Dear Michael,
Thank you for your time and assistance with this application.
We are proposing a single family home on an existing parcel on Wrights Road.
The Wright parcel was owned by Ruth and Kenneth Wright, along with the one
adjacent to it to the east, the Terman parcel, since 1957. The adjacent Terman
parcel was sold by the family at some point thereafter and a home was constructed.
The attached Red Mountain Subdivision plat of 1956 is attached, showing both
parcels and the access driveway for both parcels.
At this time the daughter of Ruth Wright, Leslie Lacey is helping her mother develop
the parcel. The lot has some challenges due to the steepness of the slope. The code
sections outlined by Michael Kraemer, in his pre -application summary will be
addressed in this letter.
At this time, we are seeking to create an activity envelope and site plan. As you will
see below in the code responses, the building is being squeezed into the portion of
the site that is less steep than the rest; which location does not quite meet the
standard setbacks for rear yards in the R-30 zone district. We will need a 4'-6"
variance for the rear yard setback to stay within the less steep area of the parcel.
There is also need for retaining walls at the driveway to create access to the home
from the existing driveway. These walls will be taller than 30" in some areas, so will

also need a variance for the site work all the way to the existing road; a distance of
18'-6 at the furthest distance from the 30' setback line. The retaining walls vary in
height with the slope and in distance from the 30' setback line. See attached Site
Plan.
The front yard setback of 30' and the side yards of 15' are both achievable with the
house in this one area of less steep slope.
The Lot is 34,664 sq. ft. and allowed .13 for FAR; which is 4506.32 sq ft. The
proposed home is 3987 sq. ft.; and the 518 sq. ft. of garage is well below the allowed
750.

attached at the end of this packet of information. This application package includes
all requested documents as outlined by Michael Kraemer in the letter dated 8.25.17.
Section 7-10-50 - Activity Envelope and Site Plan
Section 7-10-50 (a) The following will address the areas of concern regarding the
"Constrained Areas" on the lot. This parcel does contain (ii) steep and potentially
unstable slopes; (iii) water courses, drainage channels, and areas subject to erosion,;
(vi) Severe wildfire hazard; and (vii) Wildlife habitat
Section 7-10-50 (b) The applicant is requesting an Activity Envelope to encompass

the area needed for a driveway, multi-level, single family home, roof overhangs,
parking / turn around and construction access and staging. The Site is entirely a
"Constrained Area" with just a small portion of the center of the parcel being
between 30-45 %. The area that is proposed for the home, is in this area of steep
slope; fairly centered on the lot, with no access to it under 45% slope.
To minimize impact, on not only the surrounding neighbors, but everyone that
looks up towards Red Mountain, the applicant is proposing a very short driveway
directly behind the home, instead of asking to cut a driveway across the length of
the lot. This will be more visually attractive to everyone, and will have the least
amount of negative impact to the neighbors, containing the cut into the slope
to behind the home. This in effect shields the view of the driveway and retaining
walls from the view of anyone in the valley.
Beyond the issue of steep slopes, this home will comply with all Comprehensive
Plan goals and objectives. It will also comply with all the local building codes.
Section 7-10-50 (c) This home will be serviced by City of Aspen water and
sanitation, so the activity envelope will not need to accommodate a well or
septic system. There will need to be access to the existing water and sewer lines.
The water line is on Wrights Road, below the home; the sewer line is in the
driveway that is shared with the Terman Parcel to the East.
The site will have just one contiguous activity envelope for all activities proposed
for the site. The building foot print, the driveway and car turn -around and walkway
to the entry, the roof overhangs that will be cantilevered out beyond the lesser steep
slopes to be above some areas in the no -build zone due to being above 45% slope.
Section 7-10-50 (d) No clearing or grubbing will take place until an Activity
envelope has been established and approved by the County.
Section 7-10-50 (e) N/A
Section 7-10-50 (f) Construction fencing shall define the area of the parcel that has
been defined as the Activity envelope prior to construction.
Section 7-10-50 (g) Site Plan approval is being requested by the applicant at this
time of Activity Envelope approval.
Section 7-20-10 Site Preparation and Grading w/ tree mitigation plan
Section 7-20-10 (a) Please see drainage and grading plan for grading and fill
placement that exceeds 50 cubic yards. The Site Plan shall also show this area.
Section 7-20-10 (b) All clearing and grubbing will take place only in the activity
envelope; which will be defined in the field with construction fencing.

