Any changes must be approved by this department and the design engineer prior to them being made. Minimum horizontal distances between components of the system and physical features shall conform to the Pitkin County ISDS regulations. From the absorption area, there must be at least 202 feet to the well, 152 feet to the pond, and the ditches both to the north and south must be lined within 152 feet of the absorption area. The effluent line that crosses the ditch to the north of the absorption area must be encased within 10 feet of the crossing. The system will consist of one 1000 gallon two compartment tank with a pump to serve the CDU. The main residence will be served by one 1500 gallon single compartment tank followed by a 1000 gallon single compartment tank with an effluent filter on the outlet. Effluent will be distributed to a distribution box and then to 7 trenches with 24 Quick 4 chambers in each trench. There must be at least 6 feet of undisturbed soil between each trench. The existing tank and absorption area must be properly abandoned. Where the new absorption field extends into the abandoned portion of existing system, engineer specifications must be followed. The replacement sand must conform to the requirements of Section 6.28.670 A. of the Pitkin County ISDS Regulation, or conform to Pitkin County ISDS Policy 2005-001. An invoice to document the type of sand material utilized must be submitted to this department. This permit is expressly conditioned on the property owner providing for the regular inspection, cleaning and maintenance of the system by qualified personnel, in accordance with the manufacturer's recommendations. This department does not endorse any brand of products. This permit must be kept on-site during installation. The engineer must do a final inspection of the installation and submit an as -built letter to this department. This department must also be called for an inspection with a minimum of 48 hours advanced notice. Revegetation over the area of the field is very important for the functioning of the system. Pitkin County has guidelines that must be followed to assure the plants that are introduced are appropriate for the conditions of the area. The use of native plants is strongly encouraged. If approval takes to longer than 6 hours, a rate of $100 per hour will be charged. The maximum fee is $1000. The basic fee of $600 is due at the time of application. The remainder, if any, will be due in two stages: first, at the time of issuance of the ISDS permit; second, before final approval of the ISDS permit. Dear Mr. Conners: Hepworth-Pawlak Geotechnical, Inc. has observed the installation of the final components of the Onsite Wastewater Treatment System (OWTS) for the existing five bedroom residence and two bedroom caretaker's dwelling unit (CDU) at the project site. We previously performed an evaluation of the OWTS and presented our findings in a report dated December 30, 2008, Job No. 407 0386. A copy of our December 30, 2008 As -Built Evaluation letter is provided as an attachment. During our original site inspection on June 19, 2008, the CDU sewer pipe, septic tank, effluent pipes and effluent pump had not been installed. The two irrigation ditches which run through the property had also not been lined within the required setbacks. This As -Built evaluation was performed as a supplemental service in accordance with our Professional Services Agreement to you dated November 29, 2007. Our findings and recommendations are presented in the following paragraphs. During our final inspection on June 16, 2009, we observed the OWTS components including: CDU sewer pipe cleanout, effluent pump and the lining and piping of the two irrigation ditches on the property. The CDU septic tank, sewer pipe and effluent piping were buried prior to our site visit; therefore, we could not verify the installation of these OWTS components. We were able to verify the tank size based on the etching on the tank lid. The submersible effluent pump installed was an Orenco PKP350 instead of the Orenco PEF3311 pump specified in our design. We performed a pump test during our site inspection and the pump appears to work as designed. Both irrigation ditches on the property now meet the required setback to the OWTS components. The southern ditch was piped within the required setbacks and the northern ditch was lined with a PVC liner. Since the effluent line was backfilled prior to our site inspection, we were unable to verify that the line was double encased at least 10 feet on either side where it crossed under the northern ditch. A Final As -Built Site Plan is presented as Figure 1 and an As -Built Photograph Log is presented as an attachment. Based on our observations made during our site visit on June 16, 2009, it is our opinion that the OWTS meets the general intent of our design dated January 9, 2008. The OWTS components observed include: septic tanks, sewer pipe, effluent pipe, cleanouts, transport pipes, Infiltrator chambers, inspection ports, distribution box and the locations of all components. Our observations and recommendations are presented in the following paragraphs. The location of the absorption area, distribution box and layout of the transport pipes were modified from our revised OWTS design dated January 9, 2008, Job No. 407 0386. Due to the changes in the OWTS component locations, the old absorption area was left primarily undisturbed and imported sand was not necessary. It is our opinion that the changes will not alter the effectiveness of the OWTS. Based on observations made during our June 19, 2008 site visit, the components meet all the required setbacks for an OWTS except for the required setback to