REQUEST: The Applicant is requesting Activity Envelope and Site Plan Review approval to construct an
addition to an existing single-family residence.
The application has been forwarded to the Hearing Officer for consideration, based on objections and
concerns raised by adjacent property owners Merle Rambo, and Clas Nilstoft. The letters are attached.
Pursuant to Section 2-30-20(g)(2)(b)(4) of the Land Use Code, an objection to the Activity Envelope and
Site Plan request was received and the application has been continued to a public hearing before the Hearing
Officer.
APPLICANT: 97 Mountain Laurel Court Partners LLC

LOCATION: 97 Mountain Laurel Court, Block 2, Lot 79 of Mountain Valley Subdivision
ZONING/LOT SIZE: R -15A
BACKGROUND/EXISTING CONDITIONS: The lot was legally created in 1965 with the creation of
the Mountain Valley Subdivision as recorded in Plat Book 3 at Page 36. In 1977 the lot was developed with
a single-family residence and contains approximately 2,886 square feet of floor area.
REFERRAL AGENCIES: The application was referred to the Mountain Valley HOA, Planning
Engineer, Environmental Health Department, Colorado Parks and Wildlife, and Aspen Fire Protection
District. Comments were received from each of the agencies and are included in Attachments D -H.
ACTIVITY ENVELOPE REVIEW: Request for Activity Envelope and Site Plan approval must comply
with the provisions and policies of Chapter 7.
The Applicant has proposed to establish an Activity Envelope to include existing and proposed
development, improve driveway access per Aspen Fire Protection District request, and to construct an
addition to include a bedroom, bathroom, garage, and terraces. The total gross floor area will be
approximately 4,759 square feet. The Applicant is also proposing to connect to the City of Aspen Water and
abandon use of the existing well.
OBJECTION: Merle Rambo, and Clas Nilstoft have objected to the proposed Activity Envelope and Site
Plan application. The objection letters are found in Attachments A and B.
STAFF COMMENTS:
ACTIVITY ENVELOPE CRITERIA FOR APPROVAL:
SITE PREPARATION AND GRADING:
• Grading: All grading and fill placement will occur within the Activity Envelope.
• Clearing, Grubbing and Vegetation Removal: All clearing, grubbing and vegetation removal will
occur within the designated Activity Envelope.
• Tree Removal and Mitigation: The Applicant agrees to comply with the mitigation requirements.
• Protection of Natural Terrain: The Applicant agrees to comply with the standards in the Code to
protect the natural terrain and other natural features of the landscape.
STEEP AND POTENTIALLY UNSTABLE SLOPES: The Activity Envelope primarily contains slopes less
than 30%. The addition will extend west, south, and slightly east onto slopes of 30-45%. Areas
contiguous to slopes containing less than 30% which contain slopes of 30% or greater (but not exceeding
45%) may be used for development pursuant to Sec. 7-20-20(c)(1)(a) through (d).
HP Kumar conducted a geotechnical review of the site and concluded in their report dated May 25, 2017,
and letter dated August 18, 2017, that the 30-45% slopes are adequate to support the proposed development
and will not increase the potential for slope failure with proper design and construction as outlined in the
May 25t'', 2017 report.

At building permit, the Applicant will be required to demonstrate that the structural plans are engineered to
comply with the HP Kumar report recommendations and will further be reviewed for approval by the
Planning Engineer.
WATER COURSES AND DRAINAGE: The Applicant commits to adhere to all of the Code provisions
pertaining to water courses and drainage, sediment and erosion control, irrigation and groundwater, and to
demonstrate compliance at the time of building permit application. No encroachment or channeling
activities will occur.
WILDFIRE: The wildfire hazard is mapped as low. The Applicant will comply with the Code's standards
for development in a low wildfire hazard area. The Aspen Fire Protection District reviewed the proposed
Activity Envelope and Site Plan and recommended removing the soil sloughing off of the adjacent slope
onto Mountain Laurel Court, cutting back young Aspen encroaching on Mt. Laurel Court, widening the
driveway entrance to 16 feet, and modifying the driveway turning radius to 29 feet. The Applicant has
committed to making the requested improvements.
WILDLIFE: The lot is within mapped elk winter range, and is within 1/4 mile of mapped elk severe winter
range, and 1/2 mile of an elk migration corridor, however, the addition will not create additional impacts on
wildlife habitat. Colorado Parks and Wildlife ("CPW") reviewed the application and did not provide
mitigation recommendations regarding the mentioned mapped habitat. CPW noted concern for bear
conflicts in the area and requested measures be taken to minimize bear conflicts. The applicant will be
required to comply with Sec. 7-20-70 to mitigate wildlife impacts including bear conflicts.
SCENIC VIEW PROTECTION AREA: These standards are designed to minimize the visual impact of new
development when viewed from designated road corridors. Section 7-20-120(d) addresses standards for
development within a Scenic View protection area.
The parcel is within the mapped Scenic View Protection Area ("SVPA") as viewed from Highway 82.
However, the lot is not visible from Highway 82 due to the distance and topography between the road and
the lot.
RECOMMENDATION: Staff believes the application complies with all applicable sections of the Land
Use Code for Site Plan and Activity Envelope Review and recommends that the Hearing Officer approve
the 97 Mountain Laurel Ct Partners LLC Activity Envelope and Site Plan, subject to the attached
Determination.

