The fee for a ISDS application is $330 for a permit that takes 6 hours or less for the department to approve. If approval takes
longer than 6 hours, a rate of $55 per hour will be charged. The maximum fee is $1000. The basic fee of $330 is due at the time
of application. The remainder, if any, will be due in two stages: first, at the time of issuance of the ISDS permit; second, before
final approval of the ISDS permit.
Application for an individual sewage disposal system is hereby submitted. I hereby certify that the above information is true and
accurate and that I have provided true and accurate information on locations of all existing and proposed wells, contour
intervals, buildings, property lines, ditches, slopes, waterlines, springs, suction or irrigation lines, drinking water cisterns, drain
tiles, irrigation ditches, lakes, water courses, streams, floodplains, dry gulches, and existing septic systems. I hereby certify
that any such features not shown on attached site map are not present. Issuance of the permit does not imply the approval of
any other permit required for construction pursuant to Pitkin County codes. No construction may be undertaken until all
approvals and permits have been obtained.
The Aspen/Pitkin Environmental Health Department, Pitkin County and employees of these agencies will be held harmless
should the individual sewage disposal system fail or malfunction. The permit to construct is issued on information submitted by
the applicant or his/her representatives. The owner assumes full responsibility in case of failure of the system.

The Aspen/Pitkin Environmental Health Department has reviewed the details of the Gersh
application under the authority of the Pitkin Countv Land Use Code and has the following
comments.
ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-17 and 3-1104:
"It is the policy of the County to insure the availability of a water supply of adequate quality, quantity, pressure and dependability for fire
protection and support of a proposed land use prior to approval of the use. The County shall require land uses to hook up to existing public
systems if service is available."
This Department needs adequate information on the quantity and the quality of water available.
The White Horse Springs Water District provides water for this lot and meets the requirements of
this department. The ability of the White Horse Springs Water District to handle the increased flow
for the project will be determined by the District. The applicant must provide documentation that the
applicant and the service agency are mutually bound to the proposal and that the service agency is
capable of serving the development.
We recommend low water landscaping (xeriscaping), with the timing of any sprinkler systems
decreased for low water plants. Contact the Colorado State University Cooperative Extension
office or Denver Water Board for more information on xeriscaping.
A condition of approval for this application is the receipt by the Environmental Health
Department of a "...letter of intent to service the proposal..." from the water district as
defined in the Pitkin County Code. Septic and building permits can not be issued until
the applicant meets this requirement.

SEWAGE TREATMENT AND CULLECTION: Sections 2-18 and 3-1105: "It is the policy of the County to
ensure that adequate sewage treatment facilities are available to serve existing and new developments. Public and private sewage disposal systems
and connections to such systems shall comply with the sewage disposal guidelines of Pitkin County's Individual Sewage Disposal System
Regulation."
Sewage disposal for lots in the McLain Flats area is provided by individual septic systems. The
main residence has a fourteen year old septic system permitted in 1984 to serve a 2 bedroom
house. The applicant will need to either replace the existing system to accommodate the house
and proposed detached 2 bedroom caretaker unit or add a separate ISDS system for the caretaker
unit.
All such systems installed within Pitkin County require septic permits issued by the
Environmental Health Department, and must comply with the County's septic regulations.
Owners should realize that soils tests can be done only between April 15 and Nov. 15 of each year.
Building and septic permits cannot be issued without these soils tests. To receive a septic permit,
the applicant will need to submit a septic permit application through a Registered Professional
Engineer who will design the system. Included in the packet must be percolation test results and
profile hole information, site plan with pertinent physical features, floor plan for the dwelling and
caretaker unit and a copy of the County's land use approval. Once we receive the completed
application, this Department will review the proposed septic design.
It may take some time to have soils tests performed and additional time to have the system
designed. Since soils tests cannot be done all year, this schedule should be carefully evaluated
by the owner to ensure all steps have been taken to make the permitting process as fast as
possible.
The type of soil will determine how large the septic system must be. Soil data on file for this lot
indicate that the percolation rates vary from 40 mpi to 336 mpi which indicate very slowly
percolating soil. The engineer will need new site specific soil data. The engineer will need to
carefully evaluate the new soil information to determine if an enlarged or additional system
can be designed to fit on this lot to accommodate a caretaker unit.
The leach field should be in an area of no traffic, planted with dry land grass, and should not be
watered. It is desirable to locate the system below the house so that the system can operate by
gravity. The applicant should refer to the Pitkin County Sewage Regulations for detailed
information, or call our office to discuss this site.
The Pitkin County Land Use Code prohibits soil absorption systems in areas where the ground
slope is in excess of thirty percent (30%).
A condition of approval for this application is the receipt and approval of the septic
permit before issuance of a building permit.

