commerce Weather Bureau Technical Paper No. 37, and attached water balance design. The area of field required is 8080 SF. We recommend the installation of six_12 feet by 85 feet sections, one 12 feet by 70 feet section, and on"_8 feet by 70 feet section for a total_of eight sections. For greater than four b'�rooms, the septic tank must be upsized to 250 gallons per bedroom! Each additional bedroom larger than four bedrooms would require Ian additional 2020 SF of drip irrigation field. We recommend the surface of the ETA field be seeded after installation of the!,ystem. A good native grass cover will promote E -T. We recom- mend djlocal seed mix available at seed stores. These mixes do not require irrigation and develop a growth 10 to 15 inches high. No automati9c sprinkler system should be installed over the field. The own'r must realize an OWS is different from public sewer service. The ori r must assume the responsibility for maintenance of the OWS. The sys; ern is relatively maintenance free, but the owner must have the septic; anks pumped and the screened vault cleaned. We anticipate the annual reporting requiteent for 5 years and is estimated to cost $200.00. If the drip irrigat on OWS performs as the existing system has, we would apply to have monitoring period reduced to 3 years. The soil moisture monita� ng program is described below. SOIL KO STORE MONITORING - Base line soils data would be obtained at OWS con truction. The testing would include moisture and density of the nat've soil. We propose a minimum of 5 soil moisture samples be obtained and tested during May of each year. Three of the five sam- plesilocations will be from drip irrigation sections which are open and two; will be randomly selected with a "random number generator" TOTAL P.02 r 4 from a grid overlay of the field. The samples will be obtained from a depth of 12 to 30 inches. Based on the soil moisture testing a report indicating: 1. location of tests, 2. moisture/density and 3. percent saturation will be reported. If the percent saturation exceeds 90% in two of the five samples and there is no evidence of surfacing, additional samples will be obtained in August. Any evidence of sur- facing would first require closing of that section of the field and additional monitoring. OWS ALTERNATIVE - If the proposed drip irrigation OWS does not preform or is unacceptable by the county health department, we recommend a chambered ETA bed OWS be installed in the area presented in Fig. 5. We recommend the installation of a 1000 gallon two compartment precast concrete septic tank with a lift station added to the existing 750 gallon septic tank. Based on the water balance sheet we recommend the installation of six 18 feet by 75 feet ETA beds for a total square footage of 8100 SF. A total of 132 chambers is necessary. The total effective area is 2376 SF. The ETA OWS should be constructed as indi- cated on Figs. 5 and 6. LIMITATIONS - A drip irrigation design requires installation by a contractor who is an experienced installer. Our investigation, layout, design and recommendations are based on data submitted. If subsurface conditions considerably different from those described in this report are encountered, we should evaluate the effect of the changes on the proposed OWS. First, however, I will restate what our understanding is of the issue surrounding the property. The land was represented and sold to you as having a 3 bedroom home, yet the sewage disposal system had been originally designed and installed to serve a 2 bedroom house. Upon investigation you discovered this inconsistency and approached the Environmental Health Department to determine what would be needed to expand the sewage system to accommodate a 3 bedroom dwelling. Our department response was that the existing system would only serve a 2 bedroom home. It Was also discovered that the original system design had been altered and, in fact, been reduced in size as previous occupants living conditions dictated. r The Environmental Health Department cannot approve the existing individual sewage disposal system, even if it is restored to the design as defined in the issued permit, for a 3 bedroom home. We can r approve it for a 2 bedroom house as it was intended to serve. Further, no variance can be granted from the Pitkin County Individual Sewage Disposal System Regulation to allow the existing system to be classified as functional for a 3 bedroom home. The only options available seem to be to declare the house a 2 bedroom and occupy it as such, or apply for a repair permit to re -design the sewage disposal system to serve a 3 bedroom home. Although the decision was made more than 15 years ago, Protasis suing the board and for- mer inspector Robert Nelson because the family he sold his home to last year is now suing him for damages — damages they claim to have incurred from making repairs to the faulty 3 X13 -t> z- oO c e M2-7& -5 taRes aim Inspector approved sewer. Lawyers for the family — Joel and Frances Soroka — filed their suit against Protas last month, claiming the family was sold a three-bedroom home which con- tained a septic system designed to accommodate a two-bedroom home. They claim in the suit that Pro- tas, Mason & Morse Real Estate, and the real estate agent who sold them their home, were all aware of the discrepancy, but concealed the facts in order to sell the home. They are basing their claims on a document, signed by Protas, that designated the home as two- bedroom. Protas' lawyer claims that document was altered by the environmental health inspector, who they claim physically crossed out the three-bedroom home designation and changed it to two-bedroom, after Protas signed it. As a result of this claim, Pro- tas' lawyer filed the suit last week in Pitkin County Court against Nelson, the commissioners, and the Aspen -Pitkin County Envi- ronmental Health Department, claiming Nelson's actions were intentional, willful, wanton, and negligent. The commissioners, his lawyer claims, are responsible for Nelson's actions because he was a county employee. The Sorokas filed their suit last month after claiming to have spent nearly $35,000 in their first year of ownership to replace the home's septic sys- tem. They are claiming fraud on the part of Protas and Mason & Morse, and are suing for dam- ages and the difference in the cost between a two- and three- bedroom home.