DEPARTMENT OF PITKIN COUNTY, COLORADO, APPROVING THE 97 MOUNTAIN
LAUREL CT PARTNERS LLC ACTIVITY ENVELOPE
Determination No. -2018
RECITALS
1. 97 Mountain Laurel Ct Partners LLC (hereafter "Applicant") has applied to the Community
Development Director of Pitkin County ("Director") for Activity Envelope and Site Plan Review
approval to construct an addition to a single-family residence.
2. The application has been forwarded to the Hearing Officer for consideration, pursuant to Section 2-30-
20(g)(2)(b)(4) of the Land Use Code, based on objections raised by Merle Rambo, and Clas Nilstoft.
3. The lot is located at 97 Mountain Laurel Ct., and is described as Block 2, Lot 79 of Mountain Valley
Subdivision. The parcel identification number is 273717307045.
4. The lot contains 16,869 square feet and is conforming in size in the R -15A zone district.
5. The Mountain Valley Subdivision was created in 1965 as recorded in Plat Book 3 at Page 36. In 1977
the lot was developed with a single-family residence and contains approximately 2,886 square feet of
floor area.
6. The proposed addition will include a bedroom, bathroom, garage, and terraces. The total gross floor area
will be approximately 4,759 square feet.
7. The application was referred to the Mountain Valley HOA, Planning Engineer, Environmental Health
Department, Colorado Parks and Wildlife, and Aspen Fire Protection District. Comments were received
from each of the agencies and are incorporated herein.
8. The Hearing Officer finds that the proposed Activity Envelope and Site Plan are consistent with the
applicable requirements of the Code, as follows:
A. The Activity Envelope primarily contains slopes less than 30%. The addition will extend west,
south, and slightly east onto slopes of 30-45%. HP Kumar conducted a geotechnical review of the
site and concluded in their report dated May 25, 2017, and letter dated August 18, 2017, that the
30-45% slopes are adequate to support the proposed development and will not increase the potential
for slope failure with proper design and construction as outlined in the May 25r'', 2017 report.
B. The wildfire hazard is rated as low, and can be mitigated pursuant to the provisions of Sec. 7-20-
60(c) of the Code. To improve emergency access, Aspen Fire Protection District recommends and
the Applicant commits to removing the soil sloughing off of the adjacent slope onto Mountain Laurel
Court, cutting back young Aspen encroaching on Mt. Laurel Court, widening the driveway entrance
to 16 feet, and modifying the driveway turning radius to 29 feet.
C. The lot is mapped within an elk winter range, 1/4 mile of elk severe winter range, and % mile of an elk
migration corridor, however, the addition will not create additional impacts on wildlife habitat.
Colorado Parks and Wildlife reviewed the application and recommended bear conflict mitigation.
No additional recommendations were provided. The Applicant will comply with the applicable
wildlife mitigation standards in Sec. 7-20-70.

