If approval takes longer than 6 hours, a rate of $100 per hour will be charged. The maximum fee is $1000. The basic fee of $600 is due at the time of application. The remainder, if any, will be due in two stages: first, at the time of issuance of the ISDS permit; second, before final approval of the ISDS permit. Sopris Engineering inspected the excavations and the installation of system components at various times during construction prior to final backfill. The system constructed on site was designed and built to serve the needs of an equivalent 4 -bedroom house. It is our understanding that the improvements to Lot 4 include construction of a 3- bedroom home and that a single bedroom ADU will be constructed on Lot 6 in the future. Sopris Engineering performed several visits to inspect and document the as built conditions of the constructed system. We have coordinated our efforts with the contractor that built the system. The as built conditions and installation of the new OWS components is in compliance with the permitted design specifications for the system. The System was installed in accordance with Pitkin County Regulations; the design presented in the Sopris Engineering Report and the design drawing, dated November 25, 2003. A 1500 -gallon dual compartment concrete septic tank was instal''.ed with an appropriate inlet sanitary tee and an Orenco Systems Inc., duplex pump bio -tube vault dosing assembly and associated piping and controls to serve the Lot 4 house. The 1105 sq. ft Sand Filter/absorption field. was constructed with a pair of mounded gravel and pipe bed type sand filter absorption systems. The pipe and gravel distribution layer was installed over 24" to 30" of Pitkin County type ISDS sand. Suitable pit run type material fill was placed as needed below the sand filter to raise the level of the mounded beds to an appropriate height above the seasonal high ground water. The Sand Filter/absorption beds were installed level. Inspection ports were installed on each corner end chamber and on the alternate ends of the interior rows in each bed. The average depth at the top of the sand from existing ground is approximately 3 feet. The exposed soils after grubbing were suitable and consistent across the field. The distribution gravel was covered with filter fabric and a minimum of 12 inches of backfill was placed to the finish grades that have been shaped to provide drainage away from the beds. Appropriate grading around the mound is complete with approximate side slopes at 3:1. The pump assembly and distribution box has been installed according to the engineered design plans. Additional observations of the soils within the field were performed during construction indicating that the soils are consistent with the description in the geotechnical report. Seasonal high ground water levels were observed from the end of May through Mid July to be between 12 and 18 inches below the lowest existing ground elevation near the western edge of the field. Seasonal high ground water levels were observed within approximately 2 feet of the lowest surface grades below the field. The highest water level observed was at the site elevation of 7163. The 100 -year flood water level has been estimated to be at site elevation of 7164.0. All components of the engineered OWS shall be inspected on a regular basis and be properly maintained. The system and responsibility for repair and maintenance of the system will remain with the Owner. The OWS should require minimal maintenance. Several factors influencing the need for maintenance include: actual wastewater flows versus design flows, the volume of kitchen/domestic waste (excluding human waste and toilet paper), excessive household chemicals and other toxic liquids. The tank, absorption field and other system components should be visually inspected bi-annually for debris, damage, leaks, or other potential problems. In general, for a properly utilized system, septic tanks should be pumped and inspected every 2 - 4 years. The effluent filters should be cleaned every six months and at the time of pumping. Absorption fields should be maintained with suitable cover and kept free of root invasive plants. Positive surface drainage away from the absorption field should be maintained. Permit Conditions.:j General Conditions: 1. The time limit for completing the work authorized ends on March 5, 2006. If you find that you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least ninety days (90) before the above date is reached. 2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and conditions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of this permit from this office, which may require restoration of the area. 3. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by this permit, you must immediately notify this office of what you have found. We will initiate the Federal and state coordination required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places. 4. Special Conditions: 1. The permittee shall maximize the use of appropriate and effective methods to prevent excessive sedimentation, erosion, and unauthorized discharges in waters of the U.S., including wetlands. Any straw or hay used for these purposes shall be certified weed -free. The permittee shall employ a qualified wetlands ecologist or similar professional, who shall be on-site during construction, for advice and prevention of unnecessary and unauthorized discharges in such waters. Construction personnel shall be instructed and supervised to avoid unauthorized work in the aquatic environment. 2. Within 30 days of completing the authorized work, the permittee shall submit a written statement to the Corps of Engineers certifying that all of the authorized work has been constructed in accordance with the terms and conditions of this permit. The certification shall be signed by the permittee. 3. The permittee shall purchase 0.2985 acre of wetlands credits from "Rocky Mountain Institute" for a credit ratio equal to 1.5 to 1.0 for impacts to 0.199 acre of wetlands. 