an irrigation ditch. Our design stated that the irrigation ditches on the property must be lined or piped within the required 152 foot setback from the OWTS absorption area. At the time of our site visit, the irrigation ditches had not been lined. The layout was changed to six rows of chambers with 25 chambers per row and one row with 21 chambers for a total of 171 chambers. It is our opinion that the layout changes will not impact the effectiveness of the OWTS. In addition, the rows which contain 25 chambers were partially backfilled at the time of our site visit and we could not count the chambers. However, the number of chambers was verified by measurement to the observation ports. An OWTS Preliminary As -built Site Plan and an As -Built Photograph Log are presented as attachments to this letter. We contacted Carla Ostberg at the Pitkin County Environmental Health Department on October 8, 2008 to request if the irrigation ditch setbacks could be modified due to the recent changes to the Pitkin County OWTS regulations. Per our conversation with Ms. Ostberg, this would only be possible if a new OWTS design was submitted and the system was re -permitted. Subsequently, our current OWTS design is restricted by the prior Pitkin County OWTS regulations. The CDU septic tank, sewer pipe, effluent pipes and submersible effluent pump were not yet installed at the time of our site inspection. We should be contacted to observe the installation of these components once they are installed prior to backfill. We must also observe the irrigation ditches to make certain that the ditches have been either lined or piped within the required setbacks. Based on our observations made during our site visit, it is our opinion that the OWTS meets the general intent of our design dated January 9, 2008; however, a final As -Built compliance certification cannot be issued until we observe the CDU components and the irrigation ditches are inspected. Please contact us at least 48 hours prior to the day that you will be ready for the inspections. Future inspections are not covered under these As -Built Inspection fees. Additional site inspections will be billed on a time and materials basis based on our fee schedule at the time of the visit. Dear Mr. Conners: As requested, Hepworth-Pawlak Geotechnical, Inc. has redesigned an Individual Sewage Disposal System (ISDS) based on the percolation rate of the subsoils for the existing residence and proposed caretakers dwelling unit (CDU) located at 2567 Snowmass Creek Road in Pitkin County, Colorado. We previously submitted an ISDS design for the subject site on December 31, 2007, Job No. 407 0386; however, you requested that the ISDS absorption area be relocated within the septic activity envelope. The study was conducted in accordance with our written agreement to Mike Conners Construction dated November 29, 2007. The data obtained and our ISDS design recommendations based on the proposed construction and subsurface conditions encountered are presented in this report. Site Conditions: The project site slopes gently down to the northwest. The site is approximately 39 acres in size. The site consists of an existing residence, garage and barn. The existing residence is currently undergoing renovations and will consist of a total of five bedrooms. A CDU will be constructed over the existing garage and will be designed for two bedrooms. The residence and CDU will share an ISDS absorption area. Water service will be provided to the residence and CDU by an existing on-site water well. An existing ISDS absorption bed and septic tank for the main residence is located on the property. The approximate locations are shown on Figure 1. The new ISDS absorption area excavation should extend to below the existing aggregate and biomat or other obvious signs of impact from the existing absorption area. Excavated material should be dried on-site and then properly disposed of at a solid waste disposal facility. To maintain a maximum cover soil of approximately 3 feet, the grade of the excavation in the existing absorption area may be elevated by .tt 1 y placing concrete sand in the excavation. The filter sand should be placed in loose lifts not ' `A'V,,U to exceed 1 foot thick. Each lift should be compacted by wheel rolling or bucket packing prior to placement of the next lift. If water is available each lift may be wetted prior to compaction to decrease future settlement of the filter sand. Once the existing tank is unhooked from the residence it should be pumped dry. Following pumping, the tank x should either be removed or the bottom of the tank perforated and the tank backfilled with at't on-site or imported soil. A pond and two irrigation ditches are present on the property. Given the design flows for the shared ISDS, a 152 foot minimum setback is required from the ISDS absorption area to the ditches and pond. Subsequently, there is not enough space on this portion of the property to accommodate the required setback to the ditches; therefore, the ditches must L be lined with an impermeable liner or piped within the required setback area. A 20 mil ' fJ PVC liner protected on the top and bottom with a geotextile cushion is suitable for this application. Percolation Testing and Subsurface Conditions: Percolation tests were conducted on November 15, 2007 by our Glenwood Springs Office to evaluate the percolation rate of the natural soils at the site. Two profile pits and six percolation test pits were excavated at two different locations on the site. Profile Pit 2 and percolations test holes 4, 5 and 6 were used for this design. The percolation test results for the three test holes were 8, 60 and 40 minutes per inch, respectively. For