Section 7-20-20 Steep and Potentially Unstable Slopes
Section 7-20-20 (a) See site slope analysis for topography with 2' intervals and
slope analysis shown by color fill pattern.
The entirety of this lot is a slope that is at least 30%. The majority of it is over 30%
and up to 45% or greater. There is a small area somewhat centered on the upper
portion of the lot, that is a between 30 and 45%. It is in this area that we are
proposing the new home. This area has some anomalies that are steeper but
this is the only area on the lot that is feasible for development.
Section 7-20-20 (b)(1)(a) The lot was legally platted and recorded prior to 1972;
See attached Red Mountain Sub -Division Plat dated July 26, 1956.
Section 7-20-20 (b)(1)(b) The site we are proposing is the only area on the site
that has slopes less than 45%. There is no way to fit any sort of a building entirely
within that area, so we have to build over the shown anomalies of steeper slopes
and extend beyond a few feet at the perimeter in a few areas.
Section 7-20-20 (b)(1)(c) Please see attached letter from Gary Lacy.
Section 7-20-20 (b)(1)(d) The proposed development does comply with all
standards in subsection(c) (1) below.
Section 7-20-20 (c)(1) Thirty Percent or Greater Gradient No alternative
Building Site. There is no portion of this parcel that is less than 30% slope. There is
an existing shared driveway on the uppermost part of the lot. This drive is used by
the owners of the home to the east on the Therman parcel.
Section 7-20-20 (c)(1)(a) Please see attached letter from Gary Lacy, engineer.
Section 7-20-20 (c)(1)(b) The proposed home has been designed to avoid adding
anything that would cause decreased stability to the slope. The water will be
captured from the roof and detained for proper drainage.
The toe of the slope will not be disturbed, as we are building on the upper portion of
the lot. The structural engineer will provide details to retain or re-inforce slope
stability as required. The home will be stepped down the slope to help reduce
pressure by spreading out the loads; using the topography as a template.
All disturbed slopes will be revegetated to native vegetation to blend in with the
remaining area for the least visual impact possible. This will also increase slope
stability.
Section 7-20-20 (c)(1)(c) All recommended mitigation measures given by the
engineer shall be incorporated into the construction documents.

Section 7-20-20 (c)(1)(d) The engineered mitigation plan shall be submitted to the
Community Development Department for approval prior to submission of the
building permit application.
Section 7-20-20 (c)(2) N/A
Section 7-20-20 (c)(3) Minor Slope Anomaly This parcel is for the most part
above 45% slope; with a small section in the upper, center of the lot that is between
30-45%. This area is not large enough or completely contiguous, so the home will
encroach over the small anomalies of steeper slopes as it bridges over to anther area
of less steep terrain. There is no other place to put the home.
Section 7-20-20 (c)(4) Existing Roads and Driveways. As mentioned, there is
only one existing driveway on the parcel at the upper border. It will need to be
adjusted with a small amount of grading to allow for the driveway to turn off of it.
All the following conditions are met:
Section 7-20-20 (c)(4)(a) The driveway was constructed long before the County's
1993 driveway permit system. It is shown on plats since the early 1950s.
Section 7-20-20 (c)(4)(b) The existing driveway services one residential property
to the east of this parcel. The road will continue to be used for only residential use.
Section 7-20-20 (c)(4)(c) The proposed development is planning on using the
existing driveway, with a slight alteration in the grading to allow for a somewhat
"flat" spot for the driveway. The overall rise of the drive will not change, just the
locations of the steeper and less steep slopes occur. The proposed grading is very
minimal.
Section 7-20-20 (c)(4)(d) The proposed grading alterations for the existing drive
are very minor in scope. It will allow for safer and easier maneuverability getting
into and out of the drive for the new home. This will not impact the use or safety of
the driveway for the residents in the adjacent lot.
Section 7-20-20 (c)(4)(e) Please see attached letter from Gary Lacy, engineer.
Section 7-20-20 (c)(5) Short Driveway Encroachments
Section 7-20-20 (c)(5)(a) Please see attached Site Plan for proposed driveway
position. We chose to make the driveway very short and line it up behind the new
building so as to screen the road cut from the view plane. The proposed driveway
will disturb the least amount of the slope and will be stabilized by the building in
front of it and the existing road behind. The drive will slope down approximately
12" to the garage; across a slope of greater than 45%. The entire perimeter of the
lot is a slope of greater than 45%; so we chose the alignment that is the most direct
and has the least amount of impact both physically and visually for the