4. The permittee shall provide evidence of purchased credit in the form of a signed Irrevocable Certificate of Compensatory Mitigation and Exhibit A -Compensatory Mitigation Summary Worksheet, prior to commencing project construction in wetlands. The following design recommendations are based on our current knowledge of the existing site conditions and information provided by others for use in supporting your application to Pitkin County. It is our understanding that Pitkin County will allow improvements on the site and will permit a system under current accepted guidelines. Our design recommendations are feasible with respect to current and proposed land use, setback issues and geotechnical conditions. Our recommendations are in accordance with Pitkin County and the State of Colorado ISDS Regulations. We are including a detailed description of the system in this letter and have attached a site plan with details as a part of our scope of work. Conclusions We have reviewed the site's Improvement Survey Certificate, 1041 Hazard Review Plan, the preliminary site plan and the original plat. We have used this information to create an OWS plan. We also have briefly discussed the proposed tie in of thettdjacent Lot 6 ADU to the new system with Pitkin County. The area within to the existing leach field easement has been evaluated for use as an absorption field area. Based on our findings we believe that the design and installation of an improved OWS system is feasible in accordance with Pitkin County Regulations and the State of Colorado. We assume the system will serve the needs of an equivalent 4 -bedroom single-family home. It is our understanding that the proposed improvements to Lot 4 include construction of a 3 -bedroom home and that a single bedroom ADU will be constructed on Lot 6. Our design recommendations for an OWS include the installation of a 2000 -gallon concrete or fiberglass septic tank equipped with a simplex pump biotube vault dosing assembly and associated piping and controls. The treated effluent will discharge to a pair of mounded gravel and pipe bed type sand filter absorption systems. The sand filter absorption system will provide secondary treatment of wastewater for infiltration into the ground. The system will meet all required standards and setbacks for a sand filter bed treatment system. The mounded bed system can be installed over the native soils. The system will meet all required setbacks and be installed within the general boundaries indicated on the plan. The site is situated in Section 3, T 9 S, R 86 W of the 6`h P.M. The Site comprises approximately 1.3 acres. The site is bounded by agricultural lands, riparian land, Capital Creek and scattered single-family acreages. Existing Site Conditions The site is located on a relatively flat lower river bench the moderately slope up to the Road. The topography indicated a general slope to the northwest towards Capital Creek with. The site is currently undeveloped. The site includes an existing access driveway and a developed spring. The existing ground surface in the proposed leach field easement ranges from 25% to 27%. The building envelope is adjacent to a delineated wetland and 100 -year floodplain line. The developed site and undisturbed areas are covered with grasses, willows, shrubs, brush, and scattered trees. Base Flood Elevation The site is on the FEMA; FIRM map (panel No., 08097C0066 C) dated June 4, 1987, which indicates that a portion of the site is in Zone A. A100 -year base flood elevation flood plain line has been delineated on the 1041 hazard Review mapping by Wright Water Engineers, Inc. The relative BFE appears to be approximately at 7164 feet. The leach field easement is out of the floodplain. Proposed Site Conditions It is our understanding that you intend to construct a new 1950 S.F. 3 bedroom home in the Lot 4 building envelope and that an ADU is to be constructed on the adjacent Lot 6. Therefore it is the desire of the individual lot owners to share the new OWS to serve the equivalent needs of a 4 -bedroom home. The original plat and the recent survey indicate that the septic tank easement on Lot 6 and the leach field easement on Lot 4 have been established for the use and benefit of Lots 4 and 6. The proposed improvements will include a new -mounded sand filter absorption field and septic tank, with a pump dosing assembly, located in the respective easements. Sewage from the home on Lot 4 will be collected in a wet well pump basin and lifted to the septic tank with 2" solids handling pumps. The Sewage from the ADU on Lot 6 will be collected in a wet well pump basin and lifted to the septic tank with 2" solids handling pumps or if feasible by a 4" gravity line. The proposed field location, grades and site conditions will be further evaluated during construction to confirm assumptions made in the following design recommendations. The new facilities are to be generally located as shown on the plan. William Sharman C/O Keith Webster SE Job No. 23160.01 August 25, 2003 Page 3 Subsurface Conditions Attached herewith are the results of the subsurface investigation and percolation tests conducted on October 20, 2003 by CTL Thompson, Inc. The report is dated November 3, 2003. The subsoil encountered at the site consists of about 2 feet of sandy clay topsoil and 1-2 feet of slightly clayey to clayey sand overlying silty to sandy gravel in the profile Pit to a depth of 7 feet. Shale bedrock was encountered at the bottom of the profile pit. Groundwater was encountered at a depth of 6 feet in the pit. Seasonal high ground water levels are expected to be within approximately 3.5 feet of the surface at the location of the profile pit. 100 -year flood water level has been estimated to be near site grade at site elevation 7165.0. Percolation test holes were dug however test was not performed. Based on the soil analysis and assumed structure the equivalent average percolation rates within the subsoils are estimated to be between 15 and 20 minutes per inch. Desian Criteria The proposed residence will be a 3 -bedroom house with a possible 1 bedroom ADU from the adjacent lot. This design is for an equivalent 4 -bedroom house. The design flow is calculated as follows: The new OWS shall be based on a minimum of 4 -bedrooms assuming a dwelling area under 2000 SY Residence unit - 4 bedrooms @ 2 person /bedroom = 8 person From the Pitkin County I. The tank must have appropriate access openings with watertight risers and lids. The tank installation must include additional dead weight concrete anchors strapped to the tank to compensate for potential buoyancy. Mounded Absorption Field Design A site plan is provided to detail the various components of the proposed sewage disposal system. The location of the proposed absorption field system is outside of the floodplain however; a mound system needs to be built high enough to so that the system functions at seasonal high groundwater conditions. We William Sharman C/O Keith Webster SE Job No. 23160.01 August 25, 2003 Page 4 have designed the mound with the assumed top elevation approximately 6 feet above the estimated high ground water levels and the theoretical maximum base flood stage as reported in the geotechnical report. The bottom of the distribution layer will be 4 feet above the theoretical maximum base flood and seasonal high ground water level to be consistent with regulations requiring a 4 -foot separation from seasonal high ground water. The following information details the technical criteria utilized in design of a proposed system. Proposed Sand Filter Absorption Svstem Based upon the percolation test rates, the standard absorption area equation yields the area required for receiving soils: A (SF) = Q *(t) 1/ : where A = Area; Q = flow (gal/day) 5 t = time in minutes This equation will give a recommended minimum absorption area: At = = 1050*(20) /2 = 939 sq. ft. Total area required = 939sq. ft. Area required for a sand filter treatment bed in a mound system: Long Term Acceptance Rate method (LTAR) Using imported course sand media yields the minimum area: LTAR maximum loading rate for sand filter = 0.95gal/S.F./day