Galena Aspen, CO 81611 Re: Woody Creek Water Quality Dear Tom: There is no reason for this letter other to keep you informed of our activities as it relates to the Two Mile Ranch (the old Stanley Natal Ranch). As you know, we received a permit to reconstruct the historic log house on the property and also a permit to remove the 1950's era Ranch House. In the process of completing our work, we decided to evaluate the existing waste water treatment system, reported to be a septic tank and leach field serving the Ranch House, and therefore we followed the waste water line from the house towards the leach field. Upon excavation of the line to the leach field, we found that a 55 gallon drum had been installed to serve as a septic tank and/or grease trap and this drum was approximately 40% full of grease. Upon further excavation, we found that the piping from the Ranch House terminated within a buried car body. This car body was excavated into the soil at a depth of approximately two feet and the car itself was submerged in groundwater. Consequently, there was little if any treatment of the effluent from the Ranch House actually occurring. We have been in contact with Dwayne Watson from the State Department of Public Health and Environment and have been working with Dwayne to make sure that we comply with all State Water Quality Laws and Public Health Laws regarding the removal of this system. While we understand from Dwayne that the system could be abandoned in place, we chose not to follow this course of action and instead we will be removing all parts of the system and we will also remove any areas of contaminated soil in an effort to improve the overall water quality of this site and Woody Creek. Monarch St. Aspen, CO 81611 Re: Two Mile Ranch NOTICE OF VIOLATION Dear Mr. Fenton: As Building Official for Pitkin County, I am aware of development occurring at Two Mile Ranch without the benefit of permits issued by Pitkin County. Most recently, the Environmental Health Department cited you for installing a septic tank without an Individual Sewage Disposal System permit. It also appears that the trench associated with this system may be located outside of the approved building envelope. This is not the first development at the ranch to occur without permit. The construction staging area for the ranch, the little cabin next to homesite #6, and the granary, to name a few, were all constructed before permits were issued. Some were located outside of approved building envelopes. One Stop Work Order has been issued on this property and the City of Aspen has also issued one to Fenton Construction this month for work on 434 E. Cooper for work without a permit. This pattern of disregard for approvals is not acceptable. Therefore, be advised that no pending permits will be issued and no new permits will be accepted until all the following issues are resolved: 1. All building and construction activity envelopes on this parcel must be fenced with construction fencing. 2. The following concerns of the Environmental Health Department must be satisfied: a. A new Individual Sewage Disposal System (ISDS) permit application must be submitted for OWS 1. The application must be for the final design, i.e.the drip irrigation system. The design must address mitigation for the trench that was dug to divert groundwater from the illegally installed septic tank. No pending ISDS permits will be issued and no new ISDS permits will be accepted until the new permit for OWS1 is issued. b. No work on any septic system may be started until the septic system permit has been issued by Environmental Health. c. A copy of each septic system permit must be kept on-site during installation. • W 3. One representative shall be appointed by Fenton Construction who shall oversee and be responsible on behalf of Fenton Construction for all development activity on this parcel and who shall be available for all inspections. While doing this they ran into a ground water problem and have dug a —300 ft run-off ditch to mitigate the flooding. This also was done without discussion with Environmental Health or without seeing if they were in compliance with their earthmoviM permit. Norm and I met with Joanna and Connie yesterday to discuss our options. The building permit file has several'Stoo Work" orders in it for this job. Barn Dear Joanna; I have been discussing septic tank permitting issues for the Two -Mile Ranch village core with Nancy McKenric. It appears we have installed our septic tanks prematurely due to a lack of communication on the final design approvals. I am following up with Nancy on this issue. On another note, we excavated a run-off ditch last Friday, April 12"' that Nancy has seen and has concerns with. After analyzing the ditch further and listening to Nancy's comments I am not sure if we are in compliance with our current earthmoving permits and approvals. So I would like to get your comments on the situation and explain why the ditch was excavated. Over the last couple of weeks with the spring run-off increasing and our water table rising we have had immense flooding in the open hole where the septic tanks are placed. Tlus hole is in a high water table arca. In addition the gravel bed under our utility corridor piping is acting like a French Drain for the ground water and is creating