design purposes, the 8 minutes per inch reading was not used given the variation compared to the other two test hole results. Therefore, an average percolation rate of 50 minutes per inch was used for this design. ISDS Analysis: Based on the subsurface conditions encountered and the percolation test results, the tested area is suitable for an ISDS utilizing the shallow soils for the treatment and dispersal of effluent. A site plan showing the proposed ISDS, existing water well, existing structures, water courses and the minimum horizontal setback distances of site features relative to the ISDS components is shown on Figure 1. The ISDS was designed for a total of seven bedrooms. An average flow of 100 gallons per person per day was used for the five bedrooms in the main residence and an average flow 75 gallons per person per day was used for the two bedrooms in the CDU. This equates to a total design flow for the shared ISDS absorption area of 2,275 gallons per day. All materials and installation should meet the requirements of the current Pitkin County Individual Sewage Disposal System Regulations. Septic and Dosing Tanks: A two chamber 1,000 gallon Copeland Concrete septic tank, or equivalent, will be used for primary treatment of sewage from the CDU. A submersible effluent pump will be installed in the second chamber of the tank. Sewage will gravity feed from the CDU to the septic tank and effluent will be dosed to a single chamber 1,500 gallon Copeland Concrete septic tank, or equivalent. The 1,500 gallon tank will be the first of two septic tanks that will be used for primary treatment of sewage from the main residence. Sewage will gravity feet from the main residence to the 1,500 gallon septic tank. Effluent from the main residence and the CDU will then gravity feed to a 1,000 gallon single chamber Copeland Concrete septic tank, or equivalent. An effluent filter will be installed at the outlet of the second tank. Screened effluent will then gravity flow to a distribution box and the absorption trenches. If the septic tank access riser lids will be installed at grade, with no backfill cover, then the lids should be insulated with foam insulation board to provide frost protection. The sewer pipe inlet tee in the first chamber of the septic tank should be installed beneath the Job No. 407 0386 Mike Conners Construction January 9, 2008 Page 4 access lid of the first chamber of the septic tank so that it can be reached for service should it become clogged. A high water alarm switch should be installed in the dosing chamber of the CDU septic tank 3 to 6 inches above the upper float position. The high water alarm will provide audio and visual warning of a high water condition in the tank and should be placed inside or on the dwelling where it will be readily seen or heard. The PVC handle on the effluent filter should be extended up to within reach of the dose tank access riser lid. This will allow for easy access and maintenance of the filter. Approximately 2 feet of soil backfill cover should be placed over the tops of the septic tanks to allow for easy access and frost protection. For maintenance reasons, deep tank installations should be avoided and we should be contacted to evaluate this ISDS design should it appear that a deep tank installation involving more than 4 feet of backfill soil over the top of the septic tanks may be required. CDU Dosing Pump: An Orenco PEF3311, 115 volt, submersible effluent pump with a 2 inch diameter discharge assembly, or equivalent, is suitable for this application to move effluent from the CDU septic tank to the first tank for the main residence. For design purposes, it was assumed that the elevation difference from the dosing pump intake to the absorption area manifold is not more than 15 feet and that the length of the effluent transport pipe does not exceed 270 feet. The pump must be capable of providing a total flow rate of 10 gallons per minute at 15.8 feet of total dynamic head. The dosing pump will be controlled by a control panel and a system of float switches. The float switches should be set to provide a dose of about 175 gallons. The actual dose volume is about 131 gallons, assuming an effluent drainback volume of about 44 gallons in the transport pipe. At the design flow, the effluent pump will dose effluent to the first main residence septic tank about four times per day. Sewer and Effluent Piping: The sewer line from the residence and CDU to the septic tank should not be less than the diameter of the building drain and not less than 4 inches Job No. 407 0386 G 9tech Mike Conners Construction January 9, 2008 Page 5 in diameter and will service all levels of the buildings. Soil backfill beneath the sewer pipe must be adequately bedded and compacted to prevent settlement of the pipe. The sewer pipe should be installed in landscape areas with at least 40 inches of soil backfill covering the pipe, or the pipe should be insulated on the top and sides with 2 inch thick rigid foam insulation board for frost protection. Beneath driven surfaces, we recommend using Schedule 40 PVC sewer pipe and the pipe be insulated if it will be installed with less than 4 feet of backfill soil cover. We recommend the use of Schedule 40 PVC pipe between the residence and CDU and the septic tank, though this is not required by local regulations. The portion of the sewer pipe extending from 5 feet outside the building foundation should have a slope of at least 2%. Cleanout pipe(s) should be installed in the sewer line adjacent from the building foundation, adjacent to the inlet of the septic tank, where the sewer pipe bends at 90 degrees or more and at least one cleanout should be installed at least