Changes must be approved by this Department and the engineer prior to construction. This permit is for a 5 bedroom, 5,750 sf house. Groundwater was not encountered in the test pit and the design perc rate was calculated to be 29 MPI. The system will consist of a 2,000 gal, 2 compartment precast tank with screened dosing siphon. The field will consist of 4 rows of 22 graveless "Quick -4" chambers for a total of 869 sf of infiltration area. Serial distribution will be used. 6 feet of undisturbed soil shall be maintained between each trench. This Permit must be kept on-site (luring installation. The engineer must do a final inspection of the installation and submit an "as -built" letter to this Department within 30 days of the final inspection, unless a longer period of time has been agreed upon, in writing. This Department must also be called for the final inspection with a minimum of 48 hours notice. Minimum horizontal distances between components of the system and physical features shall conform to the requirements of the Pitkin County OWTS Regulation. This Permit is conditioned upon the property owner(s) providing for regular inspection, cleaning, and maintenance of the system by qualified personnel, in accordance with the manufacturer's recommendations and the requirements of the Pitkin County OWTS Regulation. Aspen Earthmoving installed the OWTS. The installation included a 2000 -gallon, two-compartment septic tank with a dosing siphon and four gravelless chamber trenches, each trench with 22 `Quick -4' chambers for a total of 88 chambers, equaling 869 SF of infiltrative area. There were greater than 6 -feet of undisturbed soil between the trenches. The trenches are connected serially. The 2000 -gallon tank has a mid -seam and was filled with water during installation. On August 8, 2011, the tank was filled with water to test for water -tightness. Aspen Earthmoving personnel observed some leakage in the surrounding soils. The seam was tarred and Aspen Earthmoving confirmed the liquid remained at a stable level above the seam. During the site visit on May 29, 2013, the liquid level in the tank was not full. This could be due to non-use of the system. It is recommended that once the system is in use, the tank be checked to assure proper liquid levels are maintained. Additionally, we recommend annual inspections of the system to assure proper functioning of the system. The OWTS was generally installed according to specifications. This observation is not a guarantee of workmanship and/or parts and materials. ALL SERVICE septic, LLC should be notified if changes are made to the OWTS in the future. Any additional OWTS construction must be according to the county regulations. LIMITS: Observations are limited to components that are visible at the time of the inspection. The installer must have documented and demonstrated knowledge of the requirements and regulations of the county in which they are working. The property is located at the top of Watson Divide, in an area where OWTS and wells are necessary. The revision is based upon a change in the building layout. SITE CONDITIONS The lot is currently vacant. A single-family residence exists to the north and is currently using a well and an OWTS. A 5 -bedroom single family residence having approximately 5700 SF is proposed as indicated on Figure 1. The proposed drain field area slopes 15% to the east, and vegetation consists of a moderate cover of native grasses and sagebrush. Water is provided by a well located 110+ feet to the north of the proposed residence. SUBSURFACE The subsurface was investigated by CHURCH by digging one profile pit and three percolation holes. The profile hole has a piezometer installed and is marked with pink flagging. The percolation holes have been backfilled. The materials indicated by CHURCH consisted of a 1 -foot of root zone, underlain by sandy clay, underlain by silty sandy clay to the maximum depth explored of 8 feet. Groundwater or bedrock was not encountered. Groundwater was checked on August 26th 2009 and no water was present. Reported percolation rates ranged from 20 to 40 minutes per inch (MPI). A 29 MPI rate will be used to design the OWTS. DESIGN SPECIFICATIONS The OWTS design is based on 5 -bedrooms and an average sewage load of 750 GPD. The installation must include a 2000 -gallon, two-compartment, precast concrete septic tank with a screened dosing siphon, followed by four gravelless chamber trenches. Each trench must have 1 row of 22 `Quick -4' Onsite Wastewater Systems Page 2 chambers for a total of 88 chambers, equaling 869 SF of infiltrative area. If ARC -36 chambers are preferred 72 chambers must be used. Serial distribution must be used to distribute effluent. Construction must be according to the Pitkin County Environmental Health and Natural Resources Department OWTS regulations, the OWTS Construction Permit provided by Pitkin County Environmental Health and Natural Resources Department, and this design. OPERATION INFORMATION AND MAINTENANCE The surface of the