D. The property is within the scenic view protection area as viewed from Highway 82. The lot is not
visible from Highway 82 and will not project above a ridgeline.
9. The Hearing Officer further finds that the Mountain Valley HOA approved the plans pursuant to the
HOA design standards.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Community Development Hearing Officer
that he does hereby approve the 97 Mountain Laurel CT Partners LLC Site Plan Review, subject to the
following conditions, which shall run with the land and be binding on all successors in interest.
The Applicant shall adhere to all material representations made in the current or prior applications or
in public meetings or hearings and shall consider those representations to be conditions of approval,
unless amended by other conditions.
2. Prior to submission of any future building permit applications, the Applicant shall be required to
submit for approval by the County Attorney and Community Development a Site Plan with an
Activity Envelope in accordance with Land Use Code Section 2-30-20(g) and Application
Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to
finalization and recordation.
3. Pursuant to Sec. 5-10, the Lot may develop up to 3,500 square feet of floor area; 4,000 square feet
of exempt sub -grade space; 750 square feet of exempt garage space. 5,750 square feet of gross
floor area is exempt from growth management. The use and approval of transferable
development rights (TDRs) or growth management allocations is required to exceed 5,750 square
feet and to develop up to 8,250 square feet of gross floor area.
4. With a building permit application, the Applicant shall:
A. Submit a copy of this recorded Hearing Officer Determination and the recorded Activity
Envelope and Site Plan.
B. Obtain a tap permit and pay the applicable fees to the Aspen Water Department.
C. Obtain the applicable Aspen Consolidated Sanitation District permit for the addition.
D. Demonstrate abandonment of the existing well.
E. Submit an access permit for the driveway improvements, which shall be approved by the
Planning Engineer and Aspen Fire Department.
F. Submit a site specific drainage and erosion control plan and accompanying drainage report to be
approved by the Planning Engineer. The drainage and erosion plan shall show all temporary
erosion control BMPs to be installed during construction. The drainage report shall demonstrate
that historical flow patterns and runoff amounts will be permanently maintained.
G. Demonstrate that the proposed development complies with the geotechnical recommendations
outlined in HP Kumar's report and letter dated May 25, 2017 and August 18, 2017.
H. Submit a revegetation/landscaping plan for disturbed areas with appropriate native seed mixes.
I. Submit a tree mitigation plan if any trees with larger than 6" DBH are to be removed.
J. Submit an exterior lighting plan with the corresponding fixture cut sheets. Exterior lighting
shall comply with the lighting code.
K. Obtain a fireplace/woodstove permit from the Community Development Department, if
applicable.
5. Prior to building permit issuance, the Applicant shall pay the applicable road and employee housing
impact fees.

6. The Applicant shall provide adequate engineering of any retaining walls over four (4) feet in
height and/or any improvements to walls over four (4) feet in height. All retaining walls shall be
a maximum of seven (7) feet tall.
7. Construction noise shall comply with County Code Sec. 6.36.030.
8. The Applicant shall comply with the applicable codes and requirements of the Aspen Fire Protection
District, including but not limited removing soil sloughing off of the adjacent slope onto Mountain
Laurel Court, cutting back young Aspen encroaching on Mt. Laurel Court, widening the driveway
entrance to 16 feet, and modifying the driveway inside turning radius to 29 feet.
9. The Applicant shall comply with the following landscaping and wildfire defensible space mitigation
standards:
A. Defensible Space: The area around all buildings/structures, limited by property boundaries
that may limit a property owner's ability to comply with this section, shall incorporate
landscaping with wildfire defensible space considerations as follows (note: actual vegetation
manipulation to meet these conditions may not be necessary where the natural vegetation
patterns have already fulfilled these conditions):
1) Brush, debris, and non -ornamental vegetation shall be removed within a minimum 10 -foot
perimeter around the structure.
2) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels for
a minimum of a 30 -foot perimeter around the structure.
3) Spacing between clumps of brush and vegetation within the 30 -foot perimeters shall be a
minimum of two times the height of the fuel. Maximum diameter of the clumps shall not
exceed 10 feet. All measurements shall be from the edges of the crowns of the fuel.
4) All branches from trees and brush within the 30 -foot perimeter shall be pruned to a height of
10 feet above the ground and ladder fuels from around trees and brush shall be removed.
5) Tree crown separation within the 30 -foot perimeters shall have a minimum of 10 feet
between the edges of the crowns.
6) All branches that extend over the roof eaves shall be trimmed and all branches within 15 feet
of the chimneys shall be removed.
7) The density of fuels within a 100 -foot perimeter of the structures shall be reduced.
8) All deadfall up to a 100 -foot perimeter shall be removed.
9) No new conifer trees shall be planted within 10 feet of a residence.
10) No flammable mulches shall be placed within two feet of a residence.
11) The applicant shall be responsible for the continued maintenance of the defensible space
vegetation requirements.
B. Roofing Materials: Roofs shall be constructed with a Class A roof covering or a Class A
assembly as defined in the building code. Wood shake/shingle roof coverings are prohibited.
Roofs with less than a 3:12 pitch are not permitted unless they comply with the following:
1) All roof coverings shall be constructed of non-combustible materials and installed on a
Class A roof assembly.
2) All roof coverings shall have a surface that shall facilitate the natural process of clearing
the roof.
3) All roof designs shall facilitate the natural process of clearing debris. Protrusions above
the roofline, such as parapets, shall be prohibited.