every 100 linear feet of non -pressurized sewer or effluent pipe throughout its length. We recommend that a straight section of pipe be installed between the residence and CDU foundation and the septic tanks. Any required 90 degree bends in the sewer pipe should be accomplished through the use of a series of 45 degree smooth elbows or a 90 degree long sweep to help prevent clogging of the pipe. The 2 inch diameter schedule 40 PVC transport pipe from the CDU should be sloped at 2% minimum to drain back to the dose chamber between doses. It is critical that the effluent transport pipe be properly bedded to reduce settlement which could cause standing effluent to freeze in the pipe. The effluent transport line from the CDU will cross beneath the northernmost irrigation ditch that crosses the property. The effluent transport pipe must be double encased 10 feet on each side of the ditch as specified in Note 1 on Figure 1. Job No. 407 0386 Mike Conners Construction January 9, 2008 Page 6 Absorption Area: The soil absorption area is designed to be approximately 1,658 square feet and will consist of seven trenches consisting of 24 Infitrator Quick 4 Standard chambers in each trench for a total of 168 chambers. Each chamber was given 9.87 square feet of absorption area. A 50% reduction in field size was applied for use of Infitrator Quick 4 Standard chambers in a trench configuration. Absorption area calculations are shown on Figure 2. The absorption area trenches should be excavated to the approximate depths shown on Figure 4. Care must be taken during installation to ensure that the soils exposed in the bottoms and sidewalls of the trench excavations are not compacted. Once the trench excavations are complete they should be left open, if necessary, to allow the soils to air dry prior to placement of chambers and distribution pipes. Once the soils have air dried, if necessary, the bottoms and sidewalls of the excavations should be scarified prior to placement of the chambers. A distribution box with at least seven outlets and one inlet will be used to equally distribute effluent to the absorption trenches. We recommend that the soil beneath the distribution box be adequately compacted to reduce settlement of the box or the box may be set on a small level concrete pad. It is critical that the box be installed level and that the flow lines of the outlets are at equal elevations to ensure that effluent is equally distributed to each trench. Speed levelers should be installed in the effluent manifold pipe outlets within the distribution box and should be adjusted to provide even distribution to each outlet. If desired, the distribution box may be installed within a vault for easy access. The on-site soils can be used as backfill over the chambers and should be graded to deflect surface water and precipitation away from the absorption area. We recommend the soil backfill be re -vegetated as soon as possible with a mountain meadow grass mix or suitable equivalent. It is important not to plant large vegetation or vegetation with invasive roots in and around the absorption area and manifold piping as the roots may damage piping and chambers. Job No. 407 0386 G95tec h Mike Conners Construction January 9, 2008 Page 7 Combination air vent/inspection ports should be installed at each end of the first, fourth and seventh trenches at minimum. The ports should be constructed of 4 inch diameter PVC pipe installed into the knockouts provided on the tops of the Infiltrator chambers. The ports should extend a minimum of 8 inches above the finished ground surface and should have ventilated removable caps. The absorption area manifold and distribution piping layout is shown on Figure 3. All materials used and installation methods should meet the requirements of the Pitkin County Individual Sewage Disposal System Regulations, Revised 2001. Subsurface Drainage: No free water was encountered in the profile pit when observed on November 14, 2007 and it is our opinion that a subsurface drain will not be required. If free water is encountered in any excavations on the site we should be notified to re- evaluate the need for a subsurface drain to protect the absorption area. ISDS Maintenance: The on-site ISDS will require maintenance. The level of maintenance will vary with the complexity of the system and water use habits of the users. We recommend that fats, oils, bath oils, greases, paint, solids, water softener backwash solution, water from hot tubs and other constituents that can clog and foul collection and disposal equipment are not disposed of in the residence drains. The absorption area and any areas directly up gradient of it should not be watered by lawn irrigation systems or other means as the soils may become hydraulically overloaded. Septic tanks and other treatment tanks should be pumped whenever the sludge occupies 1/3 of the liquid capacity of the first chamber of the septic tank. The high water alarm float switch should be checked at least once per year to ensure that it is working properly. In addition, the effluent filter should be checked for clogging at least once per year and cleaned as necessary. We recommend that an operation and maintenance manual be developed for the ISDS. The ISDS should be operated and maintained as stipulated in the manual. If you desire our services, we can prepare the operation and maintenance manual for the on-site ISDS. Job No. 407 0386 Ggtech Mike Conners Construction January 9, 2008 Page 8 Limitations: This design has been conducted in accordance with generally accepted engineering principles and practices in this area at this time. We make no warranty either express or implied. The conclusions and recommendations