drain field should be seeded upon completion. Vegetation is an important factor in drain field performance. Erosion control should be practiced prior to and during re -vegetation. Geo - fabrics or plastics should not be used over the drain field. No heavy equipment, machinery, or materials should be placed on backfilled drain field. Livestock should not graze on the drain field. Plumbing fixtures should be checked to ensure that no additional water is being discharged to OWTS. For Example, a running toilet or leaky faucet can discharge hundreds of gallons of water a day and harm a drain field. The homeowner should pump the septic tank every two years and clean the effluent filter as needed. Garbage disposal use should be minimized, and non -biodegradable materials should not be placed into the OWTS. Grease should not be placed in household drains. Loading from a water softener should not be discharged into the OWTS. No hazardous wastes should be directed into the OWTS. Mechanical room drains should not discharge into the OWS. The OWTS is engineered for domestic waste only. ADDITIONAL CONSTRUCTION NOTES If design includes a pump, air release valves and weep holes should be installed to allow pump lines to drain to minimize risk of freezing. Excavation equipment must not drive in excavation of drain field due to the potential to compact soil. Extensions should be placed on all septic tank components to allow access to them from existing grade. Precast concrete tanks and distribution boxes should be used, unless plastic or fiberglass is required. Access to all tank compartments and distribution devices is optimal. INSTALLATION OBSERVATIONS ALL SERVICE septic, LLC, and the county must view the OWTS during construction. The OWTS observation should be performed before backfill, after placement of chambers and distribution pipes. Septic tanks, distribution devices, pumps, dosing siphons, and other plumbing, as applicable, must also be observed. The proposed activity envelope on the west side of the access road designated for Pond, Utility, Landscape and Pasture lie within critical wildlife habitat —critical winter range for both mule deer and elk; mule deer summer, winter, severe winter, winter concentration and overall range; elk winter, overall and migration corridors and immediately adjacent to winter and severe winter concentration areas a migration path and do not meet the provisions of Section 7-20- 60(c) of the Code. b. The proposed activity envelopes on the far eastern portion of the parcel designated for Solar Installation and Utility Access also lies within critical wildlife habitat, as well as steep slopes and do not meet the provisions of Section 7-20-60(c) and 7-20-20(b) and (c). THE DIRECTOR DOES HEREBY DENY the Pond, Utility, Landscape and Pasture Envelope located on the West side of the repeater access road on the parcel and the Solar and Utility Access Envelopes located on the far Eastern portion of the parcel in order to preserve critical wildlife habitat and avoid steep slopes of the Rogers Activity Envelope and Site Plan; THE DIRECTOR DOES HEREBY APPROVE the Development Envelope for the main residence of the Rogers Activity Envelope and Site Plan, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicants shall adhere to all conditions and material representations made in the current application and shall consider those representations to be conditions of approval, unless amended by other conditions or as amended herein. 2. This approval shall replace Planning and Zoning Commission Resolution No. 86-22 (Reception No. 280234) and Hearing Officer Determinations Nos. 02A-2002 and 30-2006 3. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit review. Structures represented in the application might not be permitted under building and zoning regulations. 4. $Me state of the existing vegetation to the west of the access road as recorded at Book 556 Page 634, Oteception No. 498340 and to the east of the approved development envelope over the break of the --slope as it slopes to the east shall not be disturbed or changed in order to preserve the most critical wildlife habitat on the parcel. Prior to submission of any future building permit or development applications, the Applicants shall be required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2-30-20(g) and Application Manual Sections 2.1.1 & 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation. The Mylar copy of the plat shall be signed by the owner prior to submittal for recording. The Site Plan shall be amended as follows, prior to submission: a. Change the title to "Oates/Rogers Activity Envelope and Site Plan". b. Remove the "Hearing Officer Approval" signature block. c. Include a "Pitkin County Community Development Director" signature block. d. Amend the "Waiver" signature block to "Owner" signature block, eliminate the 1041 reference and change it to `environmental hazards". Amend the Clerk and Recorder's signature block to eliminate the 1041 reference and change it to "Activity