neighborhood and for anyone in town that looks up to Red Mountain. This
alignment is not in a red or blue avalanche zone.
Section 7-20-20 (c)(5)(b) The proposed driveway and turn out area, which will
also allow for 2 parking spaces is cut in the steep slope is under the allowable 100
linear feet. It is 70' wide at the intersection with the existing road.
Section 7-20-20 (c)(5)(c) Please see responses above for compliance with
Section 7-20-20 (c ) (1) (a) through (d).
Section 7-20-20 (c)(6) Micro Hydroelectric Systems N/A
Section 7-20-20 (c)(7) Habitable Retaining Structures N/A
Section 7-20-20 (c)(8)(e)(2)(a)(b) The area of the driveway that will be widened
will have retaining walls on the downhill side of the road of 6' maximum height. At
the driveway at the garage door, the walls may be up to 7' tall.
Section 7-20-20 (c)(8) (e) (4)(a) The retaining and fill at the garage will create a
driveway with a slope of 1"/1'-0 for the length of the driveway.
Section 7-20-20 (c) (8) (e) (5) (a) (b) Guidelines for Retaining Walls The only
retaining walls that exceed the 4`-0 height limit are those at the driveway and
foundation walls at the home. The tallest
walls will be at the uphill side of the garage. All retaining walls on the parcel will be
engineered by a licensed structural engineer.
Section 7-20-20 (c)(8) (e) (6)(a)Standards for Retaining Walls The retaining
walls will be board formed concrete with a stain to blend with the natural
surroundings.
Section 7-20-20 (c)(8) (e) (7)Detention/Stormwater Facilities Any negative
visual impacts created by the catch basins will be minimized with re -vegetation to
blend with the natural surroundings.
Section 7-20-20 (c)(8)(e)(8) Utility Cuts Please see attached Grading plan for
location of proposed utility lines.
Section 7-20-20 (c)(8)(e)(9) Revegetation requirements All revegetation shall
comply with the standards set out in Section 7-20-130 of this code and the Pitkin
County Revegetation Guide.
Section 7-20-30 Water Courses and Drainage
Section 7-20-30(a)(b) There are no water courses on this parcel.
Section 7-20-30 (c) Drainage

Section 7-20-30 (c)(1)(a) General The proposed drainage system will maintain
the historic flow and runoff by containing the water drainage that is disrupted from
the construction of the home by providing a new course around the building that
controls the velocity and direction of the runoff. This water will be directed to a
settling pond at a catch basin. The new water course follows the topography so as
to blend into the hillside. The lot will be revegetated with naturally occurring
plants for the area to control runoff and stability.
Section 7-20-30 (c)(1)(b) The are no water courses or ditches on the parcel. Most
of the lot will be maintained in its historic state, with the disturbed area having the
new water courses that will not impede the natural flow of water.
Section 7-20-30 (c)(1)(c) The low points on the lot are all at the lower side of the
parcel, and will maintain their natural drainage.
Section 7-20-30 (c)(1)(d) Please see attached drainage plan for drainage system
that accounts for the entire area of lot that will be disturbed; both on the steep slope
and the area of the existing driveway that will be affected by the proposed
development.
Section 7-20-30 (c)(1)(e) The proposed drainage system has been designed for
little or no need of maintenance. Settling ponds will be monitored for clean out
purposes.
Section 7-20-20 (c)(1)(f) The on-site treatment of storm water will be taken care
of with the water being contained in the settling pond catch basins, and then
allowed to infiltrate to daylight.
Section 7-20-20 (c)(8)(e)(7) The storm water will be discharged from the catch
basins in a controlled manner, designed with a max discharge of 0.5 CFS; slope min.
1% to daylight.
Section 7-20-20 (c)(2) Runoff Volumes With the installation of the proposed
drainage system, the runoff volumes will not exceed the levels as occurring naturally
on the parcel.
Section 7-20-20 (d) Groundwater This development will not result in any toxins
or contaminants being introduced to groundwater, recharge area or aquifer.
Section 7-20-20 (g) Sedimentation
Section 7-20-20 (g)(1) Please see grading and drainage plan for location of silt
fencing to control sedimentation during construction.
Section 7-20-20 (g)(2) There are no bodies of water, wetlands or riparian areas on
the parcel.

