Home My WebLink Aboutbocc.con.341.2015 • 1 EMPLOYMENT AGREEMENT CHIEF DEPUTY CLERK THIS AGREEMENT, made and entered into January 12th, 2015, by and between Pitkin County, Colorado, a body politic and corporate, (hereinafter the "County") on behalf of the Pitkin County Clerk and Recorder, (hereinafter the "County Clerk's Office"), and Linda Gustafson, (hereinafter"Gustafson"). RECITALS 1. The County has offered employment to Gustafson as a Chief Deputy Clerk, which offer is acceptable to Gustafson,and; • 2. The Parties have agreed to certain terms and conditions of employment that they wish to memorialize herein, NOW, THEREFORE, in consideration of the mutual promises set forth below, the sufficiency of which is acknowledged by both parties,it is agreed as follows: 1. Scope of Duties. As a Chief Deputy Clerk, Gustafson shall assist the County Clerk in duties and obligations she directs. Gustafson' primary responsibility will provide knowledge transfer to the full-time Recording Manager,full-time and part-time Clerk and Recorder Specialists in the Recording Department to assure succession planning; write a Recording Department Process and Procedures Manual and Training Manual that defines training requirements and timelines for all recording positions; in working with the Pitkin County Procurement Officer and Business Systems Analyst, oversee the RFP, selection process, purchase and implementation of a new recording system; and,research, design and implement an imaging project for all recording records back to 1881 in conjunction with the new recording system acquisition. During 2015,Linda will be required to conduct final verification until such time that the Recording Manager is trained and competent to perform final verification of all documents; knowledge transfer will take place to train the Recording Manager hired in early October 2014, Recording Specialist hired in early April 2014, a Recording Specialist anticipated to start in early April 2015, and the part-time back-up specialist who has assisted the Recording Dept. since September of 2013. During the first six months of 2015, Linda will also be working on the recording process and procedures manual and training manual,if time permits based on staffs ability to learn to index and verify documents effectively, otherwise it will be pushed back to the second six months. Because recording legislation may move forward during the 2015 session that will address a state level RFP for recording system(s),Linda will begin work in May regarding the recording system RFP process, incorporating the strategy for the imaging project. • • 2. Terms of the Agreement. The term of this agreement shall be for one year from the date of initiation, which date shall be January 12, 2015. The position has received budgetary approval for two and one half years. a. Base Salary The County shall employ Gustafson in the position of Chief Deputy Clerk. Gustafson's salary will be remunerated at a base.compensation level of$59,498.40 per annum($38.14 x 30 hrs.per week.x 52 weeks per year). This compensation shall be paid in the same manner as any other Pitkin County employee as provided for in the Personnel Policies and Procedure Manual as that manual may be modified from time to time. This salary shall be increased annually by a cost of living adjustment (COLA) equal to the COLA as provided for county employees on the first regular pay period of each year. • b. Benefits Gustafson will receive all benefits contained within the Pitkin County Personnel Policies and Procedure Manual, including Health with the exception of those benefits contained_in-the Pitkin County Employee Handbook concerning standards of conduct and performance counseling. j ref A'-c x ts. ► ei.67,11n 0ti cd,' /I c. Vacation Gustafson shall accrue vacation time in an amount allowable and as calculated in the Personnel Policies and Procedures Manual. Gustafson will be subject to the same vacation maximum limits as any other Pitkin County employee as provided in the Pitkin County Policies and Procedures Manual. • d. Absence from Work Gustafson shall not take any vacation leave or administrative leave without prior consultation and approval of the County Clerk. e. Severance Compensation Should the contract be canceled by the County, at any time after nine months employment, and Gustafson's employment be terminated, Gustafson shall be entitled to an amount of severance pay equivalent to one months salary at the rate of payment existing at the time of cancellation of the contract and termination of employment. Both parties recogru e and acknowledge that this Contract cannot be cancelled nor Gustafson terminated for acts,which are constitutionally protected, or for reasons that violate Gustafson's civil rights. 3. Applicability of Personnel Policies. Pursuant to this Agreement, the personnel policies set forth in the Pitkin County Personnel Policies and Procedures Manual shall be applicable to Gustafson,with the exception of the-Grievance/Appeal Procedures. 4. Cancellation of the Agreement. a. Gustafson may cancel this Contract and terminate her employment with 30 (thirty)days prior written notice to the County Clerk. 2 • b. Gustafson serves as a Chief Deputy Clerk and receives benefits under this Contract at the pleasure of the County Clerk. The County Clerk may, at any time during any term of this Contract, cancel this Contract and terminate Gustafson's employment with or without cause. If determination is based on cause,the determination shall be detailed in written form. 5. Assignability. This Agreement is not assignable by either party and may only be modified or amended in writing,signed by both Gustafson and the County. 6. Annual Appropriations. The financial obligations of the County contained in this contract are subject to annual appropriation of funds by the BOCC acting in its governmental capacity. 7. Agreement made in Colorado. The parties agree that this agreement was made in accordance with the laws of the State of Colorado and shall be so construed. Venue is agreed to be exclusively in the Pitkin County District Court for the State of Colorado. 8. Attorney's Fees. In the event legal action is necessary to enforce or interpret any of the provisions of this contract, the substantially prevailing party shall be entitled to its costs and reasonable attorney's fees. 9. Contract. All prior contracts and agreement between the parties are deemed to be cancelled and of no effect except as otherwise provided herein. 10. Renewal. This contract will automatically renew for a successive one year term, and one, one half year term unless cancelled by either party as provided. 11. Signatures. This agreement may be executed in duplicates, and facsimile signatures shall have the same force and effect as original signatures.