A=Q/LTAR = 1050/0.95 = 1105 sq. ft. 4. Use: Minimum 30' x 38' mounded absorption field or dimensions to obtain 1105 sq. ft. minimum. We recommend a pair of 15' x 38' mounded absorption beds with a minimum 6 -foot separation. The level grade of the up gradient mound may be stepped up a maximum of 2 feet to conform to the existing site grades. Inspection ports shall be installed at the terminal ends of the new 4" perforated distribution pipes running the length of the beds. The vertical inspection ports shall be 4" SDR 35 or schedule 40 pipes extending at least 6" above the surface. This will allow for checking the performance of the system. In regard to the current conditions, the septic tank, risers and sewage lines must be watertight to avoid discharge of effluent and infiltration of water into the system during high ground water or extreme flood events. Based on evaluation of the site it is assumed that the proposed septic tank will be in place with variable water table levels. Therefore the tank needs to have buoyancy protection by installation of appropriate dead weight anchors with cables. More detailed recommendations for buoyancy compensation will be made during final layout of the system. The mound needs to be graded to prevent surface water runoff from collecting on or around the mound. The mound shall be graded at 34tal to 1' foot vertical side slopes. William Sharman C/O Keith Webster SE Job No. 23160.01 August 25, 2003 Page 5 Effluent Dosin6 Distribution Svstem A septic tank effluent pump system will be utilized to transport effluent to the distribution header at the head of the distribution laterals in each bed. We recommend the use of an Orenco Systems BioTube pump vault system or approved equal. The pump system shall incorporate a simplex pump system however a duplex system should be considered in the event that the pump fails. Automatic float switches including a high water float with alarm shall be incorporated in the system. The pump assembly and dosing chamber will be installed in the secondary compartment of the septic tank. The vault will utilize a maintainable effluent filter. The transport line from the dosing pump to the absorption field shall be HDPE SDR -9 or schedule 40 PVC with a maximum diameter of 1.25 inches. The transport line will be installed to allow the drain back of effluent to the pump basin. The mounded bed will be pressure dosed through the distribution header pipe. The pressure will reduce to gravity distribution through the individual 4" perforated distribution laterals running the length of the bed. The perforated pipe will be SDR -35 pipe with the orifices oriented downward. A 4" inspection port will be installed at the terminal end of the distribution laterals. The effluent pump shall be sized to pump at a minimum velocity of 4 ft/sec. The dosing volume shall not exceed 150 gallons. Lift Station Design The lift station structure will consist of a 5' diameter concrete manhole with a concrete lid and a 30 -inch diameter access Ring and cover. The duplex system will have two 2" solids handling pumps set on the base of the structure and supported by rigid pipe. The pump system shall incorporate dual pumps to insure continuous operation in the event that one pump fails to operate or if peak demand requires additional capacity. The controls shall provide'•for alternate operation of each pump. Automatic float switches including a pump off switch, a ls` pump activation switch, a second pump activation lag switch and a high water float with alarms shall be incorporated in the system. Quick disconnect fittings will be installed on each pump discharge pipe for maintenance. Individual 2" SCHD —40 discharge plumbing assembly with flex hose will be connected to each pump and shall connect to the individual HDPE SDR -9 pressure pipes installed for discharge into the septic tank. The dual discharge pipes shall be installed with a continuous slope to allow drain back of the lines to the pump basin. No check valve will be installed however ball valve will be installed on each discharge plumbing assembly to facilitate maintenance. We assume that the control panel will be installed in the mechanical room. Electrical wires to the pump shall be installed into electrical conduit and shall be of suitable length to reach a suitable junction box. The alarms shall be tied into the homes security panel with a visual alarm indicator on a select interior security and/or system information panel. A visual indicator should be visible when one pump fails to operate. A visual and audible alarm indicator shall be activated if the second pump fails to operate. The control panel may be equipped with a telemetry system connected to a phone line that will automatically call the appropriate service provider if the high water alarm is activated. We recommend that an electronic data recorder be installed to record the pumping cycles to determine the sewage flow rates. We have designed the lift system to pump approximately 20 gallons per minute for an average 6 -8 -minute cycle pumping approximately 75-125 gallons per cycle. The Electrical requirements will be single phase, 115 volts. We recommend installing Grundfos Model PSE4011 pumps or approved equal. The existing conditions required the pumps to overcome a total dynamic head between 14-18 feet that includes approximately 12 feet of static head. The discharge plumbing assembly & connections are to be approved by the pump distributor. We recommend that verification of the specified pump or equal pump size and performance should be performed by the supplier and/or manufacturer. Contractor shall confirm sewer service components, pump specification parameters and follow manufacturers recommendation for pump installation and performance. Controls and electrical service for the selected pumps shall be coordinated with the pump supplier, the electrician and contractor. OWS Operation and Maintenance All components of the engineered OWS shall be inspected on a regular basis and be properly maintained. The system and responsibility for repair and maintenance of the system will remain with the Owner. The OWS should require minimal maintenance. Several factors influencing the need for maintenance include: actual wastewater flows versus design flows, the volume of kitchen/domestic waste (excluding human waste and toilet paper), excessive household chemicals and other toxic liquids. The tank, absorption field and other system components should be visually inspected bi-annually for debris, damage, leaks, or other potential problems. In general, for a properly utilized system, septic tanks should be pumped and inspected every 2 - 4 years. The effluent filters should be cleaned every six months and at the time of pumping. Absorption fields should be maintained with suitable cover and kept free of root invasive plants. Positive surface dr9inage away from the absorption field should be maintained. Construction and Inspections Prior to construction of the permitted system the engineer should be contacted by the contractor and owner well in advance to provide adequate time to discuss the system components with the contractor, answer questions, resolve any conflict issues and schedule inspection site visits based on construction progress. County Regulations require that the Design Engineers of record perform site inspections of the permitted system during construction and provide "As -Built" documentation of the installed system to the County after construction is complete. The Regulations further require site inspections and approval by the County Environmental Health Department of the exposed components of the system prior to backfilling. Therefore the County Environmental Health Department should also be contacted and notified of the construction schedule. General Notes 1) All materials and installation practices shall conform to Pitkin County and the State of Colorado Individual Sewage Disposal Regulations. 