Section 7-20-20 (g)(3) The site will be re -vegetated as quickly as is feasible during
or directly after construction.
Section 7-20-30 (c) Drainage, General:
Section 7-20-30 (c)(1) General
a. The drainage plan will accommodate the maintenance of historic
drainage patterns and velocities to prevent damage.
b. There are no natural water courses or ditches on the site.
c. Adequate drainage for all parts of the site will be maintained, there are no
low points.
d. The drainage system has been designed to account for all the drainage
needed due to the development of the parcel.
e. All drainage systems, those existing or created by this development shall
be maintained for best use.
f. Onsite treatment of storm water will be dealt with by retaining and
allowing infiltration of storm water on site. See attached drainage plan.
Section 7-20-30 (c)(2) Runoff Volumes
a. Please see attached drainage plan that describes how runoff will not
exceed the pre -development runoff levels and how runoff will be
controlled.
Section 7-20-30 (d) Groundwater This development will not introduce any
contaminants or surcharge to the groundwater.
Section 7-20-30 (e) Irrigated Areas
1. This development shall not interfere with the water supply for
agricultural activities and
2. will not adversely affect any existing irrigation water rights.
Section 7-20-30 (f) Irrigation ditches
1. There are no existing irrigation ditches on the site.
2. There are no proposed ditches on the site to avoid leakage.
3. There will be no irrigating beyond what is needed to revegetate the site
and maintain that vegetation. No flood irrigation will be employed.
4. N/A There will be no flood irrigation employed on the site.
Section 7-20-30 (g) Sedimentation
1. The sedimentation will be controlled throughout construction as needed
to keep sedimentation from runoff from leaving the property with silt
fencing or other means approved by the County.
2. There are no bodies of water to protect.
3. The revegetation will be done immediately after construction.
Section 7-20-30 (h) Water Quality

1. This development shall comply with the Setbacks as applicable to this lot
in Section 7-20-80 and Table 5-1. There are no Riparian or wetlands.
2. Applicant shall comply with all State and Federal statutes and regulations
pertaining to the protection and enhancement of water quality.
3. N/A
Section 7-20-30 (i) Efficient Water Use Activities and development shall emphasize the
most efficient use of water, including, to the extent permissible under law, the re-
cycling and reuse of water.
Section 7-20-60 Wildfire Hazards
This parcel is in the Wildfire Area mapped as Severe by the County, since there is no
High zone.
Please see the letter from David Hoefer, a Pitkin County approved wildfire expert.
His rating of 60 for this neighborhood with the proper mitigation measures put in
place, puts it in the lower end of the High Rating zone; and with the mitigation
recommended for the building on this parcel, the rating goes down to 43, which is
the low end of the Moderate Rating.
His analysis shows how the home can be built and the landscape can be thinned, per
the regulations in this section to bring the rating down to the lower side of the
Moderate zone. The surrounding area helps us as well, with roads above and below
the property that act as fire breaks; and the fact that there are fire hydrants at the
bottom of the property, on Wrights Road.
Section 7-20-60 (c) Standards Applicable to All Wildfire Hazard Areas
Section 7-20-60 (c)(1)(a-k) Defensible Space All the standards outlined in this
section will be incorporated into the Construction Documents for this project. This
Section of this Land Use Code will be printed on the cover sheet or within the sheets
of General Notes and Landscape plans that will be submitted to the building dept.
and from which the home will be constructed. This is the recommendation from the
expert, David Hoefer. All other requirements of the Moderate Fire zone will be met
since we will follow his recommendation for the Defensible Space, Class A roof and
Noncombustible Siding and Decks.
Section 7-20-60 (c)(2) Access The existing road (Wrights Road) and the existing
driveway that serves the adjacent parcel shall be used for this project. No new
roads will be constructed. The access to the home off of the existing driveway will
be more of a auto court/ turn around to get into and out of the garage.
Section 7-20-60 (c)(3) Water Supply for Fire Safety
Section 7-20-60 (c)(3)(a) There is a fire Hydrant located on Wrigts Road at
the bottom of the slope of the parcel.

Section 7-20-60 (c)(3)(b) The applicant will work with the Fire Marshall to
determine if a water storage system will be required for this home.
Section 7-20-60 (c)(3)(c) This development is not in the Severe Wildfire Area
Section 7-20-60 (c)(3)(d) The proposed home is less than 5000 Sq Ft. so is not
required to install an in-house sprinkler system. If the Fire Marshall deems it
necessary to install a sprinkler system at the time of building permit application due
to hazard considerations, this will be done.
Section 7-20-60 (c)(4) Roofing Materials, Vents and Projections at and below
Roof Line
Section 7-20-60 (c)(4)(c) Severe Hazard Area This project shall comply with all
requirements as set forth in this section for both Medium and Severe Hazard Areas.

constructed.
Section 7-20-60 (c)(4)(c)(4) Railings The deck railings will be constructed of
"Type iV" Heavy timber materials
Section 7-20-60 (c)(4)(c)(5)(a-d) Exterior of the Structure, Including All Walls
All exterior materials will have a One Hour Fire Resistive Rating.
All glazing shall be tempered.
All exterior doors shall be metal or 1 3/4" thick wood.
Section 7-20-60 (c)(4)(c)(6) Foundations The exterior side of all foundation walls
and crawlspace openings shall be rated to One Hour fire resistance and shall extend
from top of grade to the underside of the floor decking or walls.
Section 7-20-60 (c)(4)(d) All Hazard Areas
Section 7-20-60 (c)(4)(d)(1-5) Roofs with less than 3:12 pitch shall be
constructed of non-combustible materials over a Class A roof assembly.