4) Roofs shall be installed as required by the approved building code and shall have a
minimum slope of 1:48.
5) All roof designs, coverings or equivalent assemblies shall be specifically approved by the
Fire Marshal prior to submittal of a building permit application.
C. Additional wildfire mitigation standards:
1) Vents shall be screened with corrosive resistant wire mesh with mesh'/4 inch maximum.
2) Roofs and gutters shall be kept clear of debris.
3) Yards shall be kept clear of all litter, slash, and flammable debris.
4) All flammable materials and firewood/wood piles shall be stored on a parallel contour a
minimum of 15 feet away from any structure.
5) Non -saltwater swimming pools or ponds shall be accessible to Fire Department vehicles.
6) Fences shall be kept clear of brush and debris.
7) Wood fences shall not connect to the structure.
8) Fuel tanks shall be installed underground with an approved container.
9) Propane tanks shall be installed according to NFPA 48 standards and on a contour away
from the structure with standard defensible space vegetation mitigation around any above-
ground tank. Any wood enclosure around the tank shall be constructed with materials
approved for 2 -hour fire -resistive construction on the exterior side of the walls.
10) Each structure shall have a minimum of one 10 pound approved ABC fire extinguisher
placed in a visible and accessible location.
11) Addresses shall be clearly marked with 4 -inch non-combustible letters and shall be visible
and installed on a non-combustible post.
12) New utility lines shall be buried within the activity envelope.
10. The Applicant shall comply with the following conditions to mitigate impacts on wildlife:
A. Native vegetation shall be maintained outside of the activity envelope.
B. Landscaping shall not include nut, berry or fruit producing trees or shrubs palatable to bears.
C. Contractors/construction workers shall be required to provide bear proof containers for all
edible and food related trash.
D. Contractors are prohibited from bringing their dogs on-site.
E. Trash/garbage shall be kept in an approved bear resistant container or enclosure as required
by the County's Wildlife Protection Ordinance.
F. All outside doors shall utilize only solid round handled doorknobs unless another type is
required by the applicable building code for disabled accessibility purposes.
G. Bird feeders, including hummingbird feeders, shall be hung away from any deck or window,
and shall be at least 10' from the ground suspended between 2 trees or posts. All seed feeders
shall include a seed catchment pan to catch discarded seeds. Bird feeders should be removed
from April through November.
H. Wood rail perimeter fencing shall employ three rails or less, be the round or split rail type,
shall not exceed 54 inches in height above ground level and 12 inches in width (top view),
and shall have at least 18 inches between the lower two rails.
I. Wire fencing must be three (3) strands or less. The top wire should be a twelve -point -five
(12.5) gauge twisted barbless type at a maximum height of forty-two (42) inches. The
middle strands (which may be barbed) should be located a minimum twelve (12) inches
apart and from the top wire preventing entanglement when mule deer jump over. The bottom
strand should be sixteen (16) inches from the ground.
11. The Applicant shall comply with the County's Noxious Weed Management Plan.

12. All plants used for landscaping and revegetation shall be native species. Areas disturbed by
construction shall be re -vegetated within one growing season of the project's completion.
Landscaping shall be installed prior to issuance of the Certificate of Occupancy for the residence.
13. No development including grading, excavation, fill placement, berming, landscaping, vegetation
removal or disturbance, shall occur outside of the approved activity envelope, except as necessary
to comply with the wildfire mitigation measures described above, or for tree removals approved
pursuant to Section 7-20-130.
14. Prior to commencement of any earthmoving or other construction activity, the Applicant shall
stake the corners of the activity envelope and install construction fencing around the construction
site within the perimeter of the activity envelope. The fencing shall remain in place until issuance
of a Certificate of Occupancy.
15. No development in excess of 30" above or below natural grade shall occur within the setbacks of
the lot, with the exception of driveways and associated retaining walls of up to 6' above or below
natural grade and fencing. Landscaping in the form of berms shall not exceed four feet from the
most restrictive grade. Any development located within setbacks mandated by County zoning
regulations that does not comply with these restrictions shall require a variance from the Board of
Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a
variance.
16. No calculations for height, bulk, setback, size, floor area, or any other building and zoning
requirements have been conducted. These requirements will be considered at the time of building
permit. Any structures represented in the application may not be permitted under building and
zoning regulations.
17. Failure to comply with the conditions of this approval may result in revocation of this approval,
or any subsequent permit(s) or approval(s) related to this property, or vested rights associated
with this property.
18. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County
Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land
Use Code, § 2-20-170 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall
expire on , 2021.