submitted in this report are based upon the data obtained from the profile pit and percolation test holes excavated at the approximate locations and depths indicated in the attached Percolation Testing Report, the proposed type of construction, and our experience in the area. Our findings include interpolation and extrapolation of the subsurface conditions identified at the profile pit and percolation test holes and variations in the subsurface conditions may not become evident until excavation is performed. If conditions encountered during construction appear different from those described in this report, we should be notified at once so re-evaluation of the recommendations may be made. Based on site reconnaissance, it is our opinion that the designed location of the ISDS does not violate any setback requirements of the current Pitkin County Environmental Health Department's ISDS regulations. We recommend that the position of the ISDS components, proposed existing residence, existing water well and setback requirements be verified in the field by a Professional Land Surveyor licensed in the State of Colorado. This report has been prepared for the exclusive use by our client for the ISDS design submittal process. We are not responsible for technical interpretations by others of our information. As the project evolves, we should provide continued consultation and field services during ISDS construction to review and monitor the implementation of our recommendations, and to verify that the recommendations have been appropriately interpreted. Pitkin County requires that an As -Built evaluation of engineered ISDS designs be performed by the ISDS engineer. The As -Built evaluation is not included in our fees for the original scope of services in our Professional Services Agreement dated November 29, 2007. These services will be performed for an additional fee. No components of the ISDS should be backfilled prior to our performing the ISDS As -built evaluation. A profile pit and three percolation test holes were excavated at each of the residence and CDU sites on November 15, 2007 at the locations shown on Figure 1. The subsoils exposed in the Profile Pits consisted of about 1 to 1'h feet of topsoil overlying clayey silty sandy gravel with cobbles and small boulders to the bottom pit depths of 8 feet at Profile Pit 1 and 8'h feet at Profile Pit 2. The results of a gradation analysis performed on a sample of very gravelly loamy sand (minus 5 inch fraction) obtained from the site are presented on Figure 2. No free water or evidence of a seasonal perched water table was observed in the pits and the soils were slightly moist to moist. Slotted PVC pipe was placed in the pits for future monitoring of water levels. Percolation test holes were hand dug and soaked with water on November 14, 2007. Percolation testing was conducted on November 15, 2007, by a representative of Hepworth - Pawlak Geotechnical, Inc. The percolation test results are summarized on Table 1. The percolation test rates at the residence ranged from 8 to 60 minutes per inch and averaged 36 minutes per inch. The percolation tests at the CDU site ranged from 15 to 40 minutes per inch and averaged 23 minutes per inch. The average of all percolation tests was about 30 minutes per inch. MEMORANDUM To: Michael Kraemer, Planning Department From: Carla Ostberg, Environmental Health & Natural Resources Department Date: August 17, 2007 Re: Zabriskie Activity Envelope, Site Plan Review and Special Review for a Caretaker Dwelling Unit (PID 2645-022-00-005; Case P098-07) SUMMARY OF RELEVANT PARTS OF APPLICATION: The applicant is proposing to add approximately 1,787 square feet of floor area to the existing residence and to add a 1,000 square foot caretaker dwelling unit (CDU) within an existing barn on the property. DISCUSSION: The Pitkin County Environmental Health & Natural Resources Department has reviewed the details of the Zabriskie Activity Envelope application under the authority of the Pitkin County Land Use Code and the Pitkin County ISDS Regulation and has the following comments. On August 10, 2007, Carla Ostberg conducted a site visit to the property. Warren Palmer, representative of the applicant, described existing conditions and future plans for the onsite wastewater treatment system(s) and water supply that will serve both residences. --- WATER SUPPLY: The existing residence is currently served by a private well. No information on that well was provided in the application. In connection with any Septic System Permit for this property, this Department will require proof of an adequate legal water supply, as defined in the then -current Pitkin County regulations. The applicant should be sure to consider this issue in connection with the CDU, as some well permits are issued for only one single family dwelling unit. --- SEWAGE TREATMENT AND COLLECTION: The existing septic system on the property was permitted and installed in 1988. This system was designed to serve four bedrooms in the main house and one bedroom in a future CDU, for a total of five bedrooms. The "future CDU" was never constructed. A 1250 gallon septic tank (designed to accommodate four bedrooms) and a 1050 square foot sand filter (designed to accommodate five bedrooms) serve the exiting four bedroom house. Although the permit was not signed by the former Environmental Health Department's staff, notes on the permit indicate a final inspection was conducted. Printed on Recycled Paper Floor plans for the remodel of the main house show five potential bedrooms, as defined in the current Pitkin County ISDS Regulation. The absorption area was sized to accommodate five bedrooms; however, the tank was only sized to accommodate four bedrooms. Alternatives: If the applicant intends to use the existing system (tank and/or absorption area) to serve the remodeled residence, the system must be evaluated by a Professional Engineer. Neither the permit nor the accompanying documents contain information on the soils or high groundwater levels. Depth of sand filter media is also unclear. Given the potential for high groundwater in this area, an eight foot profile hole should be excavated in the vicinity of the existing system to assure the system is maintaining a four foot separation between the bottom of the system and high groundwater. Documentation of this evaluation must be provided to this Department. 