Envelope and Site Plan". f. Remove the Solar/Utility Envelope and Utility Access Corridor Envelope from the eastern side of the site plan. g. Remove the Pond, Utility, Landscape and Pasture Envelope and all development from the site plan. h. Include an access envelope for the access road which bisects the parcel, keeping the envelope as close to the current road as possible. i. Include a slope analysis key. j. Include the location and approximate size of the septic field within the approved Activity Envelope. k. Include the location of the 20,000 gallon water supply as required by the Aspen Fire Protection District or the location of the nearest fine hydrant or adequate water supply required for mitigation. All structures shall be located within the approved Activity Envelope. 1. Include the following Site Plan notes: i. The parcel is mapped in a moderate wildfire area. ii. The parcel is mapped as Mule Deer Summer, Winter, Winter Concentration, Severe Winter and Critical Winter Range. iii. The parcel is mapped as Elk Overall, Winter, Critical Winter and Migration Corridor Range. 6. Floor area shall be limited to 5,570 square feet exempt from growth management without the use of TDR's or growth management allotments. Floor anew shall be palculated based on the definition in effect at the time of building permit submittal. 7. Prior to the issuance of a building permit for the residence, the Applicant shall: a. Complete a fireplace/woodstove permit application form with the Community Development Department, if necessary. b. Obtain a County Access Permit for the driveway, which shall be approved by the Planning Engineer. The access drive shall be built to current County Standards, as described in the Pitkin County Asset Management Plan. The driveway layout shall be staked in the field and reviewed and approved by the Planning Engineer, prior to commencement of construction. The Access permit shall include: i. All utility line locations. Utilities shall follow the alignment of the approved driveway. ii. Applicant shall comply with the requirements of the Aspen Fire Protection Department regarding access. c. Submit a site specific, detailed drainage and erosion control plan prepared by a qualified engineer or geologist for review and approval by the Planning Engineer. All historical drainage patterns shall be maintained. All Slopes steeper than 2:1 shall utilize erosion control blankets. If the project disturbs more than one (1) acre, a State Stormwater Permit shall be obtained prior to permit issuance. Administrative Determination (0q —2009 Page 4 d. Submit a construction management plan for review and approval by the Planning Engineer showing the locations of staging, material storage including all retained soils and employee and construction traffic parking all within the approved activity envelope. e. Submit a lighting plan for review and approval by the Community Development Department to ensure comp( iance with the standards for residential use of the property. f. Pay the applicable road and employee housing impact fees. g. Provide proof of adequate water supply (in terms of quantity and availability for domestic and fire protection purposes, and for irrigation purposes, if applicable, to the Environmental Health Department. h. Obtain an OWTS permit from the Environmental Health Department. The system shall be located within the approved activity envelope and must comply with setback requirements from surface and groundwater sources. 8. A detailed landscape/re-vegetation plan shall be submitted prior to submittal for any excavation or building permits, for review and approval by the Community Development Department and the Colorado Division of Wildlife. The plan shall include: a. A vegetative screen on the north, east and west sides of the approved activity envelope to minimize the impacts of human activity on wildlife. The screen shall be planted with trees of sufficient height (approximately 12' to 16') and density to screen and minimize disturbance and shall utilize only native species including juniper, pinion pine and/or other vegetation approved by Community Development and CDOW. This screening must be in place prior to the final building inspection. If the applicant anticipates completion of construction during winter months, the screening shall be installed the previous planting season unless other arrangements are made with the Community Development Department or a Certificate of Occupancy will not be issued. b. A tree mitigation plan for any trees to be removed with a 6" or larger D.B.H. c. A re -vegetation plan for all areas of disturbance using only native shrubs and Pitkin County Approved Seed Mixes, especially Beneficial Browse mix along the borders of the approved activity envelope. d. A review, assessment and mitigation of the proposed landscapingtre-vegetation plan by a Pitkin County Wildfire Expert to ensure compliance with all wildfire regulations. 