The material's surface shall have a material that will assist in natural clearing.
There will be no parapets on the roof.
Roofs shall have a minimum pitch of 1:48.
The Fire Marshall shall be consulted with prior to submittal of a building permit
application.
Section 7-20-60 (c)(5) Maintenance and Miscellaneous Requirements
These standards of the land use code will be incorporated into the Construction
Documents; The applicable standards of this Section of the Code will be printed on
the first page or within the General Notes of the building permit application and the
Set of Construction Documents from which the home will be constructed.
Section 7-20-70 Wildlife Habitat Areas For purposes of this Sec. 7-20- 70,
Constrained Areas shall include, but shall not be limited to, locations that include:
any portion of a wetland; riparian habitat; critical wildlife habitat; severe winter
range, and/or winter concentration areas; wildlife migration corridors or habitat;
wildlife production, birthing or calving areas; important waterfowl and wading bird
habitat areas; significant mountain sage, aspen, and mountain shrub dominated
habitat; and rare, imperiled, sensitive, threatened, or endangered species critical
habitat.
This parcel of land does not contain or have any of the conditions described as
constrained above. The steep slope is covered with scrub oak and a few trees, and is
surrounded by roads on 2 of the three sides of the triangular shape lot; and other
development for wildlife habitat. This parcel is not mapped so the General Standards
apply.
Section 7-20-70(c) General Standards
Section 7-20-70(c)(1) Of course development of any kind will alter the existing
native vegetation on a lot. There is no physical evidence of any wildlife migration or
habitat on this parcel such as animal trails or bird nests. The lot itself is small, and
the area that is being proposed for development is not disturbing any more area
than what is minimally required to construct this home. The applicant will work
with the County if requests such mitigation.
Section 7-20-70(c)(2) There will be no manipulation of vegetation outside of the
defined Activity Envelope.
Section 7-20-70(c)(3) No mesh or woven wire fences will be outside the Envelope.
Section 7-20-70(c)(4-5) There are no fences proposed for this development.
Section 7-20-70(c)(6) This parcel is less than one acre in size and contains no
snags or standing dead trees to preserve.
Section 7-20-70(c)(7) No fruit bearing trees shall be planted on this parcel.

Section 7-20-70(c)(8) There is only one small home being constructed on this
parcel.
Section 7-20-70(c)(9) If the Colorado Division of Wildlife needs access to this
parcel to conduct their work, access shall be granted.
Section 7-20-70(c)(10) Trash will be kept in a bear resistant container/enclosure.
Section 7-20-70(c)(11) At this point, there are no bird feeders proposed.
Section 7-20-70(c)(12) No horses shall be kept on the property/ no horse treats.
Section 7-20-70(c)(13) Pet food shall be securely stored inside.
Section 7-20-70(c)(14) The exterior doors shall have round handled door knobs,
not levers.
Section 7-20-70(d) There is not a condition on this site that requires a Buffer.
Section 7-20-70(e) There will be no livestock on this parcel nor does it contain any
of the areas of concern outlined in this section.
Section 7-20-70(f) This parcel does not have deer, elk or bighorn sheep on it
winter or summer. It is too heavily covered in scrub oak and too steep for habitat.
Section 7-20-70(g) The parcel is not within 1/4 mile of any winter concentration
areas or migration or protection corridors; so this section does not apply.
Section 7-20-120(d) Scenic View Protection
Section 7-20-120(d)(1) The proposed home is far below the ridge line and will use
the existing topography to the extent possible to step the home down the hill to
build it into the landscape. There will be landscaping planted on the lower side of
the property to help screen the home from Hwy 82, Main Street and from the drive
up Red Mountain.
The driveway is being proposed to be mostly behind the building which will result
in the retaining walls being screened by the home.

Section 7-20-120(d)(2) The entire lot is in the Scenic View Protection Area, and
is all about equally visible. The development is proposed to fit on the least steep
portion of the site, and we will screen with landscaping as much as feasible. The
home is nowhere near a ridge line, even though it is near the top of the slope on this
property. There is only one spot on the entire lot to build this home.