2) All sewer lines and distribution lines in the system shall be SDR -35 PVC, Schedule 40 and/or HDPE SDR -9 unless specified otherwise on the plans. We conducted the investigation to evaluate subsurface conditions at the site and provide foundation recommendations for the proposed construction. Our report was prepared from data developed during our field exploration, laboratory testing, engineering analysis and our experience with similar conditions. This report includes a description of the subsurface conditions found in our exploratory pits, and presents our opinions and recommendations for design criteria for recommended foundations, floorsystems, and geotechnical and construction criteria for details influenced by the subsoils. The recommendations contained in this report were developed based on the currently planned construction. If plans will differ significantly from the descriptions contained herein, we should be informed so that we can check that our recommendations and design criteria are appropriate. A summary of our conclusions is presented below. SUMMARY OF CONCLUSIONS 1. Subsurface conditions encountered in our exploratory pits for the building consisted of about 2 feet of sandy clay "topsoil" and 2 feet of slightly clayey to clayey sand underlain by silty to sandy gravel. Shale bedrock was encountered at a depth of 6 feet (plan elevation 63 feet) in TP -1. 2. Our subsurface information indicates footings at plan elevation 65 feet or lower could require significant dewatering to construct. Design and construction criteria for footings are presented in the report. KEITH WEBSTER CONSTRUCTION LOT 4, CAPITOL WOODS SUBDIVISION 1 CTL/T JOB NO. GS -4073 4. We judge potential for differential movement will be low for slabs -on - grade supported by the undisturbed, native gravel or a maximum 3 feet thickness of densely compacted, structural fill. Below -grade areas that extend below plan elevation 65 feet will need to be designed as waterproof and to resist buoyancy forces. Floor slabs that are above plan elevation 65 feet should be provided with an underslab dewatering system. Additional discussion is in the report. 5. Surface drainage should be designed to provide for rapid removal of surface water away from the proposed residence. A foundation drain should be installed around below -grade areas that do not extend below plan elevation 65 feet. SITE CONDITIONS Capitol Woods Subdivision is located northwest of the intersection of Capitol Creek Road and East Sopris Creek Road. Lot 4 is bordered by Capitol Creek Road at the east and Capitol Creek at the west. An existing residence is on Lot 6 to the north of the subject lot. No structures are on the adjacent lot to the southwest. An existing driveway crosses Lot 4 and provides access to an existing residence on Lot 6. Ground surface on the east part of the lot slopes moderately down to the northwest. Relatively flat ground is in the west part of the lot, adjacent to the creek. The building envelope is in the west part of the lot (see Figure 1). Dense willows and hydrophilic vegetation were present in the building envelope. An easement for the individual sewage disposal system (ISDS) is in the north part of the lot. Dense brush was present in most of the east part of the site. A spring is south of the building envelope. PROPOSED CONSTRUCTION The Sharman Residence will be a two-story, wood -frame building with a detached garage. The main level of the residence will be structurally supported with a crawl space below. The garage floor is planned as a slab -on -grade. Foundation loads are expected to vary between 1,000 and 3,000 pounds per lineal foot of KEITH WEBSTER CONSTRUCTION LOT 4, CAPITOL WOODS SUBDIVISION 2 CTUT JOB NO. GS -4073 foundation wall with maximum interior column loads of 30 kips. We anticipate maximum foundation excavation depths on the order of 4feet deep. An individual sewage disposal system (ISDS) will be installed east of the residence. If construction will differ significantly from the descriptions above, we should be informed so that we can adjust our recommendations and design criteria, if necessary. SUBSURFACE CONDITIONS Subsurface conditions below the building footprint were investigated by excavating two exploratory pits (TP -1 and TP -2) with a backhoe at the approximate locations shown on Figure 1. Excavation operations were directed by our field representative who logged the soils encountered in the pits and obtained samples. Samples obtained in the field were returned to our laboratory where typical samples were selected for testing. Graphic logs of the soils encountered in our exploratory pits are shown on Figure 2. Subsurface conditions encountered in our exploratory pits for the building consisted of about 2 feet of sandy clay"topsoil" and 2 feet of slightly clayey to clayey sand underlain by silty to sandy gravel. Shale bedrock was encountered at a depth of 6 feet (plan elevation 63 feet) in TP -1. Observations during excavation indicated the sand was loose, the gravel was dense, and the shale bedrock was very hard. Free ground water was measured at depths of 4 and 6 feet (plan elevations 63 and 58 feet) in our exploratory pits for the building. The pits were backfilled immediately after excavation operations were completed. One sample of slightly clayey sand selected for gradation testing contained 29 percent gravel, 65 percent sand, and 6 percent silt and clay size particles. Gradation test results are shown on Figure 3. Results of laboratory testing are summarized on Table I. KEITH WEBSTER CONSTRUCTION LOT 4, CAPITOL WOODS SUBDIVISION J CTLIT JOB NO. GS -4C,73 SITE EARTHWORK Grading plans were not provided to us. Fill may be required to raise grades adjacent to the building. Areas which will receive fill should be stripped of vegetation, organic soils and debris. The on-site soils free of organic matter, debris and rocks larger than 6 inches in diameter can be used as fill outside the building footprint. Fill should be placed in thin, loose lifts of 8 inches thick or less, moisture conditioned to within 2 percent of optimum moisture content and compacted to at least 95 percent of standard Proctor (ASTM D 698) maximum dry density. Density and moisture content of fill