additional water runoff and massive ponding in this area. We have tried pumping the water from this area but this would not keep the flooding down. The run-off ditch was trenched approximately 300 feet West to an existing agricultural irrigation ditch to mitigate the flooding. We felt this was the most logical solution to solve the flooding problem. I lowever, if we are not in compliance with our approvals or we can do anything differently to make you and Nancy more comfortable please let me know. Also, Gary Beach from Beach Environmental is designing piping for the run-off water so the ditch can be covered up. A 2000 -gallon and 1500 -gallon single -compartment precast concrete tanks have been installed as required by our revised design dated March 13, 2002. The tanks have been installed in conformance with the design plans. Due to ground water, the tanks have been weighted with concrete `deadmen' to prevent flotation. Two concrete `deadmen' were placed on the 1500 -gallon tank and three concrete `deadmen' were placed on the 2000 -gallon septic tank. Each `deadman' is 2 feet x 2 feet x four feet, and weigh 3600 lbs. This is adequate weight to prevent flotation. Calculations are presented as Figure 1. A dewatering ditch has been installed to lower the ground water table in the area of the septic tanks. In addition to design specifications provided by Pinacle Design Consulting Group, Inc., the perforated HDPE four -inch pipe should be a minimum of 10 feet away from concrete septic tank. The area between the HDPE pipe and the concrete tank should be backfilled with crushed rock. This ditch will not effect the performance of the OWS nor will the OWS contaminate the irrigation ditch. The revisions are -based on a new location of the drip irrigation drain field from our original drip design, dated July 31, 2001. Our firm investigated subsurface conditions on July 25, 2001, September 26, 2001, and May 8, 2001. SITE CONDITIONS The investigated site includes three building envelopes at the Two Mile Ranch as indicated on Figure 1. The subject site is located in a rural mountain area where OWS and wells are required. The site slopes moderately to the southeast. There is a good cover of native grasses at the proposed field location. PROPOSED CONSTRUCTION The site includes three building envelopes, which are 1 -acre, 1 -acre and 0.5 -acre in size as presented on Figures 1 and 2. OWS 1 will serve four buildings within the three building envelopes. The average daily sewage load is 1550 gallons per day (GPD) as presented in TABLE I below per Pitkin County Environmental Health Department (PCEHD) regulations. The peak loading is 2712.5 GPD. OWS 1 provides an ISDS to the Historic House, which is presently on a vault. The remaining structures do not have specific plans, but the proposed water flows are conservative based on planned uses. The drain field is proposed to the northwest of the Agricultural (Ag) Barn, which will be 300 feet from Woody Creek and 200 feet from an irrigation lateral. The property will be served water by several onsite wells. Water is collected and treated before distribution to individual structures. A distance of 237 feet is required between the field and well per PCEHD regulations and 187 feet to creeks for the 2712.5 GPD wastewater flow. Based on our design utilizing "secondary" treatment, evaluation of risk of contamination of surface water and ground water, it is not necessary to add eight feet additional distance for each 100 gallons of wastewater per day of design flow over 1000 gallons per day, as specified in the table to prevent contamination. A 125 -foot separation between the proposed absorption area, surface water or ground water is appropriate to prevent contamination. The owners have requested that PVC pipe not be used in construction at the property. HDPE pipe has been substituted for PVC in specifications. In several details we have not changed the PVC description, but we have requested PVC components to be substituted with HDPE. SUBSURFACE CONDITIONS Subsurface conditions were investigated by excavating 2 test pits and 11 percolation holes, 12 to 31 inches deep, at the locations indicated on Figure 2. Subsurface materials consisted of 1 foot of silty sand topsoil underlain to 10 feet by reddish brown silty sand with random cobbles. Free water was encountered at 6 to 7 feet in June of 2001, when the profile pits were excavated. The test pits were filled because of safety concerns, but will be opened as requested. In April 2002 additional borings were drilled to determine the depth to ground water. The results of monitoring indicate ground water at 7 feet to greater than 10 feet in the proposed drain field area. The drip irrigation drain field can be installed at a depth of 8 to 20 inches to maintain 4 feet to water. Percolation tests indicate percolation rates of 7 to 40 minutes per inch (MPI). Percolation rates furthest from the creek and in closest proximity to the proposed drain field were considered. The average percolation rate is 18.5 MPI. EXPF,RIMENTAL DRIP IRRIGATION SYSTEM The proposed drip irrigation (shallow trench) OWS has been authorized as an experimental OWS in Pitkin County. As a part of the authorization, there are conditions, which are not typical of other permits in Pitkin County. The conditions