2. If a new system for the main residence will be designed, the proposed Activity Envelope (for purposes of placement of the onsite wastewater treatment system) should be sufficient. The proposed Activity Envelope for the CDU's onsite wastewater treatment system should also be sufficient. All onsite wastewater treatment systems installed within Pitkin County require Septic System Permits issued by the Environmental Health & Natural Resources Department, and must comply with the County's ISDS regulations. The County cannot issue a Building Permit until a Septic System Permit has been obtained, or the exiting system has been assessed as suitable to serve the proposed development. A retaining wall should not exceed seven (7) feet in height. Retaining walls greater than four (4) feet in height shall be supported by appropriate engineering and reviewed and approved by the County Engineer. c. Terracing should be limited to two (2) tiers. The width of the terrace between any two four (4) foot vertical retaining walls shall be at least three (3) feet. Standards Applicable to All Wildfire Hazard Areas: Development is allowed in wildfire hazard areas subject to conformance with the following development standard. Page 3 of 7 000014. A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): a) Brush, debris and non -ornamental vegetation shall be removed within a minimum ten -foot (i0') perimeter around all structures. b) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a minimum of a thirty (30) foot perimeter around a structure built on flat ground. (For greater slopes, reference the CSFS Safety Zone chart in Wildfire Guidelines For Rural Homeowners, which provides general guidelines that may be modified by a wildfire expert acceptable to the County). c) Spacing between clumps of brush and vegetation up to the thirty (30) foot perimeter shall be a minimum of two (2) times the height of the fuel. Maximum diameter of the clumps shall be equal to the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. d) All branches from trees and brush within the thirty (30) foot perimeter shall be pruned to a height of ten (10) feet above the ground with removal of ladder fuels from around trees and brush. e) Tree crown separation within the thirty (30) foot perimeters shall have a minimum of ten (10) feet between the edges of the crowns, except for mature stands of aspen trees where ladder fuels have been removed. In areas of aspen regeneration, understory shrubs and down and dead materials shall be removed. f) All branches that extend over the roof eaves shall be trimmed and all branches within fifteen (15) feet of chimneys shall be removed. g) The density of fuels up to a one hundred (100) foot perimeter of the structures shall be reduced where natural reduction has not already occurred. h) All deadfall up to a one hundred (100) foot perimeter shall be removed. i) No new conifer trees shall be planted within ten (10) feet of a residence. )) No flammable mulches shall be placed within two (2) feet of a residence. k) The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Access a) Access roads and driveways shall be built to County standards; however, these standards may be increased to mitigate wildfire hazards based on comments provided by the Colorado State Forest Service, the Sheriff's Department, local fire protection districts and/or a person approved by the County as an expert in wildfire area designation and mitigation. C. Water Supply for Fire Safety a) When access to a public or private pressurized water system is not available or if it is necessary to augment fire protection water systems, private ponds may be used if approved by the Community Development Department and the local fire district. b) Any fire department recommendation for individual structure water supply and storage shall be accessible to fire department vehicles from the exterior of the structure through a fire Page 3 of 7 000019 department approved mechanism (such as a fire hydrant). The amount of storage capacity on the parcel shall be determined by the Fire District. c) All new development shall conform to the appropriate building Code(s) with regard to sprinklering structures.. D. Roofing Materials, Roofing Vents and Projections At and Below Roof Line. Unless the wildfire expert has recommended a different method of construction, roofs and projections at or below roof line in Low, Medium and Severe Wildfire Hazard Areas shall be constructed according to the following specifications: a) Love Hazard Area 1, Roofing Materials 2, Class A covering or Class A Assembly as defined by the currently adopted Building Code. 3. No wood shakes or shingles. 