should be checked by a representative of our firm during placement Structural fill may be required to raise the building above potential ground water elevation (plan elevation 65 feet). Structural fill should consist of a CDOT Class 6 aggregate base course or similar soil. A sample of the planned import structural fill soil should be submitted to our office for approval, prior to hauling to the site. Structural fill should be placed in loose lifts of 8 inches thick or less, moisture conditioned to within 2 percent of optimum moisture content, and compacted to at least 98 percent of ASTM D 698 maximum dry density. Our representative should observe placement and check density and moisture content of structural fill. We anticipate excavations in the overburden soils can be accomplished using conventional, heavy-duty excavation equipment. Excavations into the shale bedrock may require or be facilitated by blasting. Excavation sides will need to be sloped or braced to !meet local, state and federal safety regulations. We believe the on-site soils will classify as a Type C soils based on OSHA standards governing excavations. The shale will likely classify as stable rock unless a high degree of fracturing or unfavorable bedding result in a Type A or Type B classification. Temporary slopes deeper than 5 feet should be no steeper than 3/4to 1 (horizontal to vertical) in Type A soils, 1 to 1 in Type B soils, and 1.5 to 1 in Type C soils. Excavation sides can be near vertical in stable rock. Contractors should identify the KEITH WEBSTER CONSTRUCTION LOT 4. CAPITOL WOCDS SUBDIVISION CTL/T JOB NO. GS -4073 4 soils encountered in the excavations and refer to OSHA standards to determine appropriate slopes. DEWATERING As part of our investigation, we reviewed the relevant Flood Insurance Rate Map (08097C0066 C, dated June 4, 1987) published by the Federal Emergency Management Agency (FEMA). The map identifies the 100 year floodplain boundary of Capitol Creek adjacent to the subject lot. Base flood elevations were not indicated on the map. The 100 year floodplain boundary is also indicated on the Floodplain Study prepared by Louis H. Buettner surveying (see Figure 1). Based on ground surface contours on the flood plain study, base flood elevations will be between plan elevation 65 and 63 feet. Ground water levels at the site are directly affected by water levels in the creek. Free ground water was measured at depths of about 4 and 6 feet (plan elevations 63 and 58 feet) in our exploratory pits. Ground water levels vary with seasonal conditions and time of year. At this site, ground water will be closest to the ground surface during peak snow melt in spring months when water levels in the Capitol Creek are at seasonal highs. Based on the mapped flood boundary, our subsurface information, and our experience, we anticipate ground water at this site could rise to about plan elevation 65 feet during a 100 year flood event. Excavations below plan elevation 65 feet at this site could require significant dewatering, depending on the time of year and water levels in the creek. We recommend excavations for the building be made in late summer months when water levels have receded from seasonal highs. KEITH WEBSTER CONSTRUCTION LOT 4, CAPITOL WOODS SUBDIVISION 5 CTL/T JOB NO. GS -4073 FOUNDATION We recommend constructing the Sharman Residence on footing foundations supported by the undisturbed, native gravel soil or a maximum 3 feet thickness of densely compacted, structural fill. The completed foundation excavation should be inspected by a representative of our firm prior to placing forms to confirm that the exposed subsoils are suitable for support of the footings as designed. Recommendations for structural fill were presented in the SITE EARTHWORK section. We anticipate maximum total settlements of footing foundations supported on the native gravel or a maximum 3 feet thickness of densely compacted, structural fill on the order of 1 inch with differential settlement of about 1/2 total settlement. Recommended design and construction criteria for footings are presented below. 1. The footing foundations should be supported on the undisturbed, native gravel soil or a maximum 3 feet thickness of densely compacted, structural fill. Soils loosened during the excavation or forming process for the footings should be removed or the soils can be re -compacted prior to placing concrete. 2. Footings should be designed for a maximum allowable soil bearing pressure of 4,000 psf. 3. Continuous wall footings should have a minimum width of at least 16 inches. Foundations for isolated columns should have minimum dimensions of 24 inches by 24 inches. Larger sizes may be required, depending upon foundation loads. 4. Grade beams and foundation walls should be well reinforced, top and bottom, to span undisclosed loose or soft soil pockets. We recommend reinforcement sufficient to span an unsupported distance of at least 12 feet. Reinforcement should be designed by the structural engineer. 5. The soils under exterior footings should be protected from freezing. We recommend the bottom of footings be constructed at a depth of at least 42 inches below finished grades for frost protection. KEITH WEBSTER CONSTRUCTION LOT 4, CAPITOL WOODS SUBDIVISION CTL/T JOB NO. GS -4073 6 FLOOR SYSTEM AND SLABS -ON -GRADE The garage floor is planned as a slab -on -grade. Based on our laboratory test data and our experience, we judge slab -on -grade construction can be supported by the undisturbed, native soils or a maximum 3 feet thickness of densely compacted, structural fill with low risk of differential movement and associated damage. Structural II recommendations presented in the SITE EARTHWORK section should be followe . Below -grade areas that extend below plan elevation 65 feet will need to be designed as water proof and to resist buoyancy forces. A water proofing specialist should be consulted regarding design of areas that will potentially be under water for extendel�d- periods of time. Floor slabs that are above plan elevation 65 feet should be provideld with an underslab dewatering system. The below -slab drain system should consist of a washed rock layer with an embedded PVC drain pipe network as discussed in the SUBSURFACE DRAINAGE section. The most positive method to mitigate floor movement is the construction of a structural floor with an air space between the floor and the subgrade soils. The structural floor is supported by the foundation system. There are design and construction issues associated with structurally supported floors, such as ventilation and increased lateral loads, which must be considered. We recommend that floors in crawl spaces be located at plan elevation 65 feet or higher. A washed rock layer with an embedded PVC drain pipe network should be provided on crawl space floors. A vapor barrier should be placed on the washed rock surface. BELOW -GRADE CONSTRUCTION Foundation walls which extend below -grade should be designed for lateral earth pressures where backfill is not present to about the same extent on both sides of the wale. Many