9. Prior to submittal for any excavation or building permits, the Applicants shall submit a covenant for review and approval by the County Attorney, which prohibits commercial agricultural use on the parcel. This covenant shall be recorded in the office of the Clerk and Recorder of Pitkin County. 10. No structural development in excess of 30" in height above natural or finished grade shall occur within the setbacks of the lot. Landscaping in the form of berms shall not exceed four (4) feet from the most restrictive grade. Any external development located within setbacks mandated by County zoning regulations shall require a variance from the Board of Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. 11. No development including grading, excavation, fill placement, berming, landscaping, vegetation removal or disturbance, septic system or wildlife friendly fencing shall occur outside the approved activity envelope with the exception of vegetation removal necessary to comply with the wildfire mitigation measures described above. No structures shall be permitted outside of the approved development envelope. Administrative Determination[ -2009 Page 5 12. The residence shall be reasonably consistent with the images included in this application. The exterior of the residence shall be finished in the natural earth tones of the immediate vicinity. Reflective materials shall not be used unless the materials are treated prior to installation to eliminate reflection. This shall include materials associated with solar or photovoltaic equipment. Color and material samples shall be provided to the Community Development Department for approval prior to issuance of any building permits. 13. Driveway lighting is prohibited and all other lighting shall comply with the lighting code. 14. All new utilities located on or servicing the parcel shall be located underground. 15. All satellite dishes must be located to minimize visibility from Watson Divide and shall use earth - toned colors and approved screening to minimize their visual impacts. 16. Development is allowed in moderate wildfire hazard areas subject to conformance with the following development standards: a. Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): i. Brush, debris and non -ornamental vegetation shall be removed within a minimum ten -foot (10') perimeter around all structures. ii. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a minimum of a thirty (30) foot perimeter around a structure built on flat ground. (For greater slopes, reference the CSFS Safety Zone chart in Wildfire Guidelines for Rural Homeowners, which provides general guidelines that may be modified by a wildfire expert acceptable to the County). iii. Spacing between clumps of brush and vegetation up to the thirty (30) foot perimeter shall be a minimum of two (2) times the height of the fuel. Maximum diameter of the clumps shall be equal to the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. iv. All branches from trees and brush within the thirty (30) foot perimeter shall be pruned to a height of ten (10) feet above the ground with removal of ladder fuels from around trees and brush. v. Tree crown separation within the thirty (30) foot perimeters shall have a minimum of ten (10) feet between the edges of the crowns, except for mature stands of aspen trees where ladder fuels have been removed. In areas of aspen regeneration, understory shrubs and down and dead materials shall be removed. vi. All branches that extend over the roof eaves shall be trimmed and all branches within fifteen (15) feet of chimneys shall be removed. vii. The density of fuels up to a one hundred (100) foot perimeter of the structures shall be reduced where natural reduction has not already occurred. viii. All deadfall up to a one hundred (100) foot perimeter shall be removed. ix. No new conifer trees shall be planted within ten (10) feet of a residence. Administrative Determination bi-2009 Page 6 x. No flammable mulches shall be placed within two (2) feet of a residence. xi. The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. b. Access: Access roads and driveways shall be built to County standards; however, these standards may be increased to mitigate wildfire hazards based on comments provided by the Colorado State Forest Service, the Sheriffs Department, local fire protection districts and/or a person approved by the County as an expert in wildfire area designation and mitigation. Where feasible, looped routes of access/egress to a public road shall be incorporated in the design of a proposed development. Looped routes of accesslegress is defined as two (2) or more dedicated access roads to the main artery/highway for widely separated ingress/egress; looped drives with one (1) entrance point or divided single entrances do not satisfy this condition. Where this is not feasible, the Community Development Department may approve vehicular turnaround areas a maximum of seven hundred fifty (750) feet apart installed between the road intersection and its terminus. Turnaround areas shall be the same standard as cut - de -sac turnaround pads; these