Good Morning, Tami!
I am writing as the owner of 98 Mountain Laurel Court. As an architect, I am pleased to have worked with the
Department on that project and with your colleagues and the County Board over recent years. I also appreciate the
efforts of your team to date on this proposed project next to my home.
I would like to take this opportunity to request that the matter of the request for 97 Mountain Laurel Court be set for
future Hearing to hopefully allow for encouragement of the applicant to consider the input of the neighbors prior to a
nod on approval.
I recognize that the applicant seems to have met the Notice requirements, but also that neither the applicant nor the
HOA appear to have made any effort to include those actually adversely effected by the proposed project that
underlies the requested approval. I am currently awaiting a return call from the applicant's architect. A representative
of the MVHOA also requested that communication and to be a part of getting together, though was told it could not
happen until a date that just happens to be after the deadline to request a Hearing. While other levels of approval
remain, perhaps this is a proper time to promote better communications.
Among other things, if approved as currently conceptualized (as now seen in the applicant's drawing phases beyond
this initial review/approval), their project will more than double the amount of view blocked by the current home on the
subject site. As an architect, I realize that it is still possible to mitigate this profound impact without destroying the
design concept, and likely at a better economy for the owner.
While further technical review may reveal other shortcomings regarding requirements, I believe that now is the time to
encourage available resolutions, and that the pause of a few weeks for a Hearing may be helpful to all.

I am writing as the owner of 98 Mountain Laurel Court. As an architect, I am pleased to have worked with
the Department on that project and with your colleagues and the County Board over recent years. I also

neighbors prior to a nod on approval.
I recognize that the applicant seems to have met the Notice requirements, but also that neither the
applicant nor the HOA appear to have made any effort to include those actually adversely effected by the
proposed project that underlies the requested approval. I am currently awaiting a return call from the
applicant's architect. A representative of the MVHOA also requested that communication and to be a part of
getting together, though was told it could not happen until a date that just happens to be after the deadline
to request a Hearing. While other levels of approval remain, perhaps this is a proper time to promote better
communications.
Among other things, if approved as currently conceptualized (as now seen in the applicant's drawing
phases beyond this initial review/approval), their project will more than double the amount of view blocked
by the current home on the subject site. As an architect, I realize that it is still possible to mitigate this
profound impact without destroying the design concept, and likely at a better economy for the owner.
While further technical review may reveal other shortcomings regarding requirements, I believe that now is
the time to encourage available resolutions, and that the pause of a few weeks for a Hearing may be helpful
to all.

I am the owner of a home at 100 Mountain Laurel Court, very close to the proposed approval of an Activity
Envelope and Site Plan at 97 Mountain Laurel Court.
We would like to express our concerns that the proposed major remodeling and multiple additions for this
project should be carried forward to a Hearing, perhaps in January, that would allow participation of the close
neighbors most effected by it in the planning process.
I recently received Notice of the upcoming decisions.
Prior to that, I was not otherwise made aware of the project by either it's owners and planners, or our Mountain
Valley HOA. Other neighbors I have now talked to also were not given these courtesies.
We saw proposed plans for the first time at the end of the week and are concerned that the project design clearly
has adverse impacts on direct neighbors as well as those nearby.
I appreciate your assistance in the scheduling of a hearing and encouragement of the owner's participation in
recognizing working with the neighbors toward a better solution.