factors affect the values of the design lateral earth pressure. KEITH WEBSTER CONSTRUCTION LOT 4, CAPITOL WOODS SUBDIVISION 7 CTL/T JOB NO. GS -4073 These factors include, but are not limited to, the type, compaction, slope and drainage of the backfill, and the rigidity of the wall against rotation and deflection. For a very rigid wall where negligible or very little deflection will occur, an "at -rest' lateral earth pressure should be used in design. For walls which can deflect or rotate 0.5 to 1 percent of wall height (depending upon the backfill types), lower "active" lateral earth pressures are appropriate. Our experience indicates typical below -grade walls in residences can deflect or rotate slightly under normal design loads, and that this deflection results in satisfactory wall performance. Thus, the earth pressures on the walls will likely be between the "active" and "at -rest' conditions. If the on-site soils are used as backfill, we recommend design of below -grade walls using an equivalent fluid density of at least 50 pcf for this site. This equivalent density does not include allowances for sloping backfill, surcharges or hydrostatic pressures. The recommended equivalent density assumes deflection; some minor cracking of walls may occur. Backfill placed adjacentto foundation wall exteriors should be free of organic matter, debris and rocks larger than 4 inches in diameter. Backfill should be moisture conditioned to within 2 percent of optimum moisture content and compacted to at least 95 percent of standard Proctor (ASTM D 698) maximum dry density. SUBSURFACE DRAINAGE Foundation drains are normally installed to mitigate subsurface water problems in below -grade areas of buildings that are above ground water level. In our opinion, a foundation drain is not required around below -grade areas of the building thatwill extend below plan elevation 65 feet. Building areas below plan elevation 65 feet should be designed as waterproof and to resist hydrostatic uplift. KEITH WEBSTER CONSTRUCTION LOT 4. CAPITOL WOODS SUBDIVISION 8 CTL/T JOB NO. GS -4C73 We recommend installation of an exterior foundation drain around below - grade areas of the building that do not extend below plan elevation 65 feet. The exterior foundation drain should consist of 4 inch diameter, slotted, PVC pipe encased inree draining gravel. The drain should lead to a positive gravity outlet, or ump to a s�it where water can be removed by pumping. Installation of clean outs along the drain pipe is recommended. A typical foundation drain detail is presented on Figure 4. Slab -on -grade floors and crawl space floors above plan elevation 65 feet should be provided with drain systems. The drain systems should consist of 2 inch diameter, slotted, PVC pipe installed on 6 to 10 foot centers and imbedded in at least 6 inches of washed gravel. The washed rock should be covered with a vapor barrier. The pipes should convey water to perimeter drain collector pipes. Water collected should be discharged to a positive gravity outlet or to a sump pit where water can be removed by pumping. Ventilation is important to maintain acceptable humidity levels in crawl spaces. A recent trend in Pitkin County is to ventilate crawl spaces with treated air from the living areas of residences. The mechanical systems designer should consider humidity and temperature of air, and air flow volumes, during design of crawl space ventilation. It may be appropriate to install a ventilation system that is controlled by a humidistat. SURFACE DRAINAGE Surface drainage is critical to the performance of building foundations and floor slabs. We recommend the following precautions be observed during construction and maintained at all times after the residence is completed: 1. The ground surface surrounding the exterior of the residence should be sloped to drain away from the residence in all directions. Backfill around the exterior of foundation walls should placed be in maximum 8 inch thick loose lifts, moisture conditioned to within 2 percent of optimum moisture content and compacted to at least 95 percent of standard Proctor (ASTM D 698) maximum dry density. 3. The residence should be provided with roof gutters and downspouts. Roof downspouts and drains should discharge well beyond the limits of all backfill. Splash blocks and downspout extensions should be provided at all discharge points. 4. Landscaping should be carefully designed to minimize irrigation. Plants used near foundation walls should be limited to those with low moisture requirements; irrigated grass should not be located within 5 feet of the foundation. Sprinklers should not discharge within 5 feet of the foundation and should be directed away from the building. Irrigation should be limited to the minimum amount sufficient to maintain vegetation; the application of additional water will increase the likelihood of slab and foundation movements. 5. Impervious plastic membranes should not be used to cover the ground surface immediately surrounding the residence. These membranes tend to trap moisture and prevent normal evaporation from occurring. Geotextile fabrics can be used to control weed growth and allow some evaporation to occur. PERCOLATION TESTING We directed excavation of a profile pit (Profile) and three percolation pits (P-1 through P-3) in the area of the planned individual sewage disposal system (ISDS). The approximate locations of the pits are shown on Figure 1. Graphic logs of the soils encountered in the pits are shown on Figure 2. Shale bedrock and ground were encountered in the p we pit within 7 feet of the adsorption zone. A standard 1percolation field is not appropriate at this site. We understand a professional engineer qualified in septic design will design the individual sewage disposal system (ISDS) for the project. Iron -----negative Hydrogen sulfide -------20 ppm (we can assume sulfide bacteria to be present as well) Total dissolved solids -617 ppm PH — --6.0 Hardness 0 grains/gallon With the sulfide level at 20 ppm (very high), and the methane potential, I would recommend running the water from the well to a buried storage tank where the gases would be atomized for release to atmosphere via tank vent. We would also install a stainless circulation pump and venturi in the tank whereby we could inject ozone for tank storage oxidation, sanitation and freshening. This would be activated by the well circuit as well as by a timer which would activate to circulate ozone daily to freshen the tank in times of dormancy. The water would then be pumped into the house where it would pass through a backwashing filter to remove the oxidized material. This would be followed by a 1-5 micron filter for finer particulate removal. We will probably want to boost the pH, which measures now at 6.0. this is low enough to be aggressive to piping and mechanical systems, as well as leaching copper to the domestic supply. I think that this would bear a follow-up test before installing a pH balancing unit, though it seems pretty sure after running the well for a considerable time prior to sampling. This