Section 7-20-120(d)(3) The proposed design of the home has avoided the
appearance of a long, unbroken plane: the roof elements step down on the east and
west sides of the structure. The taller section in the center of the home will be
curved and mostly glass (non -reflective glazing) to help break up the mass.
Section 7-20-120(d)(4) The tallest part of this building does not break the
ridgeline.
Section 7-20-120(d)(5) The proposed design incorporates the use of natural
materials that will blend into the natural surroundings. The color palette will be
muted natural colors and will be non -reflective. There is only one structure on the
parcel and it will `step' down the hill to help it fit into the topography.
Section 7-20-120(d)(6) There are not irrigated meadows on the parcel. The
natural vegetation shall be protected to the greatest extent possible.
Section 7-20-120(d)(7) The utility lines will be installed on the lower portion of
the site, below the home to help with low visibility from the view plane. The ground
where the utility lines are buried will be revegetated so the line cut will be inviable
within a growing season or two.
Section 7-20-120(d)(8) There are no satellite dishes are proposed for this lot.
Section 7-20-120(d)(9) The proposed development is not using any berms or
earthmoving techniques to try to hide the home.
Section 7-20-120(d)(10) This parcel is not in a rural Area.
Section 7-20-120(d)(11) All exterior building materials will be either naturally
earth toned color or manipulated to be a color that will blend with the natural
surroundings of the new home.
Section 7-20-120(d)(12) The roofs will be of non -reflective material. There
will possibly be solar panels on the home.
Section 7-20-120(d)(13) All areas of disturbed vegetation will be re -vegetated as
soon as possible in the construction process. Natural vegetation that is already on
the site will be replanted in the disturbed areas. The new landscaping / vegetation
will be irrigated long enough to insure the native species will survive.
Section 7-20-120(d)(14) There are not meadows or pastures on the site.... the
driveway will be very short and behind the home, which will screen it from view.
Section 7-20-130 Landscaping and Vegetation Protection
Section 7-20-130 (b) (1) All existing vegetation that is outside the activity envelope
fencing will be preserved. Any areas of vegetation within the envelope that are
disturbed during construction, will be revegetated with similar native vegetation to

blend into the landscape. There will be no areas of "cultured" or formal landscape
on the site. Just a few planters in the area of the car turn -around and front entry
porch.
Section 7-20-130 (b)(2) The building and surround vegetation will meet all of
the severe wildfire requirements. See Responses to Section 7-20-60 below.
Section 7-20-130 (b)(3) There will be no berms constructed on the site.
Section 7-20-130 (b)(4) There will be no landscape enclosures of any sort on the
site.
Section 7-20-130 (b) (5) There will be no landscaping that would interfere with the
safety or visibility of drivers at the driveway.
Section 7-20-130 (b)(6) There will be no trees planted in the vicinity of any of the
utility lines.
Section 7-20-130 (d) Required Landscaping This parcel is on Red Mountain, not
truly rural or completely urban. There will not be a satellite dish or any other such
telecommunications equipment to screen on the lot. The disturbed areas will be re -
vegetated in a manner that is natural, with clusters and groupings with indigenous
species.
Section 7-20-130 (e) Tree Removal Please see tree removal plan. Only trees that
have to be removed for the construction of the home will be removed. All other
trees will be protected during construction.
Any trees that require replacement shall be noted on the tree removal plan. The
total DBH shall be replaced with comparable sized trees; and they will be
maintained to survive or will be replaced if they expire within the first year.
If the Fire Marshall deems any trees to be a problem for wildfire mitigation
measures, a letter will be provided by him to exempt applicant from replacement
and removal permit fees. Wildfire mitigation will be covered in another section.
In Summary, we have been diligent in our efforts to conform with all the Sections of
the County Land Use Code. This parcel definitely presents some challenges to meet
all the requirements; but we are confident that the proposed design of the home will
be a nice addition to the neighborhood, blending in with the overall character of the
neighborhood and it will pose no negative affect on the neighborhood or to wildlife.
We have positioned the home in the only location feasible on this small lot and
require the variances of the rear yard setback for a small portion of the building and
the drive way retaining walls. The rest of the code sections, as outlined above have

been met.