GENERAL NOTES
1. The work included under this contract consist of all labor materials, transportation, tools and
equipment necessary for the construction of the project leaving all work ready for use.
2. All construction shall conform to the 2010 International Building Code; 2010 International
Residential Code; 2010 International Mechanical, Plumbing and Fire Codes; 2010
International Fuel Gas Code; 2008 National Electric Code; 2009 International Energy Code;
Fire Saftey Standards and any other local governing codes and ordinances. In the event of
conflict, the most stringent requirements shall apply.
3. The plans indicate the general extent of new construction necessary for the work, but are not
intended to be all-inclusive. All demolition and all new work necessary to allow for a finished
job in accordance with the intention of the drawing is included regardless of whether shown on
the drawings or mentioned in the notes. All work is new, U.O.N.
4. Any errors, omissions or conflicts found in the various parts of the construction documents
shall be brought to the attention of the Architect and the Owner for clarification before
proceeding with the work.
5. The General Contractor shall maintain a current and complete set of the construction
documents on the job site during all phases of construction for use of all the trades and shall
provide all the subcontractors with current construction documents as required.
6. The General Contractor shall verify and assume responsibility for all dimensions and site
conditions. The General Contractor shall inspect the existing premises and take note of
existing conditions prior to submitting prices. No claim shall be allowed for difficulties
encountered which could have reasonably been inferred from such examination.
7. Written dimensions take precedence. Do not scale drawings.
8. All dimensions to and from new construction when shown in plan are to face of stud, face of
masonry, centerline, unless otherwise noted.
9. All dimensions on reflected ceiling or electrical plans are from face of finish or center line of
column to center line of fixture or group of fixtures.
10. All vertical dimensions are to face of finish, finish floor, unless otherwise noted.
11. All dimensions noted "Verify" and W.I.F." are to be checked by contractor prior to construction.
Immediately report any variances to the architect for resolution.
12. Interior walls are 2x4 or 2x6 wood studs @ 16" o.c. unless otherwise noted and all exterior
wall are 2x6 wood studs @ 16" o.c. unless otherwise noted.
13. Contractor shall provide all seismic bracing and hold-down clips as required by Code for all
suspended ceiling and soffit framing conditions.
14. Coordinate all work with existing conditions, including but not limited to: irrigation pipes,
electrical conduit, water lines, gas lines, drainage lines, etc.
15. Provide adequate temporary support as necessary to assure the structural value or integrity of
the building.
16. Protect all existing building and site conditions to remain including walls, cabinets, finishes,
trees and shrubs, paving, etc.
17. Details shown are typical. Similar details apply in similar conditions.
18. Verify all architectural details with structural, and design/build drawings before ordering or
installation of any work.
19. Where locations of windows and doors are not dimensioned, they shall be centered in the wall
or placed two stud widths from adjacent wall as indicated on the drawings.
20. All required exits shall be operable from inside, without the use of key or special knowledge.
21. All changes in floor materials occur at centerline of door or framed opening unless otherwise
indicated on the drawings.
22. Install all fixtures, equipment and materials per manufacturer's recommendations.
23. Verify clearances for flues, vents, chases, soffits, fixtures, etc. before any construction,
ordering of, or installation of any items of work.
24. Sealant, caulking and flashing, etc. locations shown on drawings are not intended to be
inclusive. Follow manufacturer's installation recommendations and standard industry and
building practices.
25. All roof deck penetrations and exterior wall openings shall be guaranteed by the contractor to
be water tight for a minimum period of one year after substantial completion of all work under
this contract.
26. The General Contractor shall remove all rubbish and waste materials of all subcontractors and
trades on a regular basis, and shall exercise a strict control over job cleaning to prevent any
direct debris or dust from affecting, in any way, finished areas in or outside job site.
27. Contractor shall leave premises and all affected areas clean and orderly, ready for occupancy.
This includes cleaning of all glass (inside and outside) and frames, both new and existing.
28. Install smoke detectors in accordance with the specifications and in conformance with local
Fire Marshal requirements.
29. All exterior doors and windows are to be weather stripped unless otherwise noted in door
details.
30. Glass subject to human impact shall be of safety glazing material to meet State and Federal
requirements.
31. Any survey monuments within the area of construction shall be preserved or reset by a
registered civil engineer or a licensed land surveyor.
32. Provide shop drawings for all millwork, metal work and custom items.
33. Contractor is responsible for reviewing and complying with requirements of Soil Report as
prepared by Geotechnical Engineer.