4. All other adopted Building Code compliant methods and materials permitted. E. All Hazard Areas: Roofs with less than a 3:12 pitch are not permitted in Low, Medium, or Severe Wildfire Hazard Areas unless they comply with the following: a) All roof coverings shall be constructed of non-combustible materials and installed on a Class A roof assembly. b) All roof coverings shall have a surface that shall facilitate the natural. process of clearing roof debris. c) Protrusions above the roofline, such as parapets. shall be prohibited. d) Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of 1:448. e) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshall prior to submittal of a building permit application. Maintenance and Miscellaneous Requirements a) Roofs and gutters shall be kept clear of debris. b) Roof vents shall be screened with corrosive resistant wire mesh, with mesh one-fourth ('/a) inch maximum. c) Yards shall be kept clear of all litter, slash and flammable debris. d) All flammable materials shall be stored on a parallel contour a minimum of fifteen (1. 5) feet away from any structure. e) Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more than six (6) inches. f) Firewood/wood piles shall be stacked on a parallel contour a minimum of fifteen (15) feet away from the structure. g) Swimming pools and ponds shall be accessible by the local fire district. h) Fences shall be kept clear of brush and debris. i) Wood fences shall not connect to other structures. j) Fuel tanks shall be installed underground with an approved container. k) Propane tanks shall be buried, if possible, or installed according to NTFPA 58 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for two (2) hour fire -resistive construction on the exterior side of the walls. 1) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher. m) The Applicant shall comply with all requirements of the Basalt Fire District Code. n) Addresses shall be clearly marked with two (2) inch non-combustible letters and shall be visible at the primary point of access from the public or common access road and installed on a non- combustible post. 11. The Applicants shall comply with the following general conditions regarding wildlife: A. When existing native vegetation must be altered within the Activity Envelope, the Applicant may be required to prepare a habitat mitigation plan acceptable to the County, Such mitigation plan may substitute (in a nearby area on the subject property) vegetation equal in type and quantity to that being removed to mitigate effects on wildlife species. Should there be no opportunity on the property for habitat mitigation or restoration, off-site mitigation benefiting the same species may be required, or financial mitigation may be paid into a County habitat mitigation fund should such a fund be established in the future. B. Manipulation of vegetation outside of the Activity Envelope is prohibited. C. Mesh or woven wire fences are prohibited outside the Activity Envelope except hay storage. D. Wood rail fencing shall employ three (3) rails or less, be the round or split rail type, shall not exceed fifty-four (54) inches in height above ground level, and twelve (12) inches in width (top view), and shall have at least eighteen (18) inches between the lower two (2) rails. E. Wire fencing must be three (3) strands or less. The top wire should be a twelve -point -five (12,5) gauge twisted barbless type at a maximum height of forty-two (42) inches, The middle strands (which may be barbed) should be located a minimum twelve (12) inches apart and from the top wire preventing entanglement when mule deer jump over. The bottom strand should be sixteen (16) inches from the ground. F. Tall overly mature trees and standing dead trees (snags) should be retained at the rate of two (2) to five (5) per acre whenever possible as nesting and perching habitat. G. In areas of high black bear activity, fruit bearing trees and shrubs shall be prohibited within the Activity Envelope. This does not include pre-existing native trees and shrubs. H. Development shall be clustered to the maximum extent possible to minimize impact on wildlife. Page S of 7 000017 1. Access shall be provided to the Colorado Division of Wildlife for trapping, tagging, studying, or otherwise managing wildlife. J. Trash/garbage shall be kept in an approved bear resistant container or enclosure. These containers shall be accessible to and use at all times by contractors on site. K. Bird feeders, including hummingbird feeders, shall be hung away from any deck or window, and be at least ten (10) feet from the ground suspended between two (2) trees or posts. All seed feeders shall include a seed catchment pan to catch discarded seed. L. Horse grains, pellets, and cookies shall be stored in bear resistant containers. M. Pet food shall not be left outside. N. All dogs shall be kenneled. 12. The detached CDU shall not exceed 1,000 net livable square feet of floor area, which shall count toward the total allowable floor area for the lot. The kitchen contains the following, as defined in the Aspen/Pitkin County Employee Housing Guidelines: a minimum of a two -burner stove with oven, standard sink, and a refrigerator plus freezer. The oven must be able to bake and broil and be at least 5 cubic feet; the sink must measure at least 14"WX16"DX5.25"H; refrigerator must be at least 5.3 cubic feet and include at least a .73 cubic foot freezer. The floor plan for the CDU shall be submitted to the County Housing Office for review. 13. The Applicants shall, by covenant, guarantee that the caretaker unit; a. Shall not be required to be rented; b. Shall not be sold or otherwise conveyed or separated from the original parcel regardless of the ultimate form of ownership of the caretaker unit; c. Shall be limited to occupancy by not more than two adults and related children, who qualify as ("and have been found by me Housing Office to be) employees of the community under such guidelines as may be from time to time established, or members of the owner's immediate family, even though they may not qualify as employees of the community; d. Shall be rented for terms not less than 6 months if rented. 