Wayne, you and I may have talked about some of these, but I wanted to be sure we are on the same page before I continue. ■ The house has 4 bedrooms in 5750 sq ft. The design is for a 6 bedroom house with greater than 6000 sq ft. This increases the size of the system and setbacks significantly. The tank requirements go from 1750 gallons to 3412 gallons. The size of the field is increased by 71 1 Quick4 chambers. The system is almost double the necessary capacity. I feel our sizing criteria is already conservative - so unless there is an anticipated addition to the house - this appears to be considerably over designed. This sizing also effects the setbacks which could come into play with my next question. ■ Is the Weiss ditch running? Is it lined? It does not appear to meet the 188' setback from the field. (Using the actual sizing, the required setback to a watercourse would be 82 feet.) ■ Where is the well located? ,Z ' k. i e ,vc ` ■ The percolation tests are not located on the engineer design. If thisisredrawn for another reason, I would ask that the peres be located on the design. J7'j e ■ Wayne, I don't know where the $3750 figure came from. For the last several years we have been keeping a file on how PM 10 mitigation costs were determined. This reso predates those records as well as my time here at Pitkin County. I will ask around. The work was done in accordance with our agreement for professional services to you, dated September 26, 2006. A profile pit and four percolation test holes were excavated on October 9, 2006 at the locations designated by the client and shown on Figure 1. The subsoils exposed in the Profile Pit below about 6 inches of topsoil consisted of sandy silt and clay to 3'/2 feet overlying clayey sandy gravel to the bottom pit depth of 8 feet. No free water was observed in the pit and the soils were slightly moist to moist. Percolation test holes were hand dug in the bottom of shallow backhoe pits and soaked with water on October 9, 2006. Percolation testing was conducted on October 10, 2006, by a representative of Hepworth - Pawlak Geotechnical, Inc. The percolation test results ranged from 7 to 40 minutes per inch and are summarized on Table 1. 1800mv aveAV lte was, 22 minutes per in+cU. Based on the subsurface conditions encountered and the percolation test results, the tested area should be suitable for a conventional infiltration septic disposal system. Pitkin County requests that a civil engineer design the septic disposal system. If you have any questions or need further assistance, please call our office. The Planning and Zoning Commission adopted Master Plans for the Brush .Creek and Owl Creek areas of Pitkin County on September 23, 2003. 2. 'These Master Plans recommend that, with some exceptions, the private lands in these areas be rezoned to a large lot/conservation-preservadon/low density zone district. 3. The Pitkin County Planning and Zoning Commission considered the proposed LIR code amendment and rezoning of properties to LIR at regularly scheduled meetings on October 7 2003, on November 1 l; 2003, and January 6, 2004, and recommended approval unanimously both times. 4. The BOCC considered the proposed code amendment and rezoning at a public meeting on first reading on November IS, 2003, and voted to approve the proposed code amendment and rezoning on second reading at a public hearing on January 28, 2004. 5. The BOCC finds that the proposed code amendment and rezoning are consistent with the applicable Master Plans. NOW, TBTREFORE, BE IT ORDAINED by the BOCC that it hereby amends Title 11 of the Pitkin County Code, the Land Use Code, as follows in Attachment A to create the Low impact Residential Zone District and that the properties shown on the map attached in Exhibit' 1 are hereby rezoned to -the Low Impact Zone District. The Board further finds this ordinance is effective immediately upon adoption pursuant to C.R.S. § 30-15-405 as it is necessary for the immediate preservation of the public health and safety of the citizens of Pitkin County. The circumstances of the necessity for immediate enactment are as follows: Pitkin County has produced a Master f lan for the areas affected. by this zone district, which was adopted by the Planning & Zoning Commission on September 23, 2003. The Master Plan is a product of a study that began on April, 2003, and was pursued continuously until the adoption of the Master Plan. The Master Plan provides recommendations for zoning changes to protect the public health, safety and welfare. The zone district in this ordinance reflects the recommendations of the Master Plan and is consistent with those recommendations. Development applications, which are received prior to the effective date of this zoning regulation, must be reviewed in conformance with the existing zoning regulations. The existing zoning regulations are not in conformance with the Master Plan recommendations- Applying the existing regulations to development applications, could lead to development approvals which ane inconsistent with the Master Plan recommendations and are contrary to the best interests of the citizens of Pitkin County. Therefore, it is necessary for the zoning changes in this ordinance to be immediately effective.
