Thanks for your time the other day on the phone, your advice has really
simplified things in regards to the septic system. Enclosed is a platte map of White
Horse Springs with my parcel marked in red. I am also having an improvement survey

sent to you by someone #n Aspen. The survey shows the building envelope and there
should be an overlay of the footprint of the house too. I am in the process of
finding someone to do the Perk test. As soon as I do I'll have them contact you to
work out the details. Also enclosed is a list of the fixtures in the house. Its a
5 bedroom house so there will be plenty of fixtures. Thanks again for your assist@nce.

Re: Dictenberg 1041 Hazard Review, Parcel ID# 2465-274-00-001
The Aspen/Pitkin Environmental Health Department has reviewed the
above-mentioned land use submittal under authority of the Pitkin
County Code, Title II, and has the following comments.
SEWAGE TREATMENT AND COLLECTION: Sections 2-7 and 5-200:
Nicholas Lampiris, Geologist, states in the application that a
standard septic system may be possible. However, since much of
the lot has >30% slope and set backs are required from the water
line and irrigation ditch, the sewage disposal system may have to
be designed by a registered professional engineer to meet the
Pitkin County Regulations on Individual Sewage Disposal Systems.
ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-6 and 5-205:
The applicant should be required to connect to the subdivision
water supply.
AIR QUALITY: Sections 2-17 and 5-106:
The applicant does not mention wood -burning devices. Any
installed must comply with applicable regulations. No significant
air quality impact is expected from the proposal.
NOISE: Section 2-23
No adverse noise impacts are anticipated from this proposal.
CONFORMANCE WITH OTHER LAWS: Section 2-2
This proposal is not anticipated to be in violation of any other
laws which fall under this department's authority.

Dear Glenn:
Enclosed with this letter please find a Section Analysis
prepared by Scarrow and Walker Surveyors defining the area of the
proposed building envelope which contains slopes in excess of
30%. Generally, the northeasterly half of the building envelope
contains slopes in excess of 30%.
Because of the narrow and impractically shaped portion of
the building envelope remaining with slopes less than 30%, Mr.
Dictenberg wishes to pursue a 1041 Review with the Planning and
Zoning Commission in order to permit portions of his house to be
constructed on areas containing slopes in excess of 30%. We
believe there are no reasonable alternatives to encroaching on
such areas for the following reasons:
1. The building area needs to be set back from an existing
access easement and roadway which lies along the southwesterly
boundary of the building envelope. Therefore, we cannot move the
envelope any further in that direction. This causes the building
envelope to run up hill from the roadway which, after as little
as 20 feet, starts encroaching on areas containing 30% slopes.
2. The portion of the building envelope containing less
than 30% slopes is a long (approximately 160 feet) and narrow
(between 20 feet and 40 feet) strip of land. It is impractical,
if not impossible, to place a residence of a reasonable size
(approximately 4500 square feet) within this area. The largest
available area within the building envelope having a regular
shape is approximately 40 feet by 40 feet. Considering height
limitations, access, garage and the excavation necessary to
utilize the area having less than 30% slopes, it is apparent that
a 4500 square foot house would not fit within a 40 foot by 40
foot building envelope in this location.
3. Requiring the house to be placed in the lower portion
of the building envelope will also destroy a mature grove of

scrub oak trees which Mr. Dictenberg intends to preserve both for
aesthetics and privacy as viewed from the building site as well
as to provide visual screening of his house as viewed from the
Mclain Flats Road. In addition, because of the proximity of the
house to the existing access roadway, these trees will provide a
visual and noise buffer.
4. Mr. Dictenberg intends to incorporate passive solar
design into his residence. In order to accomplish the design the
house requires a southern orientation. Therefore, the house
cannot be placed within the building envelope in a manner which
runs parallel to the access easement (the long side of the
building envelope) but must be oriented somewhat diagonally
across the narrow portion of the envelope.
5. The selected building envelope does not have any
geologic problems nor unstable soils and, except for the presence
of 30% or greater slopes, is an ideal location for the proposed
residence. Except for the grove of scrub oak at the lower
portion of the building envelope, the building envelope is clear
of other vegetation.
6. The slope analysis further indicates that although
there are slopes greater than 30% in the upper portion of the
building envelope, these slopes do not exceed 38.4% at their
steepest location. We believe that this excess slope percentage
is minimal and does not create any unmitigatable conditions.
Title information has been provided previously with respect
to this application. Please consider this letter a formal
request to process the application as a 1041 Hazard Review. Also
enclosed is my check for $340.00 which you indicated to me was
4, the remaining portion of filing fees due. As Mr. Dictenberg
mentioned, we would greatly appreciate your placing this on a
Planning Commission agenda as soon as possible.

RE: Lot 15, White Horse Springs Subdivision
Dear Mr' Dictenberq:
I have completed my geologic investigation, for purposes of
HB 1041` of your building site located about three miles
northwest of the Town of Aspen in the White Horse Springs
Subdivision within the Aspen 7 1/2 minute quadrangle, Pitkin
County, Colorado. The 6 and 1/2 acre lot lies near the east
boundary of Section 27, T 9 S, R 85 W of the 6th PM.
The topography of the property consists of a moderate to
steep south -facing hillside covered with scrub oak, sage
brush and other shrubs, and native grasses. The Salvation
Ditch and an access road cross the lower portion of the lot
as shown on the accompanving map. It is my understanding
that the proposed building envelope is in the area shown as
"approx. location of clearing" on the map, between the road
and the ditch. The slopes there are moderate in the 20 to
25% range. These moderate slopes extend all the way to the
property boundary below the building envelope and could be
incorporated within it, especially if the road can be
redesigned. According to the map contours the break in slope
to higher percentages is above the 7910 contour line. This
is roughly where it was noted to be in the field.
The geology of the site consists of silts, sands, cobbles and
boulders of Quaternary age outwash deposits of glacier "d"
merging with the alluvial fan deposits below the site which
came out of Trentaz Gulch. The underlying bedrock of the
area cannot be seen in outcrop anywhere near the property but
is certainly the Mancos Shale of Cretaceous age fairly deep
below the surface. It dips generally to the northeast at
about 25 degrees in outcrops along the railroad tracks
southwest of the property. There are no faults mapped
through the property but the Castle Creek fault zone lies
about 1/2 mile to the east. There is no evidence of recent
movement along this fault in this area.

There were no noticeable granitic boulders on the hillside
above thesite which could potentially be a hazard, but when
thehomesite is finalized I suggest that the hillside be
searched directly above the proposed home in a fan -shaped
area all the way to the top. If any unstable boulders are
found they should be rolled down the hill or stabilized prior
t/; iniiation of construction. I can be consulted if there
ifi situations. are questions on spec c s u . There is only a small
chance of boulders being a problem on this site.
The hillside above the envelope shows no signs of instability
but there is a rather large irrigation ditch just tens of
feet above the site which could pose a problem if it were to
breach or leak significantly. There are several ways to
mitigate potential problems from the ditch but the most
effective a.d economical way is to provide positive
landscaping around the uphill side of the home so that if
breaching occurs all the water is directed effectively well
around the home—site. Perimeter drains around the foundation
are also very important and should be addressed during the
site specific soils engineering study necessary for proper
foundation design. Another mitigation which can be used in
conjunction with the landscaping is to line or culvert the
ditch the home for a length greater than the width of
thehome, but depending upon the final topography. Lining
.vpnly protect leakage, while culverting will prevent
breaching in that area as well.

should produce adequate water within 150 to200 feet depth.