WATER QUALITY IMPACTS. erections 2-14 and 3-705 and 3-710:
"It is the policy of the County to preserve and protect its present water resources. To this end it is the policy of the County that no land use be
initiated which would adversely affect the quantity, quality, or accessibility of the County's water resources; or which would occur at the expense
of established water -dependent agricultural activities; or which would result in increased salinization of water resources, loss of minimum stream
flows, further destruction of wildlife habitat, or major expenditures to reacquire or redistribute major water resources. It is also the policy of the
County to maintain a natural vegetative buffer along its surface waters such that the surface and groundwaters of the area are not encroached upon
by land uses or other human activities which could cause deterioration of water quality or impair the natural treatment processes provided by
meadows and wetlands."
The Environmental Health Department will be addressing water quality impacts on down stream
water quality. This application should not impact down stream water quality if the setbacks
between the septic system and physical features comply with the Pitkin County Sewage
Regulations.
The Environmental Health Department's mission is to preserve and protect the quality of Pitkin
County's water resources. Since a large percentage of the population is dependent upon water
from wells, elimination of groundwater pollution, and protection of aquifers and their drainage
areas are of utmost importance. Roofs and asphalt areas can be nonpoint sources of water
discharge that can contaminate water supplies. This Department recommends that nonpoint
sources of discharge be retained on the property of origin. This can be accomplished through
landscaping, drainage patterns, detention ponds, and dry wells for water runoff from buildings.
AIR QUALITY: Sections 2-13 and 3-602:
"Only that development is permitted which will not contribute significantly to degradation of air quality in Pitkin County. Developments may not
constitute an indirect or direct air pollution source under Federal, State or County regulations."
This project should not contribute significantly to degradation of air quality in Pitkin County.
FIREPLACE
Metropolitan areas of Pitkin County that include this site may have two devices: either two gas log
fireplaces, two certified clean -burning woodstoves, or one of each. Each building may also have
unlimited numbers of decorative gas appliances. New homes may NOT have wood burning
fireplaces, nor may any heating device use coal as fuel. Fireplaces or woodstoves are not allowed
in barns or agricultural buildings.
A condition of approval for this application is the receipt and approval of the
fireplace/woodstove permit by the Environmental Health Department before the
building permit can be issued.
ASBESTOS
Private Residential - Before demolition, we encourage the applicant to have the building tested for
asbestos, and if any is present, the applicant should contact this Department regarding proper
removal.

Re: Gersh Residence — Care -takers unit ISDS investigation

This letter is in response to your request to perform percolation testing and Design calculations for
the Gersh Residence existing detached care -takers unit at 2012 McLain Flats Road in Pitkin County.
It is our understanding that the existing care -takers unit is served by an existing gravelless
chambered septic system. According to the materials invoice attached, twenty Infiltrator units for
the leach field, a 1000 gallon septic tank and a distribution box were installed for the septic system.
During our site investigation we measured the depth to the bottom of the septic tank lid. This
measurement is approximately 43 inches below the ground. The leach bed location as shown by
you, is to the East of the septic tank, parallel to the ground contours and the long dimension of the
care -takers unit. The bed is approximately 34 feet from the septic tank. If the plumbing from the
septic tank and distribution box was installed at the required 2% grade the bed would be
approximately 51 inches below the existing ground surface, not taking into account the depth from
the bottom of the septic tank lid to the invert -out of the tank. It is our opinion that the leach bed is
within an acceptable soil strata to accept the amount of effluent discharged from the existing care-
takers unit. This opinion is justified by the percolation testing and soil classifications as described
below.
On September 18 and September 25, 1998 Jerome Gamba & Associates, Inc. (JGA) performed
percolation testing at the above described residence. The percolation test holes were pre-soaked the
night before the testing. Percolation test results are attached below as Attachment 1. The percolation
test holes are located down gradient of the existing septic field. A soil profile, adjacent to the
proposed absorption area was excavated to a total depth of eight feet ±.

The excavation revealed no ground water present at the time of observation. Soil Classification is as
follows:

Sandy -silt. Some large cobbles present up to 18" in size. Cobbles are a
weathered granite, easily broken apart by hand.
The percolation tests performed in the sandy layers of soil indicate an average percolation rate of
11 min/in.. This percolation rate is confirmed by the soils observed within the Profile hole. It is our
opinion according to the Pitkin County I.S.D.S. Regulations, that the septic system as reported to
have been constructed, is capable to serve the existing two bedroom care -takers unit.
Also attached as Attachment 2 is the Aspen/Pitkin County Environmental Health Department, ISDS
Design calculation sheet as provided by you.
This report has been prepared according to generally accepted engineering practices for the design
of Individual Septic Disposal Systems within Pitkin County. The conclusions and recommendations
submitted in this report are based upon data obtained from our field investigations of the existing
site. There is some possibility that the nature and extent of the subsurface soil across the site may
not have been discovered during our investigations. If further excavation in the area of the existing
system reveals conditions different form those described, our office should be notified of these
findings as soon as possible.

REQUEST: This is a request for approval of a detached Caretaker
Dwelling Unit (CDU) pursuant to Section 3-150.130 (C) of
the Land Use Code.
LOCATION: 2012 McClain Flats Road, Aspen, Colorado.
LEGAL DESCRIPTION: Lot 18, Block 1, White Horse Springs. See
Exhibit "A".
APPLICANT: Edward & Hollise Gersh, 7289 Gateside Drive, Boca
Raton, FL 33496.
APPLICANT'S REPRESENTATIVE: David Muckenhirn, Ventures West
Enterprises, Inc., P.O. Box 8352, Aspen, CO 81612, 970-
925-8889. See Exhibit "B", Letter of Authorization.
ZONING: RS -20.
BACKGROUND: The 9.5 acre property on which the CDU is located
presently contains a single family residence and a
barn/shed with the proposed CDU located in the west end
of the barn/shed.
ACCESS: The CDU/Barn (as well as the residence) is accessed off
a private shared drive off of McClain Flats Road.
SIZE: The floor area of the proposed CDU is 737 net liveable
square feet. If required, the owner agrees to reduce its
size to 699 net liveable square feet. The midpoint of
the roof is 12' 9" from the lowest grade and the building
height measured to the peak is 16' 6". The combined
areas of the residence (5,230), the barn/CDU (1,440)
would be 6,670 square feet, well under the 15,000 square
feet allowed in the RS -20 zone district. See Exhibit
„C .
PARKING: All county parking requirements for the CDU shall be
provided on the property.
DEED RESTRICTION: The CDU will be deed restricted as described in
Section 3-150.130 (C) 3 of the County Land Use Code and
as required by the Housing Authority Guidelines.
1041\RIDGELINE REVIEWS: The proposed CDU/Barn structure complies
with the county 1041 hazard and ridgeline restrictions.
