Re: Koutsoubos Lot Split Conceptual Submission

The Aspen/Pitkin Environmental Health Department has reviewed the
details of the Koutsoubos Lot Split Conceptual Submission
application under the authority of the Pitkin County Code Land
Use Code and has the following comments.
ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-17 and 3-1104:
"It is the policy of the County to insure the availability of a water supply of adequate quality, quantity,
pressure and dependability for fire protection and support of a proposed land use prior to approval of the
use. The County shall require land uses to hook up to existing public systems if service is available."
Since the source of potable water for the proposed residences and
attached caretaker units will be domestic wells, this Department
will need adequate information on the quantity and quality of
water available. This can be done from tests of wells present
on-site by a water engineer's or well driller's report. The
applicant must ensure that the water quality is acceptable by
having it tested by a lab such as Snowmass Water and Sanitation.
Before a septic permit can be issued the location of the well
should be confirmed to assure that setback requirements from the
well to the septic system can be complied with. It is our
recommendation that the well(s) are drilled first before
installation of the sewage disposal system or construction of the
dwelling.
It is recommended that low water landscaping (xeriscaping) be
used and that the timing of any sprinkler systems be decreased
for low water plants. The Colorado State University Cooperative
Extension office can be contacted for more information on
xeriscaping.
A condition of approval for this application is the receipt
of information documenting the location of the wells and
quantity/quality of the well water.
SEWAGE TREATMENT AND COLLECTION: Sections 2-18 and 3-1105:
°It is the policy of the County to insure that adequate sewage treatment facilities are available to serve
existing and new developments. Public and private sewage disposal systems and connections to such systems
shall comply with the sewage disposal guidelines of Pitkin County Code Title X."
Lots in the Brush Creek area are served by individual sewage
disposal systems. All such systems installed within Pitkin
County require septic permits issued by the Environmental Health
Department, and must comply with the County septic regulations
before a building permit can be issued. To receive a septic
permit, the applicant will need to submit a septic permit
application and appropriate fee with a completed soil data form
including perc test results and profile hole information. We do
not recommend the final design be submitted to the Environmental
Health Department for approval before a health officer has had a
chance to review the data and make his/her own design
recommendations.
The Aspen/Pitkin Environmental Health Department will design the
system for the applicant as part of the permit fee, unless an
engineered system is needed, which we determine based on soil
test results. An engineered system is required if any one of the
following conditions occurs: a percolation rate faster than 5 mpi
or slower than 60 mpi; maximum seasonal level of the groundwater
table or bedrock less than four feet below the bottom of the
proposed absorption system; or a slope in excess of 30%. The
presence of Mancos shale may require that an engineer design the
system if bedrock or groundwater are encountered.
The applicant should be aware that Pitkin County's sewage
disposal regulations are in the process of being revised and will
probably become effective sometime this spring. A septic system
for a home in excess of 6,000 square feet may be sized using the
figure of 130 gallons per person per day. As a result, the septic
system's size requirements will increase.
The applicant will need to adhere to minimum horizontal setback
requirements for placement of septic system components away from
pertinent physical features. The setbacks from the existing
septic system and well at the red farm house must be maintained.
The following setbacks are significant at this site:
*100 feet between wells and absorption fields
25 feet between an absorption field & a lined irrigation
ditch
* 50 feet between an absorption field & unlined ditch
* 50 feet between an absorption field & Brush Creek
* 8 feet of additional distance will be added for each 100
gallons per day of average daily waste flow over 1,000

gallons per day.
The Wiese irrigation ditch should be lined to eliminate the
possibility of soil saturation in the absorption field area which
would compromise the septic system's effectiveness.
The applicant should refer to the Pitkin County Sewage
Regulations and contact this Department for detailed information
and a site specific evaluation.

WATER QUALITY IMPACTS: Sections 2-14 and 3-705 and 3-710:
"It is the policy of the County to preserve and protect its present water resources. To this end it is the
policy of the County that no land use be initiated which would adversely affect the quantity, quality, or
accessibility of the County's water resources; or which would occur at the expense of established water -
dependent agricultural activities; or which would result in increased salinization of water resources, loss
of minimum stream flows, further destruction of wildlife habitat, or major expenditures to reacquire or
redistribute major water resources. It is also the policy of the County to maintain a natural vegetative
buffer along its Surface waters such that the surface and groundwaters of the area are not encroached upon
by land uses or other human activities which could cause deterioration of water quality or impair the
natural treatment processes provided by meadows and wetlands."
The Environmental Health Department will be addressing water
quality impacts on down stream water quality and specifically
Brush Creek which runs through the property.
There are no conditions of approval at this time, however,
the Department reserves the right to require groundwater and
creek monitoring at the homeowner's expense.
AIR QUALITY: Sections 2-13 and 3-602:
"Only that development is permitted which will not contribute significantly to degradation of air quality in
Pitkin County. Developments may not constitute an indirect or direct air pollution source under Federal,
State or County regulations."
This project is an indirect source of air pollution and is
expected to contribute to degradation of air quality in Pitkin
County by adding traffic in the non -attainment area. However, the
project can be approved as long as the applicant mitigates the
increases in traffic and PM10. The Environmental Health
Department can assist the applicant in devising a sufficient
mitigation program. Due to the relatively small size of this
project, it will be easy to mitigate the impacts by measures such
as paving or construction of a bike path section.
Activities such as road building and landscaping may require a
Fugitive Dust Plan. This plan would need to include, but is not
limited to, fencing, watering of haul roads and disturbed areas,

daily cleaning of adjacent paved roads to remove mud that has
been carried out, speed limits, or other measures necessary to
prevent windblown dust from crossing the property line or causing
a nuisance.
A condition of approval will be that prior to detailed
submission, the applicant must submit an air quality
mitigation plan which the Environmental Health Department
will determine whether or not the plan mitigates the
projects air quality impacts.
The less densely populated parts of the county like Brush Creek
Village may have one wood burning fireplace and one department
certified device or two department certified devices per building
(not per residence). In addition, unlimited numbers of decorative
gas appliances are allowed. Coal may not be burned in any
device. No wood burning device may be installed in barns or
agricultural buildings.
A condition of approval for this application will be the
receipt and approval of the fireplace/woodstove permit by
the Environmental Health Department before the building
permit can be issued.
CONFORMANCE WITH OTHER ENVIRONMENTAL HEALTH LAWS: Section 2-7:
"It is the policy of the County to ensure that no use or development of Land is permitted which is in
violation of the Daws of the County, the State of Colorado, or the United States of America."
This Department is not aware of any issues of concern regarding
other environmental health laws.

For your file I am enclosing a copy of the bacteriological water
test on the water well now located on Ted Koutsoubos's Brush Creek
property. The test results found there to be no coliform present
in the sample. By copy of this letter I am also sending this
information to the Environmental Health Department. If we need
further analysis of the existing well, please advise.