profile would indicate a high sodium content, and we can test for for a wider range of parameters if desired. I would strongly suggest installing a reverse osmosis water purifier for an optimum supply of drinkin /aookin , Ice water. Additionally, the Applicant has received a 404 permit from the Army Corps of Engineers to impact the wetlands within the proposed building envelope, and septic envelope. After further review from Staff, it has been determined that the entire lot is encumbered by Riparian vegetation and wetlands, and that a takings has occurred. The Applicant contends that the denial constitutes a taking of private property without just compensation. The Applicant is requesting 1041 Hazard Review, Conceptual Submission approval to establish a building envelope for the construction of a single-family residence. The proposed building envelope lies entirely within riparian and wetland areas, within which development is prohibited pursuant to Code Section 3-80-080. APPLICANT: Nancy Haywood McKenney REPRESENTATIVE: Wright Water Engineers, INC. and Mt. Daly Enterprises, LLC. LOCATION: The property is lot 4, Capitol Woods Subdivision. ZONING/LOT SIZE: The property is zoned R-30 and contains 1.27 acres. BACKGROUND: The Applicant submitted a 1041 Hazard Review application that was denied by the Hearing Officer on June 17, 2003 due to the inability of the Applicant to find a portion of the property free of 1041 Hazards. The proposed building envelope avoided all 1041 Hazards with the exception of riparian habitat and wetland areas. According the Applicant's representatives, the proposed envelope avoided the most critical habitat and wetlands. Additionally, the Applicant has received a 404 permit from the Army Corps of Engineers to impact the wetlands within the proposed building envelope, and septic envelope. The application was continued at the July 9, 2003, BOCC regular meeting due to some concerns from the County Attorney that a takings may not have occurred. After further review from Staff, it has been determined that the entire lot is encumbered by Riparian vegetation and wetlands, and that a takings has occurred. STAFF COMMENTS: The standard of review for a Board takings determination is identified in Section 3-290 of the Land Use Code, and reads as follows: "The Board shall determine whether the property owner will be denied all reasonable use and economic return on the property as a result of the questioned determination. If the Board determines that a taking has or may occur, it shall take such action as it deems appropriate to remedy the situation. In making its decision the Board shall consider the value of the property as a whole and shall not base its decision on the impact of the regulation on one portion of the ownership interest. In making its determination, the Board shall consider the beneficial uses which remain in the property notwithstanding the challenged determination and shall give due consideration to the reasonable investment - backed expectations of the landowner. " Section 4-150 of the Code requires that the Applicant submit the request for a takings hearing within 15 days of the decision and that the Board schedule a hearing within 15 days of the request. The Board is required to make a decision regarding the application for a taking determination within 15 days after the hearing on the matter. SUMMARY OF APPLICANT'S POSITION: In the attached letter, the Applicant requests a takings determination pursuant to Code section 4-150 and has included documentation that addresses Code section 5-220-010. The Applicant contends that the Hearing Officer's denial of the application has denied her all beneficial use and economic return on the property. ISSUES RELATED TO THE PROPOSED DEVELOPMENT: Issues related to the proposed development on the subject property have been fully addressed in staff's memorandum to the Hearing Officer dated June 9, 2003. The Hearing Officer, upon the finding that the proposed building envelope lies within riparian habitat and wetlands areas, denied the application pursuant to Section 3-80-080 (G) of the Land Use Code. SUMMARY OF RECOMMENDATION: Pursuant to section 3-290-020 of the Code, the Board shall consider whether or not a taking has occurred by virtue of the previous denial. The BOCC shall 1. Find that no taking has occurred because: A. The Applicant has no reasonable investment backed expectation to develop a new single-family residence in an area that contains riparian habitat and wetland areas; B. The Applicant has not been denied all reasonable use and economic return in connection with the denial of the development application; C. The Applicant does not have the right to the most profitable use of her property, which would require development in hazard areas. 2. Find that a taking has occurred because: A. The proposed building envelope is in the most suitable location on the property for development; and B. The denial constitutes a taking of all reasonable use and economic return from the subject property. RECOMMENDATION: The County Attorney has reviewed the application further and has determined that a taking has occurred. Staff recommends that the Board adopt a motion finding a taking has occurred and directing staff to prepare a resolution of remediation for review and adoption. STAFF COMMENTS GMQS: The parcel is located along Capitol Creek Road. The lot is within a BOCC approved subdivision (September 5, 1972), and, therefore, is exempt from growth management up to 5,750 square feet of floor area. 1041 HAZARD REVIEW & CONCEPTUAL SUBMISSION: Floodplain: The parcel runs along Capitol Creek, and is somewhat constrained by the 100 year floodplain of Capitol Creek. With the exception of the very Northwest corner, the building envelope avoids the 100 year floodplain. Wildfire: Scott Chism, RLA, Fire Assessment Advisor, has rated the wildfire hazard within the building envelope as low, due to the presence of wetlands and plant material with a relatively high moisture content. Development is permitted within Low and Medium wildfire hazard areas, subject to mitigation (pursuant to BOCC Ordinance No. 021-2002). Wildli e: Jonathan Lowsky, the Pitkin County Wildlife Biologist, states that the parcel is dominated by functioning riparian habitat that includes mature thin -leaf alder, Colorado blue spruce, twinberry honeysuckle, and a variety of other riparian species (see Exhibit A). Additionally, most of the proposed building envelope contains jurisdictional wetlands. It is important to note that, due to the presence of shared V easements and other 1041 hazards, there is no location that is going to be free of wetlands, and according to the Applicant, the proposed envelope is the most logical arrangement. The Applicant received a Section 404 permit from the U.S. Army Corps of Engineers in March of 2003 to impact 0.167 acres of wetlands within the building envelope, and 0.032 acres of wetlands within the septic envelope. However, according to Section 3-80-080(G), of the Pitkin County Land Use Code, development is prohibited within riparian and wetland