PITKIN COUNTY (hereinafter "COUNTY") and

2. APPLICANT understands and agrees that Pitkin County Ordinance No. 12-2016 establishes a
fee structure for land use applications and the payment of all processing fees is a condition precedent to a
determination of application completeness. The fee structure is based on the COUNTY'S policy that
development shall pay, in full, the cost of development review in the COUNTY. Fees have been set to be
consistent and fair to the public and to reflect the expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
PROJECT, it may not be possible at the time of application to ascertain the full extent of the costs involved in
processing the application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications
shall accumulate if an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County
Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally
required findings for project approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right to
collect full feesrior to a determination of application completeness, APPLICANT shall pay a base fee in the
amount of $ ��b ' which is based on)Jhours of staff time, and if actual time spent by staff to process the
application exceeds the average number of hours by more than 20%, then the COUNTY will bill the
APPLICANT quarterly for the additional time spent. Such periodic payments shall be made within 30 days of
the billing date. APPLICANT further agrees that failure to pay such accrued costs shall be grounds for
suspension of processing.

Right of access using existing driveway/road:
The access road on the north end of the Wright Family parcel has existed since at least 1955 (see 1955
aerial), prior to development of the Red Mountain Subdivision. Most importantly, the recorded 1956
Red Mountain Sub -division (Revised Plat), attached ("1956 Plat"), also depicts the access road.
The Wright Family parcel has the right to use the road based on several separate theories, any one of
which establish the right to use the road for access:
1) Every property within a subdivision takes subject to the restrictions, including roadway
easements, imposed by the original owner/subdivider. Allen v.Nickerson, 155 P.3d 595 (Colo.
App. 2006), and the Colorado cases cited there; 1 Restatement (Third) of Property: Servitudes
§2.1 cmt.c (2000) (the act of recording the development plan subjects all property in the
development to its terms). Thus, every property in the Red Mountain Subdivision takes subject
to the access road which is shown on the 1956 plat.
2) The road is located almost entirely on the Wright Family parcel (see attached survey). The short
section on the west end is located in the right of way strip running east from Wright's Road as
shown on the 1956 Plat. Adjoining owners who purchased parcels in the Red Mountain
subdivision are subject to the access shown on the recorded 1956 Plat (see 1, above).
3) Kenneth and Ruth Wright originally owned both the Wright Family parcel and the Terman parcel
(see 1957 deed). When they later conveyed the Terman parcel, that parcel would have received
at most an implied easement of necessity for access across the Wright Family parcel. No express
easement was granted by the Wrights, and certainly not an exclusive easement that would have
left the retained parcel without its own reasonable access. The Colorado Supreme Court has
recognized that a grantor does not intend to render the retained land inaccessible. Wagner v.
Fairlamb, 379 P.2d 165 (1963).

This letter is written to confirm that the proposed building and improvements proposed on the above mentioned parcel of land
can be engineered so that there is no hazard posed by the location of these improvements. Furthermore, the existing ground
surface is not prone to instability orfailure, and the proposed improvements will not cause greater instability or increase the
potential for slope failure.
I have carefully inspected the site numerous times over a numberof years and have found no evidence of any slope failure,
even though there have be numerous homes and access roads constructed in the area on similar slopes. The site'rs stable and
consists of stable soils with obvious large boulders and rock. A shale bedrock is in evidence in numerous locations as seen from
the road cuts above and below the site. Well established shrubby vegetation covers most of the site.
The proposed improvements will include properly design retaining walls, site grading, and on-site drainage improvements that
will not disturb or increase runoff or instability problems in the area. Proper soil erosion protection as well as rock/debris
protection on the downhill side will be installed and remain in place during construction.

Seeding specifications and the plant mix shown below are for review and bidding only. A final
landscape plan and seed mix to be submitted by the contractor for review by the Project Owner
and Project Engineer. Prior to construction the landscape plan and final seed mix is to be
reviewed and approved by CDOT.
Areas to be permanently stabilized after completion shall follow the requirements
of the 2011 CDOT Standard Specifications for Road and Bridge Construction,
Sections 101, 107, and 208, 213, and 620 Water Quality Control, 213 Mulching
specifications, and other referenced material.
Removal of adjacent roadside vegetation shall be minimized where possible
All temporary disturbed areas not within the work area will be returned to
preconstruction elevation and contours and reseeded with the CDOT approved native
seed mix that is certified weed free
All native seeding areas with slopes 3:1 or flatter shall be mulched and mechanically
crimped with 1.5 tons per acre of weed free hay and applied with mulch tackifier.
All other slopes shall have soil retention blanket for slopes steeper than 3:1. Roadside ditches
shall be lined with soil retention blanket or turf reinforcement blanket to contain the design flow
width (wetted perimeter). If soil retention blanket is used, mulch and tackifier are not required.

mitigate the potential adverse effects of earth disturbance.