include: a. the applicant must commit to follow recommendations of the Department and the design engineer, b. a backup system design is required, c. monitoring of soil saturation and an annual report is required and must be reported for 5 years, d. the site must be reviewed for solar and wind exposure. You will have to agree to the following conditions: 1. you must agree to the terms of the permit; 2. a backup design is an ETA bed design in the same area and 3. monitoring as described later in this letter will be required which will include an annual report as described in Item C. The site has been reviewed as described under Site Conditions and found suitable for installation of a drip -irrigation OWS. Twelve shallow trench drip irrigation systems have been installed and are performing properly in Pitkin County, so we do not anticipate problems with installation or performance ofthe OWS. There are 3500+ successful drip irrigation OWS operating in Colorado. It is our understanding the experimental status of drip irrigation OWS is being reviewed by PCEHD staff. We have discussed the status with them and hopefully experimental requirements will not apply to this application. Typically drip irrigation systems are installed where there is poor percolatiQn. Because good percolation rates were found at this site a backup drain field design was not prepared. A backup field could be chamber trenches. RECOMMENDATIONS The results of our investigation indicate an OWS can be installed at the location presented on Figures 1 and 2. The OWS design is based on an average daily sewage load of 1550 GPD and an application rate Revised OWS Design Job No. 13288W, 5/10/02 Page 3 of 0.46 GAL/SF/DAY with an advanced treatment system and a drip -irrigation drain field. A 1000 -gallon septic tank is proposed adjacent to the granary and 3000 gallons of septic tank capacity adjacent to the Agricultural Barn. The advanced treatment installation includes two 1500 -gallon (total 3000 gallons), one - compartment concrete septic tanks, with an AdvanTex1m AX20 Treatment System, as presented on Figure 3. Discharge is via a 500 -gallon tank with a pump vault unit (PVLi) with dual pumps, as presented on Figures 4 and 5. Similar to a recirculating sand filter, the AdvanTexT"" system provides treatment of nutrients (total suspended solids and BODS) and nitrate reduction using effluent recirculation through a textile media -filled pods. The AdvanTexTm units treat the eluent before being discharged to the drain field by a dosing -pump. A service contract is recommended for operation and maintenance of the advanced treatment system. Our design includes the installation of 6000 square feet of drip -irrigation field. The drain field installation should include 6000 SF of drip -irrigation field in 8 sections as presented on Figures 2 and 6_ The drip irrigation field configuration can be modified to fit the topography with prior approval of our office. The trenches should be backfilled to re-establish the original slope. The installation is presented with a trencher. The surface of the drip irrigation or ETA field should be seeded after installation of the system. A native seed mix available at seed stores should be used. These mixes do not require irrigation and develop a growth 10 to 15 inches high. No automatic sprinkler system should be installed over the field. INSTALLATION OBSERVATIONS The installation of the OWS is to be observed by the design engineer. We will verify field depth, separation distances and subsurface conditions. The septic tank and AdvanTexT" units are to be installed with risers on the tank, and inlet and outlet connections properly bedded. Other components such as effluent filters or pumping systems, as applicable, will be observed at that time. OPERATION AND MAINTENANCE The AdvanTexTM treatment system is sold as a package that includes component installation and two years of operation and maintenance. An operation and maintenance contract should exist at all times with a certified Adva.nTexTM maintenance company. During the first month of operation, the system is to be observed to ensure proper control settings and system "start up". Subsequent to system "start up" a semi- annual observation is to be performed. During the semi-annual observations, septic tank sludge and scum accumulation is to be measured and septage pumping arranged as necessary. The treatment system compo- nents are to be cleaned in accordance with the manufacturer's recommendations. Effluent quality is to be observed to confirm a clear, odorless effluent is discharged to the drain field. The dosing system is to be observed to verify its operation. The surface area over the drain field is to be observed for indications of effluent surfacing. Liquid levels in the field are to be measured and recorded. The owner must realize an OWS is different from public sewer service. The owner must be aware of, and assume responsibility for, ongoing maintenance of the system. In the absence of a monitoring program, the septic tank should be pumped every two years. Effluent filter and screened vaults, as applicable, are to be cleaned during pumping. There are daily considerations such as not putting plastic or other nonbiodegradable materials into the septic system. Garbage disposal use should be minimized to