may be incorporated into the proposed driveway entries. ii. New dead-end streets shall not be permitted, except for cul-de-sacs and other turnarounds accepted by the applicable local fire department. iii. Cul-de-sac turnaround pads shall have a minimum of thirty (30) foot drivable surface inside turning radius or a hammerhead or other T -area acceptable to the applicable local fire district. iv. New driveways and access roads shall enter the roadway at a ninety -degree (900) angle for the fust twenty-five feet of the driveway. v. Fuel breaks as recommended by a wildfire expert approved by the County may be incorporated into the design of access roads or driveways. C. Water Supply for Fire Safety: i. When access to a public or private pressurized water system is not available or if it is necessary to augment fire protection water systems, private ponds may be used if approved by the Community Development Department and the local fire district. ii. Any fire department recommendation for individual structure water supply and storage shall be accessible to fire department vehicles from the exterior of the structure through a fire department approved mechanism (such as a fire hydrant). iii. The amount of storage capacity shall be a minimum of 20,000 gallons as determined by the Aspen Fire Protection district. Verification of the closest hydrant satisfactory to the Aspen Fire Protection District can mitigate this requirement. iv. All structures regardless of size shall be required to install in-house sprinkler systems that meet the standards of the Aspen Fire Protection District and the Administrative Determination I09-2009 Page 7 adopted Building Code due to hazard considerations, emergency access difficulties and lack of proximity to fire protection services. d. Roofing Materials: i. Class A covering or Class A Assembly as defined by the currently adopted Building Code. ii. No wood shakes or shingles. e. Roof Venting: i. Soffit venting shall be located in the outer UP portion of the overhang. ii. Attic, soffit and other roof venting shall be on non -corrosive metal mesh with maximum''/4 inch openings. f. Projections at the roofline, including soffits, rafters, porch or deck roofs, fascias, or other: i. Sheath with non-combustible materials, OR combustible materials underlain with 5/8 inch Type X gypboard or equal, OR minimum 4x6 rafters with 2x T & G decking. g. Decks, Decking, Cantilevered Floors, or Other Projections Below the Roofline: i. Minimum 6x6 posts, 6x10 beams, 3x8 joists 3x decking, and 2x railing, or equivalent log construction. h. Roofs with less than a'3:12 pitch are not permitted unless they comply with the following: i. All roof coverings shall be constructed of non-combustible materials and installed on a Class A roof assembly. ii. All roof coverings shall have a surface that shall facilitate the natural process of clearing roof debris. iii. Protrusions above the roofline, such as parapets, shall be prohibited iv. Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of 1:48. v. All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshall prior to submittal of a building permit application. i. Maintenance and Miscellaneous Requirements: i. All outbuildings shall adhere to the same wildfire standards. ii. Roofs and gutters shall be kept clear of debris. iii. Roof vents shall be screened with corrosive resistant wire mesh, with mesh one- fourth ('/4) inch maximum. iv. Yards shall be kept clear of all litter, slash and flammable debris. v. All flammable materials shall be stored on a parallel contour a minimum of fifteen (15) feet away from any structure. Administrative Determination)0-2009 Page 8 vi. Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more than six (6) inches. vii. Firewood/wood piles shall be stacked on a parallel contour a minimum of fifteen (15) feet away from the structure. viii. Swimming pools and ponds shall be accessible by the local fire district. ix. Fences shall be kept clear of brush and debris. x. Wood fences shall not connect to other structures. xi. Fuel tanks shall be installed underground with an approved container. xii. Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for two (2) hour fire -resistive construction on the exterior side of the walls. xiii. Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher. xiv. Addresses shall be clearly marked with two (2) inch non-combustible letters and shall be visible at the primary point of access from the public or common access road and installed on a non-combustible post. xv. The Applicant shall comply with all the requirements of the Basalt & Rural Fire District. 