14. Upon completion of the CDU; but prior to issuance of the Certificate of Occupancy, County Housing Office staff shall be entitled to conduct an inspection of the CDU for compliance with the above - referenced requirements. 15. The caretaker dwelling unit restriction may be removed by the property owner upon approval of the Community Development Director, subject to the requirement that the dwelling is removed or modified. If modified, the remaining improvements must no longer be capable of occupancy as a dwelling unit and must meet otherwise applicable Code requirements. 16. The provisions of these regulations are for the purpose of providing a voluntary CDU on a legally created lot or parcel in the County. Any unit approved under this provision of the Pitkin County Land Use shall not be used for mitigation of employee housing requirements as established elsewhere in said Code. 17. Applicable road and employee housing impact fees must be paid at building permit. 18. No development shall occur outside the approved activity envelope with the exception of vegetation removal necessary to comply with the wildfire mitigation measures described above. No structures shall be permitted outside of the approved building envelope. Applicant shall be required to obtain an Earthmoving Permit for any work outside the approved envelope. 19. The access drive shall be built to current County Standards, as described in the Pitkin County Asset Management Plan and submit for an access permit. The driveway layout shall be staked in the field and reviewed and approved by the County Engineer, prior to commencement of construction. Page 6 of 000048 20. Prior to commencement of any earthmoving or other construction activity, the Applicants shall stake the corners of the activity envelope and install construction fencing around the construction site within the perimeter of the building envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy. 21. All areas disturbed by construction shall be re -vegetated with native shrubs and grasses within one growing season of the project's completion. 22. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, § 2-20-170 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on October 2010. 23. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. DISCUSSION: The Pitkin County Environmental Health & Natural Resources Department has reviewed the details of the Zabriskie Activity Envelope application under the authority of the Pitkin County Land Use Code and the Pitkin County ISDS Regulation and has the following comments. On August 10, 2007, Carla Ostberg conducted a site visit to the property. Warren Palmer, representative of the applicant, described existing conditions and future plans for the onsite wastewater treatment system(s) and water supply that will serve both residences. --- WATER SUPPLY: The existing residence is currently served by a private well. No information on that well was provided in the application. In connection with any Septic System Permit for this property, this Department will require proof of an adequate legal water supply, as defined in the then -current Pitkin County regulations. The applicant should be sure to consider this issue in connection with the CDU, as some well permits are issued for only one single family dwelling unit. --- SEWAGE TREATMENT AND COLLECTION: The existing septic system on the property was permitted and installed in 1988. This system was designed to serve four bedrooms in the main house and one bedroom in a future CDU, for a total of five bedrooms. The "future CDU" was never constructed. A 1250 gallon septic tank (designed to accommodate four bedrooms) and a 1050 square foot sand filter (designed to accommodate five bedrooms) serve the exiting four bedroom house. Although the permit was not signed by the former Environmental Health Department's staff, notes on the permit indicate a final inspection was conducted. Printed on Recycled Paper Floor plans for the remodel of the main house show five potential bedrooms, as defined in the current Pitkin County ISDS Regulation. The absorption area was sized to accommodate five bedrooms; however, the tank was only sized to accommodate four bedrooms. Alternatives: If the applicant intends to use the existing system (tank and/or absorption area) to serve the remodeled residence, the system must be evaluated by a Professional Engineer. Neither the permit nor the accompanying documents contain information on the soils or high groundwater levels. Depth of sand filter media is also unclear. Given the potential for high groundwater in this area, an eight foot profile hole should be excavated in the vicinity of the existing system to assure the system is maintaining a four foot separation between the bottom of the system and high groundwater. Documentation of this evaluation must be provided to this Department. 2. If a new system for the main residence will be designed, the proposed Activity Envelope (for purposes of placement of the onsite wastewater treatment system) should be sufficient. The proposed Activity Envelope for the CDU's onsite wastewater treatment system should also be sufficient. All onsite wastewater treatment systems installed within Pitkin County require Septic System Permits issued by the Environmental Health & Natural Resources Department, and must comply with the County's ISDS regulations. The County cannot issue a Building Permit until a Septic System Permit has been obtained, or the exiting system has been assessed as suitable to serve the proposed development.