This review was conducted October 18, 2017 between 10:30 and 11:30 AM by David R. W.
Hoefer, a consulting forester and approved by Pitkin County as an expert in wildfire area
designation and mitigation. Adam Rothberg was present for the field review. The purpose of the
review was to determine the wildfire hazard rating for the property and to make n
recommendation for wildfire hazard mitigation. This, in part, meets the requirements for the
1041 Hazard Review for Site Plans and the requirements of Pitkin County regulation 7-20-60
Wildfire Hazard.
PROPERTY DESCRIPTION:
Location: The property is located at 217 Trentaz Drive which is a road that branches from the
McLain Flats Road (County Rd. 19). This is a few miles west of the city of Aspen itself. The
legal description is rather lengthy and will be included with other documents submitted to the
County. It is a parcel of land situated in the NW '/a of Section 35, T9S, R85W, 6' PM.
Size: The lot size is approximately 12,000square feet.
Elevation: Approximately 8040 feet.
Aspect: Northwest.
Slope: 20% going E -W. 10% N -S
Vegetation Type: Primarily oakbrush with some rabbitbrush and snowberry. A few aspen may
be at the very northeast corner adjacent to the road. Native grasses and forbs are in the
understory and in small openings. The oakbrush on this and the adjacent property along the
fence line is about 6-10 feet tall. Oakbrush between the dwelling site and the Trentaz Road
reaches about 20 feet. All are in good condition with little decadence or dead branches. The
oakbrush is not dense and there are opening within the canopy.
Soil characteristics: Soils observed in a recently dug pit show them to be colluviums which
appear to be derived from sandstone. They are appear fertile and well drained and should be
very stable.

ANALYSIS GUIDELINE
The primary guideline in this analysis is the Colorado State University Forest Service publication
FIRE 2012-1. This was formerly Cooperative Extension Service Factsheet 6.302. The guideline
focuses on two primary factors that determine a dwellings ability to survive wildfire: the roofing
material and the quality of the defensible space surrounding it. Materials used in dwelling
construction are not a part of this review. Requirements are in Pitkin County Code Section 7-20-
60.
The defensible space is broken into three management zones. Zone 1 is the area within 15 feet
of the structure including decks. Zone 2 is the area that extends to 75 feet and to 125 feet or
more from the structure. As the slope percent increases, the distance of defensible space
increases. Zone 3 is the remaining area to the property boundaries is not applicable in this
analysis.
Pitkin County Land Use Code Section 7-20-60 has been referred to in this analysis. The Zone 1
requirements are 10 feet. The Zone 2 requirements are a minimum of 30 feet except as is
modified by the wildfire expert. The Zone 3 requirements extend beyond 30 feet and are
requirements set by the wildfire expert.
WILDFIRE HAZARD
As can be seen on the aerial photo above, there is a developed road on one side of the property
and on the southwest side is a dwelling with a pond. On the northwest side is another large
dwelling with cleared areas. Throughout the oakbrush stands are small openings in the canopy.
The major threat of a wildfire would be from the north. This is uphill and also adjacent to the
paved road. The slope and aspect of this area to the north is not conducive to carrying a large fire
unless with strong winds.
The slope on the site is about 20% but most of that slope is at the upper side against the road. In
this area are some large oakbrush trees but much of this will be taken out for the driveway.
There will be a fire hydrant along the access road to the property which will be served by a
buried tank approximately 10,000 gallons. The line to it will be specified by the fire department.
All of these factors indicate a Low to Medium Wildfire Hazard.
Mitigation measures can be taken.
Zone 1 as described above extends 10 feet from the structure. The setback for this structure is
10 feet from the property line and; therefore, the guideline has been met. This area shouldn be
kept in a low grass which can be irrigated and mowed.
Zone 2 would be the area to the southwest and to the north of the dwelling, extending 305 feet
on to the adjacent property. The oakbrush is not dense and is in good condition. As shown in
the photos below, there are numerous openings in the oakbrush canopy. Usually in Zone 2
clumps of brush are thinned or trees removed so there is a space of 2 1/2 times the height of the
shrubs or trees. Since this Zone is outside the owner's property, this guideline cannot be met.
However, if an opportunity can be made available, dead material larger than 2 inches could be
removed 10 feet from the property line to reduce any extra fuel loading. It is unlikely either
property owner would want to thin the shrubs or trees.
On the owner's property itself, dead material over F in diameter should be removed from the
natural vegetation.