17. The Applicants shall comply with the following general conditions regarding wildlife: a. When existing native vegetation must be altered within the Activity Envelope, the Applicant may be required to prepare a habitat mitigation plan acceptable to the County. Such mitigation plan may substitute (in a nearby area on the subject property) vegetation equal in type and quantity to that being removed to mitigate effects on wildlife species. Should there be no opportunity on the property for habitat mitigation or restoration, off- site mitigation benefiting the same species may be required, or financial mitigation may be paid into a County habitat mitigation fund should such a fund be established in the future. b.. Manipulation of vegetation outside of the Activity Envelope is prohibited. c. Tall overly mature trees and standing dead trees (snags) should be retained at the rate of two (2) to five (5) per acre whenever possible as nesting and perching habitat. d. Due to high black bear activity, fruit bearing trees and shrubs shall be prohibited in any landscaping within the Activity Envelope. This does not include pre-existing native trees and shrubs. e. Development shall be clustered to the maximum extent possible to minimize impact on wildlife. f. Access shall be provided to the Colorado Division of Wildlife for trapping, tagging, studying, or otherwise managing wildlife. g. Trash/garbage shall be kept in an approved bear resistant container or enclosure. These containers shall be accessible to and used at all times by contractors on site. Administrative Determination 10q-2009 Page 9 h. Bird feeders, including hummingbird feeders, shall be hung away from any deck or window, and be at least ten (10) feet from the ground suspended between two (2) trees or posts. All seed feeders shall include a seed catchment pan to catch discarded seed. i. Horse grains, pellets, and cookies shall be stored in bear resistant containers. j. Pet food shall not be left outside. 18. The Applicant shall comply with the following additional standards: a- All dogs shall be prohibited on the parcel, including those owned by construction personnel. b. No livestock or horses shall be allowed on the property. C. Commercial activity (such as seismic activity, construction, and timber harvesting) is prohibited from December I" through March 31". d. No construction shall be permitted from December 1" through March 31" if the proposed development is within one-quarter ('/.) mile of a severe winter range or winter concentration area. e. No construction shall be permitted within or adjacent to wildlife migration corridors between April 15'h through May 30th or October 15"' and November 30`h. f. High impact recreational uses are prohibited. 19. As an approved building envelope has been historically allowed since 1986 in the same location east of the repeater road, that envelope shall be allowed to continue even though the Code states: a. There shall be a minimum one-quarter (1/4) mile (1,320 foot) buffer between any building or structure and wildlife migration corridors, critical habitat, severe winter range, and winter concentration areas, and b. Development is prohibited within deer and elk winter concentration areas and severe winter concentration areas and severe winter range areas. 20. Fencing on the parcel shall be restricted to the main residential development envelope located on the east side of the repeater access road and shall comply with the following standards: a. Wood rail fencing shall employ three (3) rails or less, be the round or split rail type, shall not exceed fifty-four (54) inches in height above ground level, and twelve (12) inches in width (top view), and shall have at least eighteen (18) inches between the lower two (2) rails. b. Wire fencing must be three (3) strands or less. The top wire should be a twelve -point -five (12.5) gauge twisted barbless type at a maximum height of forty-two (42) inches. The middle strands (which may be barbed) should be located a minimum twelve (12) inches apart and from the top wire preventing entanglement when mule deer jump over. The bottom strand should be sixteen (16) inches from the ground. c. An opening shall be provided every 50 feet for the migration of big game. 21. Prior to the issuance of any earthmoving or building permit for the residence, all existing fences on the property shall be removed. 22. Prior to commencement of any earthmoving or other construction activity, the Applicants shall stake the comers of the activity envelope and install construction fencing around the construction site Administrative Determination 109-2009 Page 10 within the perimeter of the building envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy. No vegetation shall be damaged or removed outside the approved envelope. 23. All areas disturbed by construction shall be re -vegetated with native shrubs and grasses within one growing season of the project's completion. Financial security may be required for the re -vegetation of steep slopes. 24. Prior to issuance of any future permits, the Applicant shall provide proof that an access easement has been granted through the parcel to Pitkin County for the maintenance of the County Repeater. 25. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. 26. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, § 2-20-170 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on the -clay of December, 2012.