6.36.030 Noises prohibited.
B. Specific Prohibitions. The following acts are declared to be in violation of this chapter
5. Construction Activities. Any and all activity incidental to the erection, demolition, altering, assembling,
installing or equipping of buildings, structures, roads or appurtenances there to, including land clearing,
grading, excavating, filling, landscaping, use of power equipment and the delivery, loading or unloading of
materials and equipment as follows:
a. In residential, business and industrial districts between the hours of seven p.m. and seven a.m. Monday
through Saturday;
b. In all districts on Sundays and federally recognized holidays.
c. In any defined districts where such operation exceeds the sound level limits for a floating construction
district as set forth in Section 6.36.040;
d. This section shall not apply to emergency work as defined in Section 6.36.020, but such work shall be
exempted only for the minimum period of time necessary to conclude the emergency repair(s) and restore
property to a safe condition.

After reviewing the application, I propose the following conditions:
• The applicant shall supply a Tree Removal Permit that demonstrates compliance with the Tree
Mitigation Plan provided in the planning application.
• The applicant shall supply a drainage and erosion control plan and accompanying drainage report.
The drainage and erosion control plan shall show all temporary erosion control BMPs to be
installed during construction. The drainage report shall demonstrate that historical flow patterns
and runoff amounts will be permanently maintained.
• If the development disturbs one acre or more, a Colorado Department of Public Health and
Environment permit for stormwater discharges associated with construction activities shall be
applied for and obtained prior to issuance of a building permit.
• The applicant shall provide adequate engineering of any retaining walls over four (4) feet in
height and/or any improvements to walls over four (4) feet in height. All retaining walls shall be
a maximum of seven (7) feet tall.
• If the development requires a change in grade of more than 30" in the setback, or 6' associated
with the driveway, a Board of Adjustment approval of these grade changes shall be obtained.
• The existing driveway shall be improved to better meet the County's standard of a 16 -foot width.
The improvements will require an Access Permit and be approved by the fire department. All
existing access ways shall be improved to current County standards as outlined in the Asset
Management Plan.
• There shall be no parking or staging on County Roads. All requirements of the County's
Construction Management Manual shall be adhered to.

• At building permit the applicant shall demonstrate that the proposed development addresses the
geotechnical recommendations outlined in HP Kumar's report and letter dated May 25, 2017 and
August 18, 2017.
Applicant shall provide proof of adequate water supply from the public water supply that
currently serves the property.

Hi Parker,
Thank you for talking with me this morning about our project at 97 Mtn. Laurel court. I have summarized our discussion below please let me know
if you are in agreement with my notes.
General: In this situation the fire department would not ask for significant work to be completed in order to widen the access way.
The fire department would ask that the following smaller interventions be completed during the construction process.
1. Remove any of the soil that may have sloughed off of the adjacent slope onto the existing pavement. (See photo)
2. Cut back younger Aspen trees that are beginning to encroach on the road way (Uphill and Downhill side). These trees can do damage to
the ladder truck when they begin to encroach on the roadway at the higher heights. (See photo)
3. Widen the driveway entrance to 16 feet with an inside turning radius of 29 feet.
4. No access permit would be required for this work.

Sorry for the late response on this one. I talked with Kurtis and he does not have any big concerns with this application
except for mitigating bear conflicts as much as possible. Our regional leadership in GJ is leaning towards email
responses for some of these land use referrals with low wildlife impacts. Do you have other referral entities that
respond by email? Would it be better for you to have a signed letter for your files? We could go either way, so
whatever is most helpful for you. Something we were going to bring up if we can get a meeting on the calendar as
well.

The residence is on utilities, so I do not have well or OWTS concern. Given the close proximity to the neighbors I would
ask that the following section of the noise code about construction be attached and to please have the applicant contact
EH if they have any questions.
6.36.030 Noises prohibited.
B. Specific Prohibitions. The following acts are declared to be in violation of
this chapter.
5. Construction Activities. Any and all activity incidental to the erection, demolition, altering,
assembling, installing or equipping of buildings, structures, roads or appurtenances thereto, including
land clearing, grading, excavating, filling, landscaping, use of power equipment and the delivery,
loading or unloading of materials and equipment as follows:
a. In residential, business and industrial districts between the hours of seven p.m. and seven a.m.
Monday through Saturday;
b. In all districts on Sundays and federally recognized holidays.
c. In any defined districts where such operation exceeds the sound level
limits for a floating construction district as set forth in Section 6.36.040;
d. This section shall not apply to emergency work as defined in Section 6.36.020, but such work