areas. Geologic: The proposed building envelope is relatively flat and containsslopes of less than 15%. The eastern portion of the parcel contains slopes in excess of 15% and 30% slopes. The proposed building envelope is located in the alluvium of Capitol Creek. According to the Applicant, the primary_eolo is hazard is high groundwater and flooding. Foundation design will reflect those potential hazards. Access: The property is accessed from Capitol Creek Road on an existing drive. The existing driveway accesses Lot 6, and will easily accommodate access to the Applicants building envelope. It should be noted that the existing access was done without an access permit, and is outside of the platted driveway easement for Lots 4 and 6. The platted driveway easement could not be utilized, however, due to the existing slope issues. The County Engineer has recommended that the Applicant apply for a Pitkin County Access Permit for the existing driveway, and remove the old driveway easement off of the recorded Plat. Water & Sewer: Water is available from the existing spring on the parcel for which the Applicant has _rights for domestic use. The Applicant proposes to utilize the existing septic easement for a septic system which would comply with Pitkin County standards. RECOMMENDATION: Staff recommends denial of the McKenny 1041 Hazard Review based on Section 3-80-080 of the Pitkin County Land Use Code which prohibits development in riparian and wetland areas. For Lot 4, the servicing septic system will not be placed in "waters of the United States." Figure 2A is the proposed two-level house plan for this activity. Other than the no action alternative, other alternatives considered, but discounted are summarized as follows: 1) easement constraints limiting lot development to two smaller (less than 1000 square -feet each) non-contiguous areas bounded by Capitol Creek's floodplain and steep slopes greater than 30 percent (depicted in Figure 3), 2) a one -level house plan with similar square -footage as a two-level plan, but with increased impact to wetlands (0.287 acre compared to 0.205 acre for the preferred two-level plan), and 3) purchase of adjacent property for a re -located residential development is not practicable as none is available for purchase, is already developed or may not reduce the amount of impacts, if ever available for purchase. AREA DESCRIPTION: Lot 4 of the Capitol Woods Subdivision is situated within two distinct wetland types; forested and scrub -shrub wetlands. Generally, wetlands encompass the center portion of the lot, with a steep slope on the east side of the lot, recorded easements for a water line and leach field, an existing driveway, and mature trees on the southern end of the lot. The result is approximately 2,000 square -feet outside of these constraints in two areas that is available for development. The forested wetland, which occurs toward the southern end of the lot, is dominated b/hin-leaf alder (Alnus tenuifolia), honey suckle (Lonicera involucrata) and yellow willow (Salix lutea), with beaked sedge (Carex utriculata), arctic rush (Juncus arcticus) and wintergreen (Pyrola rotundifolia) in the understory. The scrub -shrub wetland, which is somewhat drier, occurs around the west and northeast sides of the forested wetland and is dominated by coyote willow (Salix exigua), Drummond willow (Salix drummondiana), Nebraska sedge (Carex nebrascensis), beaked sedge and arctic rush. Both wetland types are sustained by shallow groundwater and possibly over -bank flooding from Capitol Creek, and provide function for flood storage, groundwater discharge/recharge and wildlife. Additionally, the area of mature trees on the southern portion of the lot exist within the wetlands and represent the highest quality wetlands on Lot 4. ADDITIONAL INFORMATION: The applicant has requested water quality certification from the Colorado Department of Public Health and Environment, Water Quality Control Division in accordance with Section 401 of the Clean Water Act. THE DUPLEX PUMP ASSEMBLY COMPONENTS SHALL INCLUDE THE BIO -TUBE VAULT, A COLD WEATHER DRAW DOWN DUPLEX DISCHARGE PLUMBING ASSEMBLY WITH FLEX HOSE, PIPE, AND AUTOMATIC CONTROLS WITH ALARMS AS PACKAGE COMPONENTS IN THE PUMP VAULT ASSEMBLY. INSTALL WATERTIGHT RISERS CENTERED OVER THE ACCESS PORTS TO EASILY INSPECT AND MAINTAIN SYSTEM COMPONENTS FROM THE SURFACE. USE INSULATED ACCESS LIDS. 3. INSTALL ISOLATION BALL VALVES AND CHECK VALVES ON EACH PUMP DISCHARGE LINE. INSTALL QUICK DISCONNECT THREADED COUPLERS ON EACH PUMP DISCHARGE LINE. EXTEND DISCHARGE LINE UP TO WITHIN 12" OF THE ACCESS LID TO PROVIDE EASY ACCESS FOR MAINTENANCE OF THE PUMP. 4. A SINGLE DISCHARGE PIPE (TRANSPORT LINE) INSTALLED FROM THE PUMP BASIN RISER AT THE SEPTIC TANK TO THE DISTRIBUTION HEADERS SHALL BE INSTALLED FROM A TEE CONNECTED TO EACH PUMP'S COLD WEATHER APPLICATION DISCHARGE PLUMBING ASSEMBLY. AFTER THE PRESSURR DOSE IS COMPLETED GRAVITY DRAINBACK OF EFFLUENT TO THE BASIN WILL OCCUR THROUGH THE 1/8" ORIFICES IN EACH PUMPS DISCHARGE PLUMBING ASSEMBLY. 5. THE PUMP DISTRIBUTION TRANSPORT LINE SHALL BE INSTALLED TO DISCHARGE EFFLUENT TO THE ABSORPTION FIELD THROUGH THE SOLID HEADER PIPE THAT CONNECTS TO EACH 4" PERFORATED DISTRIBUTION PIPE. THE PRESSURE LINE CONNECTION FITTING ON HEADER PIPE SHALL BE AT A HIGH POINT TO ALLOW GRAVITY DRAINAGE BACK TO THE PUMP BASIN. THE EFFLUENT WILL EQUALLY DISCHAGE OUT OF THE 1 1/4" HEADER PIPE LINE THROUGH APPRORIATE BUSHINGS AND REDUCERS TO THE 4 INCH PERFORATED DISTRIBUTION LINES. THE INVERT OF THE PRESSURIZED TRANSPORT LINE FITTING AT THE 1 1/4" HEADER PIPE SHALL BE AT LEAST 2" ABOVE THE INVERT OF THE PERFORATED DISTRIBUTION LINES. 6. THE DOSING VOLUME SHALL BE 40-75 GALLONS PER DOSING CYCLE. THE APPROXIMATE DRAWDOWN IN THE SECONDARY TANK COMPARTMENT IS 6". 7. INSTALL PUMPS ASSEMBLIES, RISERS, ELECTRICAL SYSTEMS, FLOATS AND DISCHARGE LINE PER MANUFACTURES INSTALLATION GUIDELINES. USE AN ORENCO SYSTEMS MODEL P100511 W/ 4" FLOW CONTROLLER. THE SYSTEM SHALL BE INSPECTED BY A QUALIFIED TECHNITION EVERY SIX MONTHS. 8, ALL INSTALLATION AND MAINTENANCE SHALL BE PERFORMED BY A QUALIFIED PERSON IN ACCORDANCE WITH THE INSTALLATION & MAINTENANCE GUIDELINES FOR THE ORENCO SYSTEMS BIO -TUBE VAULT PUMP ASSEMBLY. g, THE EFFLUENT WILL DISCHAGE FROM THE PUMP THROUGH A 1 1/4" LINE TO A 1 1/4- HEADER PIPE WITH FOUR 1 1/4" DISTRIBUTION LINE TEES CONNECTED TO THE 4" PERFORATED DISTRIBUTION PIPES RUNNING THE LENGTH OF THE BED. THE INVERT OF THE EFFLUENT DISCHARGE LINE 11 AT THE PUMP BASIN OUTLET PORT SHALL BE AT LEAST 24" BELOW THE ENLECTRIAL TNHWSERFORATED DISTRIBUTION LINES. 1. AN ORENCO SYSTEMS PUMP CONTROL PANEL SHALL BE INSTALLED BY THE ELECTRICIAN IN COORDINATION WITH SCG. THE POWER SUPPLY FOR THE PUMPS AND CONTROLS SHALL CONSIST OF (2) 20 AMP CIRCUITS FOR THE PUMPS AND (1) 10 AMP CIRCUIT FOR CONTROLS. PROVIDE LINE OF SITE DISCONNECT WITH CONTROL BOX. 2. THE ELECTRICIAN SHALL INSTALL ELECTRICAL WIRES IN CONDUIT FROM THE CONTROL PANEL TO THE PUMP ASSEMBLY IN THE PUMP BASIN IN THE SEPTIC TANK. INSTALL COLOR CODED WIRES PER CONTROL PANEL DIAGRAM.
