There must be a minimum 90 -foot separation between the field and the ditch. The system will consist of one 2000 gallon, two-compartment tank with an effluent filter on the outlet followed by a dosing tank. The field will consist of 5 rows of 15 chambers serially distributed. With groundwater confirmed at 6 feet August 22, 2003 — an extra foot was considered for a safety factor. Given the high groundwater potential, the field should not be buried more than 1 foot below existing grade. Additional fill from on-site should be used as backfill. This department does not endorse any brand of products. This permit must be kept on-site during installation. The engineer must do a final inspection of the installation and submit an as -built letter to this department. This department must also be called for an inspection with a minimum of 48 hours advanced notice. The property is zoned RS -30 PUD and contains 38.66 acres. 3. The property is located on East Sopris Creek Road and is more specifically described in attachment A. 4. The Hearing Officer heard this application at a duly noticed.public hearing on August 28, 2001, at which time evidence and testimony were presented with respect to this application. 5. The Hearing Officer finds that the building envelope avoids slopes exceeding 30 percent, has minimal impacts on wildlife and riparian habitat and has mitigatable wildfire hazard. NOW THEREFORE, BE IT RESOLVED by the Pitkin County Hearing Officer that approval is hereby granted to the Granny Enterprises 1041 Hazard Review, Conceptual Submission, and Caretaker Dwelling Unit for a building envelope. I . The Applicant shall adhere to all conditions and material representations made in the application and public meetings except as amended herein. 2. The Applicant shall record a 24 X 36 inch mylar 1041 Hazard Review Site Plan in accordance with Section 5-70-040 of the Land Use Code. The site plan shall also be submitted in digital format for integration in to the County Geographic Information System (GIS) prior to submission of a building permit. 3. The Applicant shall obtain an access permit from the Pitkin County Engineer prior to building permit submission. 4. The Applicant shall submit, for review and approval by the County Engineer, a Construction Management Plan in accordance to the Asset Management Plan, prior to building permit submission. Any disturbed areas of vegetation outside of the building envelope shall be revegetated with beneficial browse species per Code Section 3-80-080. 14. Fencing outside the building envelope shall be prohibited. 15. Surface and ground water flows shall not be diverted away from any existing wetlands, streams or existing ditches 16. Only plant species that are identified by the Pitkin County Revegetation guide as being appropriate for riparian or wetland areas, or native species found to occur on site but not listed in the Pitkin County Revegetation Guide may be introduced into or used for revegetation of any existing wetland or riparian habitat area. Planting or introduction of any other plant species shall be prohibited. 17. An orange safety fence shall be required around the construction site (not extend beyond the building envelope) to prevent unnecessary vegetation disturbance during construction. 18. Although there are no identified wetlands within the approved building envelope, any wetland or riparian areas disturbed during construction must be mitigated at a 2:1 ratio with native riparian plants according to revegetation plan to be submitted by the applicant and approved by the Land Management Department prior to issuance of a Certificate of Occupancy. The plan must contain the following elements: A. The name of the project; B. The name, address and phone number of the person preparing the revegetation plan; C. The name, address and phone number of the person(s) responsible for executing the plan; D. If applicable, the availability of irrigation water and, if available, the amount of water, the name of the ditch company and the method of delivering water to the site. E. A brief narrative describing the planting and seeding methods; F. A description by scientific names of the species of plants to be used, seed ratios and source, and container size or caliper measurement of plants to be installed. G. A drawing of the site with the location of the plants to be installed shown clearly. 19. The building envelope must be set back at least 30 feet from the Little Elk Creek high water line per code Section 3-50-040 (A). 18. The Caretaker dwelling unit shall comply with the following conditions A. unit shall remain less than 700 net livable square feet. B. kitchen shall contain at least a two burner stove with oven, standard sink, and at least a 6 -cubic foot refrigerator plus freezer. C. One off-street parking space shall be provided for the unit. The Applicant shall comply with the following wildfire mitigation measures: Defensible S ace: Note: Actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions. A. Brush, debris, and non -ornamental vegetation shall be removed within a distance a 10 foot perimeter of all structures. B. For a distance of 10 feet around all structures, establish and maintain vegetation at 6 inches or less. Woody vegetation shall not be planted in this perimeter and flammable material shall not be stored within this perimeter. C. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a 30 foot perimeter around a structure built on flat ground. D. Spacing between clumps of brush and vegetation within the 30 foot perimeter shall be a minimum of two times the height of the fuel. Maximum diameter of the clumps shall not exceed 10 feet. All measurements shall be from the edges of the crowns of the fuels. E. Beyond a distance of ten feet around all structures, evergreens (i.e. spruce, pines) shall be planted with a minimum of 10 foot spacing between as measured from the outermost branches. The lower limbs of these trees should be removed up to half the total height to eliminate ladder fuels. Planting of aspens is encouraged especially in clumps. F. All branches from trees and brush within the 30 foot perimeter shall be pruned to a height of 10 feet above the ground and removal of ladder fuels from around trees and brush. G. Tree crown separation within a 30 foot perimeter shall have a minimum of 10 feet between the edges of the crowns. This does not apply to mature stands of Aspen trees where the above recommendation for removal of ladder fuels have been complied with. H. All branches which extend over the roof eaves shall be trimmed and all branches within 15 feet of the chimneys shall be removed. I. The density of fuels within a 100 foot perimeter around all structures shall be reduced where natural reduction has not already occurred. J. All deadfall within the 100 foot perimeter shall be removed. K. The Applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. The Applicant shall comply with the following additional wildfire mitigation standards: A. Roofing: New roofs shall have a non-combustible roof covering on a class A, assembly roof system. Wood shake/shingle roof coverings and flat roofs (up to a 3.12) pitch are prohibited. B. Vents shall be screened with corrosive resistant wire mesh with mesh one -fourth - inch (114") maximum. C. Roofs and gutters shall be kept clear of debris. D. Yards shall be kept clear of all litter, slash, and flammable debris. E. All flammable materials shalt be stored on a parallel contour a minimum of 15 feet away from any structure. F. Weeds and grasses within the 15 foot perimeter shall be maintained to a height not more than 6 inches. G. Firewood/wood piles shall be stacked on a parallel contour a minimum of 15 feet away from any structure. H. Swimming pools shalt accessible to Fire Department vehicles. I. Fences shall be kept clear of brush and debris. J. Wood fences shall not connect to any structure. K. Any outbuildings or additional structures shall adhere to the same standards as structures. L. Fuel tanks shall be installed underground with an approved container. M. Propane tanks shall be installed according to NFPA 48 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for 2 hour fire resistive construction on the exterior side of the walls. N. Each structure shall have a minimum of one pound approved ABC fire extinguisher placed in a visible and accessible location. O. Addresses shall be clearly marked with 2 inch non-combustible letters and shall be clearly visible at the primary point of access from the public or common access road and installed on a non-combustible post. P. New utility lines shall be buried. 9. Native vegetation must be maintained outside the building envelope as long as it complies with the wildfire mitigation standards stated above. 10. Exterior lighting on the property must comply with any applicable lighting ordinance or master plan at the time of building permit issuance. 11. Dogs on the property shall be kenneled pursuant to Code Section 3-80-080. 12. The Applicant shall comply with the 2001 Wildlife Protection Ordinance No. 010- 2001 for waste storage.