reduce the frequency of pumping. Water use 11 Revised OWS Design Job No. 13288W, 5/10/02 Page 4 must be monitored so toilets are not allowed to run when seals malfunction. To illustrate the point, a flowing toilet can use in excess of 1000 GPD. An additional 1000 GPD loading may flood and irreparably harm the system- - We caution against the installation of a water softener. The hydraulic loading from the backwash of a water softener is detrimental to an OWS and a separate drywell should be constructed for the backwash waste, if a softener is installed. No landscaping or plastic can be used over the field, which will reduce performance of the field. Chemically treated water from a swimming pool or spas should not be introduced to the OWS. The design of the OWS is based on the treatment of domestic sewage only. No industrial or hazardous wastes should be introduced into the OWS. Floor drains should not discharge into the OWS. As a part of the experimental permit, there are conditions imposed by the PCEHD. The differences from other installations are the requirements for monitoring of the installation of the drip -irrigation system. These may be required because of a prior experience in Pitkin County with experimental systems. Drip -irrigation systems have been installed in Pitkin County and there have been no problems. We anticipate the annual reporting will be a requirement for five years and the cost is estimated to be $200.00 per year if the experimental status is required. LEWrATIONS Our investigation, layout, design, and recommendations are based on data submitted. If conditions dif- ferent from those described in this report are encountered, we should be called to observe the conditions. If proposed construction is changed, we should be notified to evaluate the effect of the changes on the wastewater system. All construction is to be in accordance with the ISDS regulations. Pipe type and size, burial requirements, septic tank construction, and other specifications, which are not depicted in our report, are to conform to the requirements of the ISDS regulations. The installer of the system is to be by an experience installed and is to have demonstrated knowledge of the ISDS regulations and requirements. Galena Street Aspen, CO 81611 Re: Two Mile Ranch Building Permit Dear Carla: I am enclosing a completed application for an Individual Sewage Disposal System with a check in the amount of $110.00. Pursuant to our conversation last Friday, we completed a series of percolation holes but encountered groundwater at 48". Consequently, it is our intent to proceed as agreed, with the installation of a -2;000 gallon tank (see drawing attached to submitted application) which will collect all wastewater from the historic log home. This tank will be located in a relatively flat area within the approved building envelope and will serve as a holding vessel until such time as we complete, submit and receive approvals for an engineered residential waste water treatment facility to be constructed on the Two Mile Ranch property. It is proposed that this facility will ultimately receive and treat all effluent from the restored log home. With regard to domestic water supply, we have drilled a well under state permit no. 225395 to a depth of 298 feet. This well is exempt from administration pursuant to C.R.S. 37-92-602(3)(b)(II)(A) and may be used as a primary water supply for up to three single family homes and up to one acre of lawns and gardens. For your convenience, I have included a copy of the well permit within the application. The well was drilled by Shelton Drilling Company through sandstone and shale formations and completed in Pennsylvania sandstone. Water was encountered at 270 feet and rose to 12 feet within 40 minutes. The well is cased with 7" steel casing and a pump has been set at 290 feet. The water quality was tested by Grand Junction Laboratories and with proper treatment to reduce sodium (Na), sulfates (SO4), dissolved solids and turbidity to within state guidelines. A pump was set by Samuelson Pump Company and the well was tested on April 3, 2000 for reliable yield by Beach Environmental, LC. The well produced in excess of 15 gallons per minute during testing where the static water level of the well at the commencement of the test was 4.41 feet and draw down was relatively slow. After 260 minutes of pumping the static water level decreased to 13.59 feet (9.08"dd). 715 W. Main At the cessation of the test, the well recovered to 5.1 feet (94%) within 60 minutes Suite 304 and to 4.6 feet within 24 hours. The well lies within the two acre building envelope, is beyond required setback limits for all water ways, ditches, lakes, ponds and other water systems and does not lie within the 100 year floodplain. It is also beyond required setbacks for existing septic systems on the ranch property and adjacent properties. Percolation test holes were hand dug near the profile pit on July 18, 2000 and soaked for percolation testing the next day. ("Applicant") intends to create 4 parcels of 35+ acres each, which does not legally constitute a subdivision within the purview of the County's subdivision review authority. The Applicant proposes to accommodate four new single family residences on the parcels. 2. The Applicant has applied to the Board of County Commissioners of Pitkin County. ' Resolution No. 99-i 7 Page 2 7. The BOCC finds that the application is generally consistent with the applicable provisions of the Pitkin County Land Use Code, based on the following conclusion: A. The proposed density is 42% of what is allowed under the current RS -20 zoning. B. The Applicant has limited the floor area on three of the parcels to a maximum of 7,500 square feet, which will help to minimize visual impacts. C. The Applicant has designated building envelopes of approximately 2 acres in size, all of which avoid wildlife habitat areas, geologic hazard areas (including slopes of greater than 15%), riparian areas, and the 100 year floodplain. In addition, the wildfire hazard within the envelopes is low and can be mitigated. D. The development is consistent with the intent of the RS20 zone district to permit low density, single family residential development, to preserve agricultural operations, to maintain the rural lifestyle and to locate development outside bf wildlife habitat. However, avoiding wildlife habitat has required the development to be located within irrigated lands. The development on Parcels 1 and 2 is clustered to a certain extent, and while the developmentlon Parcels 3 and 4 is more "scattered," the constraints on the site do not accommodate further clustering. E. While the building envelopes on Parcels 1, 3 and 4 are located within areas that may have previously been used for agricultural purposes, the Applicant has limited the size of the envelopes in order to be able to preserve minimum of 95% of the "acreage historically available for human food production, or hay, grain and other feed crops for livestock." F. The Applicant has committed to preserve the historic structures on the property. NOW, THEREFORE, BE IT RESOLVED by the BOCC that it does hereby designate Parcel 1 in its entirety and the log cabin on Parcel 2 to the Pitkin CountyHistoric Inventory. BE IT FURTHER RESOLVED by the BOCC that it does herei by approve the Natal Ranch GMQS Exemptions, Special Review, 1041 Hazard Review, Conceptual Submission and Caretaker Dwelling Units, subject to the following conditions which shall run with the land and be binding on all successors in interest: Prior to recordation of the 1041 Hazard Review Site Plan, the A�plicant shall submit the Protective Covenants for review and approval by the Community Development Department and the County Attorney. Submit executed Irrevocable Certificate of TDRs for the four TDRs necessary to achieve a growth management exemption pursuant to the Pitkin County Land Use Code for development of up to 7,500 square feet of residential floor area on each of Parcels 3 and 4. C. Record a covenant or deed restriction approved by the County Attorney's Office prohibiting further subdivision of the property. 4. Prior to submission of any permits for the development on Parcels 1 and 2, the Applicant shall submit an access permit for the common road improvements to the County Engineer for review and approval. If the driveway exceeds 30 inches above or below natural grade within the setbacks, the Applicant shall submit and the Board of Adjustment shall consider a variance application prior to submission of the Access Permit. A fugitive dust control plan shall be included with the permit for review and approval by the Environmental Health Department. Prior to submittal of an ISDS permit for each parcel, the owner shall provide documentation of adequate quality and quantity of water from a well to the Environmental Health Department. The well shall be located within the building or development envelopes, unless a location outside of the envelopes is approved by the Environmental Health and Community Development Departments. Prior to submittal of any building permit for the new residence on Parcel ?, the Applicant shall obtain a permit for the demolition of the Natal residence and shall abandon the existing septic system. 7. Prior to submission of any building permits for development on Parcels 1-4, the owner of each parcel shall: A. Obtain a fireplacehvoodstove permit from the Community Development Department. B. Obtain an access permit for each individual driveway (Parcels 3 and 4 only). Nvhidl shall be approved by the County Engineer. If the driveway exceeds 30 inches above or below natural grade within the setbacks, the Applicant shall submit and the Board of Adjustment shall consider a variance application prior to submission of the Access Permit. C. Submit a site specific drainage plan for review and approval by the County Engineer. Submit a landscaping plan for review and approval by the Community Development Department. G. Submit a weed management plan for review and approval by the Land Management Department. H. Submit a traffic mitigation plan to address the contribution to air quality degradation for review and approval by the Environmental Health Department. 18. Prior to issuance of any building permits for development on Parcels 1-4, the owner of each parcel shall obtain approval of an ISDS permit from the Environmental Health Department. Septic systems shall be located within the approved building envelopes, unless a location outside of the envelopes is approved by the Environmental Health and Community " Development Departments, and must comply with the setback requirements from surface and groundwater sources. A qualified professional engineer must design the system. 9. Prior to submission of earthmoving permits for ponds on any of the parcels, the owners shall demonstrate that there are adequate water rights for the ponds. The earthmoving permits shall include a plan to ensure that herbicides or pesticides from the property do not enter Woody Creek via the ponds and that water from the ponds does not adversely influence the temperature of the creek. 10. Prior to submission of a building permit for a detached or attached caretaker dwelling unit on each of Parcels 3 and 4, the owner shall obtain and the Housing Office shall record a caretaker dwelling unit deed restriction. Floor plans of the unit shall be provided to the Housing Office when the deed restriction is submitted. The caretaker dwelling unit shall be limited to 700 net livable square feet, and the kitchen shall contain a minimum of a n%o- burner stove with oven, standard sink, and a 6 cubic foot refrigerator plus freezer. 11. Prior to issuance of a Certificate of Occupancy for the caretaker dwelling units, Housing and Community Development staff small inspect the unit. 12. All structures shall comply with the standards and requirements of the Aspen Fire Protection District. 13. The Applicant shall comply with the following provisions regarding irrigation ditches: A. Grant access to irrigation ditches to ditch owners. B. Construct buildings immediately uphill of active irrigation ditches unless a ditch is culverted. C. Design land uses to avoid flooding problems from flood irrigation. D. Place basements and soil absorption sewage disposal systems in locations where they will not be impacted by flood irrigation or seepage from irrigation ditches. 14. For a minimum of 30 feet around all structures, future landscaping (trees) should be spaced so that the outer edges of tree crowns will not be closer than 10 feet. C. Roofs shall have a Class A, non-combustible roof system. Wood shakeshingle roof coverings and flat roofs (up to a 4:12 pitch) are prohibited in all wildfire hazard areas. D. Vents shall be screened with corrosive resistant wire mesh with mesh 1/4 inch maximum. E. Roofs and gutters shall be kept clear of debris. F. Yards shall be kept clear of all litter, slash, and flammable debris. G. All flammable materials shall be stored on a parallel contour a minimum of 15 feet away from any structure. H. Weeds and grasses within a 10 foot perimeter of all structures shall be maintained to a height of not more than 6 inches. I. Firewood/wood piles shall be stacked on a parallel contour a minimum of 15 feet away from the structure. J. Swimming pools or ponds shall be accessible to Fire Department vehicles. K. Fences shall be kept clear of brush and debris. L. Wood fences shall not connect to the structure. M. Fuel tanks shall be installed underground with an approved container. N. Propane tanks shall be installed according to NFPA 48 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any above -ground tank. Any wood enclosure around the tank shall be constructed with materials approved for 2 hour fire -resistive construction on tite exterior side of the walls. O. Each structure shall have a minimum of one 10 pound approved ABC fire extinguisher placed in a visible and accessible location. P. Addresses shall be clearly marked with 2 inch non-combustible letters and shall be visible and installed on a non-combustible post. Q. New utility lines shall be buried within or along roadways. 15. No development, including grading, excavation, fill placement, landscaping. vegetation removal or disturbance, cisterns, entry gates, septic system and well, shall occur outside of the approved building envelopes, except agricultural uses, ranching, equestrian and hiking trails, recreational activities, utility and driveway extension and maintenance. Landscaping. including installation of ponds, may occur outside of the building envelopes, subject to review and approval of a specific landscape plan by the Community Development Department. Wells and septic systems may be located outside of the building envelopes, if approved by the Environmental Health and Community Development Departments. 16. The property shall be subject to the following limitations on floor area to be measured based on the County's regulations in effect at the time of building permit submittal: A. Parcel 1 shall be limited to a maximum of 7,500 square feet of resi&ntial floor area, exclusive of the historic Natal residence. B. Parcel 2 shall be limited to a maximum of 15,000 square feet of residential floor area. The Applicant is not required to submit annual reports attesting to conformance with the conditions of this approval, nor is the proposed use required to commence within 12 months of the date of this approval, as would otherwise be required under the Special Review provisions in the Land Use Code. 19. The Applicant shall adhere to all material representations made in the application or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 20. The vested rights for the approval contained herein shall expire five years from the date of this approval on the _gt— day of S e_p r, , 2004. 21. The Applicant has recombined Parcels 1 and 2 for purposes of consideration of this application.
